In criminal court first appearance hearings, defendants are formally informed of charges, advised of their constitutional rights (including the right to remain silent and right to counsel), and assigned bond conditions based on factors such as immigration status, prior criminal record, and the severity of charges. The court determines probable cause for each charge and sets appropriate bond amounts, with conditions including pre-trial release requirements, no-contact orders with victims, and restrictions on weapons possession.

Ms. Fuller, do you have any challenges to the probable cause in this case?
>> I have not had an an opportunity to review the criminal report affidavit as it has not been provided to me by the state.
Would the court read the criminal report affidavit, and then after hearing it, I could um stipulate to the PC found, your honor, and then proceed to um bond factors.
>> I'm not going to have an interpreter I'm not going to have him interpret every word of this affidavit.
Are you waiving that ability?
>> That's correct, Your Honor.
>> All right. So, Mr. Interpreter, you're not going to um read what I'm reading, okay?
Um on the May 25th May 25th, I stopped behind Deputy Sheriff Elliott while he was conducting a traffic stop eastbound on I-4. I observed a white SUV passing our location traveling in the lane directly beside our vehicles. The SUV failed to move over or reduce its speed to 20 mph below the posted speed limit of 70 mph. I captured the vehicle's speed with my stalker dual radar and it gives a serial number. The vehicle was traveling 74 mph. I conducted a traffic stop on the same vehicle. I contacted the vehicle's driver asked the driver for his driver's license and the driver gave me his driver's license. The driver was identified as Peter Yunan Ibrahim, um a male 4 12 88 and and a US citizen.
Excuse me, and not a US citizen. I conducted an NCIC FCIC check on the driver and vehicle. The vehicle The vehicle had an expired tag of 4 12 23.
The yellow sticker expired November 26th. I learned later the yellow sticker was not the proper sticker for that vehicle. The Florida Excuse me, the driver's Florida license was suspended 1 30 20 for failure to pay traffic fines 12 times. The vehicle was released to the Bolton Towing at the scene. Mr. Ibrahim was transported to the Polk County Jail Processing Center. Um they further uh conducted an inquiry and found that um Mr. Ibrahim is not a United States citizen citizen and it was confirmed by the Department of Homeland Security Immigration and Customs Enforcement.
>> Thank you, Your Honor. We will stipulate to the criminal report affidavit and move on to bond factors.
>> All right. So, Mr. Akub, you can tell him that part of it.
>> I'm not doing the whole thing, Your Honor. And uh let the attorney um have about more than enough the what I said Ibrahim that the uh had >> So, sir, I do find probable cause for your charge.
Because of the immigration situation, the bond is increased one level, so the bond will be set at $5,000.
Sir, you are subject to an immigration hold.
I am going to be signing a detainer which the clerk of court will prepare for me today.
You will be held no bond pending ICE retrieval, sir.
His next court date here, ma'am, will be an arraignment on June 30th at 8:15.
Anything for the record?
>> Yes, Your Honor. Would um will the court allow me to just give a brief um some bond factors just to reduce the amount of the $5,000 bond, or is the court set on on that based off his immigration status?
>> I am set on that based off his immigration status.
>> Thank you, your honor.
>> Thank you, your honor.
>> Thank you, your honor.
>> Thank you.
Thank you, your honor.
Thank you, sir.
Thank you, Mr. Furman. Have a good >> Thank you, your honor. You too.
>> Can you mute me, please?
>> Yes.
Thank you, your honor.
>> Can you unmute me, T.J.? Oh, I'm sorry.
Mr. Brant, sir, who is your client?
>> Uh good afternoon. Our my client is Paul Fussell.
He should be in central.
>> please?
>> Present.
>> Mr. Fussell, you are here this afternoon charged with possession of paraphernalia, possession of methamphetamine, and elderly exploitation, and grand theft over $750. Mr. Mr. Brant, will you be representing him throughout the course of the case, sir?
>> Yes, I was just retained yesterday. He was just arrested yesterday.
Um In regards to >> Let me Let's do it step-by-step. Do you intend to represent him throughout the course of the case?
>> Yes, [snorts] I do.
>> All right. And do you have any challenges to probable cause?
>> Well, your honor, um I have like the prior attorney, um I've not had a chance to review the affidavit. My understanding is this has already mentioned it was a direct info file and a warrant was issued.
I just got retained yesterday late, so I'm ramping up here to catch up. So, no, I've not had a chance to even review any affidavit whatsoever.
>> All right. Well, he has a KPS on the two cases that the information was filed on.
On the other two charges, it is just an arrest. So, I have reviewed both. I do find probable cause for all four charges.
Do you have any argument regarding bond, sir?
>> Yes, if I may, one moment, your honor.
Let me just write that down. Okay. Um yes, your honor, actually I have several arguments. Mr. Fussell has not been charged with any felony where life imprisonment life in prison would be an issue.
Uh he has very significant ties to the Polk County area. He I believe he's a third or fourth generation Polk County-an.
Uh he has a significant amount of property uh in Polk City area. Um he has no prior convictions.
Uh the warrant was uh just recently issued on a direct file filed back in September.
I know PC's already found the warrant.
Not challenging the warrant per se. What I'm asking judge if it could be his bond could be either pre-trial release ROR due to fact that he had he has a a clean record with no convictions.
Uh the level of charges are three felonies and one misdemeanor, but they are all third degree felonies.
Um he has the financial resources and the and the property here in the Polk County to ensure his appearance.
Um I would see of course I'll speak as defend defense witness I'll finish finish finish attorney, your honor.
>> [gasps] >> Um that basically I think he'd be a candidate for PTR, your honor. For the court, so we had that. Thank you.
>> Mr. Um can you say to me to me the um first name Can you spell his last name out, please?
M-A-T-T M-A-T-T-H-E-W-S, correct?
All right, Mr. Matthews, any response to that?
>> No request to stand on bond, judge.
>> All right, sir, I am going to set your bonds as follows. On the possession of paraphernalia, $1,000. On the possession of meth, $5,000.
On the elderly exploitation, $5,000. And on the grand theft, $5,000. If you do bond, sir, you will be on pre-trial release. Conditions will include you contacting pre-trial services in person immediately upon your release and then every Wednesday. Every Wednesday. You will not use You will You will not use, possess, or carry any firearms, guns, weapons, ammunition, or knives. You will have no contact with the alleged victim in this case. You will stay 500 ft away from the victim, the victim's home, vehicle, place of employment, and or school at all times.
Do you understand these conditions, sir?
>> Yes, ma'am.
>> Mr. Brant, anything further, sir?
>> Uh if I may inquire for my client, you may reach out to your family now, sir.
>> Please.
>> Okay. That's all I had, Your Honor.

>> next arraignment will be on June 16th at 8:15. Thank you, sir.
>> Thank you, Your Honor. That's all I have for Paul. Be in touch [clears throat] with you when you get out. I'll be in touch with your family. Thank you very much.
>> Good day. Any other private attorneys on the line?
>> Your Honor, if I may, Ricardo Alvarez on behalf of Yoseline Vasquez.
>> Good afternoon, Mr. Alvarez.
All right. Can we have Yoseline Vasquez, please, at the podium? She is not present.
>> She's here.
Good afternoon, Judge.
>> Alvarez, will you be representing her throughout the course of her case?
>> I will, Judge.
>> She is here on a violation of her probation. Warrant served. Probable cause has previously been established.
Um she will be held no bond until she she sees a judge on June 22nd at 12:45.
Anything additional, Mr. Alvarez?
>> No, ma'am.
>> All right. Ma'am, thank you.
Have a good afternoon.
>> Thank you, Judge.
>> Any other private attorneys on the line?
All right. Good afternoon again. I am Hope Payne. You are here for your first appearance hearing. Uh the way we will proceed is I will call your name and you will step to the podium. I will advise you of the criminal charge that brings you here today. I will then ask if you have an attorney representing you. If you have an attorney representing you and they are present, then they will speak on your behalf as you've already seen here this morning. If you have an attorney and they are not present, then you will have to make a decision as to whether you wish to move forward with your first appearance hearing today, or if you wish to postpone your first appearance until tomorrow. If you elect to postpone your first appearance until tomorrow, it is your responsibility to reach out to your attorney to make sure they will know that you will have first appearance tomorrow. No one else will make that phone call for you. If you elect to move forward without your attorney, then we can certainly do that today. If you do not have an attorney, I will ask if you can afford to hire one.
If you can, we will make note of that and move forward. If you cannot, then I will appoint the office of the public defender to represent you. That is a condition conditional appointment based upon an application that you will fill out during during the course of their representation. You have a right to have your attorney present before and during any questioning.
Sir, if there are any challenges to the probable cause, we will address those.
And finally, I will review your bonds and your other release conditions to determine if there are to be any changes made to those. Please be aware that if you are placed on pre-trial release today, while you are in custody, with a provision that you have no contact with a victim or a witness, all of your pre-trial release conditions go into effect today, even while you remain in custody. So, if you make a phone call or have any contact third party, any contact whatsoever with that person while you are in custody, it will be a violation of your pre-trial release, and you could also be facing an additional misdemeanor in the first degree. So, do not have contact with any victim that you are aware of while you are in custody, and obviously once you are released from custody.
Throughout this entire process, you have a constitutional right to remain silent.
If you choose not to remain silent, anything you say can be used against you. Everything that is being said where I am located, as well as where all of you are located, is being recorded.
There is an assistant state attorney present in the courtroom listening to everything that is being said, so do not say anything about the crime itself.
Keep each of these rights in mind as your name is called and you approach the podium. One further thing, many of you will bond out prior to the court date that you are going to be given today.
Please be aware you will not be notified of additional court dates. The court date that you are given today in court is the court date that you need to follow. So, regardless of whether you get any additional things in the mail, the court date that you received today is the court date that you need to make sure that you are present here for. Do you I hope you all understand that so KPS additional KPS's are not issued. Ma'am, do you have a case?
>> Yes, your honor. We have Ronald Gayheart.
>> Can we have Mr. Gayheart, please?
>> I'm a good file. My notice was sent to me yesterday.
I'm Christine Vasquez, defense attorney.
>> Thank you, ma'am. Mr. Gayheart is present and approaching. He is here charged today with dealing in stolen property and grand theft. $20,000 above or less than 100. Um, do you have any challenges to probable cause in this warrant?
>> For the dealing in stolen property, he hasn't turned over any property to anyone else.
Uh, the affidavit describes an attempt.
>> Um, it's a warrant.
>> Okay.
>> I asked you about probable cause without looking at it saying that's a warrant so probable cause is an issue.
>> No, your honor.
>> Probable cause has already been established by the judge that issued the warrant.
>> Thank you, your honor.
>> Thank you, ma'am. And I shouldn't have asked you because I didn't notice that it was Thank you so much.
>> I I would ask for a reasonable reasonable bond, your honor.
>> Thank you.
Um, so I do find probable cause or public probable cause has previously been established. Mr. Matthews, any comment on bond, sir?
>> Not on the amount, your honor. The state requested state of Ohio a typical bond for the F2 and for the court to honor the pre-trial release conditions as part of the warrant.
>> So, sir, your bonds are going to be set at $15,000 per count, sir. If you do bond, you are going to be on pre-trial release conditions will include you contacting pre-trial services in person immediately upon your release and then every Wednesday. You will not use, possess, or carry any firearms, guns, weapons, ammunition, or knives. You will have no contact with any victim identified in this case. You will stay 500 ft away from any victim, their home, vehicle, place of employment, and/or school at all times. Do you understand, sir?
>> Yes.
>> Ma'am, anything further?
>> No, Your Honor.
>> His arraignment will take place on June 30th at 8:15.
>> Thank you, Your Honor.
>> Thank you, sir. Thank you, ma'am. Have a good day.
All right, Mr. Fonti, ma'am, if you'd like to make your speech, please.
>> Yes, Your Honor. It says the comparison comparison only four purposes. First, I will inform you about the charge the charges presented against you. Second, I will ask you if you representing an attorney. If you already have an attorney and he is present, then he attorney representation.
If your attorney is not present, you have the option with your today or postpone it until tomorrow. If you decide it will be your responsibility to contact your attorney to let him know that you will have Nobody else will do this for you. If you decide without your attorney present, If you do not have an attorney, if you can if you can, we will take note and proceed. If you cannot the court will assign a provisional attorney the office of to represent until you fill out a form for this service.
You have the right to have an attorney present during any interrogation.
Third, any objections to the charges will be addressed immediately.
Finally, I will be reviewing your conditions and conditions of release with you to determine if any modifications are necessary. If the court places you on conditional release regardless of whether or as the conditions announced today in this hearing will take effect immediately.
Even though you are still incarcerated.
For example, if you are >> That's all, Your Honor.
