Plaintiff Tiffany Galloway says a year after she started dating the defendant they moved [music] in together and everything changed. Tiffany claims her ex ran up their first [music] month's cable bill ordering porn and he's been to jail three times [music] in the past five months for selling drugs and carrying guns. Tiffany's suing her ex for bond money, unpaid bills and car damages. [music] Defendant James Roberson admits that he ordered pornographic movies on their cable bill but insists [music] he and Tiffany were watching them together.
James is counter suing his ex for emotional distress [music] because he claims Tiffany's constant arguing caused his ulcer to flare up. Start with you.
I began dating James in February of 2006.
He seemed like a great guy at the time.
Had his life going in the right path. He was in school full-time. He went to work full-time. He owned a car. He had hobbies. He stayed with me at my mom's house overnight almost every night.
Um Naturally we got an apartment in January of 2007.
>> Good. Your mama don't want no man staying in her under her roof [laughter] with you every night.
>> Go ahead. You all got an apartment together.
>> Right. Once we got our apartment everything started change. I started to see a whole different side of James.
First month that we had our cable on he ran up our cable bill to $200 buying porn.
>> of the utility bills you're suing for.
Buying what? PORN.
>> [clears throat] [laughter] >> I'M NOT CRAZY. YOU ALL WATCHING IT TOGETHER, RIGHT?
>> YES, SIR. YEAH. YES, SIR.
TOGETHER. Every time he bought it I was at work. I was getting ready for when she come home. He was getting it ready for for when [laughter] SHE COME HOME.
THAT'S ENOUGH OF THAT. LET'S GET BACK to the case.
Um First of all tell me the agreement regarding bills when you all first moved in. Our agreement was to pay half of everything.
>> When did you move in? January 2007.
>> All right. Did you pay the cable bill?
>> I paid Yes. All right, all of it.
>> Yes. So, you want his half. Yes. What other bills has he failed to pay? Um electric, gas, phone.
>> months? For March from March of 2007 through July of 2007.
And what do you want to say, sir? First of all, your honor, everything was fine until we moved in together. Then she wanted to argue and fight all the time.
I couldn't even stay in the same room with her, you know. What was she arguing and fighting about? About everything.
You name it, it's Give me an example.
You name it.
>> I mean, she accused me of cheating on her. If not, she want to argue about money I owe her.
>> What for?
Cable bill, uh I mean, anything you can name. I mean, basically what she said.
>> Light bill.
>> Light bill. Rent, your share of the rent, your share of everything.
>> I mean, I told her when the agreement was when we moved in, if I could help her, I'mma help her.
>> Help her? Yeah. How about yourself?
>> I mean, she pressured >> yourself?
>> You right.
Want to live off a woman? No, no, no, no, sir.
That's what it sounds like. You would help if you can. That's living off of a woman, sir.
It's not the appropriate thing to do.
True. If you're going to pimp, pimp.
Okay.
>> [laughter] >> What you're doing is scrubbing. You know, just trying to get a nickel or dime here and there.
And a pimp take all the money.
I don't want you to do that, but I just want you to know the difference. Say no [laughter] more. All right.
Now, do you work at all? Uh I had a job.
I don't no more. I just got uh released like couple weeks ago, but I had a job then.
>> when you all together? Well, then you definitely should have been paying your part. Get to the furniture and the other things she's suing for. We were going to go half on everything, so that goes for the furniture as well.
Um I had got my income tax return. He hadn't received his yet. Unfortunately, when he got his return, somehow most of it got taken or garnished because he owed his school prior to that. Okay, so he was in college? He was He was in college when I met him.
>> While he was with you?
>> Um for the first few months. He stopped going.
>> All right, so why you sweating the man?
He's in college trying to get his life together. Why couldn't you support him?
I'm in college, too, and I was working two jobs when we were together.
>> All right. He should have worked two jobs.
>> He should have did something. Okay. Let me see that. Sir, what do you say about this furniture?
I mean, we ain't together, Your Honor.
And when we depart, she take the furniture. What you What you going to give me the couch on the weekends and the love seat on the weekdays?
>> [laughter] [cheering] >> Uh Man makes a good point, man.
>> That is That is a lie. How do I take furniture out of the apartment? He still lives there and sleeps on the couch almost every night. Is that true? Yeah, Your Honor. When she there, I go out the back door. When she coming in the back, I go OUT THE FRONT. SHUT UP.
EVERY NIGHT I COME IN, HE'S ON THE COUCH WITH THE Xbox 360 turned off, which lets me know that he was just finishing helping his self out.
>> share of the couch you allege is how much?
$625.
>> Okay.
The car damages you're suing him for? In May of this year, my car was hit. So, he tells me. I don't exactly know what happened because he lies so much and he's had so many run-ins with people with I found out he was selling drugs and carrying guns. He's went to jail three times within the past 5 months, basically.
>> Drugs and guns. Not even a good hustler.
>> [laughter] >> He got busted three times in 5 [clears throat] months. He should stay in school. Yeah, he should have stayed in school, like D'or said. Yeah, cuz the game isn't for you.
You You can't You're not You're not a good You're not a good pimp.
You're not a good thug cuz you keep getting busted and you got to sleep on the couch, so you must not be a good lover.
THAT'S WHAT I'M SAYING. I DON'T UNDERSTAND how he could have bought so much porn in the first place. We He got a stack of DVDs like this high at the apartment anyway. And not only that, but do I look that bad? No.
I'm just saying. Do I look that bad?
>> No, you look very nice. But I'm not getting no love and it matter how good it is, I'm not getting no love and he's giving it to himself.
>> [laughter] >> Too much information. That's what Hey.
Let's get to the bond money, ma'am. Oh, first of all, you're saying he damaged your car, you don't know how?
>> I don't know how he damaged his car.
>> caused to it?
>> pictures of my car.
>> it. Um it was hit in the back.
Um a week after my car was hit, his window was shot out. Go ahead, sir. The damage to the car, what do you want to tell me about that?
>> how am I getting sued for a damage to a car that I didn't even do? I didn't crash it or I didn't hit it. I'm saying what am I getting sued for?
Responsibility? Um It was I was at my cousin's house. I parked it outside the house. I went in the house. We in the house, we hear a big boom. We run outside and the car it was a van riding down the street. They got away.
So it was a hit and run on your part?
>> yeah. He agreed to pay for the damages.
Sir? I agreed to help her out to pay for the damage cuz I didn't feel like I had to pay for everything. I didn't do it.
I mean, I'm not going to lie. I felt bad about her car.
>> are the damages, ma'am? The damages, I have three estimates. The first one starts at 3296. The highest one I have is 41.
>> 3296, we'll go with that. 32 and you say you were going to help her? Yeah. I'm going to order that you PAY HER 3295.
YOUR COUNTER claim for $1,000 is for what? Emotional distress, how? I mean, she I mean, Yana, she know I has ulcer and she know when I get angry, I'm stressed and we argue and I get sick cuz of my ulcer, but she don't care. She keeps stressing me, nagging me, and pushing me to it, you know. Where'd your ulcer come from? It come from stress.
>> [laughter] >> Um Your witness want to speak? Yeah.
Actually, the only thing I'm really here to Divina Giles. The only thing really that I'm here to testify about is the fact of the emotional stress that she's been through ever since they've started dating as far as the not paying bills, him promising after the car was totaled that he would pick her up, take her to and from work. That was stuff that was never upheld. The fact that, you know, she's tried to kick him out of the house several times, but because his name is on the lease, he will not leave and she can't get him to leave.
>> Only thing he pays half the rent. I've even had to take out a student loan to catch up on bills.
So, I'm just curious, what college, what stage of college were you in? I uh completed a semester. Why did you stop? I mean, I I needed money, so I had to work more. I mean, I had bills and whatever.
>> not obtain financial aid? I don't know what happened to my financial aid. I know I had it, but You didn't go to office and ask?
>> I did. My financial aid went towards my tuition and they didn't give me nothing but like $500 back.
>> you living with? I was living with at I think I was living with >> Her? Yeah, yeah, yeah. RIGHT.
AND YOU WEREN'T PAYING, HUH?
SO, why couldn't you use that money for college? You just wanted to be a gangster. What type of household do you come from? You come from a You live in a drug and crime-infested neighborhood. Is that how you grew up?
>> Yana. His stepdad He's been with his stepdad for years now and he pays everything. He was driving a Benz prior to the past what month when he got arrested. From From drug money or from >> No, his dad paid for His dad paid the car note. His dad paid his cell phone bill. His dad paid his insurance.
>> a thug. He He's been watching too many videos.
He's been watching too many gangster videos. That's what happened to all these young guys. Even in the suburbs, middle class, upper middle class guys, they walking around trying to be thugs and don't have a reason to be a thug in the world. You all need to stop watching these videos.
Cuz every thug I know, every real desperate thug I know, they trying to get out of the ghetto.
You all trying to break down the door.
Go to Shoot me. Send me to jail.
Bond money, ma'am. How much does he owe you for that?
>> Um I paid $270 on his bond money.
>> true, sir? Yes. All right. $3,359.
Have a good day. And sir, get your life together. I'm denying your emotional distress request for $4,000. Try to go back to college the best way you can.
Work two jobs like this young lady is doing. Stop fantasizing >> that pays for his medicine.
>> Yeah, stop fantasizing about being a thug. You're not a thug. You fantasizing. Have a good day. Judgment for the plaintiff.
