In criminal trials, evidence that is not directly relevant to the charges can be excluded to prevent unfair prejudice, and judicial misconduct such as tampering with evidence or influencing the jury can result in convictions being overturned and a new trial being ordered.

What’s Really Going On Between Buster And Alex Murdaugh??Added:
Hello, and welcome back for another episode of Patriotic Housewife.
Well, allegedly, we'll just put that out there that this is coming from a source close to Alex Murdaugh's son on how he feels about his dad, his case being overturned, and he gets a new trial. And again, this is his only uh remaining living son. Um we all know about the murders that happened in 2023, and that just last week Alex Murdaugh uh what his the case was overturned, and there is going to be a new trial for him. No date set yet, so we're waiting to hear on that. But, we are going to uh go over an article that the New York Post had uh released um regarding someone who's close to Buster that had come out and talked about how Buster feels about this new trial. Again, this is a source close to him. Before we jump into that, please be sure to like, comment, share, subscribe to the video and the channel for all the updates because this was one that I think shocked a a ton of people uh and Miss Becky Hill totally uh writing a book during this time to even, you know, hand him this retrial on a on a platter. It just it's made a lot of people upset uh in the true crime community and any and you know, anybody who believed that he really was guilty of murdering his son and his wife.
So, we're just going to jump right into this together because this was in- interesting, not totally shocking if you've been following this from the very beginning.
Uh but, this is from the New York Post.
Buster Murdaugh reacts to uh dad Alex Murdaugh's double murder convictions getting overturned, a nightmare.
Uh this is Buster.
Um it says the sole surviving son of disgraced legal uh scion Alex Murdaugh is furious over the nightmare decision to overturn his father's convictions for murdering his mother and brother.
He's not happy this is going to put him through all of this again. He has to relive the hardest years of his life all over again, a source close to Buster Murdaugh 30 told the Daily Mail.
Uh earlier Wednesday, the State Supreme Court released a bombshell 27-page report detailing the justices 5-0 ruling to overturn Murdaugh's double murder conviction, a decision that centered around a local county clerk who had placed her fingers on the scales of justice.
Uh the stunning twist will likely result in a retrial.
Um Murdaugh, 57, who was serving two consecutive life sentences without parole for the grizzly 2021 murders of his wife, Maggie, and their 22-year-old son, Paul. Uh Buster famously backed his father during his traumatic uh 6-week trial that gripped the nation in 2023, but began to distance himself after a jury unanimously uh found his father guilty of the vicious slayings. Since then, the father and son have only had a couple of phone calls, according to a source who said Buster will not visit him uh to celebrate the new ruling.
"Buster needs some time to process this.
He's not happy at all," the source told outlet and slammed Murdaugh as a selfish, selfish old man for wanting a retrial. "This is a nightmare. How is Buster supposed to move forward to have this happen again? It's more poking at a wound that's not even healed yet. What happens if the whole thing happens again and he's convicted again? It'll put us all through this you can spell that word again. Uh Buster, who tied the knot with his wife, Brooklyn, in May of 2025, has largely stayed out of the public eye over the last couple of years. The couple now live in a modest $445,000 house in a leafy middle-class neighborhood and uh which is about an hour south of the sprawling Murdaugh family estate where Maggie and Paul were gunned down near the outdoor dog kennels on January or sorry, June 7th, 2021.
Uh he's a beach guy, goes to Hilton Head Island a lot. He loves to hunt uh and fish and stay busy, the source uh said about Buster, who they uh also they also worked as corporate counsel for a restaurant chain last year. While awaiting a retrial, Murdaugh, who has long maintained his innocence in his relatives murders, uh will still not be allowed to walk free as he is serving a concurrent 40-year federal and 27-year state sentences for financial crimes for stealing from his clients.
Um His lawyers appealed the murder convictions, arguing that former Colleton County Clerk Becky Hill tampered with the jury during the trial, claims that were supported in the justices shocking decision on Wednesday.
Um although uh we were aware at the time money and effort expended uh for this lengthy trial, we have no choice but to reverse the denial of Murdaugh's motion for a new trial due to Hill's improper external influences on the jury, and uh remand for a new trial, the report read.
Prosecutors efforts to secure conviction for Murdaugh were in vain because of Hill, who placed her fingers on the scales of justice, thereby denying Murdaugh his right to a fair trial by an impartial jury.
Uh Hill uh pleaded guilty in December to obstruction of justice, uh perjury, and two counts of misconduct in office after admitting she showed sealed crime scene photos to a reporter and lied about it.
She also fessed up uh to promoting her book about the trial through public office. Hill was sentenced to probation.
Uh it's more likely that Murdaugh will be acquitted during the retrial, criminal defense lawyer Tyler Bailey of Columbia, South Carolina told the post.
They can try to attack the case from a different angle. Um so I think he has higher odds of being acquitted now that than he did before, simply because it's been some time and his team knows how people think about it, Bailey said.
However, selecting a jury pool without knowledge of and personal opinions about the highly publicized case will be a true nightmare, according to Columbia-based criminal defense attorney Dane Phillips. I think it's going to be impossible just about or highly improbable. Um I just lost my place, you guys. Hold on.
Uh highly improbable to find 12 people who don't know anything about the case, he said.
Um Murdaugh's defense team said it respected the Supreme Court Justice's decision Wednesday to also limit the amount of testimony about Murdaugh's financial crimes and the prosecution will be allowed to introduce uh that the prosecution will be allowed to introduce during the double murder retrial. The initial jury heard more than 12 hours of testimony about Alex's financial crimes.
The court held that uh this evidence went far beyond what was necessary and gave rise to unfair prejudice. On retrial, that will not be permitted.
Um Alex has said from day one that he did not kill his wife and son. We look forward to a new trial conducted consistent with the Constitution and the guidance this court has provided, they said. South Carolina Attorney General Alex Wilson said his office disagrees with the Supreme Court's decision, but will aggressively seek to retry Alex Murdaugh for the murders of Maggie and Paul as soon as possible. No one is above the law. As always, we continue to fight for justice, Wilson said.
So, that is the entire article. Now, first off, yeah, again, you know, there was a lot that was, you know, pointed out in the first trial if you followed it.
Um a lot of uh you know, the idea of why the murders even were committed really was around the fact that there was money issues, life insurance, those kinds of things. Um I do think where this gets interesting is he has a 40-year federal and a 27-year state sentence for financial crimes. So, even if he got off on the murder charges, I wonder I mean how I mean he's still going to have to serve. So, I'm curious I know that that right there is 67 years, but I wonder like good behavior, certain things if how long, you know, how early you could get out of that. Are they going to try to I mean he played guilty to those, so you can't change those.
But, um I don't know, you know, him and Buster I don't In my opinion, I never felt like they seemed to have a close relationship.
Um you guys if you guys have been following this case, you know about how, you know, a girl died when the boat crashed with Paul being drunk and driving the boat and that kind of, you know, that really put the family was already a prominent family in this area.
And so, it it really just put a huge spotlight on the family and from there it just you know, it was back-to-back with this stuff. So, there's just a lot of speculation. There was a friend of uh Buster's that ended up a deceased in the middle of the road. A lot of people speculate uh who did that because they never found out who did that. Uh there's all kinds of rumors around this situation. So, I just wanted to kind of go over this article um about, you know, Buster being upset. I I know that they say it's because he, you know, he wants to move on with his life and he doesn't want to like rehash this whole thing.
Um but I'm curious to hear what you guys have to say about this, you know, um I'm To me, it comes across in my opinion that Buster feels his dad did this and I think that it's upsetting to rehash it for those reasons. Um I don't know, you know, and not visiting your dad and and barely speaking to your dad, I just think that speaks volumes without having to say uh much of anything. Um and I I'm sure he does want to move on with his life and get away from all the negative and the years and years and years um of negative. And there was a lot of other rumors surrounding Buster, um his sexuality, and different things like that that have gone on, um, through like his dad's trial, before his dad's trial. There was a lot of different speculations that went on. So, um, there's a lot there, I think, on a personal level amongst him and his father where they've had disagreements and it hasn't been like the best.
Um, which happens, right? Like there's there's a lot of parents and kids that they have, you know, they grapple with getting along sometimes or not seeing eye to eye on things. That's kind of a part of life, but um, I guess we'll have to see where this lands. Uh, we obviously don't have a date yet of when this is going to be retried. That article says that they're looking to get this done as soon as possible.
Um, so we'll see. He's obviously going to sit in prison until this, you know, trial's done. We'll see what where where they go after this retrial.
Um, I do think there are some, you know, benefits for the defense. It sort of seems that way anyway, based on that article. But you guys let me know what you guys think. I'm curious to see where you guys sit. Um, as always, before we get off here, please be sure to like, comment, share, and subscribe to the channel. It helps the channel grow, our community grow. You guys are the best. I appreciate all of you, and I will see you guys on the next one.
