An Insight Into Sana Yousaf’s Case Hearings | TCM Up-Close with Advocate Sardar QadeerAdded:
Umar Haya went to G-11 on June 2, took a car from the showroom in Markaz, went to the round board at 3:00 in the drivers on rent, from there he parked the car a little distance away on the side of G-3 street, from there he went on foot, the door was open from there he went up to their floor, as soon as he came he shot him two bullets, the culprit is Umar, he had made preparations that after shooting I will take his mobile so that the evidence can be destroyed and he took his mobile and went away but Sana had two mobiles, he ran there in the car and was scared, terrified, was trembling, the driver saw that there is a railway bridge inside G-31, he formed a team of Islamabad police there, then Jadwala left from here at night, when we reached there, he was there in the street itself, the iPhone was recovered with him, Sana was conducted on 13th in Addala jail, both the witnesses had identified him as soon as they saw him on the spot. On 23rd, he confessed his crime in front of the magistrate, the confession is in the state that I used to like her, I came on 29th also, she did not meet me and after that I told him that I came again on 2nd to meet her, I did not meet her with the same intention that if she does not meet me this time, I will kill her.
If the accused had any one-sided obsession, then Sana had no idea about it, if you look at her Insta account, it is written there that if you DM for paid promotion, then she keeps giving her home address, similarly, basically, she got access to WhatsApp here and she never met him in her life, till date you had not seen any photo of Yusuf or this accused, Umar also planned while sitting inside the jail so that Sana Yusuf's family could be implicated in some other case.
He has arranged a call and in one of it he made it seem as if he was talking from Afghanistan.
I am a man of Gul Bahadur Group Taliban. A 22-year-old kid is wondering in the morning after going to jail how to get out.
This means he was brought up with a criminal mindset.
In June 2025, Sana Yusuf, who was a social media influencer, was murdered in Zee3. So, if you tell us about that day, what happened that day, the account means that because you were in her legal team, you must have done the entire case study, you must have seen the evidence, what each thing was like, if you look at it, the confessional statement and because there is WhatsApp chat also. He came on 29th May before 2nd June and on 29th May he tried very hard to meet Sana. She was not found. Actually she used to work on Ina and now let me tell you that she joined TikTok a month ago. People had created fake accounts of him.
He was getting promoted by uploading Instagram videos. So to counter them, he created an account on TikTok. If you look at her Insta account, it is written there that you can DM for paid promotion or collaboration, so the brand used to do it there, obviously for the clothes or whatever she wanted to shoot, she had to give the address of where it was sent, she used to give the address of her home only, she did not have her own office address, so that address used to go, similarly this person also, basically whatever reached her on WhatsApp, similarly he goes away, then he sends a very angry message to her on WhatsApp and I have never met her in my life. Till date you have not seen any photo of Sana Yusuf or this accused.
Ok? And when the second one comes, she again said that yes, if you come again then I will meet you. Your WhatsApp chat along with its attached exhibit is part of the case. Then it comes to two. When he came, he replied once or twice. He has tried to make her see him as a fan and now if he had any one-sided obsession then Sana was not aware of it that she is not seeing anything like that in the chat that is visible to her. So maybe he had created something like this in his mind.
So here he comes to Islamabad and writes that when he had come for the first time, he had not gone back, so he had said that next when he did not reply to that message, he asked that then after that he again said that you called me because you sent an angry message, after that his repeated calls are there, all of that is part of the record, he kept calling again and again, he did not attend the calls, okay, at 2 o'clock, that means his calls kept coming till 4:00, this whole criminal mind of this boy, this criminal, he has done this through him and from there he got the brand address, the exact brand address, through that the courier used to come, through that he reached there on 29th, let me tell you, he had brought a car from Faisalabad, he had brought a big car and when he was arrested, it was found that he had not even paid the rent to that showroom owner, when he came on 2nd June, he came on 29th May, then when he came on 2nd June and he tried to meet Sana Yusuf But he could not be found apparently, then what does that mean, he came on 2nd June, he came on bus number 26, after that he went to Markaz, he went to the showroom there and from the showroom he took the car on rent along with the driver, at around 3:00 pm he went from there to G3 roundabout and the same street because he had already done the round before, that means you can consider it as completed. First I parked the car a little distance away on the side of the street.
From there he went on foot. Two families are living there. There is a different family below.
He was living upstairs. So the firm is not locked all the time. It is a normal routine. The door was open from there. From there, there is only a small house on their floor above. So as you climb the stairs there, you come across two doors. One comes for his TV lunch and one comes for his guests etc. So as soon as you open the door of TV lunch and climb the stairs, you can see the bed in front of TV 11 where Sana was lying.
Absolutely. Her mother was present at the TV launch as the house had two rooms. Two rooms and a TV are small. So I went from there but the door ahead was half open.
He opened the door in such a way that as soon as he came in he shot him. Two bullets were very close to him. He had an aunt and a mother.
He said that as soon as I went inside, I heard the sound of two shots being fired. And because he had already made up his mind in my opinion because he had come twice and there was some anger in his mind. I didn't spend time there, I spent it at this place. Meaning, he came, shot and ran away, he had already made some preparations.
How was the preparation? His intention was that after shooting, I would pick up his mobile so that the evidence could be destroyed and I picked up his mobile and went away. But Sana had two mobile phones. There was a mobile phone, an iPhone for social media, which he took away and which was later recovered from him when he was arrested. The second day in Faisla Jwala, there was another mobile which was for communication, that was the second one. Android was the second mobile phone which had words in it, all those things are still there.
So if Sana is shot, does that mean she dies there itself or is she taken to the hospital?
Look at the two bullets that hit his chest, there was a vital injury above the heart due to which he died. So she fell right there.
The way we study medicine, the time of death is two to three minutes. So of course it must have happened there only.
Phuppi and Valada went towards Sana. They saw that she was lying there covered in blood, they came and shouted outside, people in the street came in the meantime, then they put her in the car which was on their floor downstairs, then they took her to KRL Hospital, it means it took 15 to 20-25 minutes, there was a doctor on staff in KR Hospital, he examined her and said that she is dead, okay, they did not waste time, because this is a police matter, then from there KRL people gave her an ambulance, after putting her in the ambulance they took her to PIMS, then the post mortem was done in PIMS at 9:00 pm, after that when the culprit who has committed murder, when he commits murder, then he goes immediately, how does he go, as if he was shot, that culprit picked up the mobile along with the pistol and ran away, he had parked the car far away, he ran there in the car and was scared, terrified, he was trembling, the driver saw him because even when he was in G1, he was sitting in that car, he was sitting in the back seat, not in the front. When I was sitting, he asked what happened, you seem very worried and scared, he said come on, come on, you leave, I want to go, you are from number 26 Atar. Ok.
Then it went inside G31 there is a railway bridge there. He got it kept there.
Later the pistol was recovered from under the same bridge.
Actually, he had hidden his pistol there.
After that he said that he would come to number 26 and then from there he left by bus.
Islamabad Police takes action and the next day they announce that they have arrested the accused who has now become a criminal.
So how does Islamabad Police establish that the culprit is a resident of Islamabad? The police had reached the spot where the dead body was taken and the first IO, Sana Yusuf's mother had given him a request, the evidence in the return was later converted into an FIR, after that at night the police again went to the well with the eyewitness Guhan and the expert from the forensic laboratory was called.
Collected all the things from there. There he had taken Sara's second mobile phone, the same iPhone, which he thought he would destroy during communication. All the evidence that was there was his social media mobile in which he had his Instagram and TikTok accounts, those accounts are not active till date because they are with the police. He took it away. But the other mobile phone with which I used to communicate, make WhatsApp calls and send messages on WhatsApp was left there. The police had found that case and apart from this, fingerprints and all the things were also found.
When that mobile was opened, the communication inside it was seen as to whose calls were coming.
How did the message go? The police observed a lot of people there.
His communication, his chats etc., this guy was found suspicious. There is a whole department of Islamabad Police which gives you the location. When checked from there, it was found that his location was Islamabad on 29th and he kept roaming in the same area. After that, when it was searched on the same day, its location was found to be in Islamabad. Then coming and then going and then when WhatsApp was matched with it then it was done.
After declaring him a suspect, his location etc. was determined. A team of Islamabad police was formed which then left from here to Jadwala, after about 2 o'clock in the night, they took along the police of Sadar police station inside Jadwala and his address etc. had been found out earlier because all the things were found from his mobile number, so when they reached the place, he was there in the street itself, the mobile which was taken away from him for which Kale has also been sentenced to 10 years, that iPhone has been recovered and when he was investigated further, he said this thing, yes sir this happened to me. Then he was brought to Islamabad on the same day and on the same day, as soon as he arrived, the pistol which he had hidden under the G31 railway bridge was recovered.
He was wearing the same clothes which you and all of us saw, which came in the evidence, which the witnesses told that it was his black shirt and blue pant trouser type.
Produced before another magistrate. Then he was given judicial responsibility. The purpose of judicial remand, not remand, is to investigate whether there is any other associate with him. Some recoveries have to be made from this.
In friend, when the name of the accused is not mentioned, it is not clearly nominated that so and so did it, then what happens is that his identity is ready. His physical remand would not have happened earlier. Then when you present it before the magistrate within 24 hours, the magistrate judicialises it. Then what happens is that the magistrate who goes inside the jail or whatever jail it is, gets the conduct of the case done in a decent manner. Eye witnesses are also summoned and dummies are made to stand there.
These Holi clothes were worn like this. This was a physical feature. People of the same type, of the same height, of the same style, who are prisoners, are made to stand in a line inside the jail and then the witness who has said that I have seen him, I can identify him, then the magistrate says to him, sir, you tell your accused which one is this, on 13th, the arson parade was conducted in Hadla jail, both the witnesses had identified him as they saw him, the arson parade is conducted inside Hadla jail and his mother and daughter confirm that this was the person who committed the murder, this is the name of Yusuf. After that the proceedings of the case have to begin.
So if you could just explain how it starts and how it's unfolding.
He was produced again on the 17th and then his remand was taken from this magistrate and during that remand, he used his own mobile phone through which he made calls and sent messages on WhatsApp, that was the communication.
He had got that mobile recovered. On 22nd, the police once again took her to the jail and from there she got her mobile recovered. On 23rd, she confessed before the magistrate that she had committed the crime. The confession is in the state. I used to like her. I had come on 29th also but she did not meet me.
I had brought flowers, I don't know what other things she had brought, so I took the car, all those things are present inside her and after that she told me to come again on 2nd to meet her and after that I could not find her, so I was very sad. Then I will come with the intention that if I don't get her this time, I will kill her. Then his signature and thumb impression were taken on all the pages of that statement. He confesses that he has committed this crime and what happens after that, the trial goes on for about eight months in the court, what kind of proceedings was that in the first session court, a long procedure starts, the police completes the preparation of the challan, then all the investigation that is done in the case, gymnastics is done during the investigation, all the witnesses who have recorded their statements, for example, there are 31 witnesses in it, the IO prepares a final report of 173 in the light of all the evidence that is collected, in which he tells that through this, it has come to light whether the accused is guilty or not. If yes, then he forwards the challan to the court if the police investigation proves that he has committed the crime.
Therefore, the court should try it and decide the case. This challan was being prepared till July. There were holidays in August, so in September it is again submitted to the court and on 20th September a case is registered against it. And this court case initially went to Session Judge Rana Nasir Javed Sahib. He was marked by Afzal Majoka Sahib who tried the case and gave the verdict. There was a court atmosphere. I will brief you. This is a date case. It has been reported all over the world.
During this, it has been established that he has a very clever mind. He is clever. He is criminal minded. He has made plans even while sitting inside the jail. Planning to trap Sana Yusuf's family in some other case. Which he had planned. While sitting in the jail, he kept communicating with one of his brothers-in-law and when he went to the jail, another criminal who was lodged there became his partner, he stayed in the same barrack and stayed with him for eight months, when they got him bail, he was again sent to the court, he came there and when he came to the court, they created a scene there, created a ruckus, it was a pre-planned thing, he said that I have taken a contract from the plaintiff party and I want to murder both of you, that is, his lawyer and instead of proceeding with a criminal case, they gave a request and got a form cut, when they investigated him, when they came to know about it and checked all his data, they came out of the jail and stayed in the same room for eight months and they became friends, but still they did not step back, when the FIR was not registered, then they filed a 22 case, this is that when the police is not registering an FIR, then they go to the Justice of Peace who is a Sessions Judge and say that yes, the FIR is my right.
So if the police is not cutting it then an FIR has been filed in that too, the court has not yet given them the order for FIR and after this they had hatched another plan, they had arranged a call on their own, there was a Pashtun person who did not know proper Urdu, in that he made a call that I am talking from Afghanistan, I am a man of Gul Bahadur Group Taliban, so I have a friend of his, I don't know, he was a fan, he was murdered, this case was closed, on the basis of that what did they do that they filed a petition to NCC, first of all they filed a petition in the court and created a spectacle and they filed petitions against the judge in every upper forum.
We were sitting with the target that we have to complete this very soon and fight it in a very good manner. So we kept bringing evidence and recording the statements of the witnesses. We have almost completed the witnesses. There was pressure on him that he had to do cumin. If these cumin seeds were not doing it. The court understood that he was involved in some other matter.
In the Masubabandi case, the court appointed a council on state expenses on their behalf. He had recorded the statements of only a few witnesses. He went to the High Court.
He had summoned the entire trial court file to the High Court.
When they studied it, they came to know that he submits some request or the other on every date. They create chaos inside the court. They attack the judge. The High Court dismissed their petition and along with it issued a direction for day to day hearing. The lawyer of the accused had the last opportunity that you are given one more chance to appear below, why are you not doing it, then the trial court gave this direction that it does not appear in this case, then a binding order was issued that in any case the trial court will complete the hearing by appointing a counsel on state expenses, the case will be completed by appearing on one witness, after that they started the same work again, they were given around 20 opportunities, then the trial court appointed a counsel on state expenses and handed over the accused to them, when they did that, they appeared on some witnesses, then they went to the High Court regarding that matter and then a request was made in the court for lack of trust, the session court saw the record of the file, they saw that you only create a spectacle on every date, every date, in the court, that petition of the accused was before Nasir Javed Rana Sahib in the session court, they filed a dismissal petition There were 31 witnesses in the case and we were worried about the evidence getting destroyed and this also happens mostly that no witness goes out of the country, this had happened to us a little bit, one witness who was a driver had gone out of the country, this case was concluded in less than 8th March and the verdict was given, a few days before the verdict, it came to light in the media that the accused Umar Hayat has said that he has gone back on his confessional statement, the trial is complete, then why is the accused being questioned again and why is this being asked, what is the procedure for it?
See, when the trial takes place and when the trial evidence is completed and concluded, after that there is a statement of the accused which is called statement 342 CrPC, that statement is the record of the accused, in it it is written that whatever evidence has come, the Honorable Court questions that during the testimony, on 2 June 2025 at 5:00 pm, at Sana Yusuf's house in G31, Sana Yusuf's mother and her aunt were present there, who were eyewitnesses, in their presence you fired two shots at him which hit his chest and due to which he got murdered.
What do you say about this? These are the questions. That's where your fingerprints came from. What do you say about this? And those matches have also taken place.
His biometrics have been verified by Nadra that he belongs to the same accused. The culprit is Umar Hayat.
After this, tell that your mobile number is owned by you and you yourself accept it. This is your number.
Its location that day is Islamabad and you are a resident of Faisla.
What do you say about this? And you know about this, you saw that in that city he had said that I have not come to Islamabad and the number he admits is mine, the location is coming from Islamabad, what do you do about this, then in this, the mobile of Sana Yusuf which was taken away by the accused at that time, at that time it was not known who had taken it, that was recovered from you, when you were arrested in Jawala, it was found from your pocket there and you have also told all the things, so what do you say about this, similarly every single evidence which we produce in the court, it is put in the form of a question. Brother, this testimony has also been made against you.
This testimony has also been made against you. Those were the answers to it. He denied every answer and every accused does the same. If he had accepted it then it would not have been even eligible for appeal. Then if it had gone to the High Court, the High Court would have asked whether the prosecution evidence is good or bad, let it be, you yourself have accepted this.
When the verdict of any case is given, what happens in its next stage, that is, there is a review, there is an appeal, where does it happen, how does the whole process happen, if you tell me, after this they will go to the High Court, even if they do not go to the High Court because every accused has the right to appeal, there is a law department inside the jail, their appeal is automatically heard, for those who do not have anyone, but obviously they will do it and secondly, the death penalty is subject to confirmation of the High Court, okay, and if the appeal is dismissed and does not go further, then the High Court endorses it, then also it will be hung. If you go to the High Court, the High Court gives a decision, then you review that, then you cannot go to the High Court for leave to appeal, if you have known the decision of the High Court, of course, you have gone to the Supreme Court. This is what mostly happens. It is a big forum. There is Apex Court. So we go to the Supreme Court and if the Supreme Court gives its verdict, as seen in the Noor Mukadam case, the death sentence remains intact.
Trial court then Supreme sorry High Court Supreme Court. The Supreme Court has also upheld the death penalty. Now after that he has gone for review. Review before Supreme Court: The same bench which gave the verdict upheld the death penalty. And the review can be done only in front of the judge who gave the decision. Yes, if the judge who is an honourable judge retires or dies, then another judge or another bench is added.
Otherwise the basic concept is that the review takes place in the same bench. What happens with the review is that if the Supreme Court is reviewing, then when the first decision was taken up, there was some evidence which was not considered at all, which the judges could not even notice. Ok?
And there is no discussion of law in it. And if the review is also over then a mercy appeal is made before the President of Pakistan. And if it ends then it goes into execution.
Then the matter comes back down to the session and the session then issues it for execution.
That is the final procedure for the death warrant.
