This video demonstrates the arraignment process in a district court, where defendants are formally charged with misdemeanor offenses such as operating while intoxicated, driving without a valid license, and retail fraud. The judge explains that misdemeanors are punishable by up to 93 days in jail and fines up to $500, with some charges carrying points on driving records. The court follows standard procedures including reading charges, explaining rights, setting pre-trial conferences, and recommending legal counsel. The judge also addresses practical courtroom challenges including technical issues with microphones and cameras, and the impact of construction on court operations.

Misdemeanor Arraignments 3B District Court April 21, 2026Hinzugefügt:
All right, you can hear me. Very good.
Uh, we worked on it. I just did a couple of attempts at an eloquent introduction to this courtroom and we'll have to do it again later today because we're about to start our business. Uh, we have a lot to do. We have a very very busy day uh full of misdemeanor arrangements, full of pre-exam conferences, and uh I will just say I had a wonderful few days off in Florida, chasing my granddaughters in the surf, building sand castles, and enjoying time off with beautiful, beautiful weather. Our first line today, we'll get right to it. Somebody suggested this while I was gone. I could do probably 30 first lines from John Prine.
This song is some important. Everybody knows these people.
We had an apartment in the city and me and Loretta liked living there. Well, it had been years since the kids had grown, a life of their own and left us all alone.
John and Linda live in Omaha and Joe is somewhere on the road. We lost Davey in the Korean War and I still don't know what for. Doesn't matter anymore.
Everybody knows John and Loretta. All right. Can you hear it?
>> Uh, all right. So, we are going to start our arraignments. We've got extra stuff.
Yes.
>> I want to know why your mic is green and everything else is >> Good morning. Good morning. Come on in.
Have a seat. Or you might wait outside for your attorney. We're going to get a long way before we get to your case.
>> All right.
>> All right.
>> Okay. Can they hear now?
>> Yes.
>> Okay, great.
>> All right, >> everybody can hear.
>> All right, >> so Joan Bayz did a beautiful cover of that song when John Prime passed away.
Yes, I can lock and unlock the cameras.
Um, when we get people in here, you're seeing the courtroom, at least a portion of it. You can't see where the jurors would sit. uh as in my introduction that you couldn't hear. Uh I talked about the courtroom and the history of this courtroom and maybe we'll try it again uh in a little bit. Apparently I've also got some bench warn arignments and that'll be great too. So we have a lot to do. Uh we have about I don't know 50 people to deal with this morning. several different attorneys. Uh the m microphones are wireless. They tell me I need it right in my face here.
We'll see about that.
I did have an opportunity when I was in Florida to meet Stingray Tom. He drove all the way from Orlando area. had a nice visit with him and uh thanks to him also met a lot of other nice people.
Uh they did have a jury trial in Three Rivers. Judge, retired judge Alexander Lipy came down and tried a criminal sexual conduct case with the attorney general handling the prosecution from Lancing and uh Ross Truckucky representing the defendant. and they uh reached a verdict of guilty yesterday afternoon.
Uh we're still, as I said, working the bugs out in here. I can't show you the entire courtroom, these cameras. I guess I could show it at some point with my uh camera from my monitor. So, may we'll try that at some point when I do the introduction properly.
Uh, those chairs are all been restored.
They're really hard and uncomfortable.
The chair that I'm in is too short. I wish I were higher up, but we'll see.
Good morning.
Yep.
We uh are really working the bugs out here with the correction staff. Uh where they're going to be um how they're going to get people in and out of here, who's opening the courtroom in the morning.
This morning I get early at 7 and uh set things up. So, we're about to fill in the courtroom.
Uh the public defender will be here.
We're going to do things just like we've always done.
and uh people will uh come up to the podium.
The rest of the courthouse is in disarray.
There's stacks of drywall, scaffolding, tools, junk, dust.
Uh it's >> Yeah, I do.
>> All right.
>> More general.
>> I think I'm good. I'm good. All right.
So, uh, as soon as we get the public defender, we'll start. Good morning, everybody.
Uh, this is the first day in about 60 years we've had arraignments in this courtroom. Uh, this was the original St. Joseph County Circuit Court. And because of the construction that you saw on your way in, everything on the old side of the of the court structure and the court office has been closed. It's under construction. And you see building materials and dust and people all over the place. So for the next year or two, we will be conducting court in this building. And this is the original court building. So, I'm going to turn off the live chat and uh thank you all for saying good morning and I will do a better introduction to this later. I'm sorry that whole very eloquent introduction that I did didn't have any sound. So, the only one that heard it was me and Autumn.
Uh anyway, let's get to business. Mr. Stickley is here. Morning.
>> Good morning. We did do some dry run stuff yesterday afternoon.
Uh, which seemed to work. That's why I got here so early this morning, but we had a few bugs right at the last minute.
All right. Uh, I've got it on the overall picture.
Uh, maybe I'll just take it off of that.
We're going to do the arraignments the way they were always done in the other courtroom. When I call your name, I want you to come up to the podium right there and you'll be on the camera and we're live streaming this and we will conduct the arraignment. This distinguished gentleman is Mr. Keith Stickley. He's the chief public defender here for St. Joseph County.
So, we'll see. I've got kind of a limited workspace here. Um, this is all a new experience.
They've given me the check-in list.
And our first person to check in is Tiffany Tiner. Would you come up to the podium, please? Good morning, Mr. George. Welcome to our inaugural day.
Today is the last day that anyone is eligible to file to run for my seat on the 3B District Court.
So far, only one person has filed and that would be Mr. Timothy George.
>> Good morning. Are you Tiffany Tinure?
Am I saying that right?
>> Tinure.
>> Yes.
>> Yes. Uh the file number here is 26 582D. It's an ordinance case and you got charged in three rivers with operating while intoxicated.
>> Just tinure. Bear with us. We're working on everything. That's a misdemeanor.
It's punishable by up to 93 days in jail and a fine of up to $500.
Carries six points on your driving record and it requires that your license be suspended.
Can't tell very much about this other than it happened at about 11:40 on March 31st.
>> Uh at Wood Street at Michigan Avenue, not too far from your house.
I would suggest, Miss Tinure, that we get an attorney to help you with this and set it for a pre-trial conference.
Is that acceptable to you?
>> Yes, sure.
I'm gonna have to get a taller chair in here sitting like this for >> eight hours going to kill me.
>> No way. Sorry.
>> Oh, >> we have crammed full the first Friday of May.
So, we're going to go all the way to the first Friday of June.
going to set an attorney pre-trial for June 5th at 8:30.
The air conditioner just came on and it has a noise. We haven't experienced that yet.
Appoint an attorney.
What do you do, Miss Tinure?
>> What do I do?
>> Yes.
>> Um, I'm a stay at home mother right now.
>> All right. Well, I'm going to send you out to the court office with the bail.
He will take you out to the clerks.
They'll give you some paperwork with your attorney's name and number on. I want you to call that attorney, make an appointment >> to discuss this with them >> prior to June 5th.
>> Okay? Don't get in any more trouble till I see you there.
>> Thank you so much.
>> All right. Well, just a minute. Let make sure that you don't owe me any money.
I don't think so. All right. You're good to go. Thank you.
>> Okay. Thank you. Have a good day.
>> All right. We're working on it. Got to start somewhere.
All right. Mr. Guthrie, would you come forward, please?
We are limited for space up here. Good morning, Mr. Truckucky.
>> Sorry, sir. I'm going to tell you I have a hard time hearing.
>> All right, I'll try to speak up. Can you hear me?
>> Yes, sir.
>> We do have some hearing assist headphones. Would you like those?
>> Uh, yeah, sure.
>> All right.
I got to fix this chair or grow taller.
>> Oh, no. No worries at all.
Make sure you can hear.
And your honor, the dynamics are a little tricky that it is difficult for us to hear here. Uh, can you say his name one more time, your honor? I didn't see the >> His name is Justin Albert Guthrie.
>> Got it. Okay. Thank you.
>> Yeah, here you may. Now, there are some speakers here. We've been working on this sound. Judge Patterson's courtroom has terrible sound.
Anyway, Mr. Guthrie, you got a lot going on here. You're charged with driving suspended first offense and open intoxicants from an incident that occurred on October 28th of 2025.
A warrant issued back in December and you didn't get picked up until April when you got arrested for domestic violence second offense and cruelty to animals. That case is 264 or 605SM.
Domestic violence second offense is the most serious charge. It's a misdemeanor punishable by up to a year in jail and a fine of up to $1,000.
My suggestion, Mr. Guthrie, is we get a lawyer to help you with this. These cases could have serious consequences.
Do you understand?
>> Yes, sir.
>> Is that agreeable to you?
>> Yes, sir.
>> Are you still living in school craft?
All right. Well, does because of this is there a no contact order?
Let me look at this.
>> I don't know. I have no contact.
>> All right, let's take a look.
The warrant says that you assaulted Rachel May Guthrie, your spouse, and uh at 301 East Street, and that you had a previous conviction for domestic assault, making it punishable by up to a year in jail and a fine of up to $1,000.
Second count is you did cruy drive, beat, or work an animal. That's a misdemeanor also. punishable by up to 93 days in jail or fine of up to $1,000.
Because of the no contact, are you staying at the Schoolcraft address?
>> Yes, sir. That's my mother's address.
>> All right.
Are you still working at Walgreens?
>> No.
>> Are you working anywhere?
>> Not at the moment. Your health problems have been catching up with you.
>> Yes, sir.
My dad loves an attorney. said attorney pre-trial for 6526 at 8:30.
Keith, we're doing the same thing. We're overloading that day of the month, but it just is what it is.
>> Mr. Guthrie, these are all potentially serious charges. The driving suspended charge is a misdemeanor. It's punishable by up to 93 days in jail and a fine of up to $500 and could further suspend your license. You've had license issues for a while now. But the most serious charge is a second offense, domestic assault. I don't know very many of the facts. All I know is what I told you from the complaint. So, I'm going to do the same thing. I have the court officer take you out to our office. They're going to give you the paperwork with your lawyer's name and number on it. I want you to call that lawyer, make an appointment to discuss it with him prior to June 5th. That's a long way away. The next available date would be May 1st, which is 10 days from now, but that day is already overfilled.
So, you go to the court officer, your next court date is June 5th. All your bond conditions remain in effect.
>> Tiffany me, you go to the court officer. Take your headphones off.
>> You guys have signing for the arments. to the judge.
>> Oh, you did? Okay. Because I'm like trying to judge the budget schedule.
>> That's it. Okay.
>> Sorry, I didn't have I'm trying to backtrack and find everybody because I didn't have the signin sheet this morning because we didn't have our normal >> Do you need more info?
>> No. No, I think I'll be okay, but I think only four people signed in and I'm assuming you have more than that. So, >> I see others. I see Mr. Kelly and I see other people that are here. We'll see.
>> Just trying to forensically put it together here.
>> Well, we're working the bugs out to be sure.
>> Yes.
Oh, are you Rachel Guthrie?
Oh, just a minute.
Stay here for a minute.
I don't see a bond form.
I just wanted to make sure that we're not doing anything wrong.
>> Well, I don't see a no contact provision here.
Uh and I lo I gave the file away so I can't even tell what the bond was. $100 cash or shy.
Um, did he get fingerprinted?
>> No.
>> What? We can't do fingerprints.
>> Oh.
Um, apparently there is not a no contact provision in there.
>> Okay.
>> All right. U, you're good to go.
>> Okay. Thank you, sir.
>> That something's not quite right with that complaint.
My sheet says Tiffany me. Is there a Jon a Jonathan me here?
>> Yes.
This is file 26 576ot.
The light's not real good here either.
>> Good morning, Mr. Me.
>> Good morning.
>> Let's take a look at your case. This is an ordinance matter. Charge under three ordinance.
Well, I don't think you're in my queue.
So, give me not only did they call you Tiffany, uh, I don't seem to see your case here.
I'm not crazy. It's not here. Give me a minute.
Oh boy, I can't find it. Let me try it by case number 26 dash.
You got a ticket in Three Rivers on March 30th for driving without a valid license ever applied.
>> It's a misdemeanor. It's punishable by up to 90 days in jail and a fine of up to $500.
According to driving record, your license is expired. You have a real ID.
You don't have anything. You don't have a speeding ticket. You don't have any.
Um, the date of this ticket was April 30th.
Yes, sir.
And I don't know what date your license expired, but you have zero points. Mr. Tim George, the Three River City Attorney, is here. Uh, this is an odd one. Uh, did you have a license at one time or at least a temporary permit?
>> I had a temporary permit before >> and the temporary permit expired and you never got the actual license >> and then before I came here, I got it renewed again.
>> All right. So, you have your license now?
>> No, I got the >> temporary permit.
>> Yeah, I was ready to go take the driver's test.
>> I see you had somebody bring you here today.
>> My father.
>> Very good. Mr. George, you have any thought on this? You >> know, based on that, your honor, we'd be willing to do the reduction to the 326.
>> All right.
M A first J O H. Okay. So just M H Let me find the one. signed up slash Mr. George is the city attorney for Three Rivers, at least one of them. And this is charged under Three River City Ordinance. So, he's agreed to amend this charge to a charge of allowing another to violate the motor vehicle code. That one doesn't carry any points. Doesn't go on your driving record. Won't affect your ability to get your license.
>> You understand?
>> Yes, sir.
>> If this charge hit your driving record, it would prohibit you from getting your license for about 180 days. This charge, it is a minor misdemeanor, but it won't go on your driving record. And if you pass your driver test, you'll be a lawful driver.
Okay. Your honor, >> are you willing to plead to that charge?
>> Yes, sir.
>> So, where were you going on that day, March 30th?
>> I was on my way to Paul's Pantry within within a block of my house.
>> You should have just walked.
>> Yes, your honor.
>> Um, all right. Whose car were you driving?
>> All right. Well, she can get in trouble for letting you drive a car, but that isn't going to happen here. But you've done what what we wanted you to do. You went and got it renewed. You got your temporary permit. You're going to take your driver test. You're going to be good.
Um All right. Uh the fine is Well, let me ask you a couple things. Anybody promise you anything to get you to plead to this?
>> Did any other than this plea offer?
>> Anybody promise you anything other than they would reduce the charge to this other charge?
>> No, sir.
>> Anyone threatened? No, sir.
>> Uh, did anyone give you a copy of an advice of rights this morning?
>> Yes, your honor.
>> You understand you're giving those rights up by entering this, please?
>> Yes, honor.
>> Very good. All right. Now, Mr. George is a man of faith and he believes you're going to pass your driver test. So, rather than make you come back here all over again, I'm just gonna do this deal right now.
So, that's a good thing for you. Are you working somewhere?
>> Yes, your honor.
>> Why is that?
>> Where is that guy?
>> Yeah.
>> Come in, Michigan. Uh, Trump packing.
>> All right. Yeah, you need to get your license. All right. So, well, the fine here is $100. There's a $75 crime victim's rights fee and a $50 state minimum fee. That $125 goes on everything because the state thinks that everybody is rich.
Uh, that goes to help fund the court.
Some other things. All right. Can you pay that today or need time to pay it?
>> I should be able to pay that today, your honor.
>> All right.
Well, you can go right out to the court office there and pay it. They'll give you some information. You can pay with credit card, green cash.
>> Yes, your honor.
>> Or cryptocurrency.
We don't take cryptocurrency anyway. you pass your driver test and you'll be good. This won't jam you up, but you do have to pay this $225 fine.
Just like everything else, the cost has gone up.
Uh, but you're good to go.
>> Thank you, honor.
>> Sorry, we didn't have your file in there. Did you have that one, Tim?
>> I'm sorry.
>> Did you have that in your queue?
>> That case, >> what was the last name?
>> His name was >> me. Me.
>> Jonathan me. For some reason, he wasn't in my queue, but uh we took care of him. All right, next up is Michelle Scarberry.
Well, she signed in.
All right, how about uh Sylvia Wararez Stinton? I think she called and asked for in German. Billy Kelly.
As you know, there are several guys named Billy Kelly, but you'll you're Billy Darren Kelly.
>> He needs to be printed also.
>> Sounds like it's >> all right. Very good.
This file number is 26169 SM.
All right, let's see if I can find your case.
There's about 80 cases in here this morning, but you're here, Mr. Kelly. They charge you with a retail fraud second degree. They alleged that on February 1st of 2026, you were at the Walmart store and you took some property that was worth more than 200 but less than a thousand.
alleged that you took multiple.
You brought in your own reusable bags.
Allegedly, they knew you from previously. They allege it was $313.30 57 items.
They requested a felony retail fraud first degree, but authorized only uh misdemeanor charges. They indicated Connie Burgerer was driving the car. I don't know if she got charged or not.
>> Uh Mr. Stickley, you think we should get counsel here?
>> I do. Uh it would be appropriate here. Your honor, >> that's annoying. Can you turn that off?
Vivian, I'm going to mute your microphone for a minute. We're getting some feedback from your >> All right, I think that's better.
>> Are you still at Ninth Street?
>> Yes.
June 5th at 8:30 appoint an attorney. You're barred from Walmart for the time being.
They have a video of this. So, when you get with your attorney, you may want to request the video, see what that shows, and um see what we're going to do. All right.
You go with the court officer, and he will take you out to get counsel now. Is Michelle Scarberry back? She did check in or at least get her name written down. What's your name, sir?
>> My name is Chad. Anybody here for freelance with attorney strong?
>> Good morning.
>> I just received >> That's what I understand. There's a there's a new protocol uh that I just learned of yesterday and we'll do the best we can. You're always on top of your cases. So, we're going to be >> to everybody had contact with >> All right. Thank you.
All right, Vivian, uh, would you come back to us for a moment?
>> Yes.
>> Which case are you here on?
>> Uh, the Guadalupe via That would be Casey Strong.
I'm not sure what her status is. Uh she just checked in. So stick with me. Uh it may be a minute. We're This is the first day of our new utilization of the historic courtroom. Vivian, we got all kinds of bugs we're working out here.
Uh, so stick with me.
>> Um, all right. Let's see who it is and isn't here. Uh, Delicia Nelson, Michelle Scarberry got her name written down. I don't see her.
Angela Scott, uh, Haley Vandere, Larry Voice, Kyle Wellington.
I don't believe all these people aren't no-shows. I think they're lost out there somewhere. Michael Wolf, Delmer Wood. Someone called and said Delmer is in the hospital. has had some significant health problems.
I can't believe all those people didn't show up. Would you see if you can locate Michelle Scarberry?
>> What?
>> What's your name?
>> Angela Scott.
>> Oh, I called your name. Uh >> oh, I'm sorry. I guess I wasn't watching. Angela Scott, would you come back up?
Now, the way they've got it spelled, it's N G A L A. Is that right?
>> Yes.
>> But it says, but it's Angela.
>> All right.
I should know that.
You got a ticket for driving with no valid operator's license and no license plates. We get lots of these. I call it driving while poor. These are under three rivers ordinance. I just lost Mr. George.
Uh driving without a valid license is a misdemeanor. It's punishable by up to 90 days in jail. Fine of up to $100.
carries two points and uh it goes on your driving record.
Uh improper plate. Scott stated she knew it belonged on a Tahoe. She stated she had no license but believe she had a right to travel. Um let's see if I can get Mr. George back here to help me.
Well, did we find Miss Scarberry?
Like I said, we got logistical issues getting people up here. There's one small elevator.
Um, one thing, this courtroom didn't have an elevator when it was in use. The whole time it was in use as a courtroom, there was no elevator. Uh there was a narrow wooden staircase full of stacks of paper from a clerk's office, which would be where the fire would have started if this courthouse would have burned down. That was theoretically a fire escape.
>> All right. Apparently, she is here and she's getting printed.
>> And I lost Mr. George, so I don't know where to go with Miss.
>> He'll be back. But one one brief suggestion, your honor, and I don't maybe we can address this another day.
>> Maybe we can operate with that door closed. Or maybe it's just me, but it's constant like >> All right. Good morning, Daniel. We could try that. I don't But I Every time they open and close it.
>> Oh, I guess. Yeah, >> we'll see what that's going to do.
So, well, let's try it.
>> Much better.
>> Much better.
>> That is an improvement. We'll see what happens every time they clang it in and out.
>> Okay.
>> It's way quieter in here.
>> Yeah, much better.
>> Uh, it's way quieter >> and and the morning's just going to get more busy. Um, Miss Scott, you live in Marcellis?
>> Yes, >> let's take a look at your driving record.
You don't have any points.
You have $1,071 of unpaid fines. No valid ops. No valid ops. No proof of insurance. No proof of insurance.
Back to 2021.
So, you could go to jail for this because you keep driving and you don't pay the fines. And there is no there's a right to travel. There certainly is, but there isn't a right to drive.
Um, >> can I do a payment today? Your honor, >> what's that?
>> Can I do a car payment today, honor?
Well, I could wipe these out with a jail sentence if you'd like. You could just do like 10 days and I could wipe out all your fines.
>> No, I have a whole family. I can't just >> Yeah, I bet. Uh, but yeah, you keep getting tickets and not paying them, then you keep driving. I call it driving while poor. Um, which isn't meant to be an insult, but people don't have enough money.
No insurance, no plates often go hand in hand. But you've been driving without a valid license for >> I've never had one.
>> You never had one and you >> I was supposed to be going this week to get one.
>> All right. So, you planned to go get a license?
>> Yes.
>> All right. Well, let's try that.
>> Maybe we could set up for a pre-trial after uh after our drop dead Mayday.
Where do you work? Do you work someplace?
>> Um, I'm self-employed. We do wood during the winter and then we just stock up on the summer. They just sell it throughout the year.
>> Well, there's plenty of wood that's been fallen.
Um, this is Angela Scott, Mr. George.
She's got an ordinance charge of driving without a valid license and no plates.
She got $1,000 worth of previous unpaid tickets.
Some of it's a booking fee, so she got about $800 worth of unpaid tickets.
um she would like to try to pay on the old tickets and she says she has an appointment. Tell me about your appointment with the SOS. Have you actually made an appointment?
>> Yes, it's for I'm pretty sure it's for this coming Wednesday at the um the bureau over there in the WJack.
>> All right.
In the old days, they wouldn't give you a license if you had unpaid tickets.
They called it fail to comply with judgment and they would suspend your license for unpaid tickets.
They don't do that anymore. But you have some old Cass County tickets that might be jamming you up also.
>> I agree. If you haven't got if you got unpaid tickets, they shouldn't give you a driver's license.
>> I think I paid the ones in Cop, >> but they changed the law. So, it would be great if you could come in here and show that you have a valid license and valid plates. So, I'm going to continue this for a pre-trial.
I don't have a calendar here. This bench hasn't really been set up good for me yet.
So, let's see what we got.
I'm going to set this for a pre-trial when I don't have uh prelims and pre-exams. I'm going to set it for May 26.
the ocean.
Like I said, this isn't ideal, but we'll work on it.
>> Did you end up cutting a lot of wood after the tornadoes?
>> Yes, we did, actually. I was surprised.
And there's still so much wood on the sides of the road. It's crazy.
>> Yeah. All you can do is just pull up and throw it in your truck. Yes. And >> they'd be happy to get rid of it. This will be a Tuesday, May 26th, 2026 at 8:30.
Courtroom C pre-trial conference.
Mr. George will be here to bring license and plate info.
You're on the driving suspended merrygo round. It's hard to get off of it. So, I want you to go to the SOS. Do what you need to do. Even if you only get your temporary permit, bring that also.
>> All right, you're good to go.
>> Thank you, your honor.
>> Oh, let me give you this.
I'm not worried about the booking fee on here.
I am worried about all the previous tickets for driving on a license. You take that out to the counter and show it to the ladies and you can set up a payment plan.
>> Morning, Mr. Gabriel. How's it going back there?
teaching.
>> We're doing We're doing the best we can.
All right. Did we ever find uh our missing Miss Scarberry?
>> Yes, she was getting >> Good morning. What case have you got today?
>> I was just introducing myself. Okay.
>> Oh, good morning. Good morning to you.
Welcome to our first day in this old courtroom.
>> Yes.
>> This old courthouse.
Boy, my throat on the floor.
So, we did find Miss Garberry or we didn't. All right, Miss Garberry, would you come forward?
I do think we have a lot of no shows.
There we are.
Are you Michelle Lynn Scarberry?
>> Yes. You got arrested for operating while intoxicated at Chicago Road and Lincoln Street in White Pigeon.
Uh, this was written under state statute White Pigeon ordinance.
Um, and it is a misdemeanor punishable by up to 93 days in jail and a fine of up to $500.
uh carry six points on your driver's license and requires that your license be suspended.
It looks like your driving record is completely clear. I can't tell anything from the ticket other than it was at 0.156 >> which is about two times the legal limit.
Does anybody Uh, Mr. Stick, they recommending that we get a courtappoint council for you.
Yeah, she she would approve for a court appointed attorney.
>> A plea of not guilty appoint an attorney.
I'm going to set this for May 1st. This is a white pigeon. No, it's a county case, but I'm going to set this for May one.
should be able to fit in a couple more.
>> Miss Garber, you still live on US 12?
>> Yes.
>> What's your occupation?
>> Uh, I work in sales at North.
>> Okay. Well, I want you, you've got a valid license. Um, you don't have any points. Uh, this is a kind of case the prosecutor is likely to reduce to impaired driving. And when you get uh your courtapp appointed attorney, you can discuss that with them. But I'm going to have uh bail take you out to court office and uh I'll see you on May 1st.
>> Okay. Thank you.
>> Now Tim, you did have a pre-trial that you conducted. I got so much stuff here and not enough counter space. Alexandra Wickham.
Is Pablo Pena here?
He's set for sentencing today. It doesn't appear he showed up.
Good morning. Are you Alexander Lynn Wickham?
>> Yes, sir.
>> Miss Wickham, you got charged with violation of an instructional permit and no proof of insurance.
We adjourned this uh for a pre-trial today and Mr. George has met with you and he's agreed to dismiss both of those charges if you plead to the charge of allowing another to violate the motor vehicle code. That's the one that carries no points, doesn't get abstracted to your license, won't affect your ability to keep or maintain your license. Do you understand?
>> Other than that plea agreement, did anyone promise you anything to get you to plead to this or threaten you?
>> Now, this ticket says this happened on um February 23rd. Were you driving a car that day without another licensed driver in the car with you?
>> I was on my way to work.
>> But you have your license now.
>> No, I have to go get my license. I can go take my driver's test later today at 11.
>> That's acceptable to you, Mr. George.
>> And she did bring proof insurance and registration.
>> Very good.
>> And I do have a new tag and a new license plate on my car as well.
All right. Anybody threaten you to get you to plead to this?
>> No.
>> Or promise you anything? I'm giving up all the advice of rights on the advice of rights sheet. It's a $100 fine, $125 of state cost, which is a $75 crime victim's rights being a $50 state minimum fee.
So, the total is 225.
Can you pay that today or did you >> All right. Very good.
All right. This will keep you off the driving suspended marital round and uh that would be a good thing. The bail will take you out to the court office.
The ladies give you instructions how to pay either with green cash or you can use a credit card and uh you're good to go.
All right. Well, let's take a minute and clean this docket up and uh see who else has shown up. We are in some bit of a chaotic situation.
All right, Delicia Nelson is not here.
She has an unpaid speeding ticket. Also, We'll do an order of show call in that case first.
26 631 >> trying to show cause first.
It's Uh, Sylvia Wararez Stinton called yesterday and I believe they rescheduled the matter.
Uh Haley Verheisle Vander Reel driving suspended from Ever, Michigan, which is the hometown of Janette Jackson and Bill Johnson.
They also made a movie about some people that figured out the Michigan lottery system. remember >> and made millions of dollars.
There's also a bottling plant. Anyway, she's not here.
We will do a order to show cost first. A long way from Ever to here.
San Oyola County.
Larry voice.
Um, I'm not sure all these people are here.
Um, Larry Boyce is from Midland driving suspended.
He is not here. There's ordinance. We'll do a show cause on him rather than a bench warrant at this time.
Keith, I have a bench warrant that uh was given to me first thing this morning.
on uh Carrie Green failed to appear for a pre-trial. It's Jordan Harden's case and uh I thought Jordan was going to be here this morning, but I don't see her.
Would you be available if we tried to do that bench arrangement here this morning?
>> Yeah, if we could if we could do that now. I've got a call. I got to get on 10, but that'd be great.
I've got the uh >> uh let's see we went through 73.
>> They could you print a waiver uh in this case? Does that >> I try We're working the bugs out. In addition, Mr. Gabri, the chief assistant, is picking up for Josh Roar, who had done these pre-exams for many, many years.
And Gary's here uh working on this, too.
Their office is also in disarray. He's apparently sharing space.
>> Uh Tim, you don't have anything else to be here for. Let's see. Kyle Wellington, Michael Wolf, Delmer Wood. As I indicated, somebody called said Delmer was in the hospital.
Would you call the hall for Kyle Wellington and Michael Wolf?
28 election.
>> Somebody was asking for signatures this morning. Mr. >> Hi, Sergeant Herman. Could I see Carrie Green, please? This is Judge Middleton.
>> Tim's been car Green.
>> All right. Thanks. Bye.
>> No response. No, >> that's not the Carrie Le Carrie Green that was in Lucas, which was one of my favorite 80s movies.
Nobody remembers the body of Tim. Someday all this will be yours.
Uh Kyle Wellington is not here and we'll do an order to show cause and uh Mr. Michael Wolf is not here. He also had some health problems. I'm not sure what his deal is, but thank you.
>> Yes.
I have the items for next week. You want me to leave them with Laura? I picked them up.
>> The what?
>> The for the Liberty Belt. I picked those up. You want me to leave them with Laura before I go?
>> Yeah, the invoice.
>> I have everything. That's all.
>> Oh, very good. Yeah. Thanks.
>> No problem.
>> I'm going to do the press release probably tomorrow.
>> Okay.
>> Thanks for your help.
It is a nuisance when people don't show up when they're supposed to because everything we're doing right now is redundant and waste of inefficient.
Michael Wolf.
>> His house was right in the middle of hurricane or tornado damage central.
He is charged with trespass. I think he's quasi homeless.
Okay.
>> Yep.
Yep. I'm not Well, generally it goes to Diana first and then it comes back to us. Dave was a real stickler for that.
He was afraid we wouldn't get him back.
So, give it to Diana. will come back to us.
You keep No, we're good to go here.
Well, let's make sure Mr. Aken doesn't owe the court anything.
He's good to go.
All right, I'll give you guys.
Anyway, let me complete Michael Wolf failed to appear for arraignment.
Try order to show cause first.
Then Delmer Wood, as I indicated, uh, someone called and said he's in the hospital, which is plausible.
Let's see if Carrie Green is here.
Ross, have you got something for me?
I've got one pre-exam I'm going to ask to be reset for next week, which is my normal week.
>> All right. Is that person here?
>> Yes.
>> All right.
Is that all you got this morning?
>> Yes.
>> All right.
Vivian, >> I got to fix this chair like a [ __ ] Not sure if that's politically correct.
That was a very short person.
How you doing?
>> Good. Hey, how are you?
>> How you doing?
>> Good. Appreciate.
>> Just have a seat.
>> I'm doing everything.
>> Yeah. Well, >> that's all right. You got appreciate you.
>> Good.
>> Uh, all right. Why don't you come forward?
>> Come on, Mr. >> Miss Green. I'll be with you in just a moment.
>> Good morning, Y.
>> Good morning, sir. Let me get this file.
This is file number 26 505 FY people versus Anthony Dwayne Grant. Mr. Grant is charged with witness bribery, intimidation, or interference and two counts of resisting obstructing a police officer. It's here with his lawyer, Mr. Ross Truckucky. Also present in the middle of everything else he's doing is chief assistant Gary Gabri. Um, that is correct, isn't it?
>> That is the charge that was filed by the prosecutor, your honor.
>> No, but you're back as chief assistant.
>> Oh, yeah. I'm sorry.
>> Okay.
at least for today.
>> Not just for today, but uh Chief Assistant Prose Gary Gamry, I held that position once before. You held it a couple times before, a few different places, a couple different places.
Anyway, I've known Mr. Grant for many years. He's here with his lawyer, Mr. Ross Truckucky. Uh Mr. Grant was here at his arraignment. Mr. Truckucky is asking this matter be adjourned one week for pre-exam.
That's right, your honor.
>> All right. Any objection to that?
>> No, your honor. I think that's appropriate given Mr. Chucky's involvement with the circuit court.
>> That would also shift this to um Judge Patterson, which is all right with me.
All right.
adjourn one week.
PEC will be calendar up here. Uh a May April 28th my birthday.
>> All right.
I've got a guess.
>> 70. Your 70th birthday.
>> The 28th. I be >> Oh, okay. All right. It' be 28 on the 28th 28th. That's I'll take it out.
>> April 28th, 2022 668:30 and the prelim if needed would be then May 5th.
>> Mr. Trucky's been involved all of last week up until yesterday at a felony trial and three of us with a visiting judge and uh I think it's appropriate that they have more time to review this.
Um so it's ajourned one week. Stay in contact with your lawyer and uh Judge Patterson will see you next Tuesday probably right in this very room.
>> Your honor, I would like to note uh Mr. Grants indicated that had his initial hearing. There was criminal history read out that belongs to a different grant.
So, I just want to make sure the courts got that on their radar.
>> I we I think we discussed that. As I said, I've known Mr. Grant for a long time. Um All right. Uh you're good to go.
>> Thank you.
>> Thank you, >> All right. Let's take care of Miss Green. Give me a minute here.
Uh, this was given to me first thing this morning >> by one of the clerks.
>> Yes.
I don't know the answer to that. I do know I have Vivian in the waiting room for All right.
Um, well, we're going to uh at some point need you and he and Vivian to talk.
>> All right.
>> Okay.
>> All right.
Fine. All right, Vivian, I don't know if you heard that. We are going to uh need your services here in a moment.
All right, Miss Carlin Green has been waiting patiently there.
Uh, Miss Green, can you see me?
>> Yeah.
>> Can you hear me?
>> Yes.
>> All right, we can see and hear you. Um, we've got Mr. Keith Stickley, the chief public defender, is here. Also, your lawyer, Jordan Harden, is not here.
Uh, so that's why Mr. Stickley is here. Let me get up your case. See if Shane put this in the queue for me.
Are you also known as Carrie Angelmeer?
>> Yes.
>> Which do you prefer?
>> Um, I would prefer my maiden name, but I'm not sure the divorce.
What's your legal name?
>> I think my legal name is under.
All right.
This was originally charged as a felony.
Uh larseny over 200. Well, was charged as lars in a building and larseny over 200 less than a thousand. It says you failed to appear for an attorney pre-trial.
>> Um, I think I was there and I talked to Jordan, but she had like gone to the prosecutor and we were going back and forth on a couple things and then I thought I was waiting for a um waiting for her to contact for the next court date.
because of the the back and forth with the prosecutor.
>> Judge notes. Let's see what I wrote.
Defendant did appear for preconference.
She left before there was any record.
Attempted to call your numbers. Um the problem is this is a felony.
It's not set for an attorney pre-trial.
It should be set for a pre-exam conference.
>> Um, >> I don't know the difference. I just knew I was waiting for another court.
I'm waiting for another court date to be scheduled.
>> Well, anyway, you were here and then you just left and uh I tried calling you.
She tried calling you. She tried calling you since >> my uh my phone came up missing out of my stepdad's car.
>> How did you get arrested last night?
>> Um uh Kilbornne saw me walking.
>> Kilborn saw me walking.
>> Do you still live in Three Rivers?
>> Uh yes, I'm always Yeah, I'm always in Three Rivers. Yeah. on Fourth Street.
>> Um, no, that's just legal address.
>> That's on my ID.
>> Where do you actually stay?
>> Nowhere technically. Um, I keep my possessions uh with my stepdad at his hotel room >> at the Fourth Street address. No, my stepdad stays at a hotel in Three Rivers and I keep like all my stuff there. So, I'm go there, I get my stuff or I leave and just wander around.
>> What's his name?
>> Ivan Erson.
>> What's that again?
>> Ivan Erinson.
>> Okay.
>> Well, you walked out. You never contacted your lawyer. I haven't seen you since. I tried to call you multiple times.
>> Uh yeah, I guess I misunderstood the the proceedings that day cuz we were going back and forth and uh >> well that then it doesn't work. You just leave and never come back.
>> I didn't know I thought that was a >> plan.
I I thought that we made uh progress that day and the notice is waiting for paper in the mail for the next court date because it was changed from the original one because of the choices that we made that day.
>> Well, this I'm trying to decide whether to leave you in jail to make sure you show up for the next hearing or to let you out on the representation that you show up. So far, it's not very good.
Don't have an address. Uh, you're living on the street. Uh, I don't know how to get a hold of you. None of your phone numbers work. You didn't show up.
>> No, I have the number for my stepdad's number. Like I said, I'm there every day.
>> All right. According to Jordan, this matter was amended to a misdemeanor and you missed your pre-trial.
Um, maybe they'll amend it back up.
I thought we had to do a different court date because we changed because we were going to do uh we weren't going to do the circuit court because of the >> it's a district court case, but you still didn't show up. Thank you, Jordan.
All right. Uh >> I'm going to set an attorney pre-trial for May 1 at 8:30.
The question is whether I leave you in jail for the next 10 days or let you out on the representation that you will show up. You needed to do two things. You need to call your lawyer and you need to show up here at the courthouse on May 1st. You understand?
>> Yes. I cannot forget that date. So that's a that's a very easy to remember day.
>> I'm going to reset the bond at $1,000 PR.
I'm going to do Find you're in contempt for failing to appear for an attorney pre-trial.
One day jail credit. one day.
Your lawyer's monitoring this proceeding by Zoom.
>> Okay.
>> I want you to call her and discuss this with her. It was charged as a felony.
They reduced it to a misdemeanor and you repaid the favor by not showing up or being available if anyone was trying to find you.
So May 1st at 8:30, I want you to call your lawyer. If you don't show up, I'll do a bench warrant and set the bond at about $10 million.
This is not the crime of the century, but it was a felony reduced to a misdemeanor and I expect you to appear on May 1st.
>> You understand?
>> Yes, I do.
>> All right. I'll give you a PR bond.
>> All right.
>> Thank you, Mr. Stickley.
Now, uh, I'll remove her.
Don't want anybody to go anywhere yet.
Shane sent me another email. See what else I got.
All right. I believe that finishes our misdemeanor uh arraignments and pre-trials. I'm going to stop the record. We're going to take a recess. We're going to come back.
Um do you need an opportunity to confer with the assistance of Vivian?
>> No, you're not.
>> All right.
All right. We're going to take a minute while I take out all the misdemeanor files.
First of all, I also got a guy that was supposed to show up for sentencing.
Pablo Pñena. Is he here?
He was adjourned for this matter. Did we shut the record off?
>> Yes.
It is 9:30. Defendant failed to appear.
This is Pablo Da Vinci Pñena.
He was charged with a multiple offenses.
He had a no valid operator's license that was reduced to allowing another to violate the motor vehicle codes. He has hundreds of dollars of unpaid tickets.
And so I adjourned the matter to see whether he paid anything on his unpaid tickets.
And the clerk checked that this morning and doesn't appear that he did and he failed to appear here this morning. Mr. Pñena, I'm disappointed.
This is 26 268.
Senate failed to appear for sentence to bench warrant bond $1,000 cash only 48 hour hold.
See if the bond will reduce him actually to pay his fines. Uh, I'm disappointed.
I adjourned this for him to have an opportunity to pay and then he didn't.
All right, with that, Jordan, thank you for your help this morning.
I'm going to take all the misdemeanor files out. We'll come back and be ready to focus on our felony pre-exam cases.
I'm still a bit of a disarray around here.
