This is Olivia Henderson, a 23-year-old Door Dash driver from upstate New York.
On October 12th, 2025, she was working a late night shift and picked up a Wendy's order. She delivered to a customer's home. Here is Olivia explaining exactly what she says happened.
>> Three days ago, October 12th, 2025, I was a victim of essay by a Door Dash customer while I was doing my job as a Door Dash driver. Excuse me if you've already seen this. This is my third time posting this because Tik Tok keeps silencing me and taking my videos down and giving me strikes. So, on October 12th, 2025, the Door Dash customer requested that their order be left at their front door. And when I arrived at their front door, their front door was wide open. Their lights were on. They were sleeping on the couch within eyesight of the front door with their pants and underwear pulled down to their ankles and they were indeently exposed to me. Um, I got this on video and I'm not even going to be posting the video clip anymore because I'm pretty sure that's what's getting me the strikes.
Um, but yeah, I reported it to Door Dash and Door Dash did ban the customer and then two days later, Door Dash banned me, which doesn't seem unrelated.
>> So, she reported it to police, police investigated, and things just didn't add up.

>> I'm Megan Coleman. Police say 23-year-old Olivia Henderson claimed she was sexually assaulted during the incident, but they say that never happened. Henderson was arrested last week. Investigators tell NBC3 the customer was incapacitated and unconscious after drinking alcohol.
That's when she got to the home last month. They say she shared the video on social media and that's when the man called police.
>> So now we have a couple of discrepancies. Olivia saying that she was sexually assaulted by this person.
>> Hey guys, so Door Dash just deactivated me 2 days after I uh reported my sexual assault. Hey guys, I just lost my job.
But now the guy is saying that he was recorded illegally by Olivia while he was in his own home.
>> They say she shared the video on social media and that's when the man called police.
>> So you have two competing stories and police did their investigations and this is what they came to. Captain Brian Thompson is getting questions about this case from across the nation. This one just took a life of its own because of the social media aspect of it.
>> Before his officers got the call last month from a Door Dash driver claiming she was sexually assaulted by a customer, she put her story on TikTok along with video of the naked man passed out on his couch.
>> Determined that some of the claims that she had made on social media after the fact were not in fact true, such as the sexual assault component of this uh of the allegations. um no sexual assault took place.
>> Instead, police determined her post itself was illegal.
>> Unlawful surveillance is obviously some sort of uh uh video or recording uh without that individual's consent or knowledge.
>> So, for you non- lawyers out there, this is essentially revenge porn. She's filming someone who's unclothed in their house and she's disseminating it on the internet. So, police arrested her and charged with two felonies for filming someone nude and then disseminating it over the internet.
>> 23-year-old Olivia Henderson is charged with two felonies for recording the naked drunk man and posting it for millions to see.
>> Being in in your own residence and having you be recorded like that, especially in this the state that he was in, uh, no consent was given. Uh, no consent was given to have the images taken or disseminated. And you know, realistically, at the end of the day, we're talking about some of these, you know, private areas being put all over the internet.
>> So Olivia is now charged by the police, but she says, "Hold a second. She's the victim.
>> THEY JUST PUNISHED ME FOR POSTING ABOUT MY SEXUAL ASSAULT WHILE DOOR DASHING.
THEY JUST FIRED ME." AND THE POLICE ARE DOING NOTHING. I LOST MY JOB. IN THE POOL. THAT WAS MY ONLY WAY TO MAKE MONEY TO PAY MY BILLS. I'M THE VICTIM.

>> BUT THE AUTHORITIES SAID, "NO, you're not the victim. You're the criminal."
>> To the courtroom in Asiggo County now where a Door Dash driver accused of filming a naked customer in a video that went viral set to appear in court again tomorrow morning. 23-year-old Olivia Henderson charged with disseminating unlawful surveillance. The incident in question happened in October while Henderson was making a delivery in January. The court deciding that her trial will go to the grand jury.
>> So, as you see, the grand jury came back with two felony counts, one for an unlawful surveillance and the second for disseminating surveillance information.
So, police criminally charged Henderson with two counts related to unlawful surveillance. Court documents accuse her of recording quote intimate parts without consent when he had a reasonable expectation of privacy. Now, Tik Tok girl is not going to do decades in jail.
She's facing something like 8 years, but she's a first-time offender. This is a nonviolent felony. So, I'm assuming probation would be key. She has not taken any deal and she's going to trial because again, she believes she's the victim.
