Citizens have the constitutional right to record law enforcement in public spaces, including sidewalks and public easements, and officers cannot legally detain or harass individuals exercising these rights; the Supreme Court has ruled that unlawful detention and arrest can and will be resisted, and citizens may file lawsuits under Section 1983 if their rights are violated.

Shocking! Officers Want Fight Me American Security FAIL First Amendment Audit | Corrupt Cops CaughtAdded:
Okay.
I'm free to stay, too, right? Okay, cool. See you guys later. Appreciate it.
And why would I have to take my hand out of my pocket?
>> Sir, it's just an officer safety issue.
The police issued orders without clear legal basis, but they didn't expect the person in front of them to understand the law better than they thought.
Protection Corporation don't >> me on no camera.
>> I I'm going [music] to. Y'all can't detain me out here. I've done no I've committed no crime. Pardon me. I hate to.
They thought it was just a routine check, but every action was pushing them closer to a very thin legal line.
The cameraman was at the Strom Thurmond Federal Building, but from the very first moments, a threat from law enforcement pushed everything out of control.
In Columbia, South Carolina.
And they just don't like filming.
So, we're going to see how it goes.
No.
It's like I just got There's a guy here.
See what he got to say. What's up, bro?
I work for myself. What you doing?
Nothing.
You recording? Yeah.
You recording the building? Yeah. You can't do that.
>> I can.
What's your name?
Harold Jenkins. Yeah. What's your name?
What's your name? Do you work here? I don't know. I'm not I'm not doing that.
So, you work here? Yeah. Do you see that sign right there?
Before you waste whoever time you finna call, read that sign right there, okay?
>> Okay, that's all you had to say. I just asked you. Okay, yeah, that's fine. All right. If If you know If you don't want to read that sign, you shouldn't have answered the question. I'm done talking to you, but So, this sign here regulates what I'm doing, and he decided to come out and investigate anyway. I'm wasting everybody's time.
And now he's doing the walk of shame back to where he's come from.
I know it sucks coming out not doing your job the way you thought it was going to go. I'm sorry.
Maybe next time.
So, as we speak he's calling the local PD on me as we speak.
This is him here.
This is him.
You work for Homeland Security?
You don't? You local PD around here?
Sheriff?
Security? Okay.
Got it.
Is he security as well?
So, does he know that his jurisdictions stops where this sidewalk starts? This is It's a public easement here. They got somebody that's coming to talk to you.
Okay. I appreciate it.
I was talking to him. Our conversation has nothing to do with you.
You decided to move yourself from the conversation, so you stay down there.
It seemed like things would stop at a tense exchange, but no. As more people showed up, the atmosphere clearly began to shift. Simple questions gradually turned into control, and the line between duty and abuse of power started to blur. I know, right? As always. How you doing? How you doing, man? I'm all right, bro. What's your name? Kelvin Moses. How you doing? I'm all right. You videoing around the building?
>> I am.
>> Videoing the building? I am.
Can I see some ID? You cannot. Why? Cuz well, wait. Do you Are you You're So, so you're the First I want y'all to see this. The First to Fire Protection Corporation don't >> me on no camera.
>> I I'm going to. So, your jurisdiction stops >> No, you stand fast. Oh, I'm not going nowhere. Oh, I'm Oh, wait a minute.
Y'all can't detain me out here. I've done no I've committed no crime. Oh, so you told me to stand fast.
>> Nobody detained you, man. So, I can leave, right? No, you can't leave. So, if I can't leave, that mean I'm being detained. Can you articulate the crime?
>> back. Yeah, call them back, please. Man, I talk to whoever I talk to whoever I want to out here. Why? I'm busy right now. Yeah, he real busy. And he finna be a a whole lot busy at home, jobless, if he don't tell me that I can leave.
>> Wait, they got to You got to wait. I'm doing something else real important right now. Just tell the guy to wait. It ain't that important.
So, you have no jurisdiction over this public easement, and you going to tell me that I can't stand here I mean that I got to stay here I can't leave?
I I think you got your job title all backwards.
You're the type of officer that my attorney will have fun with.
You say I'm lucky you're at work? That's what I said. Are you threatening me? I'm not threatening Are you threatening me?
I ain't threatening If you that If If the well, I'm talking to you. If you that big of a guy, take your badge off.
Don't threaten me and tell me that I'm lucky you're at work, buddy.
Don't tell me I'm lucky you're at work.
Yeah, okay. Cuz you're barking up the wrong tree.
Well, I am. I'm talking to you. A hit dog will holler on it. Yeah.
Going to tell me Going to tell me no?
He going to tell me I'm lucky you're at work cuz you got a badge and a gun on his hip like they're the only ones that carry guns, man. That dude don't bother me.
Call who you going to call, please.
Yeah, I know.
I'm free to go, but I kind of want to stay here now cuz he going to tell me I'm lucky you're at work.
>> fast.
Come on up there with you. I think he going to do something, too.
>> Can both of y'all come to the back of the building ASAP, please?
At the back of the employee entrance outside.
This This This dude is joking you. At this point, the situation had spiraled out of control as the back and forth turned into serious accusations right in front of the camera.
But that wasn't the peak. Just minutes later, things became even more tense and unpredictable.
Supreme Court's already ruled that illegal detention and arrest can be and will be resisted.
Yeah, so we going to continue walking up and down this sidewalk here. I'm going to slide by you here, brother. Pardon me. I hate to.
Excuse me, sir. Hold on. Hold on. Sir, don't touch me. That That's an assault.
That's an assault. You just put your hands on me.
That You just put your hands on me.
That's an assault. I hope you know that and I got it on camera. You just put your hands on me un- unwillingly. That's an assault. I'm going to walk here. If you put your hands on me again, I will defend myself cuz you have no legal reason to touch me. I've committed no crime. I've broken no law. This is a public easement. I can walk here as long as I want to, okay? Please do not put your hands on me.
That is a legal activity. Read the Constitution. The Supreme Court has already ruled that federal installations Okay, well, I'm walk this way.
All All you had to do was just answer the question.
>> I don't have to answer any questions.
The Supreme Court does not say, "Hey, answer that question and you can do what the Constitution says you can do."
That's not how this works.
You like to see me defend myself? Yeah, with all three of us Put your hands on me. That's a lawsuit, and I and I promise you it's a lawsuit.
Put your hands on me.
>> You're on federal property. It Which makes it public. Which is public. This is public. This is public property. It's public. It's federal. Tax funded.
Y'all funded through private agencies?
Okay then, thank you. Don't put your hands on me.
Yeah, I'm I'm telling you now.
Oh, so I'm being detained?
Am I being detained?
Yeah, I'm going to get his name. His name is Jeffrey Yeah, that's his name.
You saw it.
And this officer here put his hands on me, and I got it on camera. It's all going to my attorney, don't worry about it.
All of them going to be jobless tomorrow.
The First to Fire Protection Corporation, and they think they have jurisdiction on a public sidewalk. This is great here. I want y'all to see this.
I'm I'm I'm surrounded.
And this guy here told me I'm lucky you're at work.
Well, you can't be the complaint. Stop making threats, sir. Oh, I'm threatening Oh, Oh, I'm threatening? You told me No, no, no. You told me that I'm lucky you're at work. I got that on camera. I got that on Don't get mad now cuz your buddy's walking out here.
Don't get mad. You You told me I'm lucky you're at work. What does that The tension had reached its peak as neither side was willing to back down.
But unexpectedly, the explanations and actions from law enforcement soon after caused the situation to take a completely different turn.
Making threats to all these officers.
I got it on camera. You making threat about what he would do. He talked about we eating out of the hands of the white man.
I got it on camera.
It's on camera. So, everything he's saying I can back up it. This This officer told me I'm lucky he's at work, and I said, "What does that mean?" And he And he would not explain what that meant. I told him that he cannot >> So, what what started the whole thing in here? I'm out here filming. Doing Doing what the Constitution tells me I can do.
And this guy here came out here and told me that I can't film a federal building.
I said, "Sir, I'm on a public easement."
Okay, so So, tell them that, please. Because they told me I couldn't. But this officer right here told me that I'm lucky he's at work, and I said, "What does that mean?" Because the Supreme Court has already ruled that unlawful detention and arrest can and will be resisted.
No, I did not. I told him, "If you that big of a person, take your badge off and talk to me." He wouldn't do it. But he told me I'm lucky you're at work, and the officer standing right here, I got it on film. I tried to walk by he impeded my right of movement right here and put his hands on me. That's an assault. I want to file a complaint.
All right, file a complaint right here.
This is This is Columbia, so you're going to have to file it with Columbia >> Okay, yeah, but that That officer there put his hands on me, and I got it on film. And that officer at the back told me I'm lucky he's at work. Now, I asked him, "What does that mean?"
I'm not stopping my camera cuz my life's in jeopardy right now. I'm not. Yes, it is. I had a officer right here threatening my life. This officer here threatened my life, told me I'm lucky he's at work. Okay, so go ahead Go ahead if if you won't show it to me.
Um go ahead and file a complaint with Columbia PD.
Uh and you can file anything you want.
That'll be fine. Um you're back here.
You can film. Go ahead. Yeah, I was filming, and these guys came out here and surrounded me. And then they told me I was detained. That's unlawful detention. They have no jurisdiction on this public easement.
But I'm telling But I'm telling you. If a woman came up to you and told you that I grabbed her butt, you got You got to do something about that. So, you would talk to him.
Yeah, I'll talk to him. That's all that means. So, you let your officers assault people, and all you say you're going to talk to them?
So, you're going to back that up. I just got assaulted by one of your officers, and all you're saying is I'm going to talk to them?
Okay, I will.
Can I have your name, please? My name is Inspector Jewel. J. E. W. E. L.
Inspector Jewel. And your name?
The incident came to an end, but many questions remain unanswered.
Has the line between duty and abuse of power been crossed?
And if everything was clearly recorded like this, who will have the final say?
Citizens may file a lawsuit against police under Section 1983 if their rights are violated.
Officers who violate those rights could face financial liability and may also be subject to discipline or termination.
Up next, the cameraman was filming at the Fremont Police Department to test how officers would react to recording in public. Everything seemed fairly normal at first, but in a brief moment, the attention from law enforcement began to increase.
I'm good.
There it is, Fremont Police.
The way their cars logos looked, I haven't seen any other uh like logo or car.
Looks like those people are still watching me, but it's okay.
They can watch me.
Looks like they have solar panels >> help you?
on their uh I think they have solar panels on their carport.
Pretty cool.
Sir.
Nice little Lexus there.
Oh, boy.
Sir, can you give me your badge number?
It seemed like everything would remain just simple observation, but the constant presence of the police showed they were watching very closely.
Then, just minutes later, the distance between the two sides began to close, leading to an unavoidable direct interaction.
What was that?
Is there anything we can do for you? No, I'm good.
Okay. I'm good. Thank you. Appreciate it.
Well, I guess we can go look at their vehicles.
Oh, all right. Let's go see their car, see how it looks and check out the upkeep on it.
Looks like they're being smart enough to stay away from me, but we will see how that goes here in the very near future.
The situation began to heat up noticeably as the officers' requests went beyond mere observation.
And just minutes later, a small detail unexpectedly became the focal point, pushing the confrontation into a more intense phase than ever before.
See you guys later.
>> Sir, I'm not trying to detain you at all. Do you understand that? What was that? You're free to leave.
Uh okay.
I'm free to stay, too, right?
>> Yep. Good. Go. See you guys later.
Appreciate it.
What uh what's your name and badge number? Well, my name is Officer Cortez, badge number 12509.
What was that?
Oh, I'm not detained. I'm not taking my hand out of my pocket. No. All right, I'm Sergeant Cortez, badge number 12509.
And what's your name and badge number?
>> Sergeant Kindorf, 13914. And why would I have to take my hand out of my pocket?
>> Sir, it's just an officer safety [music] issue. Officer safety has the You don't control me, right?
Yeah, you are. You're trying to tell me to take my hand out of my pocket. Not at all. We're done here. Yeah, what's your name and badge number? I gave it to you.
Oh, you did. Okay, cool. Yeah, see See you later.
See you later. Appreciate it. You, too.
Cool.
Would you mind just taking a few steps back, please, so I can get inside the car? Kind of, yeah. Yeah, it would mess up my I'm not comfortable getting inside the car, so if you wouldn't mind just simply stepping on the sidewalk. It would mess up my my shot here with the camera, though. Okay. So.
Okay.
Yep.
And I'll walk away. I'll walk towards the I'll I'll hang out. I'll walk with you.
No, thanks. You can stay right there.
>> No, I'll walk with you. Okay.
I I know. I'll roll with you.
We can walk together.
See you later, babe. You're dismissed.
And that was an easy dismissal here at the Fremont PD. They didn't like the fact that I have my hand in my my uh hoodie pocket here, but there's nothing that they can do. I can put my hand in my hoodie pocket. If I was detained, then they would have control to tell me not to put my It seemed like things had cooled down, but in reality, the attention hadn't gone anywhere. As the situation continued, the next developments revealed a different perspective.
One where every action was being closely watched. I'm this wall and recording these people.
Well, let me see me or not. Oh, yeah, they obviously see me.
But it doesn't matter cuz uh leaning leaning on a wall and recording in a parking lot is not against the law, so they can see me and not see me.
It doesn't really matter at all, so.
All right, pretty cool.
I'm going to go ahead and keep filming and uh looks like we got a little bit of curiosity.
Oh, this is a park ranger. Cool.
So, we got his address, or not address, but his license plate.
And we're going to go ahead and roll on in over here.
See what else I can see.
>> [snorts] >> That's their little box where they click and and come in at.
And this is their SWAT vehicle that we saw earlier.
I don't know why anybody would ever need a SWAT vehicle like that.
Um that thing's big.
Hello.
Little Fiat 500.
The confrontation ended without any arrests, but what happened spoke volumes.
When civil rights and law enforcement power stand face to face, which line is right and which one has been crossed?
