[00:07:04]Ms. Fuller, do you have any challenges to the probable cause in this case?

[00:07:08]>> I have not had an an opportunity to review the criminal report affidavit as it has not been provided to me by the state.

[00:07:28]Would the court read the criminal report affidavit, and then after hearing it, I could um stipulate to the PC found, your honor, and then proceed to um bond factors.

[00:07:38]>> I'm not going to have an interpreter I'm not going to have him interpret every word of this affidavit.

[00:07:52]Um on the May 25th May 25th, I stopped behind Deputy Sheriff Elliott while he was conducting a traffic stop eastbound on I-4. I observed a white SUV passing our location traveling in the lane directly beside our vehicles. The SUV failed to move over or reduce its speed to 20 mph below the posted speed limit of 70 mph. I captured the vehicle's speed with my stalker dual radar and it gives a serial number. The vehicle was traveling 74 mph. I conducted a traffic stop on the same vehicle. I contacted the vehicle's driver asked the driver for his driver's license and the driver gave me his driver's license. The driver was identified as Peter Yunan Ibrahim, um a male 4 12 88 and and a US citizen.

[00:08:34]Excuse me, and not a US citizen. I conducted an NCIC FCIC check on the driver and vehicle. The vehicle The vehicle had an expired tag of 4 12 23.

[00:08:43]The yellow sticker expired November 26th. I learned later the yellow sticker was not the proper sticker for that vehicle. The Florida Excuse me, the driver's Florida license was suspended 1 30 20 for failure to pay traffic fines 12 times. The vehicle was released to the Bolton Towing at the scene. Mr. Ibrahim was transported to the Polk County Jail Processing Center. Um they further uh conducted an inquiry and found that um Mr. Ibrahim is not a United States citizen citizen and it was confirmed by the Department of Homeland Security Immigration and Customs Enforcement.

[00:09:51]Because of the immigration situation, the bond is increased one level, so the bond will be set at $5,000.

[00:14:24]Um In regards to >> Let me Let's do it step-by-step. Do you intend to represent him throughout the course of the case?

[00:14:36]>> Well, your honor, um I have like the prior attorney, um I've not had a chance to review the affidavit. My understanding is this has already mentioned it was a direct info file and a warrant was issued.

[00:14:47]I just got retained yesterday late, so I'm ramping up here to catch up. So, no, I've not had a chance to even review any affidavit whatsoever.

[00:14:55]>> All right. Well, he has a KPS on the two cases that the information was filed on.

[00:15:00]On the other two charges, it is just an arrest. So, I have reviewed both. I do find probable cause for all four charges.

[00:15:08]Do you have any argument regarding bond, sir?

[00:15:10]>> Yes, if I may, one moment, your honor.

[00:15:11]Let me just write that down. Okay. Um yes, your honor, actually I have several arguments. Mr. Fussell has not been charged with any felony where life imprisonment life in prison would be an issue.

[00:15:24]Uh he has very significant ties to the Polk County area. He I believe he's a third or fourth generation Polk County-an.

[00:15:31]Uh he has a significant amount of property uh in Polk City area. Um he has no prior convictions.

[00:15:40]Uh the warrant was uh just recently issued on a direct file filed back in September.

[00:15:46]I know PC's already found the warrant.

[00:15:48]Not challenging the warrant per se. What I'm asking judge if it could be his bond could be either pre-trial release ROR due to fact that he had he has a a clean record with no convictions.

[00:16:00]Uh the level of charges are three felonies and one misdemeanor, but they are all third degree felonies.

[00:16:07]Um he has the financial resources and the and the property here in the Polk County to ensure his appearance.

[00:16:15]Um I would see of course I'll speak as defend defense witness I'll finish finish finish attorney, your honor.

I will advise you of the criminal charge that brings you here today. I will then ask if you have an attorney representing you. If you have an attorney representing you and they are present, then they will speak on your behalf as you've already seen here this morning. If you have an attorney and they are not present, then you will have to make a decision as to whether you wish to move forward with your first appearance hearing today, or if you wish to postpone your first appearance until tomorrow. If you elect to postpone your first appearance until tomorrow, it is your responsibility to reach out to your attorney to make sure they will know that you will have first appearance tomorrow. No one else will make that phone call for you. If you elect to move forward without your attorney, then we can certainly do that today. That is a condition conditional appointment based upon an application that you will fill out during during the course of their representation. [00:19:53]And finally, I will review your bonds and your other release conditions to determine if there are to be any changes made to those. So, if you make a phone call or have any contact third party, any contact whatsoever with that person while you are in custody, it will be a violation of your pre-trial release, and you could also be facing an additional misdemeanor in the first degree. So, do not have contact with any victim that you are aware of while you are in custody, and obviously once you are released from custody.

[00:20:34]Throughout this entire process, you have a constitutional right to remain silent.

[00:20:37]If you choose not to remain silent, anything you say can be used against you. Everything that is being said where I am located, as well as where all of you are located, is being recorded.
