This video documents a pretrial hearing for Megan Haffner, a Strongsville Board of Education member arrested for OVI (Operating Vehicle Under Influence) in Strongsville, Ohio. The footage shows the complete field sobriety testing process conducted by law enforcement, including the Horizontal Gaze Nystagmus (HGN) test, Walk-and-Turn test, and One-Leg Stand test, which are standard procedures used to assess driver impairment. The video also illustrates the legal consequences of OVI convictions, including vehicle impoundment for repeat offenders and the mandatory chemical testing requirements under Ohio's implied consent law. The hearing demonstrates how legal proceedings address public safety concerns while protecting individual rights through Miranda warnings and the right to legal counsel.

>> I'm not saying that.
>> Oh, okay.
Um, >> you're on, Rick?
>> Yes.
>> Okay.
>> What's going on, officer?
Like I said, >> you drive.
>> You're just going to make sure you're okay to drive.
>> You're trying to arrest me.
>> I'm not trying to do anything.
>> We're I have to check your eyes. I have to make I have to make sure you're sober enough to be driving. Okay.
>> So, do this for me. Put your feet together. Hands down at your side.
>> Yeah. Can I call my grandfather?
>> The mayor?
>> Can I call my grandfather?
>> Is that the mayor you were telling me about?
>> It It doesn't matter. Okay, that's exactly right. It doesn't matter.
>> So, let's let's check your eyes real quick. Keep your hands down at your side, feet together. You see my finger?
Okay.
>> Yes.
>> Okay. So, you're going to follow it with your eyes. Your eyes only. Meaning, don't move your head along with it.
Okay.
You don't wear glasses or contacts or anything?
>> No, I do.
>> You do? What do you got in contacts?
>> Contacts.
>> Okay. You see everything? Okay, though.
>> For the most part.
>> Okay. Just follow my finger with your eyes only. All right.

>> Anything else?
>> So, if I went and grabbed your receipt and all that, it would line up with that.
>> Yes.
>> Okay. What kind of beer? How? Like >> tall beer and a cup or a >> No, it was a Guinness and a short and then I did two short woods. That's it.
>> Okay. All right. Appreciate your honesty. Um, here's what I'm going to have you do. No, no problems with your feet or your legs. Nothing like that.
>> No.
>> Okay. I'm going to have you stand right here. Put your right foot in front of your left. Heel toe. Your hands out on your side. Okay.
>> Trying to arrest me.
>> So, I'm trying to test you right now and make sure you're you're okay to be driving. Okay.

>> I I don't think your grandfather's going to appreciate me calling him.
>> No, he's not. But he he will he will come and he will get me.
>> Okay. Well, let's run through this.
Okay.
>> Right foot in front of your left. Stand here. Face me and just keep your hands down at your side. So, you're going to be like this. Right foot in front of your left. Heel to toe.
There you go. Heel to toe. Touch your heel to toe. God, >> I can't do this.
>> And you're going to hold that position.
Okay. Well, hold it. You're going to hold it right there. I'm going to explain the instructions to you. Okay.
So, it's going to look like this. You're going to take nine heel to toe steps.
>> Have an imaginary line >> coming directly towards the car here.
>> During this, you're going to be keeping your hands down at your side. You're going to be looking down at your toes.
>> I don't feel comfortable doing this.
>> You don't feel comfortable? No.
>> Okay. So, this is for me to gauge your sobriety. Okay.
>> No, I understand, but I I can tell you right now I I can't do this any other time.
>> Okay. Let's try this one then. Um, for this, just stand with your feet together, hands down at your side. This is this is the position that you're going to hold while I'm instructions to you.
>> I don't know if you understand the seriousness of this.
>> This is this is all part of me evaluating your sobriety. So, if you can't stand with your feet together and your hands down at your side and follow that instruction, that's a strike against you. I'm just letting you know.
>> I'm not saying that. I don't understand it. But I'm >> hold this position for me while I explain it to you. Keep your feet together. Feet together like this. Hands down at your side. There you go.
>> So, what you're going to do for this, hold that position till I tell you to.
Okay.
>> What you're going to do is pick up one foot, whichever one you want, directly in front of you. You're going to keep that foot parallel with the ground.
Raise it about 6 in off the ground.
Okay?
>> You're going to keep your hands down at your side. You're going to look down at your toes. And you're going to count out loud as each second passes. 1,001 1,002 1,003 and so on. I'll tell you when to stop.
>> Okay? So, I'm going to demonstrate it for you real quick.
>> Sure.
>> Keeping your hands down at your side, your uh eyes down at your toes, you're going to pick your one foot up. 100,002 1003 and so on. Does that make sense?
You got any questions or anything?
>> I don't think so.
>> Okay.
Whenever you feel comfortable, you can go ahead and begin. Going to step forward so you're off the curb.
>> There you go. [snorts] 1001 10024 1006 1002 1003 1004 1005 1006 12 two.

Consequences of test and refusal code 451192 must be read to OBI or physical control offender. You're now under arrest for operating vehicle under the influence of alcohol, drug, or combination of them. Operating vehicle under the influence of list controlled substance or list of metabolite of a controlled substance, operating vehicle after underage alcohol consumption, or having physical controlled vehicle under influence. If you refuse to take any chemical test required by law, your Ohio driving privileges will be suspended immediately and you'll have to pay a fee to have the privileges reinstated. If you have a prior conviction of OBI or operating a vehicle while under the influence of a list of controlled substance or list metabolitance under state or municipal law within the preceding 20 years, you're now under arrest for state OVI. And if you refuse to take a chemical test, you'll face increased penalties if you subsequently are convicted of the state OVI. If you have previously plead guilty or been convicted of two or more OVIs over the UAC's or equivalent offenses in the previous 10 years, or plead guilty or been convicted of five or more OVIs over UAC's or equivalent offenses in the previous 20 years, or plead guilty or been convicted of a felony of any of the above violations, and you refuse to submit to a chemical test as required by law, I am authorized to use whatever means necessary to ensure you submit to a chemical test. If you take uh any chemical tests required by law are found to be at or over the prohibited amount of alcohol controlled substance or metabolic controlled substance and your whole blood, blood, serum or plasma, breath or urine is set by law. Your Ohio driving privileges will be suspended immediately and you'll have to pay a fee to have the privileges reinstated. If you take a chemical test, you may have an independent chemical test taken at your own expense.
