This analysis expertly highlights the critical tension between prosecutorial discovery obligations and the fundamental right to due process. It serves as a sobering reminder that procedural integrity is just as vital as the evidence itself in federal criminal proceedings.

My goodness. Happy Friday. Happy Friday, everyone. I forgot to put myself on stage. Happy Friday, everyone. Today is Friday, May 8th, 2026. And welcome to the last minute add-on today. That is the Miles King bail revocation hearing.
Uh, I'm going to talk fast because it starts at two. And once I go into the Zoom room, I will not be speaking. So, for all of those people who hate the way I interrupt and explain things, today's your lucky day. It's your lucky day because once I'm in the Zoom room, I will be zipping it. And the reason for that is because uh there have been so many times when the zoom information is made public and there are many viewers on there. Some of them may be trolls and they have me on in the background and then they have um they don't know how to mute their microphone on the Zoom and so the court hears my voice coming through the Zoom and thinks that it's me. Uh and I hate when that happens. So if anybody comes in and they're like why isn't she talking? That's why I'm not talking.
Unless we find that there's going to be a um actual news camera in there like news like Boston 10 or Boston 25 on YouTube. If we can do that, then I can stop and explain. Um however, uh once I go into the Zoom room and put it up on the screen, I will not be speaking.
Okay? It may not always be trolls.
Sometimes it's people who just don't know how to mute their microphone and then I'm the one who gets in trouble. If you did not know, we covered this extensively last night. Miles King has been out on bail since June of 2025. The reason that he's out on bail for his murder charge is because Proctor, Lai, and Tully failed to turn over discovery to Miles King attorney Rosemary Scapichio, who we love. So, Miles King was sitting in jail for almost four four years without a trial. Um, and then Judge Dulan was like, I got to let this guy out. like that's, you know, a violation of due process and it's a violation of his constitutional rights.
We can't just keep keep him here endlessly forever. Uh and so Judge Dulan let him out in June of 2025 on something like Well, the order said $100,000 cash.
Some of the reporting says $10,000 cash.
Regardless, there's a potential murder murderer roaming the streets in NF County. His name is Miles King or Missy Cash, depending on if you call him by his given name or his nickname. Um, and what had happened was yesterday Miles King was arrested on federal charges. He was picked up by the feds. We went over the federal indictment last night and uh there are him and six of his buddies were picked up on uh gun trafficking charges and Miles King charges were uh while he was out on bail uh were for dealing and or conspiracy to deal uh fentinel and crack cocaine. And so today, while there was supposed to already be a status hearing on where, they are now looking to revoke his bail on the murder charge and a prior gun charge that he had that popped back on the calendar, too. And so we will get to hear from Rosemaryio and um others. I think Kraky is there. So I'm popping into the Zoom room now. Yes, I do have orders. The temporary orders on Kelsey Fitz Simmons. Yes, I have them. I have them. Please don't come in and think you're giving me information. I'm doing doing that show at 5:00 PM. Very good news for Kelsey right before Mother's Day. It's going to be 5:00 PM. We're going to The airwaves are very crowded today. So, I'm I'm waiting for more. I had to schedule it far enough in advance so that more people would actually get their notifications. We're going to go over the temporary orders.
It is great news for Kelsey. I'm very, very excited for her. And uh I'm going into the Zoom room. I'm going to mute myself. Everyone else, if you're in the Zoom room, please for the love of the traveling Mary, mute yourself, too.
There are other cases on the calendar.
It may not be the first one called.
Okay. So, uh I'm going in and as soon as they let me in, I am uh going to put it up on the screen.
That is when I will zip it.
So if um anybody comes in they're like why isn't she talking that is why this is why we can't have nice things.
Okay. This is why we can't have nice things. Now there are other ca this is in North Superior Court. There are other cases on the calendar that they may hear first. So until I'm allowed into the Zoom room I will keep talking to you.
Okay. All right. I only scheduled this about a half hour ago, which is why you might not have gotten notifications. Uh, today's motivational quote of the day, Ralph Waldo Emerson said, "What lies behind you and what lies in front of you pales in comparison to what lies inside of you." And I I suggest everyone remember that what lies behind you and what lies in front of you pales in comparison to what lies inside of you.
What lies inside of you is the most important. That is Ralph Waldo Emerson.
There is your motivational quote for the day, May 8th, 2026.
We also have time for an empowerment card today. We pull one of these every day because we need some damn empowerment, don't we? All right, here we go. And shuffling, shuffling.
All right, this is it. Everyone who needs to hear this today, here's your empowerment card of the day. Girl, you totally got this. Girl, you totally got this. Anybody who needed to hear that today, there it is for you, girl. You totally got this woot woot.
So, that is uh our motivation for the day and we're going to come back at 5 and talk about what's going to happen with Kelsey temporarily. And uh I think it's a very fair order and I'm very happy for her. And uh don't spoil it for others in case you haven't seen it. Um happy early Mother's Day to all of you.
Thank you. Thank you, Bill. I appreciate you. So, look at Gigi came in. She gifted five memberships and she sent a $50 cash app. You know why? Because Gigi is an amazing Gigi and she's an amazingly generous cupcake. And we love you so much, Gigi. Thank you so much for your generous donation to my college fund for my twins who are already in college and my third daughter who will be in college in the fall. And if anybody has kids in college, you know exactly how expensive it is. This is a very busy time of year.
Thank you, Gigi. I love you so much.
Hi, Kai. Not fade away. Kai says replay train since last week. Glad to catch you live. I'm glad you've been here for a year. Did you get your new red velvet cupcake? I think you did.
Thank you so much. Gigi's watching on her phone. Healing her shoulder replacement. Oh, girl, I love you all my heart, too. Sending you all the healing vibes. Stay ahead of the pain if you can. Uh that is a very um invasive surgery and I hope that you feel better real soon. Real soon.
Thank you. Uh thank you Karen. I I got a little color touch up this morning and then I just put it a little back a little bit in a clip. Thank you very much for your compliment. Happy Mother's Day to you too Karen. Happy Mother's Day everyone.
Desida Dorado says, "Best two years I've ever spent right here." Happy anniversary to us. Happy anniversary to us. Thank you. 24 months. You got your new cupcake. That's the two-year cupcake.
LMP69 says, "Testing. I hope this works." I see you. I see you.
Thanks for the deuce. Little Sea Star says, "I love Melanie on the chat. Even though I'm typically replay crew, you all open my mind and fill my mind with knowledge." Oh, I'm glad you feel that way. Thank you so much for your five.
And uh thank you very much Christine Mitchell for tuning in from across the pond. Very very sweet compliment. And uh thank you so much for your super chat.
Boxer mom says gifted five memberships.
Boxer mom gift gifted five memberships.
There are um special emojis for members.
If you're a new member, check them out.
So many of them were uh curated during the Karen Reed persecutions and so many of them have been repurposed ever since.
So check him out. Miles King, I mean Miles King, we have we have one for Miles King today. It's called handcuffs.
We got handcuffs. And uh there they are.
He's going back in handcuffs today. And this is why we can't have nice things, okay? Because Proctor, Tully, and Lai, the Proctor effect is going to be going on, I don't know, for years, for a very, very, very long time.
Had they just turned over the discovery that they had had in their possession in their possession since 2021, including search warrants and other things, Miles King would probably still be in custody by now and he probably his trial would be already be over. I did an extensive deep dive into that into that last night in addition to covering Karen Reed's civil hearing from yesterday uh in which Mark Diller said that Karen Reed's attorneys were sandbagging him uh and the judge wasn't very happy about that.
Nope, he wasn't. Uh, Rosemary must be furious. Melissa, can you imagine the wrath of Rosemary? How mad she is. She's like, "Maybe, just maybe, you dumbass.
Maybe I was going to be able to get you off on the alleged murder because of Proctor's bias, you know, and his whole um, hey everyone, it's killing nword day in Canton. Get there uh, to Sergeant Good text message." Maybe they she should have she could have been able to show some bias. Maybe the case would have been dismissed due to egregious governmental misconduct and the failure, the abject failure of the NOFK DA's office to even give one iota. I keep it clean because it's um it's daytime and I might be playing in the Quinsey Barber Shop. Shout out to everyone at Nick's Barber Shop uh if I'm on the TV there. Uh they just don't care. We rewatched last night a little bit of Alli's testimony from the evidentiary hearing that Rosemary Scapichio had back in when was it? Uh July of last year of 2021. And Lai could not have given less.
He couldn't have cared less. He there was there's no way he could have cared less. He he was like, "Yeah, you know, every time Proctor walked by like I asked him for the discovery, but you know, I really don't have a system. I really don't take notes. I don't know where my notes are. I didn't look at my notes. I don't have a tickler system. I just, you know, like, you know, I just I just assume they're going to give it to me. And uh, you know, if they don't, like, no big whoop.
Massachusetts is where your constitutional rights go to die. Fight me on it. It's fentinel Friday in Massachusetts today. 25 years on the job. Please do not write any drug names in chat. YouTube's AI program, uh, while they think that they've improved it, uh, it really is making it very difficult for creators because we are being punished for the things that chatters put in the chat. So, please do not write out any be creative. Be creative with your words and your spellings and just just try and, you know, try and keep it tight, okay? Just try and keep it tight.
That's all I'm asking. That's all. Jen says, "Two years, my second longest relationship. Love you, Mel." Oh, I love you too, Jen D. 34.
Thanks for being here. And I like your brand new pink iced cupcake for the 2-year anniversary. Next witness. Mel, we know you've been so busy wondering if you had a chance to watch Trial 4 yet. No. No.
But thanks to everyone who keeps sending me Venmos uh asking me uh if I've watched it yet and telling me to watch it yet, but yeah. No, I haven't. I started it once and then it kind of like I didn't get right into it right away.
And so, you know, it's like many episodes, but I'm glad if you guys have watched it, you will get to see Rosemary Scabicho in all her glory. And also, um, you know, exonerating another wrongly convicted, uh, man by the name of Sean Ellis. I don't I don't know what year that happened. Um, but I'm sure you guys do because you've all watched it. Thank you, Next Witness, for your five. Go check out Next Witness's channel. Um they've got a lot of really good um reaction videos that are amazing. Look at Aunt BB is here. She gifted 10 memberships. Thank you, Aunt BB. You're amazing. Love you so much. You were my first member ever when I opened memberships on my channel and I'll never ever forget. Okay.
>> All right.
Apologize I got here a little late.
Sorry, >> right, >> your honor. We're starting today with two add-ons on today's list in the matter of the Commonwealth versus Miles King. Miles King indictments 2021 0315 and 0320.
They're both on being advanced at the request of the Commonwealth.
Commonwealth is represented by ADA Bill O'Driscoll and defendants represented by attorney Rosemary Capichio and attorney Nicole Scapitio. Council kindly identify yourself to the court in the record.
>> Afternoon William O'Driscoll on the upcom good afternoon.
>> Good afternoon on behalf of Mr. Keny.
I'm also standing in um on the gun case as well but I think we notify the court that I would stand in on that case for the purposes of this warrant.
>> All right.
>> Good afternoon your honor. Nicole Scapichi on behalf of Mr. K.
>> Council nice to see you. All right. So, uh, Comoff, I'll hear you on this.
>> Thank you, honor. Uh, Mr. King was out on bail on the two dockets. Uh, we were notified yesterday, uh, that he had been arrested and indicted by the federal government. He is currently in custody of the federal government. Uh, we're asking for a warrant to issue. We did file a motion to revoke his bail in both cases, but that's to reserve our rights on that motion uh, for when he's brought in.
>> All right. Uh, Tony Scapichio, either one. I'm asking this bill be revoked now, judge. I don't need I don't think there's any need to wait. I don't want it to do dead time. Um so to the extent that we can revoke the bill now on both cases and uh um visa warrant there if that's what wants to do. I don't know much about the federal case, judge, but I get it. Um but I just want the record to reflect that last time we were in court, we filed a pro motion that I know you can't hear, judge, but I'd like to get it heard sooner rather than later.
Um, and today we filed a motion regarding the state police crime lab.
Um, we're not asking for any action on it today, but I would like it marked up.
I don't think we're back here until June.
>> June 18th is the next.
>> So, I'm hoping that you can give the com the date to respond sometime before the day before the next date. So, if they're going to respond in writing to the motion, I I just don't want to be reading it next time before I'm standing before the court.
>> So, we can get a response date to them maybe a month before would be great.
So we're going to I say we're going to the request is to revoke the bail.
>> Yes. We have to hear >> in custody.
>> Yes.
>> So then the question >> to his federal defender. I've spoken to the US Marshall's office and I've spoken to somebody who was actually in court yesterday. He's being detained without bail in the federal court. I do not represent him on that matter, judge, but um I I have every confidence that the federal government's not inclined to let him out.
>> All right. So why don't we do this? We go step by step. So, um, Commonwealth, I'm going to allow I'm going to issue warrant. I'm going to but I'm going to allow the def the motion to revoke the defendants's um release as of today.
>> All right. So, like that on both the cases that's on 21CR 320 and uh 21CR 315.
>> Yes, sir.
And then I'm just looking for a response date on the motion uh for discovery regarding the state police um database.
>> And just by way of of background, I know we're not deciding, but just to give you an idea of of what's involved, judge, um we just we were to come up disclose to us a database um that they call a corrective action database. It deals with all of the state police experts. Uh essentially what it is is it's a database of every time they make a mistake and it could be as simple as they use the wrong letter head to they individualize a print to the wrong person. Um and so every time that happens there's there's an entry and and then there's an investigation there's underlining documentation to that and it gets resolved one way or the other.
Sometimes they're transferred out of the unit, sometimes they're retrained. Um but we typically don't get that information.
Commelt in this case gave us that information. And so of the 22 experts that are that are involved in I'm sorry of how many six >> in Kings um there's more I can't remember.
>> So there's a number of experts that are involved in King we went through every single solitary expert. We went through the database and we have identified all of the entries to each expert. And now what we're asking is to come almost give us the underlining data um that should be in in the state police lab for all of those entries so that we can do our due diligence in our investigation. Um and I think in Mr. King we have a January >> trial date. Yes.
>> Um, so I'm looking for them to respond before the next court date. So if there's any dispute about what we're we're asking for or any argument in the comments that they don't think we get the underlining data, I want to be able to make an intelligent argument and not be reading the motion on the way into the courtroom.
>> No objections by that.
>> I think that makes sense. And so when's the next date?
>> June 18th.
>> June 18th.
>> Oh, you can't you're not going to hear >> I'm not I believe Judge Crump will be hearing that, correct? No, it's a that's a um I think it's a Zoom.
>> That's a he going to hear that by Zoom.
>> That's what the plan was.
>> Yeah.
>> Then schedule the motion to dismiss.
>> So we might have to come in before that then. How much how long do you need to you haven't read it but I mean give them a couple of weeks judge to respond and then if if if there's a disagreement then maybe we can mark it up for a hearing.
If you can if you can reply within two weeks, if after reviewing it, you find that you need more time, then you can speak to council and bring it forward.
But if you think two weeks will do it, at least then we'll give a date that we can kind of get that >> I'll speak with the other ADAs on the matter and because I know we have we just got the motion to dismiss that we have to work on.
>> So why don't respond two weeks, whatever it be 20 First 22nd.
>> All right.
>> Two weeks before what?
>> Two weeks from today.
>> Oh, I got you.
>> Yeah.
>> 22nd.
>> All right. And then you want to keep that 18th date.
And the reason we have the 18th state judge because I know you haven't been involved in this case but uh we are filing our motion to dismiss based on the proctor stuff today. Com has a date to reply once Judge Crop reads both sets of motions. We're going to have a Zoom conference he said to determine um what we what the next step is whether it's a continuation of the evidentary hearing or it's something different than that.
>> So is the 18th just so we have a date is that a just a status scheduling date >> a status regarding the motions to dismiss.
>> All right. So, why don't we keep that?
So, at least there's a date and then um whatever date you end up uh dealing with Judge Crop, then at least we'll figure that out. So, we got a date. We got a date to respond. Um we have the allowance of the motion to revoke.
Anything else we have to do?
>> I would like it March, but I thought we were going forward on the proctor motion today. I understand you can't judge. Um but my understanding was we were going to go forward on the proctor motion with Mr. King today. Um, in terms of additional discovery, Tom has had the motion for a while. They haven't responded. So, again, if they could respond to that within the next two weeks, let me know what their position is. Maybe we don't need a hearing on it.
Judge, maybe they agree to it.
>> All right. If at least this time we you'll know that if it if it is on, it'll have to go into the other session.
We can deal with it.
>> Thank you.
>> All right, council. Thank you. Thank you. Have a great weekend. Thank you.
>> That is continued to June 18th.
Commonwealth opposition is due by May 22nd.
>> Thank you, M.
>> Thank you all.
Have a great weekend.
>> Do you have the parties on the Dwayne Anderson matter?
Your honor, for the record, this is number seven on today's list. Commonwealth versus Dwayne Anderson. It's indictment number 20250128.
It's on for a lobby conference. Mr. Anderson's appearing via Zoom as he's out of state. He's represented by attorney Jim Gavagan who's here in court. Caramel office is represented by assistant AG Alicia um Willis. Council, kindly identify yourselves for the court and the record.
>> Good afternoon, your honor Alicia Willis for the Commonw.
>> All right, council. Good afternoon.
>> Attorney J behalf of Dwayne Anderson, your honor, who is presently before the court on Zoom.
>> All right, council. Good afternoon, Mr. Anderson. Good afternoon.
>> Afternoon.
>> All right. All right. So, this is on for a a lobby.
>> Yeah, sure.
>> Um, so can I see council sidebar?
>> Yeah.
All right, we're out. I was going to say, let's watch and see what Mr. Anderson did, but that's okay. All right, here's the deal. Here's the deal.
She's not happy. Rosemary Spichio is not happy. Uh, for those of you just tuning in, she was just like, "Yeah, revoke his bail. Revoke his bail 100%. I'm not even going to oppose it. Just revoke his bail." Miles King uh is up on murder charges. Up on murder charges for the 2021 murder.
We went over everything last night.
Allegedly, he murdered a guy on a bicycle. And allegedly, maybe the guy confessed to someone, law enforcement, I think it was law enforcement, uh, right before he passed, a dying declaration, if you will, and pointed at at Miles King as the shooter.
People have said it might have been it might have been Proctor that he that he confessed to you. I don't know. I don't know that there's any truth to that. I really don't know.
But based on what happened with Proctor, Tully, and Lai not turning over discovery timely to the defense to Rosemary Scapichio, Miles King had been held in jail for something like almost four years.
And because of the failure, the abject failure for from the for the Commonwealth to turn over basic discovery that they had had for since 2021.
Judge Dulan agreed to let Miles King out on bail in June of 2025 while he was out on bail.
And just yesterday, he was picked up by the feds and he is currently being held by the feds and they're not letting him out on alleged distribution and conspiracy to distribute fentinel and crack cocaine charges.
Today's was supposed to be a hearing on the motion to dismiss. She says she filed another motion to dismiss based on the proctor stuff. I don't have a copy of it yet, but boy do I want one.
And when I get it, we're going to talk about it. I don't know if it was Proctor because I don't know if it would have been Proctor because MSP doesn't get involved until there's a death. So, they wouldn't get involved until after there's a death, I think. So, that might have been just a wild rumor. people put a lot of wild rumors out there on the internet and then you know people just run with them and so I don't want to I don't want to run with it but and so I don't think that that was it but what I think happened is that in the um phone extraction of Michael Proctor which as we know was um extracted by the Commonwealth and contained not just 30 days of data which is what Michael Proctor's attorneys said it would contain. and it contained all of his phone data going back all the way to 2012.
Text messages, emails, uh, voice memos, photographs, hundreds of thousands of items.
Many of those items were intimate body parts andor nudes of women and maybe men, we don't really know who were not party to these conversations that were passed around by Proctor and whoever he was texting them to. In fact, at least one of them that we know of was were photographs or a photograph of an essay victim from what we just heard Rosemary say.
and that is her daughter Nicole Scabichio who was second chairing her.
She feels like she's got a really great shot of getting Miles King off on the murder case because of what was found in Proctor's phone.
Sounds like she thought the Commonwealth might even agree with her. That's what it sounded like to me.
And so when the Commonwealth moved to revoke his bail, she just said, "Yeah, do it. Do it. I'm not even going to fight it. I don't even want to wait.
just do it today. The feds have him.
They're not going to let him go. And so that is not uh the hill that she's going to die on. Right. But the other interesting thing that she said, which is new information that I don't think anybody knew about, is she said that the Commonwealth had turned over information about the state crime lab. Did I hear that right? Because I may have to rewind and listen to it again. Correct me if I'm wrong. I know you will. She said the Commonwealth in the Miles King case has 22 experts who are going to come in and testify about evidence from the crime labs. Crime lab, I think she said state crime lab. And what we just learned today, and she said she had never seen it before, is that the Commonwealth has a corrective action database and they turned it over to her. And apparently this database has everything from when they forgot to file something, records that they keep, right? Business records about things that go wrong in the crime lab and what they did to correct it.
I don't know that Karen Reed's team ever got a hold of the correction action database.
Exactly. What is a corrective action database? I'm going to go back on my own stream and rewind it myself so that I can listen to what exactly it was that she said because I was unable to I was unable to um rewind the zoom. Uh hang on for just one second while I do that and I'll give you something to watch.
Uh maybe this is like a secret vault.
Maybe it's a secret vault of um corrective actions that the crime lab has been screwing up and they have and it's never been revealed before to any criminal defendant because that's what it sounded like to me.
Uh Gigi, I know you're on a lot of pain meds. Did you send me another 50 by Cash App? Listen, girl, if that was a mistake, just email me and I'll send it back to you because I know you're on paid meds. You're recovering from a shoulder replacement surgery and um if it was an error, I will send it back to you. just email me. Um, uh, I love you so much. All right, hang on one second.
I'm going to, uh, show you while you're waiting. I'm going to entertain you because I never would leave you not entertained. Hold on. This is, uh, Emily C's version of the Commonwealth hearing, the re the hearing that we watched yesterday with Lai.
Uh, and if you don't follow Emily C on all socials, what are you doing?
Uh, let Emily C entertain you while I just go back and listen to what it was that Rosemary Scapichio said. Talk amongst yourselves. Enjoy, Emily.
This is Emily's version of the July 21, 2025 recreation of that hearing.
Enjoy.
Wait, give me some volume. Yo, >> we need to understand the communication that was happening and the police. We can do that, but we'll be here until the cap.
>> Hold on. I got to rewind it for you.
She is Emily Ce on all the socials. She's a cutie pie.
Here we go.
>> We need to understand the communication that was happening between the Commonwealth and the police. We can do that, but we'll be here until the cows come home. Then send in the cattle because troopa has emails with the Commonwealth that we need to get our arms around. Okay. How do you want to proceed on that? Let's get ADA Lai up here. Your honor, Lai should not have to take the stand. Why? It would probably be faster so he doesn't have to walk to the witness stand. And I would like the motion is denied. This could be embarrassing for certain individuals.
This could be embarrassing for the office. Get that slow poke up here.
Assistant District Attorney with the Norfolk County District Attorney's Office. I started with the District Attorney's Office. I worked a few warehouse jobs. Speak up. No one can hear you. I went to SuffK undergrad. I went to University of Southern California. Let me back up a little. No.
His backstory is boring me already. Can you just ask about this case, your honor? So, do you keep records? I mean, I keep records in the form of a list and your lists with the check marks. Do they remain in the file? To the best of my knowledge. Did you review the file about this case?
Why not? I didn't have the file. You work in the DA's office, right? I do.
So, what did you review for your testimony today? The file.
Okay. Do you keep notes about what you ask for? Yes, with Bodie Technology and the Milton Police. No, for the state police. How many search warrants are there in this case? Um, six. When did you get all six search warrants from Proctor? I did not. So, your checklist system doesn't really work. I don't know. He said, "Trust me, bro." And I just got excited cuz he called me bro.
Work in the same building as Proctor. Do you ever just go down the hall and talk to him? It It's scary going to the cop side of the building. They're always calling me a nerd. This was back in 2021. You must have been getting upset with Trooper Proctor. No, I'm not allowed to. Do you ever go to his supervisor, Tully? I did that once, but he put me in a big trash can and called me a dweeb. When did you become aware that you didn't turn over the search warrants? Maybe right now. Remember saying to the court in January 2024, we could proceed forward because discovery would be complete? Uh, no. Reading that refresh your memory? Um, no, it didn't refresh my memory because I did not.
Okay. Attorney Lai just told me that he needs his cigarette, so we need to break. Thank you, your honor.
We'll return here August 5th. Your honor, um, Trooper Proctor's attorney is here. Can he communicate the new date to him? I don't want to go back to his home. He was just laying on his front lawn crying, eating two Big Macs, and just scrolling through his phone looking at pictures of himself in his uniform. I don't want to have to go through that again. We need to understand the communication that was happening between the Commonwealth and the police. We can do that. But we'll be here until the cows come home then.
>> Isn't she the greatest? I hope you enjoyed it. Okay, I'm going to listen to it in my earpiece and I'm going to repeat to you what it is that Rosemary Spichio says so that we I don't know who the judge was today because it wasn't on the calendar, but she said she filed a new motion today regarding this state police database that she was unaware of. I'm going to repeat to you what she said. Here's the background on the motion.
>> The Commonwealth disclosed to us a database. Um, essentially, >> wait, it's called a corrective action database. Essentially, what it is is Oops, wait. Maybe I can put this on slower mode.
>> Essentially what it is is >> it's involving >> all of the silly all of the state police experts. And essentially what it is is every time they make a mistake um it's put into this database.
This is really interesting information.
Oops.
Oops.
>> Could be as simple as they use the wrong letter head >> to they what it could be as simple as they >> do to they um do something about they enter in the prince for the wrong person.
Every time that happens, >> there's an entry and an investigation and underlying documentation regarding that and it gets resolved one way or another. Yes. A database containing exculpatory information called the um correction action database or corrective action database.
all the juicy bits.
Sometimes they're retrained.
>> And she said, >> "We typically don't get that information, >> but in this case, the Commonwealth gave us that information." And there's 22 22 experts in the police database. I'll try holding it up to the mic. It may not work. It may work. Let's see if you could hear it.
Can you hear it?
>> I know we're not just to get an idea of of what's involved, judge. Um, we just call up um that they call a corrective action data.
>> Can you hear it?
Oh, yeah. Maybe that would be a better idea. Hold on.
I mean, who knew we were going to get this information today? Olivia's already on it. I can tell.
No, please.
I mean, it is on speaker, so there's no other way for me to do it. I mean, it is. Can you hear it? Wait.
Um it gets resolved.
There's more. So there's a number of experts that are involved in games.
We went to the identity in the state for all of those January.
Um so looking about what we're asking for any make an intelligent not a motion in the way.
>> Yeah. So, the thing is she filed a motion today about this because she typically doesn't get that information about the state crime limb. There are 20 she's saying there's 22 experts uh in the King case alone, not in the whole of the database. It involves every single state. It's it's run I she said it was run by the Massachusetts State Police.
I'm not sure. And that is if she meant that or if she meant the state crime lab. Um, it's a corrective action database that every time something oops, every time something like they draft something on the wrong letter head all the way up to they put the wrong person's prints in, um, there's a corrective action taken and there's all kinds of documents that are going to flow from it and she wants everything.
She's going to demand everything. She made a motion for it and uh, it's state police crime lab experts. It's not going to be outside experts. It's going to be, you know, the people that work in the crime lab that analyze the DNA, that do the blood alcohol content extrapolations, that analyze the fingerprints, that analyze the cell phone forensic data, and all of the evidence, every single piece of evidence that the Commonwealth intends to use, forensic evidence, fingerprints, blood spatter, blood samples. Think about all the things in the murder of John O'Keefe case alone, right?
The testing of the the the Lexus telematics, the testing of for looking for fingerprints, the looking for DNA, all of the unknown DNA on John O'Keefe's clothing, the blood in the solo cups that wasn't test. Think about every single case that we have watched in Massachusetts and all of the physical evidence. They analyze everything and every time time something goes wrong, they put it in a database and she wants everything. She wants to know what corrective actions were taken.
She's got a lengthy motion on it. She filed it today. Um, can't wait to get a hold of a copy of that because she told us everything. Can you imagine what's in that database and the fact that she's never seen it before and apparently no one's ever turned it over to her before. I wonder if all of the other defense attorneys in Massachusetts have any idea that this corrective action database exists.
Oliv says, I would love to search Moren Hartnet. Yes, remember Moren all of the glass testing. We've we've heard from so many of these experts in so many of the cases that we've covered, many of them in the Karen Reed trials alone. Uh right. So, they're going to come back. she would like the Commonwealth to uh respond to her motion and then they're going to come back on um June 18th. I believe she also filed another motion to dismiss based on all of the Proctor stuff that we just talked about. And um Massachusetts is the state that just keeps on giving, isn't it? It's like we can't even get out of there. We can't hang on because I have some more documents for you from the federal system. And of course, um Oh, thanks, Tiff, for the motion to uh revoke, but Rosemary just agreed to it.
Just agreed to it.
She didn't even fight it. She said, "Yeah, just revoke his bail."
Oh, here's a little bit of a clarification in the record. So, uh, what they were arguing today was, they didn't really argue it cuz Rosemary was just like, "No, I I don't even I'm not even going to oppose it. Take away his bail."
Here's what the Commonwealth argued on the, uh, motion to revoke Miles King bail. And it does clarify something. This was filed, uh, today.
Actually, it does clarify something about his bail conditions. Um, on December 21st, 2021, defendant Miles King was arraigned.
Attorney Rosemary Scapichio filed her appearance. The defendant was ordered to be held without bail on December 22nd, 2021. The defendant was arraigned on another case. So, there was a gun charge and then there was the murder charge and that was a different he had a different attorney in that case. Her name is Christine Feny. Rosemary said she was stepping in for her today.
Um, and in that case, the gun charge, his bail was set at $10,000 shy and $1,000 cash. He was advised of his bail warnings, but he's being held without bail anyway. Those are both on the same day. On June 26 of 2025, Judge Dulan, as we just talked about before, allowed a joint request for a continuence and a reduction in the defendant's bail that was filed on the murder docket number. The defendant's bail was set at $1,000 shy, which means a bond. One, I'm sorry, $100,000 shy or $10,000 cash with GPS and home confinement. And the defendant was released on personal recgnizance on the gun charge and uh he was able to make bail on the murder charge because somebody came up with $10,000 in cash.
And we also learned that uh in some of the paperwork we read yesterday from the feds that the day he was released, he was picked up in a white sprinter van and his buddies gave him $20,000 in cash because you just can't make it up.
On May 7th, 2026, which was uh just yesterday, the Commonwealth was informed by Associate Probation Officer Carrie Mlelen that a probation warrant had issued for the Miles King for a vi violation of his terms of release, specifically a curfew violation generated because he was arrested by the FBI. And so, I guess the GPS monitor figured out he wasn't home because he was in FBI custody. That's why there was some miscommunication yesterday. People thought he was picked up um by the feds on his uh violation because he was uh because of his curfew. That's not why.
It's because he was arrested on federal charges.
Uh and so all of these alleged drug charges happened while he was out on bail.
Yesterday, the US Attorney's Office told the Commonwealth that Miles King had his initial appearance yesterday afternoon, May 7th, uh, and consented to voluntary detention without prejudice. Listen, Miles King, you had one job. Okay? You had one mother effing job and that was to stay out of trouble awaiting your murder trial because there was a good chance Rosemary Scapichio is telling us that you might have been able to get off because of Proctor and you just you had one job.
One job.
The defendant is now in custody of the US Marshalss unless or until he requests a detention hearing.
Commonwealth now alleges that the defendant violated his conditions of release by being indicted by the US attorney's office on multiple drug offenses that allegedly occurred while the defendant was out on conditional release on this matter. And so Commonwealth said, "We'd like to uh revoke his bail uh in this murder case."
And uh Rosemary Scapichio said, "Go ahead, do it." She said, "Do it. Do it."
And the judge said, "Okay."
Right. It's kind of like a Brady list for the crime lab experts. Kind of. Kind of. It's like every time they make a mistake. Yeah. And then there's there's other, you know, proceedings that stem from it and corrective action that's taken. Uh and it's a good way to impeach state crime lab employees. And wasn't there like a big scandal about the state crime lab a couple of years ago or something? Was that Massachusetts or Rhode Island? I don't know. I'm getting conflated. Uh, thank you, Linda, so very much for your VMO. She says, "I'm driving from Boston to North Carolina to visit our daughter at college. So happy to have you with us on this road trip."
Shout out to Linda.
I'm so glad to keep you company on your drive. I don't know if I'll be here all the way until you get to North Carolina, but uh I'll try because we have another show at 5 about Kelsey Fitz Simmons. Uh Betsy, thank you for your VMO says uh per usual, XOXO XOXO to YouTube. uh bets.
All right, moving on.
Let us take a look at the other papers regarding Miles Kang and see if there's anything interesting in there that we did not talk about last night.
Uh there's an affidavit from the the special agent pictures and everything, one job.
Uh, it's a detention affidavit from the special agent John Christensen.
Thank you for your super sticker.
IW9338.
Let us pull this up and take a look. See what he says. What if anything he says about Miles King, please?
Mark McKay says, "I'm watching and working." Honest. I know you guys. You guys pretend you're working, but you're really not.
I apologize to all the bosses who are getting less uh less than stellar work products out of their employees who are uh watching on the tubes of you.
Ducky Grammy says Rosemary must be so mad. She's amazing in trial for Thank you much. Thank you very much for being here for 18 months. Jessica says, "Taylor really does have a song for every occasion." I know she does, right?
Thanks, Jessica. Corruption and masses almost two years. Nowhere else I'd rather be. A thank you for being here for 23 months. You're almost there.
Thanks on top for your super sticker.
Aunt BB again, thank you for gifting 10 memberships. Desa Dorado said uh the prayers for Bella last week from all of you worked no osteio saroma. Thank you all. Arthritis is manageable. Gluc glucosamine is wonderful. I live with all my heart. That's amazing. Power of prayer is amazing, isn't it? It really really really really is. Happy Friday to Romy in Massachusetts. And uh thanks for your attent. Dunin Noggin says just because it's Friday, I'll allow it.
Thank you. And Gigi said, "I'm trying to prevent I'm trying to keep my shoulder replacement from having to be replaced."
That's great. Thanks, Gi. Bmax says, "Happy Mother's Day weekend." Happy Mother's Day weekend to you, too.
Thanks, Gigi. The Watcher says, "So, the judge is just straight up hearing the motion to dismiss. What happened to our evidentiary hearing?" This is a different motion to dismiss. This is based on the Proctor stuff she said. So it's different.
No more Lally on the stand. No Proctor on the stand. I don't know. This is See, it seems to me from what I heard her say that this is a different motion that she filed today. Oh, please.
Thank you for tuning in from across the pond. Also, she said that this judge couldn't hear it cuz it's supposed to be I think did she say in front of Judge Dulan?
I think so. Thank you, Sarah, for um being here for two months. Sarah, juror 13. Thank you so much. Cupcakes for Justice says, "Hi, Melanie. This is hello also to Gigi on her shoulder replacement. Sending good wishes to her.
I had that last year and it's a long road." Thank you very much. And then Cupcakes for Justice gifted five memberships because she's awesome. Thank you.
Laura says, "Happy Mother's Day, Queen Melanie." A thank you so much. I appreciate you. And uh Duncan has been here for eight months and says, "The deeper you dig in Massachusetts, it gets worse." It feels that way, doesn't it?
IW says that sent me a super sticker.
Thank you so very much, IW9338.
And uh Charles, thank you very much for your super sticker. I appreciate you, Charles Stoutzman. Let's take a look and see if there's anything else that we can glean from this affidavit of the special agent. I don't want to read the whole entire thing because it's 28 pages and sometimes we just like to skim through.
And what I will do is I will um skim through slowly so that you in case you want to read the whole entire thing, you can do that later.
But this has to do with the new arrest of Miles King.
Did she say corrupt or or Dulan? maybe corrupt could be. I get them conflated in my head sometimes.
Uh and so here is the detention affidavit of his special agent Sean Christensen that went along with the federal indictment uh from yesterday on Miles King and I think six of his cronies. I think there were seven altogether.
He's a special agent with the Bureau of Alcohol, Tobacco, Firearms, and Explosives, the ATF, submitting this affidavit in support of the government's motion that the following defendants be detained pending trial. I call them just by their nicknames. We have Poncho, Champ, EBK, Frenchie, Miles King is aka Mizzy Cash, uh Junior is Jiggy. Oh, well I don't know who Malachi Martins is. I don't remember that person. I thought there was a Jillian in there.
Six of the targets have been charged in the US versus uh Poncho at AL and the seventh Malachi Martins has been charged by federal criminal complaint in connection with approximately seven-month federal, state and local investigation resulting in the controlled buys of numerous guns, fentinyl, and crack cocaine from the targets. Miles King was a target and the execution of federal search warrants at residences contained with the targets. Uh Miles King was not arrested on any gun charges. His charges were just just just for the fentinel uh and the crack cocaine.
Here's a little bit of background on the uh the Colombia Point Dogs D AWGS 2015. The US Attorney's Office charged 48 leaders, members, and associates of the Columbia Point dogs, also known as the Point, after a two-year investigation by federal, state, and local. And uh at the time, The Point was one of Boston's largest and most influential citywide gang. Oh, it's all gang related.
Here's a little bit of history. and to them and their expansion of their drug trafficking business throughout southern Massachusetts, establishing strongholds in Brockton and Fall River, southern New Hampshire and southern Maine. The gang was largely run by four families, all of which had descendants among the targets in the CPD investigation. Don't get confused. This doesn't mean Canton Police Department. It means Columbia Point dogs.
Uh, the Williams family, the Woods family, the Berry family, and the Funches family.
I mean, okay, it's like organized crime.
The takedown of the Columbia Point dogs causes significant reduction of crime, particularly shootings and drug and firearm trafficking in the Boston area is typically dominated by can not be PD the uh Colombia point dogs and uh again there's another Boston gang Johnston Road together members of these gangs formed an alliance that gave them protection status and a network for selling drugs and guns. The targets of this investigation are members or associates of Columbia Point Dogs and Johnston Road operating in Boston Brockton Randolph and other parts of southeastern Massachusetts.
Apparently the big dog is uh Ron Williams aka I think that's Poncho for example.
He a member of Johnson Road sold drugs with Miles King who is also a member of Johnson Road and his drug trafficking associate uh whose name Acram and uh as you can see they were all conspiring together and allegedly dealing all of these guns and uh fentinel not only powdered fentinel over 300 grams of powdered fentinel fentinyl, 62 g of fentinel pressed pills, and approximately 175 gram of crack cocaine.
And uh look at all the firearms that were seized as a result of this investigation. These were controlled buys and there's lists, a very very long list of all of the firearms.
Some of the buys were made by an undercover agent and some of the buys were made by a cooperating witness.
And uh let's get down to business with uh Mizzy Cash aka they got pictures. Oh, I probably can't even show those pictures. YouTube hates the pictures. I got to go real fast past them.
A lot of YouTubers uh were stricken when one of the what trial was it that we were watching where um was it Kelsey's trial where the Commonwealth attorney like started brandishing uh a firearm in open court and people got their streams taken down. So, let me just I'm not I'm not getting involved in that nonsense. Let me just scroll through here and get to the part about Miles King. Okay, here it is.
Miles King, aka Mizzy Hash, is a member of the Johnson Road Gang and a member of the group Self-Made.
King is on pre-trial release for a 2021 murder case out of NOFK Superior Court.
In 2021, King was charged with the uh murder of victim one. Reports alleged that King shot victim one in front of victim 1's home shortly after victim one arrived there on a moped. In 2019, police arrested King while he was sitting in a stolen car with a loaded gun outside of victim 1's home, resulting in King being charged with possession of a large capacity weapon, carrying a firearm with ammunition without a license, and receiving stolen property. Both cases are currently pending in Norfk Superior Court, while King remains on pre-trial release.
One job.
One job.
When King was released from jail, members of Self-Made picked up King from jail in a Sprinter van and provided King with $20,000 in cash.
King maintains an Instagram account, Mizzyash 617, and a YouTube channel, Mizzy Cash, with a dollar sign as the S, where he has posted photos and videos depicting this event, as well as other posts flashing cash and numerous firearms.
Oh man, are you kidding me? This is the YouTube video entitled Missy Cash First Day Out that was posted on King's YouTube channel following King's pre-trial release in June of 2025.
really.
He posted this the day he got out.
You can't make this up.
I'm not going to play it because it'll probably copyright strike me, but I'm going to listen to it in my headphones.
He made a whole I'm gonna link these Can't make this up.
Uh, footnote 7 says, "This is a YouTube video titled Missy Cash Airbnb featuring King and other flashing and others flashing numerous firearms originally posted in 2021." The video's description states, "All firearms look alike.
All firearms look alikes are props.
Based on my training and experience, the firearms appear to be real.
Oops.
I will link both of the videos below for your viewing pleasure in private.
Stupid stupid.
Oh, and here's some screenshots from the videos in case you're interested. King holding a stack of cash in the Sprinter van. the day of his release from jail in June of 2025. There it is.
It's telling us everything.
Wow. I mean, to be dumb enough to post it all over the internet. I mean, here he is. A screenshot from a YouTube music video. Uh Mizzy Cash Airbnb 2021.
He's holding firearms. I can't really show that to you, unfortunately. Those are YouTube rules. I don't like it.
King and Williams were cellmates when they were both both incarcerated at Plymouth County Correctional Facility.
King and Oram previously lived in the same apartment complex in Eastn, Mass.
King and Oram have both conspired with Williams and selling fentinel and crack cocaine to the UC on numerous occasions.
Throughout the investigation, King sold over 175 grams of crack cocaine to CW1.
After arranging the drug buys through Williams, CW1 would meet Kang to buy the drugs or King or he would send a runner known as Jiggy to complete the drug buy.
King told CW1 that Jiggy worked for him in Oram. During a buy on March 11th, 2026, when King sold CW1 57 grams of crack cocaine and three grams of fentinyl, King told CW1, "I got everything you need. Help me, help you type [ __ ] I want to make money with you, not off you. King then stated, "You think you can blend that stuff?"
Referring to the three grams of fentinel King just sold CW1.
And so that's it. And that is why the uh US attorney's office or the thing uh says that uh the targets should be detained pending trial. Please detain them. Seems that they're being detained.
Seems like Rosemary just agreed oops just agreed that uh they should be and so they are going to be. And that my friends that my friends is why you may have picked up on the vibes that Rosemary Scapicho was really really really really mad today.
And you wouldn't be wrong, wouldn't you be? Seems that they might have had a wire tap also says uh Scott 25 years on the job.
You can't make it up because you just can't.
Jersey to Georgia. Happy and one year anniversary to us and happy Mother's Day. Thank you. Thank you for being here for 12 months. Courtney asked earlier uh will she walk away from King Rosemary?
No. No, she can't. She won't.
I don't think she will. She's not a public defender. She's she's a paid attorney and uh you know just because he did something dumb doesn't mean that she's going to walk away from him, but I don't think she's happy.
Yeah. Nothing like your client making your job harder for you. 100%. 100%.
And uh the the StayHot podcast said Miles King couldn't appear like he cares less, right? Some people thought that was that he was in court. Um, but he wasn't. No, because he's in federal lockup right now.
Why? Why?
Friendly farm girl says, "Have a great weekend. Happy Mother's Day to all."
Happy Mother's Day to you, too, everyone. Thanks for tuning in from Canada. Uh, Bri like the Cheeses. I've been here for 24 months. Congrats. Got my jury duty summons in Massachusetts for August. Good. You should serve. I think everyone should serve.
It's just It's your duty. They need jurors who understand reasonable doubt and who understand the process. And many of you do. Thank you for your early birthday, Cupcake. Oh, thank you. Happy birthday to you. Happy birthday, Charles. Happy birthday. And thanks for your super chat. Uh Gigi said, "No, I sent the 50 to you for Mother's Day. I never take pain medication. Love you."
Oh, you're so sweet. You're so sweet.
Yeah. I don't No, she won't withdraw.
She won't withdraw. Listen, uh she's a fighter. She's a fierce advocate. She believes in justice and uh these charges are different. And maybe they set him up. I don't know. I don't know. Maybe they set him up.
Maybe a lot of people have hypothesized.
I've seen some hypothesizing on the internet. I don't like to, you know, feed into the rumor, gossip, innuendo, and speculation, but however, but but but but is it is it a possibility that was what was on Proctor's phone is so egregious that it's going to lead to the dismissal of the murder case and people know it, so they wanted to try and get him on something else? I don't know.
I don't know because I haven't seen the motion to dismiss yet and I really really really really want to.
So, uh I don't think I don't think that she's going to No, it would it wouldn't come into his case. I don't think it would come into his case because this is like a subsequent bad act. And so, I mean, we've seen so many trials like this in Massachusetts where, you know, even like Brian Walsh's stuff didn't really come in.
It's not relevant. Happened after. So, no, I don't think so. Happy Mother's Day. Blessed be says to all the strongest mommies, we run the world. We do. We run the world.
Yeah. I wonder how the victim's family feels. Right down the rabbit hole we go.
This is what happens when you have bad actors like Lai and Proctor and Tully and Lai. And we we rewatched it. If you never watched the June or July 21st, 2025 hearing that Emily C just reenacted for you. Um, it's wild. Lai really really just didn't care. He had zero intellectual curiosity. Um, and he didn't care about turning over discovery. There's never any any sense of duty or obligation. It's just like, oh, when Proctor gets to it, he'll just give it to me. And if it's if it's 4 years later, so so what?
So what?
Mhm.
Okay.
um thoughts, questions, comments, concerns. We're going to come back here at 5:00, so don't worry. You won't miss me too much. I'm just going to go for a little lunch break, and I suggest you do the same. Uh we're going to come back to talk about the temporary orders for Kelsey and what this means for her and Mother's Day. And I'm very happy. And I'm sure she's very happy, and I think that you should be very happy, too, because we've been fighting for Kelsey since 11 days after her shooting. And it is so good and so rewarding to see her being able to rebuild her life and see her baby. So Sheree says, "I can't even say that Mile's music is good. It's me.
It's meh. It's me." Megan said, "Proctor's uh misconduct put a lot of people's safety at risk." It sure did.
It sure did. Happy Mother's Day, Andrea.
Happy Mother's Day to you, too. Amanda says she probably went off on Miles. He deserves it. She She might not have even been able to visit him because he was just picked up yesterday. He's in federal lockup. I don't know that she'd even had time to get over there and speak to him, but um she was like, "Yeah, keep him. Keep him. Revoke his bail." And this is true. Carrie says it's better for one guilty person to go free than an innocent person be jailed.
Uh and they they need to learn that the hard way. They do.
They do. All right. I'm going to see you at 5. I'm going to uh teleport you over there. We're going to talk about Kelsey at 5. So, get on over there. Buckle up your seat belts. Thank you moderators for coming in here for this very last minute this very last minute live stream. Uh and we covered a very short hearing and we learned all about the uh correction action database that is maintained by the Massachusetts state police and has all of the things uh that are all the mistakes in the crime lab and uh all of the people who made the mistakes and 22 experts and I how many of you are out there just drafting your foyer requests as we speak? a lot of you. I bet this is probably my shortest live ever. It's only an hour and 10 minutes. Um, but I think we got a little information. Got a lot of information out there, right? All right, we're coming back at five. Buckle up, buttercups. Love you guys with all my heart. If I don't see you soon, I'm going to die. But I'm going to see you.
I'm going to see you. I'm going to see you at 5:00. If you are familiar with the Edric Fost case, even if you're not, Peter Trey Gos is doing, I don't know, some sort of Friday series on it. He's going to review the trial. I can't wait to hear what he thinks about it because those of us those of us who watched Edric Fost uh be convicted of a uh 25year-old murder were horrified. It was like a modern-day lynching uh a a real time tequila mockingb bird uh based on bogus junk science and um it's an abomination.
So check it out if you're not familiar with it. If you want to watch the whole trial, I streamed the whole trial. I have a playlist for Georgia versus Edric Fost. Um, it's horrific. I also did a a review of the DLine episode about Tara Baker and Edric Fost. Um, and it is one of my least views viewed shows. I'm surprised about that. Guess it didn't generate a lot of interest. Um, so if you haven't seen that, go back and look.
I'll see you at 5 o'clock. Buckle up, buttercups. Uh, thanks moderators. I love you. Uh, everyone smash the like button on the way out and then also please smash it on the way in. Boxer Mom, I think I thanked you for the five memberships, but if I didn't, thanks again. Stay cool, stay kind, stay glassy. Don't believe everything you read on the internet. Come on back at 5:00. We I should teleport you right on over. Peace out. Bye.
