Let's talk about what in custody really means. You can be sitting in a police station being questioned and legally not be in custody. Yeah, that's [music] real because in custody doesn't mean what people think it means. The question is would a reasonable person feel free to leave? Let's go over some examples.
Example one, there's a Supreme Court case where a guy voluntarily went to the police station. He sat in an interview room, confessed and the court said he wasn't in custody. Why? Because officers told him he was free to leave. Example two, same thing but with a traffic stop.
You're pulled over, lights behind you, you're definitely not driving away. But legally, that's usually not custody which means they can ask you questions without ever reading you your rights.
Third example, here's the one that really surprises people. Even if you're already in jail, questioning you isn't automatically in custody for Miranda.
Miranda still might not apply. And here's what officers do, they'll say things like you're free to leave anytime. Or hey, can I get you some water, snacks? They do that to try to keep you relaxed because if it doesn't feel like custody, legally, it might [music] not be. And that's how people end up talking without Miranda ever coming up.
