In criminal trials, when the government intercepts confidential attorney-client communications discussing trial strategy and preparation, this constitutes a structural error that violates the Sixth Amendment right to counsel. Such violations are considered so serious that the harm cannot always be measured, and courts have ruled that these constitutional violations can justify a new trial. The defense argues that once prosecutors gain access to confidential defense communications, the playing field is no longer level, as it could influence witness preparation, trial tactics, jury presentation, and the entire balance of the case.

R. Kelly Trial SHOCKER! Defense Claims Confidential Strategy Was Intercepted 🚨 Civil Rights 🚩Added:
All right, y'all. The defense filed a supplemental brief arguing what they called a structural error in R Kelly Chicago case. And this is important because they're not just saying a mistake happened. They're arguing the entire fairness of the process was compromised from the inside out, which we all witnessed. And I don't care what nobody on either side got to say, cuz I don't give a [ __ ] The motion claims the government intercepted confidential attorney-client communications discussing trial strategy and preparation. In simple terms, the defense is saying prosecutors allegedly got access to conversations they were not supposed to hear. Now, according to the filings, this goes beyond ordinary misconduct claims. They cite Supreme Court cases arguing that when the government intrudes on attorney-client communications, it can violate the Sixth Amendment right to counsel and even create what courts call structural error. So, when we hear these people try to play to the left, the breach that we refer to, pay them no mind, cuz they know exactly what's going on. And even those who continuously told me Devona was definitely going to be testifying, they know who they are as well and why I remain on my side of giving reasonable doubt. So, why does this matter? Because structural error is considered so serious that the harm can't always be measured. So, when R Kelly himself was asking genuine questions, oh, he was just pushed to the side. Oh, it didn't affect the trial. [ __ ] The defense argues the prosecutors knew defense strategy ahead of time. It could influence witness prep, trial tactics, jury presentation, and the entire balance of the case.
The motion basically says, once the government gets a window into confidential defense communications. The playing field is no longer level, and according to the cases they cite, some courts have ruled those kind of violations can justify a new trial. So, now the big question becomes, will the court agree this was harmless, or will they see it as a constitutional violation serious enough to shake the foundation of the conviction itself? Cuz people seem to distort the fact that just because R Kelly's previous attorneys tried to exhaust all opportunities available and were shut down, that that doesn't mean he still has other options even in New York. So, you can let them keep playing in your face if you want to, but we going to stay tuned because the paperwork party is getting real interesting considering could nobody on this internet tell me what I saw with my own eyes.

>> [music] [music] [singing] [music] [music] >> Now, let's go back to the beginning because this is where people started questioning whether the defense was truly prepared to challenge the strategy behind the indictments. From day one, prosecutors didn't just build a case around individual allegations. They built what many viewed as a larger narrative strategy.
The government framed R Kelly as the center of an alleged criminal enterprise, tying together former employees, associates, travel, finances, and personal relationships under broader conspiracy theories and racketeering concepts.
But, here's where people began raising eyebrows. Some critics argue the defense appeared reactive instead of aggressively dismantling the structure of the indictments early on.
Instead of forcing the government to clearly separate allegations, witnesses, timelines, and jurisdictions, many felt the prosecution was allowed to present years of unrelated accusations and emotionally charged testimony that painted a larger image before the jury ever evaluated specific charges individually, which is why I maintain that people should be aware of the open investigation that we saw. Questions also started forming around the use of prior acts, media influence, witness preparation, and whether enough emphasis was being placed challenging prejudicial spillover from the beginning. Because once the public narrative became larger than the actual counts in the indictments, the courtroom atmosphere itself changed. And let's be honest, many people watching the proceedings felt like the defense was constantly trying to catch up to a strategy that had already been carefully constructed years before a trial even started. Now, with the new filings discussing attorney-client intrusion and structural error, some are revisiting those earlier concerns and asking a bigger question.
Was the defense simply overwhelmed by the scope of the prosecution strategy, or were there warning signs from the very beginning that the playing field may not have been balanced at all?
Because when you go back and connect the dots, the timeline starts timelining a little bit differently.
You think you know, but you have no idea.
This is Surviving Lies.
What does Mr. Kelly have to say about not only the the charges that have been brought today and the allegations made today, but also all of the things that have been said over the years including what happened in the Surviving R. Kelly situation. What does he say to the women? Look, I finally got around to watching that documentary. And so you had people like Lisa Van Allen.
Lisa Van Allen was basically thrown out of court when she testified here at his trial. It wasn't credible testimony.
Sparkle says it's her niece, but her niece said it wasn't her. Her parents said it wasn't her. Now maybe they've changed that now because they think there's some gravy train or they've got some some Michael Avenatti making some kind of promise to them or Gloria Allred. I don't know, but the fact is that everything in that documentary was a rehash of things they've known for years. The police have investigated, the prosecutors investigated, the jury heard, and everybody rejected.
Now even as the years passed and I watched all of the distortions being created and I watched people act oblivious to how I documented a lot of the misconduct, janky stuff that I was witnessing, and how I was able to discern how they were strategizing to get their key witnesses to cooperate, and they started out by doing a whole lot of implications, skipping when these people got exposed by other witnesses that weren't on the stand. And even the biggest red flag when individuals brought to me a page that was being used allegedly by Boss Baby herself. So when we started seeing paperwork put out here, I left room just in case she didn't cooperate. But when you have individuals like his attorney telling you that she could have been incentivized and people on the internet distort why it wasn't my job to break out case laws and to come out here and impede upon the defense when it doesn't take all that to do my research on the topic, give out my talking points, structure my content around my views, and let you come to your own conclusions.
These women are lying. Yes, all of them.
I think all the women are lying. Yes.
This has become Hey, R. Kelly, I could say R. Kelly did something Boom. There was a a press conference yesterday. Oh, these two girls were assaulted by R.
Kelly. And the lawyer stood there with a picture of LL Cool J.
So, when you say that the the victims obviously say that they are they are not lying. Look at Look at Look at Look at Let me just say These women are Everyone Everyone Hold on. Everyone in that documentary First of all, they're going on a Surviving R. Kelly tour. Have you ever heard of anything like that?
Getting paid, selling tickets to go speak to groups about their experiences.
Every one of the women in that documentary had a song they were now going to release, a book they were now going to release, a a a deal they were now going to do. Everybody's trying to profit off of R. Kelly.
Hey, I met R. Kelly once. Look, oh, he looked at me the wrong way. I'm Boom, money. What about these videos that Michael Avenatti has released?
Avenatti says he has a video. I've never seen it. I don't believe anything I don't believe anything Michael Avenatti says. Did you see the photos Michael Avenatti released today from the video he's talking about?
>> I don't know where Michael I saw the three photos that he posted on on Twitter. Someone sent them to me. He He blocked me from his Twitter account cuz he's a coward.
>> [laughter] >> She was 17.
Did you have sex with her when she was 17?
>> Absolutely not. Absolutely not. Although her parents wanted me to, what kind of father what kind of mother will sell their daughter to a man? Who did that?
Now, when people first heard this and couldn't overstand what was being revealed, they didn't realize how the media edits these clips and puts these videos together. And they didn't comprehend that all of the noise that were being plastered all over these social media websites were being fueled by instigators. So, when he made certain references, it was up to the people to use their common sense, especially when they spent the block and tried to morph a trafficking charge associated with what he's talking about right now, right? If people were plastering messages that was supposed to be from a so-called janky ass inner circle and it's specifically revealing that these parents were in the know about specific things. And then they were used to come out here and facilitate this narrative about their daughter being missing, about all the stuff they were doing to try to get their daughters back. And people kept manipulating when it comes to this age factor and why people held reasonable doubt to all the claims being waged. So, as you begin to unpack all of the information that we collected over all these years, it should make sense why some of us knew exactly the strategy they were using when they put specific names in their indictments, huh? Don't take a genius.
How come it was okay for me to see them until they wasn't getting no money from them?
Everything [music] they said in that documentary about you is not true. They are lying on me.
>> You are supporting a pedophile.
Nothing good about me?
I'm just a child molester?
THE DEVIL?
COME ON, GUYS. AS LONG AS MY BREATH is going in and out, you know, I try to even when I get ready to complain, I think about that and I say, "You know what?
I ain't going to even say nothing.
