In defamation lawsuits involving public figures, plaintiffs must prove malice (knowing the statement was false or reckless disregard for truth), and the burden of proof increases significantly when the plaintiff is a public figure. This legal standard means that public figures face higher barriers when suing for defamation, as defendants can argue the plaintiff should have known the information was false given their public status and access to information.

LAWSUIT: Candace Owens in SHAMBLES | SUED by Charlie Kirk InsiderAñadido:
Candace Owens is in shambles because her second defamation suit has hit her. We will be breaking down the facts of the case, her reaction, and Benny Johnson finally sounds off on Candace as well.
Also, stick around to the end because the Daily Wire exposes $1 billion in Democrat Medicaid fraud in a new investigative piece and we review it. So Benny Johnson finally responded to Candace Owens corruption and it was a response to the new defamation suits coming against her which we'll talk about. Basically he says this is what happens when you don't have any proof for your allegations and vindictive backbiting and nasty grams [snorts] uh that that are all based on vibes and your feelings at the time then you're going to have a really you're going to have a real tough time when people start suing you. And from what I hear saying going to be the last one. I hear this going to be just the just the start. Canada is already being sued by the first lady of France.
It is what it is, right? So high stakes game. Uh come correct. Since I do this professionally, it's time to like not stop with the both sides of some stuff.
You either bring it right. You either bring your receipts, you show people what you're talking about, or you don't have any receipts and you're effing liar. So bring your receipts or you don't have receipts. If you don't have receipts, then shut up.
>> Better late than never from Benny, I guess. I think those who actually came out against her back in October and November have a lot more validity, but at least he said something. So, Candace has received her second defamation suit.
Obviously, the first is from the Mcron.
This one, and I promised these would be coming, guys. Remember, there's going to be more. This is just the beginning, believe me. But this one comes courtesy of Charlie Kirk's head of security, Brian Harpull. Essentially, in previous episodes, Candace had on someone named Mitch Snow. We've talked about him before. He lies for a living. He's like literally been on multiple podcasts who just and he just makes things up because he wants to get famous and meet these cool people that he really likes like Hannah Owens. And he said that he saw Harple and Erica Kirk at a military base plotting the assassination of Charlie Kirk. That is how he got famous. This occupied about 10 episodes of Candace Owens show. Here is Candace's reaction to getting served by Brian Harple over this lie.
>> Let's actually pivot to the lawsuit because it is remarkable. Okay, the lawsuit itself is 69 pages and for some unknown reason, he begins the lawsuit and I'm talking like the first few pages with strong support for Israel. I guess that's mandatory. Candace is anti-Semitic [laughter] just even though Brian Harple's not Jewish. I am not Jewish. Charlie was not Jewish. He mentions this. it just kind of sporadically in a paragraph where he's painting this picture that I'm a conspiracy theorist. They also mention uh we can bring this up here on uh on point 19 that I I I don't believe the moon landing. Guilty is charged.
Guilty is charged. I think the moon landing was fake. I'm not sure what this has to do with anything if I'm required to believe the moon landing is real, but he just kind of mentions that and then you know you got >> So this is very relevant to the case and the reason why is because Harpull is most likely going to need to prove malice. Meaning his lawyers have to prove that Candace knew that she was lying. Not just a mistake, but that she knew it. And the reason why he has to prove malice is because in defamation, uh, if you're a public figure, that means that the proof goes up. And since Harpool is a public figure, you know, it's possible that he wasn't at the time that the defamation came through. I don't know if he was. If he wasn't, then all the lawyers would have to prove is that Candace made a mistake, which would be fantastic. And most likely that's probably going to be the actual center for the entire litigation process. Is them just deciding is Harpole a public figure or not. If he's not a public figure, he wins this case easily. If he is, he still may win the case. But most like likely his lawyers are going to have to go after uh Candace actually having malice. But the reason that the fact that Candace is a conspiracy theorist is relevant is he can prove that she has a pattern of doing this.
This is very important and that she has a pattern of lying for money. That's going to be part of the process of actually proving malice. So here are the main details of the lawsuit. As it stands, it's about 69 pages. And so I'm just going to review them. you know, just a little summary because we can't go through 69 pages together, but his main defense is that he has travel records that place him in Dallas, Texas at the time of when Mitch um Snow says that he was at Fort Wuka in Arizona. So, it is verifiably false. It is not true what Mitch Snow said. Candace Owens shared this as well. He denied any involvement saying Owens, you know, was completely and obviously fabricating this stuff. And the suit calls Owens quote a wealthy, influential conspiracy theorist who monetizes defamation. That feels pretty accurate to me. That was according to Newsmax, by the way. For damages sought by Harple, there are both compensatory and punitive damages. And the suit mentions specifically a 75,000 jurisdictional minimum, but also it claims reasonable award that could go well into the millions. That is the exact words they use, well into the millions, which I think is very accurate. He also seeks an injunctional to remove defamatory statements, which would be massive because what that would mean is Candace Owens would have to cancel like half of her episodes and just remove them from the internet. And that seems like very deserving. Harpel also alleges reputational harm, lost business, emotional distress, and harassment from Owen's audience. That seems very easy to prove to me because obviously being accused as a murder conspirator is going to have an effect on your reputation and your ability to work in security. No one's going to ever try to hire him again if they think that he conspired to murder his boss. So, I think that side of it is going to be very easy to prove. In other words, if the lawsuit goes his way, it's going to be in the millions. He's going to get what he wants. So, with this with this lawsuit hanging over Candace, she has began to walk it all back. She is trying to act like she didn't say all the things she said. And Candace, you're not going to believe this, is now asserting that Erica Kirk is the aggressor and that Candace has never said Erica murdered Charlie and that Candace is the real victim.
>> Most I woke up this morning and I was highly upset. I had a little bit of a yesterday news hangover. I realized that I'm actually so not okay with what Erica Kirk did. She essentially put a target on my back by wrongly asserting that I accused her of murdering her husband. I don't think we can let that fly, right?
No, her punishment is going to be more truth. I always say she is sentenced to more truth and I have been keeping a little secret and it's time for me to reveal it.
>> Total narcissism. She wants you to believe she is the victim. that even though Erica Kirk is a widow, even though she has defamed her, even though that Mitch Snow has defamed her, and she's also defamed Harple, she's actually the real victim. Insanity. Why didn't she say this before? She wasn't being sued before. Why didn't she say this before? Because she wasn't being sued before. She's only walking back when the litigation comes through. And likely, her lawyer's looking at this and saying, "This doesn't look good, Candace. You need to start walking this back immediately." But the moment again a lawsuit came in, she went, "No, I would never do that." I would never say Erica Kirk would do that, even though we've seen her do it over and over again. Again, we've got the transcripts, we've got the videos. You posted them, Candace. In addition to trying to cover butt, she is turning on Mitch Snow now, who is like her favorite right-hand man before. Now, he is public enemy number one for the Candace Owens audience. Here she is in the same episode throwing him under the bus. What is so shocking about this is that throughout this lawsuit, he explicitly lies that the lawyer explicitly lies in this filing by claiming that I asserted over and over again that that Snow that Mitch Snow was telling the truth about Harpole when in fact no. I went through a great many pains to repeatedly assert publicly that I could not confirm that he saw Harpole.
Okay, here is just one of many examples on my podcast. This is actually when I interviewed Mitch Snow where I said, "I can't confirm who you saw. Take a listen." And I want to be clear. I can confirm on this podcast live every step of your story in terms of where you went, what time you were there, um that there was this big meeting that happened. I've confirmed the location with other people that are that are on uh Fort Wuka currently. I can confirm everything with metadata. Um, I obviously can't confirm that you saw who you say you saw.
>> She's doing the Tucker Carlson skit.
She's saying, "Oh, no. I would never say that. I never said any of that. I just had Mitch Snow on my show 10 times and said it was a bombshell secret that was going to get exposed on my show and this was a major finding in my investigation." But no, I never said it.
I had someone else say it for me. Why have him on your show if you don't believe what he's saying? It It's very simple. If a jury gets involved in this, it's going to be very simple for them to see this. Clearly, she believed all of what Mitch Snow was saying. She is, again, like Tucker Carlson, laundering other people's ideas so she doesn't have to take responsibility. I like to partner with people who are actually making a difference right now in America. That is why I'm partnering with Judicial Watch. Judicial Watch is suing to force the DOJ to release records on the Biden FBI spying on President Trump and other Republicans. This was bombshell news. like top five things that happened in the last few years. We need to know more. Judicial Watch is making that happen. If you want to help them, it's completely free. They are not asking for your money. All you have to do is sign their petition. I put a link for it at the top of the description below. Luke Rosiaak over at the Daily Wire posted a bombshell investigative report. Everyone needs to know about this, so I'm going to be sharing it with you right here. And essentially, he uncovered $1 billion worth of Democrat Medicaid fraud with, you named it, immigrants. And I want to start with this section. It is basically a continuation of what Nick Shirley found in Minneapolis, but it goes even deeper.
It is quite shocking. You can see at the top here, and I'm going to read all of this out for you if you're just listening because there's a lot of people just listening the shows. Um, but the billboard that you can see, this is in Columbus, Ohio, says, "Caring for a loved one at home, get paid. Get support." And this is what Luke Rosia says. He says, "Driving down Cleveland Avenue, in less than 40 seconds, you come across endless home health companies. Capital Home Health, Continental Home Health, Dynamic Home Healthcare, Ohio Senior Home Healthcare.
Entire buildings throughout the city are filled entirely with what appear to be identical businesses." He then continues, "The enormous complex pictured below is 6161 Bush Boulevard.
Its lack of windows would be a problem for most office buildings, but there's almost no one in this one. What's inside is 94 different companies signed up to bill Medicaid, each with a tiny office, often marked with a sheet of paper proclaiming some generic company name ending in home health LLC and sometimes another piece of paper claiming the employees had to step out for a break.
This building alone build taxpayers $66 million in the span of a few years, the records show. So there is empty buildings taking millions and even a billion dollars from taxpayers in Medicaid. This is the story that Luke Rosak tells. Pick the owner of a Columbus home healthcare company at random and look him up in the public records and you are likely to go down an endless rabbit hole. Years of unpaid taxes and debts, sometimes criminal records and an astonishing number of LLC's created in another industry. as if the millions they make from Medicaid are just a side gig. We went down several of these rabbit holes in the coming days you will meet and he's going to come out with more information on each of these people. I'm very excited about it, but here they are. He says, "A politician who founded an 11 million home healthcare company that he appeared to run part-time without even mentioning it in his political biography, who funded his campaign with donations from other home health care owners. A woman who reinvented her janitorial LLC as a health provider then build Medicaid nearly $100,000 the first month. A landlord who bought airplanes after renting space to hundreds of home health care companies that build Medicaid a quarter of a billion dollar. A million-doll Medicaid businessowned by a couple with repeated fraud, violence, and theft convictions. a man who went to prison for Medicaid fraud but told the government he was too broke to pay restitution while his neighbors and associates preside over a poverty program empire and an accountant who lost his license for stealing public funds then opened a $7 million home health company using the address of a convicted money launderers teenage son.
Just for some context really quick, what a home health company is is I have a mother who is older and I watch after her at home and I tell Medicaid I'm watching after her uh and I'm a health care professional. Give me money to do that and they do it. He continues, this is kind of the big bombshell. When we asked one what when we asked one what home health care companies did, one man threatened journalists. Who cares? Do you guys pay my bills? I'm going to tell everybody you guys are racist. The government is not and likely has no ability to monitor all the people it writes million-dollar checks to in Columbus. They all share combinations of just a few names like Ahmed Muhammad and Muhammad Ahmed. Documents reviewed by the Daily Wire show individuals will spell their own name multiple different ways within a single document. And many of them list their birthday as January 1st because their birth rates birth dates are unknown. The business model is simple. A 40-year-old Somali immigrant gets paid for spending time with and maybe cooking for his own 65-year-old mother. The middleman is one of thousands of home health firms that have the NPI number necessary to bill Medicaid. The 40-year-old becomes an employee of that company, but has no clients other than his mother. There is no way to verify whether he actually even provided the services unless his own mother is willing to testify against him, which of course he's not cuz she's probably getting a cut. This poverty program is different from things like food stamps because it has no monetary cap and its extent is decided not by politicians but by any doctor willing to sign a form saying you could use some help around the house. It only takes one doctor who will say yes to turn out enough forms to bankrupt a state. This is insane. It's just printing money. And for some reason it is all Muslim immigrants from third world countries that have figured this out because obviously there's the middleman. There's the people working between Medicaid and the other people. They're making bank.
They're the ones forming the companies.
And then what they're doing is employing. They're going to all of their friends and they're saying, "Look, work for me. I'm going to get $100,000 from Medicaid and I'll give you $50,000." And uh no, you know, will your mom tell on you? No, of course not. You can cut her in with $10,000. Uh so long as she doesn't do that, you don't need to do anything. just a free $40,000 for you, 50 for me, 10 for your mom. So Trump tweeted this out and this is related but not in response necessarily. He tweeted out and this is very welcome from Trump.
He said, "Lifetime contribution per immigrant." And this got a lot of controversy. A lot of people were very angry about facts being posted by the president of the United States. Uh the lifetime contribution per immigrant from North America is $573,000.
From Scandinavia, it is $557,000.
Oceanana is $476,000.
Japan is $525,000 and the UK is $481,000.
So if a North American like Canada or Mexico, a Scandinavian, an Oceanan, Polynesian, I guess you would say, uh that includes u New Zealand and Australia though, a Japanese person or someone from the UK comes to America, they make America more rich for the most part.
But Somalians are negative $1.1 million.
They take in welfare $1.1 million. From the United States when they come, that is one person. This is per immigrant.
From the Caribbean, it is negative $675,000. From the Middle East, it is $624,000.
From Latin America, it is $271,000.
Subsaharan African is $730,000. And Central or North Africa is $700,000.
So all of those places, I'm just going to say the obvious here. Don't come to our country. We we I'm sorry. We shouldn't let you into our country.
Obviously, you want to come to our country, and I don't blame you for that, but our politicians and we the people should not allow you into our country.
This is not a charity. For every Somalian here, we lose $1.1 million. And it has nothing to do with race, guys. It really doesn't. Because guess what?
people from Oceanana not white, Polynisians not white, Japanese not white. By the way, it does not distinguish race in those places. So there may be Indians from the UK that come to the US. That's fine. It says on average they contribute $481,000 over their lifetime. In Japanese places, there could be Africans living in Japan and then moving to the US and they may, you know, Nigerians are a good example.
They may contribute $525,000. It's not about race. It's about the culture in which they lived in. And then they come here and they either take or they give.
This is why both illegal and legal immigration is so important to reform.
It's not just illegal immigration. It's legal immigration as well. It's also why we need investigative journalists like Luke Rosiaak to do this work. The Daily Wire is an important company. They do great stuff. Luke Rosiaak does fantastic stuff. A billion dollars is a lot of money. That is so much money. Democrats would rather have us steal from billionaires rather than taking back money from fraudsters. Just think about that for a second. Uh just think, you know, it's very clear that this is a way that they funnel money to themselves. If they really cared about maximizing the amount of revenue and saving that money for the US government, they uh wouldn't do what they've done with USAD. They wouldn't do what they did with SPLC and they would not do what they are doing with Medicaid right now. The left is a cult, guys. I don't mean that as a slur.
I mean quite literally. They act like a cult and they do some very scary things.
I wrote all about it in my book, A New Cult. Go check it out right now. It is on sale on Amazon. Also, if you are watching this on YouTube right now, just be aware I am also on your favorite podcasting apps. You can listen to me on Apple Podcast, on Spotify, or anywhere else.
