And this is important which led the officer to believe that the person had committed was committing or was about to commit a criminal offense. Officer Jimenez already said it is a crime because we got a call about a suspicious vehicle. There is no code for that. There's no policy for that.
There's no law for that. You don't lose your rights because somebody initiated a call on you. And you aren't a criminal and can't be suspected of committing a crime because you're sitting in what they determined a suspicious vehicle.

>> Seth attempted to appeal to the supervisor's humanity and gave him an opportunity to do the right thing, but the supervisor just couldn't exercise all that discretion and do the right thing. As you heard, Seth went to jail, not for violating HB 1365, but for resisting arrest. You can't arrest somebody for a secondary offense without a primary charge. And since officer Jimenez, who is the arresting officer, made it clear that this couple wasn't doing anything illegal and that they just got a call for a suspicious vehicle. They have a great 1983 case. If any of you lawyers out there want to take the Lakeland Police Department to court over this clear violation of rights, Seth was taken to jail and the jail staff told Andrea that she needs to bring $1,000 if she wants her husband out of jail. After handing over the money, Seth was still detained in jail for several more hours before setting him free. I requested that they set up a GoFundMe and they did. and they're going to need help because the Lakeland Police Department is sapping them of all their resources just to fight this in court.
