The defendant, Kilmar Abrego Garcia, the man who got mistakenly deported to El Salvador, he sued the Trump administration and won. The Supreme Court ordered him back and the day he landed, the DOJ reopened a closed 2022 investigation and charged him with human smuggling. The case was closed in 2022, no charges filed, he got a warning and went home. Then he embarrassed the government in court and suddenly the case is back open. The judge said the record showed an abuse of prosecutorial power. The DOJ's own deputy AG went on camera and publicly linked the criminal investigation to Abrego Garcia's deportation lawsuit. The judge said that statement alone tainted the case. But here's the thing, the law doesn't care about your feelings. If the evidence supported charges in 2022, charge him in 2022.
