Earlier today, the jury said they were deadlocked. So, the judge ordered them to continue deliberating before finally declaring a mistrial for the murder sentence only at the end of the day.
This comes a day after the jury was instructed to restart deliberations because of a comment from one of the jurors. That juror was dismissed and an alternate was called in. Deliberations resumed this morning. Last month, I-N Mitcham was convicted of murdering and raping Allison Feldman in her Scottsdale home. And after only one day of deliberations with that new juror, they could not come to a unanimous decision.
>> The jury has sent out a written message um that they are at an impasse. They don't need any more clarifications.
Um that nothing would resolve the impasse. So, at this time, I am declaring a mistrial just as to count one in the penalty phase only.
>> The attorneys and judge are set to meet tomorrow to review the sentencing for the other two charges, burglary and sexual assault. They'll also be discussing how to proceed on the murder sentence and if Mitcham will spend the rest of his life in prison or still face the death penalty. We'll bring you the latest as soon as we learn the outcome.
