Those pre-Miranda statements are now suppressible at trial. Miranda was eventually read correctly.
The subject responded, "I don't know what I'm supposed to do."
Under Berghuis versus Thompkins, that ambiguity is not an invocation of silence or counsel.
By continuing to speak, she impliedly waived her rights.
Every word that followed is admissible.
She then voluntarily described the entire operation: the orchestrator, the locations, the participants.
That cooperation cannot reverse the legal jeopardy she created by speaking without counsel.
Under the Fifth Amendment, the correct response to "I don't know what to do" is three words: "I want a lawyer. I want" Well, that's the one from earlier. No, thanks.
