The Dugan-Ashley case presents a controversial legal theory where prosecutors argue that monetized firearms content (through YouTube ad revenue, Patreon, and similar platforms) can constitute 'engaging in the business' of firearms under 18 USC 922 A1A, potentially requiring content creators to obtain Federal Firearms Licenses (FFLs) even without actual gun sales. This interpretation could extend to gun reviewers, reloading channels, military content creators, and any online firearms content that generates revenue, raising significant concerns about free speech and the future of online firearms education.

The DOJ Just Declared War on GunTube… This Is Wild本站添加:
So, the government has adapted a new position on what they feel about engaging the business of that affects all your favorite gun channels, uh your military channels like uh Krappie and all of them really. So, Task & Purpose, all those people now need to like realistically have an FFL if they're going to make videos about guns. And we're going to talk about that in today's video. Apologize if I'm a little bit nasally, caught a summer cold and man, these things are the worst. But we're just going to power through it.
Also, don't forget to shop at otis tek fiza shopify.com. That's the merchandise store that supports all this because I'm permanently demonetized from YouTube.
Got plenty of gear there. I buy gear specifically for people like you. So, go check out. I promise you'll find something you need.
So, let's get into it. To the DIGITAL BOARD OF KNOWLEDGE. TODAY'S TOPIC is engaging the business and how does change? It has taken a major shift. And this shift uh this is a problem.
So, how they're using it right now is they're saying uh this is about the dude in Ashley case.
Basically, YouTube money plus Patreon money, if you're making gun content or in his case explosives content, you are engaging the business of that particular thing because you are netting money off of firearms or explosives or the military channels of military equipment, you are now engaging the business of. So, you don't have to sell the products.
Why this threatens every gun channel?
Well, that's pretty obvious, right? So, if I'm making gun videos and I don't have an FFL, I could find myself on the wrong side of the law.
So, what's the actual law engaging the business? That's 18 USC 922 A1A.
Now, the actual law is dealing in firearms without a federal firearms license. That that's pretty self-explanatory. Am I or am I not selling firearms? If I am and I'm doing it to make a profit, well, that's engaging in the business, I should have an FFL.
The precedents claims or the prosecutor's claim in Dugan's case, because he makes YouTube money, has a Patreon, he's making income off of firearms, therefore being in the business. Now, I didn't understand this at first. I thought that they were trying to shove it through the hole that uh because he had explosives or precursors for explosives, they're they're running through that through engaging in the business, but now that I understand his case a little bit more, it kind of makes sense because that would just be a straight-up possession charge, cuz that's easy. Did it test out? Yes, it did. Well, that's possession of an explosive, therefore that is illegal.
But, they're shoving it through the mouth of engaging in the the business of, which has qualifiers, and they're saying that the money he makes off of YouTube for ad money and the money he makes off Patreon, well, that's an income off of explosives, so therefore he's engaging in the business of explosive manufacturing.
No actual gun sales, nothing like that.
They're saying, you don't have to sell guns, you don't have to sell explosives, you just have to make money off of them in some way, shape, or form.
They're claiming he made $3,000 a month, which from what I understand, that's drastically exaggerated.
Uh from gun-related content.
Well, again, YouTube plus Patreon plus Kufu, I don't know what the hell that is, but apparently that's some sort of like Patreon or something like that.
That's profit off of firearms, you're engaging in the business. This is even gets worse with when you're talking about NFA items, reloading, building. So, if you're reloading ammunition and you're making money off of it, you're engaged in the the business of manufacturing ammunition. And if you're making money off of NFA items, you're showing suppressors and that, and you don't have an SOT tax stamp, well, you're engaging in the business of selling NFA items or making money off of NFA items without your 0207 SOT. So, that's a problem.
Uh Uh what's going on here is this evidence where no gun dealing, no profit from guns, but they're saying that, you know, the Patreon money, the YouTube money, that qualifies.
Bottom line here, this isn't about gun dealing, it's about monetized speech.
So, they're saying that monetized speech puts you engaging the business of, which is pretty freaking scary.
If they can do this to TubeGun, they can do this to any gun channel. So, that's the whole point of this video. You guys need to spread the word out there.
Every gun channel, whether that's a military channel, an explosive channel, a firearm channel, anybody doing any kind of gun content, any kind of gun build, long-range shooting, anything like that, they all need to know about this because if this precedent sticks, they're all at risk. Anybody that does not have a firearms license, they're making gun content, again, this covers your military channels, too. If they're talking about the military's brand new XM7 and they don't have an FFL, especially if that XM7 is an NFA item, which it is, and they don't have an SOT, they could find themselves hypothetically on the wrong side of the law. Will they?
Uh it's not likely unless they piss somebody off, but they could. So, that's why this needs to be Everyone needs to know about this. There There needs to be a basic not an uprising, but like widespread knowledge, hey, this is a problem. This is not okay.
Awareness plus support of his defense fund is how we attack this.
If there isn't complaining about it, if there isn't people about in about it, this will just get checked in the little box of tools the government can use to come and screw you over. This case most certainly infects the entire Second Amendment community. And when I say that, again, those military channels that don't even really talk about firearms, they just talk about military stuff, that's a problem because they're engaged in the business of firearms if this precedent sticks. So, spread this out.
Make sure everybody knows about this.
>> [snorts] >> Cuz running this logic all the way through the end, gun reviewers engaged in the business. Reloading videos engaged in the business of manufacturing.
Any second Amendment contact content at all can make you a felony a federal felony without an FFL. Big deal. So, even your gun YouTubers, podcasters, they could all be next. Who knows? Just because you don't think that you're engaged in the business of it, you don't think it'd be a problem, you could be though. So, this you guys need to know about this. It's a big deal.
>> [snorts] >> Uh so, what are they exactly claiming?
Uh free speech and gun education. Yeah, turning content creators into felons overnight.
That that's that's a huge deal. Will this stop at him?
I don't know. We'll have to see cuz this would be a great tool for them to get into the second Amendment community and start taking out major creators.
They're searching for high-profile voices obviously. So, if you're a little guy, you're probably not going to have a problem, but say you're Demolition Ranch and you don't have your FFL and they want to take you down, yeah yeah he's engaged in the business of.
Uh this sets a precedent that everyone needs to be aware of.
Here's the key takeaways. The change is about monetize speech, not actual gun dealing.
If it sticks with Dugan, it can hit any gun content creator. This is a high-profile case.
Um The feds are trying to send a message.
So, if they're trying to send a message that hey, uh we're going to consider making money off of your speech about guns as engaged in the business of, it's for a reason.
They're trying to fire a warning shot over all of us that we all need to get our FFLs if we're in the gun sphere regardless what that is.
Support his defense fund. Spread the awareness now while it still is really small and it can matter. Cuz yeah, with this administration we could probably have this change or a tax or something like that, but imagine if Biden was still president and they still had a huge anti-gun administration and this sticks.
Now all of a sudden every gun YouTuber, military, whatever, it doesn't matter.
They're like, "Hey, uh do you have your FFL because you're making money off of firearms?" So that's engaging in the business of.
Call to action, donate to Dugan's defense fund. This is important. Link will be in the description. Share this video with anybody in the gun sphere.
This way they're aware of it. This why they need to promote this case and get this case out there and shine a light on the [ __ ] they're pulling because if this sticks, this this a bad deal.
Anyways, appreciate you guys watching the video. Hopefully uh this will get shut down. We'll have to see what happens. He hasn't been formally federally indicted yet. This is just a criminal complaint. Will the federal indictment include this? Very likely.
We'll have to see and then they'll run super seed indictments on top of that.
We would like that charge take taken off because that that's a bad one. That affects all of us.
Cuz again, it's not that he was selling explosives or anything about that. He was just making videos which earned profit off of the explosives. So that's where the whole engaging in the business came from.
Anyways, like to help support the channel. Only connect affiliate shopify.com is the best way to do that.
