In domestic violence cases, police determine charges based on the evidence and circumstances, including whether physical contact occurred, the level of threat, and the relationship between parties; in this case, the officer determined that while the accused's behavior was intimidating and aggressive, it constituted assault (creating fear of physical harm) rather than battery (causing physical injury), resulting in a misdemeanor charge under Arkansas law.

Huh?
Yeah, it's hot. We can go to the front of this car right here.
Howdy. So, hey, um I'm Corporal McCoy with the Sheriff's Office. I'm going to get your side of the story while I'm out here. Yeah. So, before I do anything doesn't mean you're going to jail, doesn't mean anything like that. I just like doing it on the front end, okay?
Miranda warnings. I just do it on the front end right off the Am I going to jail?
I don't know. I got to get your side of the story. Okay. First, I mean you know what I mean? Like, I don't know. I'm trying to get it all sorted out right now.
That makes Before you get his side, I want to say something. I'm his I'm his father. I'm married to his mother. Okay.
He's an idiot.

Okay. I'll I'll handle this. It's just policy, too, you know, I got got to handle it.
So, you know, you have the right to remain silent. Anything you say can will be used against you. Do you understand each of the rights I explained to you?
So, having these rights in mind, do you wish to talk to me?
Yeah. Okay. What the heck happened today?
Well, so I got funny and bunch of the stuff was sitting on my washer. Okay. And I was like, "Hey, what's all this stuff doing all over the washing machine?"
And she said, "Oh, I'm taking my stuff."
And I was like, "Oh, you're moving out?"
She said, "Yep, I'm going to be gone by the 1st."
I was like, "Well, you told me you'd give me 30 days."
It kind of sucks that you picked like right after I got injured. I was off work for 3 days. We got you. I got a big old hole.
It hurt my I bruised my ligament with the doctor. Got you. I was like, "It kind of sucks that you like, leaving me like that."
So, uh uh I don't know, it's whatever. I was like, "Well, I mean, if you are going against what you said in the 30 days, then why don't you get out right now?"
That's what you told her? Yeah, and she was like, "I don't have to. I already paid rent this month." And I was like, "Okay, whatever, dude." So, I did leave that alone.
My grandma, my grandpa, and uh he said something about she was hanging out with some married dude and all that with his motorcycle.
And uh I guess the dude's wife got mad. And I was like, "She had to have known that was going to happen cuz she told me about it." I told her that was going to happen. So, she starts freaking out telling me I need to mind my own business.
One thing led to another, she starts like, "Well, I don't I'm taking this TV." And I was like, "Don't take the TV.
What are you talking about? You're taking the TV." And she was like, "It's mine." So, she said it's hers. She gave my mom the money and I did tattoos and I gave her the money. And I was like, "Here, since you bought the TV."
Whatever.
>> So, I got the I bought I had the TV. And when she went in there, she tried to grab it. And I was like, "Woah." And I I made sure I would not touch her. Did not touch her. So, I grabbed it from the top. I was holding it like this. And she kept on trying to shove me. And she was pushing me with her shoulder. I'm like, "Dude, just leave the TV alone. Like, it's my TV." Mhm.
And she was like, "Yeah, whatever." And she throws it. So, it's on the ground in there. It's broken.
>> How did she get the TV?
Like, if you were holding it away from her. Uh she So, it's hard Yeah, the TV stand right here.
The TV sitting on top of it.
So, she goes over and she grabs it like this from the base. And side and starts yanking on it. I'm sitting there holding it from this side and up here. So, that she can't try to not let her move it.
>> Yeah. And finally, she just said, "Fuck you."
And she flipped the TV. So, it's on the ground in there. It's broken. It's all pieces are all hanging out.
And then uh I got about this close to her. I was like, "Get the [ __ ] out of the house, then. You broke my TV." You got up in her face? Yeah. Okay.
>> right about right here and she like threw herself at the door and got down on the ground. She was like, And uh Yeah, she was like, "I'm letting them know you pushed me." I said, "I didn't touch you."
I got you.
When you came out, man, I put my hands over here. With the TV, I had my hands up here.
Would not touch her. She was She had the TV was on the stand.
And I was holding it like this. Okay.
>> She was towards the door. Like she was yanking it like this. Okay. And that's Now, she did start shoving into me.
And I pushed her away from the TV, but I'm holding it. I'm just not letting it move.
I'm just saying like, "Quit." How did that make you feel?
How'd it make me feel? That she was when she was shoving you. Annoyed. Annoyed.
And then were you Were you scared at all? I mean, I'm a I'm a big dude. I'm not I'm not like worried that she's going to hurt me. I mean, if she did, you know, I'm not That's not something that I'm too concerned with. I've been hurt worse.
But Did it hurt you like Did it hurt you like on a scale of 0 to 10, 0 being no pain, 10 being okay? My ankle hurts. But that's from a different injury? Yeah.
It was a little awkward trying to But 10 being But 10 being no pain like I'd say good three.
Your ankle? Yeah. And this all happened here? Yeah.
>> Was there any witnesses?
Um I was talking to my grandpa, but not really.
Okay. Unfortunately, that's what worries me the most.
It's Did you take it So, you were Did you Were you close in her face? Like When you said, "Get the [ __ ] out," was it like here?
No. Okay. No, I was probably like from here to you. Okay. How were your hands? I put them on my back. Okay.
Penguin. Okay.
>> I was like, "Just get the [ __ ] out, then."
And that's when she was like, She threw herself against the door and she dropped down on the ground. She was like, "You!
I'm scared."
Okay. So, I walked to the kitchen and as soon as she was on the ground, I walked to the kitchen and I was like, "Man, you are not going to say that I put my hands on you."
You can't I say that. I would never.
Never. Never. I got you.
Uh will you face that way for me? I'm going to take some pictures of you.
Will you fill out a statement form for me? Uh face Face turn towards me.
This side. Go like this.
Howdy howdy. Howdy howdy. How are you, sir?
I'm doing good till I got woke up with this bull crap. Yeah, did you see any of it go down? No, but one thing I that's that's my son-in-law. Okay. Oh, okay.
This this thing between them two has been toxic for a minute now. Mhm. And one thing, he's an idiot. He runs his mouth. He don't know when to shut up.
But he would never put his hands on her.
Oh. So, if she's telling you he's put his hands on her, he didn't.
Oh. And she has threatened to call the cops and say that he has several times.
Really? Yes. Mhm. My wife can testify to that. I can testify to that. I can tell you I don't like that boy one bit because he he's learning he's growing, but he's doing it his way. Mhm. You know, he's only been out of prison a few years and he's never really held a job.
Well, he's finally got him a job and he's working and he's trying to get into the groove of life.
But this relationship they have is utterly so toxic it's really unbelievable. Uh okay.
You know, they they do things to piss each other off intentionally and then they fight about it. But he would never Oh, okay. Never put his hands on a woman because he does not want to go to jail.
Mhm. You know, he he is a he's a registered sex offender. Yeah, yeah. Is this your This is your wife's son? Yes.
So, that's Aaron Tyler Rhodes. Okay. How How long have you live have together? Oh. oh, I We've been together since before he got out of prison. I've known him since he got out of prison. Oh.
>> Several years. Oh, okay.
But you didn't happen to see anything?
No, I was over here asleep. My wife said, "Hey, Tyler's in something. Come over there."
She called the cops on him.
And I said, "Okay, we talked about this yesterday and said it was coming because they had big fights. I mean, they fight every day.
Mhm. Every day. And they're not even together. Mhm. They're not even in a relationship. They're roommates.
Okay. But he's brought women over. It's pissed her off. She had a dude over the other night. And it just Okay. Yeah, there's a there's a lot of backstory to this. Jeez.
Yeah, he's supposed to be at work at 11 and he he said he I guess he was going to leave earlier and she said, "I'm not moving." You know, and I told him, I said, "You know, but yeah, don't leave."
And I want to talk to Which car is hers?
Hers is the one blocking the driveway.
Oh, okay.
Huh? Like she does that every time. She'll pull in and intentionally block him in to where he has to go to her and be like, "Hey, can you move so I can leave?" And when she can park right here in front of mine >> Mhm. because I don't want my I drive mine to work and that's it.
Okay. Well, if you would just hang tight for a second, I'm going to see how much longer they got on this and then I got you. We'll we'll try and get him to work before too long.
Hey, Taylor. Yeah.
Hey, I got a couple questions for you.
Okay. Hey.
Uh Let me ask you this and I want you to be honest with me. When y'all were fighting over that TV, were you shoving him first? No.
You weren't No, I hit him with your shoulder.
>> of the TV. Okay. Whose TV is it?
>> My TV that I paid for and I sent his mom the money for it.
He's saying he paid the money.
>> Of course he does, but I have it on Cash App. Okay. How long have you had that TV?
A couple months.
And let me ask you this. Did you throw yourself against the door? No, I did not. He just Okay, can I ask him can I take this over there? I'm going to listen to it with THE OTHER GUYS.
HEY, DO YOU HAVE EMAIL?
CAN YOU SEND THAT TO ME, PLEASE?
Is this that's today time stamp?
Say it's 7:00 County. What time was the call placed?
Let me get you a call you got email?
Will you email that to me?
Hey, actually step out for me.
Hey, Mickey.
So, you said you were scared that he was going to hurt you?
Yes, but call the cops? Okay.
Hey, still under Miranda. I'm going to ask you a couple more questions. Is that good? Okay.
So, I just listened to a recording that she had going. Yeah.
Did you call her Yeah, I did I did I did tell her she Okay. She was messing all the married people.
Okay.
Did you [ __ ] Did you get up in her face closer than you're what you're telling me? No, I didn't get like corner, no.
I I I don't I I know how she is. I don't ever want her to be able to say that I put my hands on her or nothing like that.
>> Okay. Well, she's not saying you put your hands on her. Yeah. She's saying she get You got so close to her your belly was touching her.
Would that be right? I doubt it. You doubt it, but you don't know. I doubt it. I There's no telling, but Okay.
>> I I I would have threw my hands back.
Did you lunge at her and say you stupid like you like you Did you lunge at her and say Just be honest with me, man.
That was when she threw the TV. Okay.
And I said I stepped back. I was like, "You stupid Mhm.
I said she's been All right, step up here for me, man.
Got you.
Go to that front of that car right there.
All right, go ahead and put your hands behind your back.
Yeah. I'm going to jail.
Assault.
Assault and battery.
>> Assault.
In the third degree?
He She said I didn't put my hands on her. That's battery assault.
Make somebody feel physical harm.
There's no way.
Well, assault is fear of physical harm. Yeah. I mean, she was shoving me.
She was the one shoving me, and I was Well, hey, you have your day in court, okay?
Face that way for me.
Say 71015.
She Then she looked at she said she was going she's not afraid she knows she's not afraid of me she's just saying that but what okay and how about this when we talk spread of danger before she walked out of the house she said I'm going to make sure you get everything you deserve.
That scares the [ __ ] out of me.
And I did not touch her. All right spread of people.
Nobody saying Nobody saying you touched her. Yeah but that that Yeah it's assault If there if we know that I didn't touch her she knows it.
She says I didn't touch her. Well when you get in somebody's face that makes them feel a little threatened. She was shoving me I felt threatened I mean I didn't feel like she was going You already told me you weren't scared and you told me you weren't and you told me that it didn't hurt. I didn't feel like she was going to cause me pain.
No but when she said her shoving me she said she's hit me in the face before.
So like there's the thought of okay she's going to Well you you didn't tell me that off the bat.
I asked you those questions did I not?
But I don't want her to be in trouble I really don't I just want her to be able to grab her stuff and go. I just want her to I don't want her to get in trouble I just wanted her to come grab her I just wanted her to grab her stuff and leave.
>> do you want to take >> I'll call him and go talk to Jerry.
Yeah.
Who's Jerry? My landlord. Okay.
Cuz I'm probably going to lose my job and and Got it.
Is there any way I can just not go? No I got to take you in.
So in Arkansas there's an assault charge and then there's battery.
Battery is actually causing physical injury or a complaint of pain. She had no physical injury and she had no complaint of pain. She was scared, and we just listened to a recording where he was chewing her out and throwing [clears throat] all sorts of stuff. So, that's that's where we're at.
>> Yeah.
So, that's that's >> intimidation. Yes, exactly. It's more intimidation than anything. And so, since they've lived together, it classifies as a domestic relationship.
We're we're required by the state, if there is charges, to make physical arrest. So, that's why we're taking him to jail right now.
She needs to be out of this house by today. I'm going to go talk to the landlord. Okay.
>> And uh she's not on the lease. Who's uh >> She's a She's >> Who's the landlord? He lives right back here. His name is Okay. I'm fixing to go talk to him. And she's she's going to get out of here because this is my house.
>> Was she moving out? She said that's the She's supposed to be She said she's moving out by the 1st. But she just got my wife's son locked up.
>> Yeah.
>> Granted, his his response to her played a big part in it. He's a grown man. He has control.
>> Yeah.
But he don't know how to control his emotions, and therefore Oh, okay.
>> You know, it it it it is what it is. But she knows he would never touch her.
Okay.
>> She knows what this outcome would have been like. So, she intentionally did this knowing that nine chances out of 10, he would go to jail. You know, I'm a next con man. I've been in prison five times. I've been I've had my life together for years now.
>> Yeah. You know, the kid would never hit a woman. He would never He He's He's He talk He don't know when to shut the [ __ ] up.
But he would never Yeah.
Yeah.
No, that that makes sense, man. So, I Get put her in jail. Do what? I'm talking to him. Why are you? I'm not I You know, don't get me wrong. If he did something to go to jail, take his ass to jail. He needs to learn to be accountable. I'm all for >> So, there is a there is a audio we listened to.
>> I I know. I heard. You know. And it's just how convenient that you got his side of it, not hers.
I agree with you. You know, what you know You mean the other way around?
>> Yeah, I'm telling you she's a vile woman. She We have heard we he has called us when she has talked to him and a lesser man would have knocked her on her period. Well, we don't always know what goes on in that house.
You know what I mean?
And like I said in the state of Arkansas we're required to make a physical arrest if charges arise.
Charges arose because of that audio recording.
>> But what is the actual charges going to be? Assault third on family household member. Yes.
>> Misdemeanor? Misdemeanor.
>> Misdemeanor.
>> Okay. Misdemeanor. Yeah, no felony none of that.
Have you been here before?
Yeah. Okay.
Sex offender.
Come on.
