We're going live again today because for those been around all week, you know that I've been in trial the previous two weeks, previous 11 days actually. So, we are trying to make it up to everybody and um also, you know, kind of get back in good graces with the algorithm to let them know we're still here because it kind of plummeted. So, you know the drill.

So, we uh put up a video not long ago, did some more work, and then we're, like I said, we're going to go live here today because I promised five days in a row of being live. It's pretty pretty good, actually. I kind of like it. You know, we should do this for like a three-hour show every day at some point when I can just figure out how to clear my schedule from everything else I need to do in the world today. Uh, so I'll work on that. All right. I'm going to work on that because there's so much to talk about out there. And um obviously, you know, let's kind of start off with uh some of the um you know, highlights of the week, so to speak. Obviously, the sentencing in the Tanner Hero case uh is over. You know, the man that got the death penalty as it relates to the uh murder, kidnapping, and sexual assault of 7-year-old Athena Strand. Um, we got some developments in the ongoing pre-trial proceedings for the uh case involving uh David Anthony Burke, also known as David, spelled with a four. Never understood stuff like that, but whatever. Anyway, prosecutors alleged that Mr. Burke killed the teen to silence her about the alleged elicit relationship that could damage his music career or certainly is not doing anything good for her now, but he was worried that that was it. That's at least that's the prosecution's theory.
um with additional charges including continuous sexual abuse and mutilation of the remains. Bad bad stuff. Um what can you what can you say about stuff like that? Anyway, so that's what I kind of want to talk about this afternoon is the uh case with Mr. Burke.
All right. And I think it's interesting if we can uh add this here to the uh page. Let me see if I can make this any bigger. If I can do that. Let me see if I can make this any bigger. Um, all right. So, this is the people's brief regarding the preliminary hearing evidence. All right. I think I made this a little bigger. Did I not? I think so.
Um, so let's take a look at this. All right.
This is where you kind of get the good stuff. I'm telling you, you know, you can you go to the news, but you got to go to the source. You got to really see what's going on. And now, a lot of these facts we already know, but I think this is important, right? And obviously this is the people of the state of California versus David Anthony Burke and the case number is the 26 CJCF02399 and it's the people's brief regarding the preliminary hearing evidence. Now this is unusual. I don't think I've actually ever seen this in um anywhere where I practice where you get a written filing saying this is the evidence that we intend to bring. But hey, that's okay. um you know this is kind of I guess for a way for the uh defendant to actually see what the evidence is going to be.
Now remember a preliminary hearing is a very low standard of proof.
And normally the detective just gets up and regurgitates what's in the affidavit for the arrest warrant.
Court finds that there's probable cause, right? When a reasonable person believed that a crime was being committed and that the defendant may have had something to do with it. Pretty low standard of proof. All right.
And you can go to preliminary hearing or you can wave the preliminary hearing.
Now, it's going to be interesting to see if uh you know the attorneys for Mr. Burke will be able to be prepared uh for this preliminary hearing that's rapidly approaching, but let's just kind of go through this. Like I said, some of the facts we already know, but the dismembered body of a 14-year-old Celeste um victim was discovered in the front trunk of the Tesla on September 8th of 2025. The vehicle been towed u 3 days prior uh from 1405 Bluebird Avenue, which was uh parked approximately 400 ft from the defendant's home. For some reason, I thought it was actually parked much farther away, like just some random car parked on a street, but no. 400 ft from the defendant's home. Surveillance video and other evidence confirms the defendant was the last person to drive the vehicle, more than likely from the uh video from the Tesla. Oops. All that video evidence. Anyway, on September 8th, 2025, the manager of the towyard where the Tesla was impounded noted a very strong smell of decay and the presence of flies coming from the vehicle. He notified the police department. The detectives came, determined the Tesla was registered to the defendant through the uh departmental resources at the towyard.
The LAPD detectives opened the Tesla's front storage compartment and observed a black cadaavver bag covered in insects.
You know, all that stuff that happens when people die. It's it's it's real thing. You can actually date it based upon the bugs that are actually there.
Anyway, uh cadaavver bag covered in insects. Inside the bag, they discovered a severely decomposed head and torso.
Head and torso. Hm.
That's not good, right? Um, a plastic garbage bag beneath the black cadaavver bag contained the dismembered arms and legs. H. However, the victim's ring and pinky finger on the left hand had been amputated and were not found in the Tesla.
Now, on September 16th of 2025, the Los Angeles County Medical Examiner's Department positively IDed the uh body from the dental records uh and belonging to the victim. Now, if I was the defense attorney on this case, my first thought would be, hey, those cops had no reason to go into that car. Motion to suppress, right? Make the body go away.
Case goes away, right? Something to think about. I'm not saying it there's there, but that's the first thing that's popping into my head as I am a defense counsel if I was on Mr. Burke's case.
Now, um, pursuant to the investigation, the LAPD robbery homicide detectives determined the victim uh, and the defendant met in January of 2022 when she was 11 years old. They began a sexual relationship in November of 2023 uh when the victim was just 13 years of age and he was 18.
Detective learns the victim had been reported missing by the family members and um this is going back to February and April of 2024.
Uh during the call, the defendant claimed he had spoken to the victim uh last on February 13th or 14th of 2024, but hey, he was unaware that she uh was a minor and uh she had been reported missing at all. Anyway, the police advised him that the Los Angeles County Sheriff's Department would be coming to his home on that day. Defendant was living at the 804 North Dohenny place in uh West Hollywood. Then they requested that the uh Los Angeles police conduct a welfare check for the defendant's home.
Anyway, the deputies, the Los Angeles Sheriff's Department deputies went to the defendant's home about 8:15 that night, informed the victim was 13-year-old Runaway. Defendant claimed he was unaware she was a minor and uh that he had only met the victim once in person back in November of 2023. Oh, so he starts already lives taking place, right? However, defendant showed deputies a yearbook photo of the victim he had on his cell phone. And although he claimed to be unaware of where the victim was at the time, she returned home two days later. Now, despite being informed by law enforcement that the victim was only 13, the defendant continued to pursue her. And after the victim returned home in February of 2024, her parents took her cell phone away. The defendant then drove to uh where she lived, this Lake Elsenor, and paid a junior high school student in the victim's class $1,000.
$1,000 to give the victim a cell phone uh the defendant purchased so they could stay in contact. Throughout 2024, the victim spent a significant amount of time with the defendant, including summer weekends at his home in Hollywood Hills and traveling with him to Las Vegas, London, and Texas, and to ultimately meet with his family, which is just a, you know, little weird in and of itself, right? Um, wonder how what the passport said for her age was when they're going to Europe. Anyway, there was text exchanged between the victim and the defendant uh contain reference to sex, pregnancy, abortion, and the use of plan B emergency contraceptives.
There are also explicit photographs documenting and corroborating their sexual relationship. And in November of 2024, the defendant and the victim broke up, although they continued to communicate, and text messages suggest they um continued to have a sexual relationship. Then on April 23rd is likely the date the victim's death when her cellular activity ceased. The night prior, April 22nd, 2025, defendant Annie and victim had been engaged in a lengthy argument described in detail in their text messages. The messages reveal the victim's jealousy over defendant's relationship with other women as defendant led her to believe that they had a future together. She became extremely upset, threatened to disclose damaging information about her relationship with the defendant to end his career and destroy his life. Ouch.
Right. H, that's not good. Anyway, the defendant's first studio album was due to be released in April of 2025. He probably was sitting around saying, "I don't need this right now." Right?
Anyway, he had an emerging multi-million dollar career already in progress.
multiple uh products, endorsements, and going to be highly profitable. Certainly gives somebody the motive to want to get rid of somebody or keep them quiet, does it not? Allegedly.
Then on um April 23rd at 8:40 p.m., the defendant sent an Uber to uh transport the victim from her Lake Elsenor home to his residence. They communicated before and during her Uber ride, which dropped her off at the defendant's home. At approximately 10:30 p.m., defendants sent text messages to the victim inquiring where she was. The people comp contend that this was part of the defendant's pre-meditated plan to cover up the murder as she was already dead by this time. And knowing that he had to silence the victim before she ruined his music career and she had threatened uh very soon after her arrival at home, defendant stabbed the victim to death multiple times and stood by while she bled out. At no time did he call law enforcement or 911 or take any emergency steps to save her life.
Despite knowing she was dead and knowing that her family was trying to find her, the evidence will show. According to the prosecution, the defendant lied and claimed that he didn't know where she was. In fact, the defendant drove to Santa Barbara County immediately after the victim died attempting to dispose of her property and to destroy evidence.
At approximately 11:30 p.m. on April 23rd, 2025, he drove away from his home as he texted and called the victim's phone asking where she was. By golly, she just never showed up even though I was texting her in the car. Gee, that's not going to look like premeditation. H consciousness of guilt plan.
Anyway, uh he drove away from the house texting, "Where were you?" Again, these were acts calculated and planned to set up his defense within a very short timeline after the victim's u vicious murder. Defendant drove his Tesla north um to Santa Barbara County. He returned home earlier the following morning on April 24th before going to a radio interview for the release of his album that week. He uh uh sent two additional texts to the victim's phone that day, which obviously went unanswered because, well, she was dead. After April 25th, April 26th, the defendant never attempted to contact her again. Almost like he knew he wasn't going to get a response. Right. Tellingly, defendant subsequently purchased tools to carry out his plot to dismember and dispose of the victim's body. On April 24th, the defendant ordered a shovel from Home Depot that was delivered to his home there uh from Postmates. Then on May 1st, the defendant ordered and subsequently Amazon delivered two chainsaws to his home. Two chainsaws.
And on May 5th, 2025, defendant ordered an Amazon and Amazon subsequent delivered a body bag. I didn't even know you could buy a body bag on Amazon, but who knew? Maybe we'll have to check. Um, also ordered some heavyduty laundry bags and a blue inflatable pool to his home.
He made these purchases under a fake name. The name was Victoria Mendes. And then on May 8th, 2025, defendant returned to the same area in Santa Barbara County, leaving his home around 11:30.
He returned uh to the area again on May 31st. This is an isolated site off of uh State Road 154 where the victim's identification and subsequently was discovered on January 2026. Then on July 7th, 2025, defendant ordered and subsequently Amazon delivered a burn cage to his home under the same fake name for his plan to incinerate evidence.
Moreover, defendant took horrifying measures to destroy and discarded the victim's body. After placing her body into the blue inflatable pool to prevent her blood from spilling onto his garage floor, defendant used a chainsaw and perhaps other tools to cut off her limbs. Small blue plastic fragments were found embedded in the victim's remains, which were collected by the Los Angeles County Medical Examiner's Department.
The fragments were analyzed by the LAPD's Forensic Science Division trace anal trace analysis unit. An expert was able to make a physical fit match from the blue fragments to the blue inflatable pool purchased by the defendant in May of 2025.
In order to distance himself from the victim, he amputated her left ring and pinky finger because her ring finger contained a tattoo of his name. His fingers have not her fingers have not been recovered. Now, let me tell you, ladies and gentlemen, you may say, "Gee, Scott, what do you know about fingers being amputated?" Well, coincidentally, I may or may not have a case recently where uh let's just say maybe the video of the amputation was taking place. Um it is not an easy thing to do. Um even with, you know, your everyday gardening implements that you may find around the house, it doesn't come off easy. It takes a little bit of work even if you're dead. Okay, so like I said, her fingers have not been recovered. Defendant then placed her head into and torso into the cadaavver bag that he had purchased. He placed her limbs into a garbage bag which he deposited into his front trunk.
laying the cadaavver bag on top. For several weeks or possibly months, the defendants the defendant left the victim's body to decompose inside his Tesla.
He lied to friends, business associates, and others who noticed the strong smell of decay in and around his home and vehicle. Before leaving um on his concert tour at the end of July, he parked his Tesla on the street around the corner. I mean, that's like your friends are coming over like, "Dude, what's that smell?" Oh, dude. You know, I mean, is that like the guy that, you know, goes and blows up the restroom or something and comes out and like, "I don't smell nothing. I don't know what you're talking about." Apparently, that's what David was doing with the smell of the body bag uh in in the uh in his trunk of his car.
Anyway, the LAPD served a search warrant at defendant's home at the 1368 Dohaney Place on September 17th, 2025 after the victim was identified by the Los Angeles County Medical Examiners on September 16th. Inside the garbage, detectives discovered evidence consistent with the dismemberment of the victim's body in the inflatable pool, which contained multiple linear cuts. Several biological samples which tested positive for blood were collected within the garbage area.
DNA analysis determined that various samples uh match the victim's unique genetic profile. This is almost like the photos dulos case. Uh where was that in was it Maryland? Something like that maybe Connecticut where he remember he chopped her up Boston maybe where he chopped her up. He ultimately died, but it killed his wife, didn't find her remains, and then dropped her pieces all over the um city with the new girlfriend. Yeah.
Uh Mr. Burke, not saying you did it because you're given the presumption of innocence, but it really makes you wonder why go to all the trouble of chopping her up and then just leaving her across the street. Doesn't make much sense.
Anyway, um on December 9th, the medical examiner ruled the uh victim's death a homicide. G medical examiner.
I wonder why it took so long for that to take place. What did she slip and fall and uh hurt herself on some sharp objects?
Yeah. Anyway, on January 17th, the victim's US passport card was found by um Calrans workers off of SR 154 in Santa Barbara. Now, I've seen people if she's a juvenile and she had a passport photos when she traveled with him overseas. It really makes you wonder because I've seen parents that couldn't take a kid out of the country um unless they had permission like from the other parent if they weren't traveling with both parents. So, it really makes you wonder maybe they flew privately. They might maybe, who knows? Maybe they flew privately. That'd be a lot easier, I guess, to get somebody there. Evidence.
So, the people will present the following evidence at the preliminary hearing, including but not limited to the description of photographs depicting the victim naked, as well as while she was engaged with defendant in sexual activity when she was 13. And as the evidence constitutes child sexual abuse material, the photographs themselves will not be presented. While all possible charges that could be proven were not filed, the child sexual abuse material is proof of their ongoing sexual relationship while the victim was 13 and 14 years old.
Numerous text messages between the defendant and the victim evidencing their sexual relationship, pregnancy, abortion, and use of the Plan B emergency contraception.
messages through March of 2025 proved defendant continued to manipulate the victim as the message quote, "All we do is have sex and just hang out, man. I want more than that for myself." End quote. These messages were obtained from the defendant's iCloud data. Oo, that pesky iCloud data. You know, even a 13-year-old wants a little bit more than just a little casual sex there, Mr. Burke. Yes, she wants a future, a relationship. if she wants to go out in public to be seen. Yeah. Anyway, defendants cellular activity and communication drive from defendants iPhone and Tesla, which demonstrates the defendants's activities on April 22nd through April 24th of 2025, including a trip to Santa Barbara County in the middle of the night after the victim arrived at his home, creating that alibi.
surveillance surveillance video of the defendant driving his Tesla on July 29th for the last time before parking the vehicle and leaving it on uh and leaving on tour at the end of July. Those pesky video cameras in Tesla, they get more people, right? Whether you're vandalizing a Tesla or leaving a dead body in the trunk, Tesla's got you covered. [laughter] Um, DNA developed, DNA evidence developed from blood stains collected from defendant's garage, which uh matched the victim's genetic profile. What a coincidence because apparently she was chopped and sliced and diced and put in many little pieces, including body bags and garbage bags. Proof of defendant's Amazon purchases and deliveries to his residence, including two chainsaws, a body bag, an inflatable pool, heavy duty laundry bag, and a burn cage. after April 24th, 2025. Proof of defendants purchase and delivery uh from Postmates of a shovel from Home uh Depot uh after April 24th. And uh proof of defendants purchase and delivery of Postmates of the shovel, sorry. Uber record showing defendants uh transactions.
Um, Uber records showing defendants transactions where he ordered an Uber to pick up the victim from her home and transport her to his residence.
[snorts] Proof of defendants's lucrative career as a singer and songwriter prior to April 23rd, 2025.
Proof that he uh had an album release party on the night of April 24th, 2025 before embarking on his international tour.
Uh so that's what's going to be uh presented at the preliminary hearing.
Now obviously it's a very low standard of proof. Anyways, this brief is filed to assist the court in understanding the scope and relevance of evidence. The prosecution intends to present at the preliminary hearing. The prosecution has issued numerous subpoenas and is prepared to proceed to hearing. Defense has had multiple opportunities to request a continuence but has not done so. Furthermore, California Penal Code requires the defense to provide at least two court days notice to request a continuence in view of the limited scope of evidence to be presented at the preliminary hearing. Remember, limited scope. Um, uh, they filed this brief. There should be no substantial impediments to moving forward at the hearing scheduled. So, it looks like, you know, they figured, hey, they got nothing. uh they're going to use the um Scott Rich uh theory that you should go forward and um if uh you know things are bad if things are bad what are you waiting for uh hold on hold on there we go I'm back all right so the the the defense is clearly uh since you know they're getting ready to is hopefully this will be televised.
If so, we will try to uh bring it to you here on Crime Talk. And um like I said, the interesting thing is is hey man, this is bad. I mean, if I was his attorney, I'd be like, dude, we got some serious problems, right? How much money you made as a as in the music profession because you got to give it all to me.
All right? Or to his defense attorney.
That's what they're saying. and uh we're going to go forward and we're going to do this and we're going to push speedy trial and we're going to see if the prosecution can really get all their ducks in a row and prove this case. Now, the prosecution should, right? They've had a year since she disappeared, investigated, went to the grand jury, did everything they were supposed to do.
Got to press forward, man. Sometimes the best defense is a good offense, which simply says, "Prove it. Prove it now. Let's go to preliminary hearing. Let's see what you got and then yeah, let's do trial. I don't know you available I don't know like uh next week because chances are they're still doing testing. Chances are people are on vacation. You're heading into the summer months, right? Get a waiver from your client understanding, hey man, I know that this is be bad.
They could even go death, but understand bad information here. We a strategy is are you on board? Let's do this. Let's press press forward. Maybe they'll make a mistake. Maybe they can't get their uh case ready to go. You know what I'm saying? That's what you need to do.
That's what you need to think about.
Just something to think about.
Interesting. Interesting case it's going to be. Obviously, Mr. Burke, David spelled with a four. He's entitled to the presumption of innocence. We got to give it to him. He's entitled to it.
But we certainly can explain the evidence and say, "Looks bad. you happen to be the last guy that just happens to park your car across the street from your house before you go on your international music tour and your friends are complaining like, "Dude, what's that smell coming from your car?"
And he's like, "I don't smell anything."
Right? Like I said, situation where the guy maybe goes to the restroom, blows the place up, everybody's like shocked looking at him. He's like, "What are you talking about? I don't know what you're talking about. Smells like roses here.
[laughter] But Mr. Burke, he goes and parks the car across the street. Maybe no one will notice. How did that get in there? I was out of town. He tries to create an alibi. Who orders a pool under a false name delivered to your house and chainsaws? I mean, I'm just going to do a little gardening. Did you any any evidence of any trees on the property being taken down? My guess not. My guess is they probably are comparing torsos and body parts that were connected. Still didn't find a finger. And like I said, if you ever seen a limb removed, ladies and gentlemen, it's it's it's gruesome. Okay, I can tell you we we have a case right now, something very similar to to something like that. And um you know one of the parallegals was watching it and she was like I can't watch it again.
Like she saw it once and she's just like can't do it. It is and can be uh disturbing to say the least. So um you know my guess is there's probably surveillance. Like I said the preliminary hearing. You don't have to put on your entire case. You don't have to present all the evidence that you intend that you have or may develop obviously in the future. But you just have to present just some evidence to establish probable cause as to each and every element of the offense charge, right? Charge is murder, then this ongoing uh relationship. He could be charged with more than likely, you know, the feds could pick him up and he could get charged with the uh production of the child sexual uh abuse material, right?
He could be charged with that. I can guarantee you that carries a mandatory minimum 15 years to 30 years in prison on top of that. So that could add to his legal wos here. We'll also have to wait and see. You know, um, you know, I bet this music company, you know, people at his label, they may be saying, "Hey, if there's any money there, we may want it back because you didn't fulfill your contract." So, he may be getting courtappointed counsel here very soon.
And nothing not disparaging the public defender or courtappointed counsel in any way whatsoever. I'm not. But I'm just saying his private council days uh they're probably burning through that cash really really fast trying to get up to speed on this case and trying to hold the government uh to their burden of proof. So it may be interesting. Private council may be withdrawing. He could get the public defender here real soon, you know. Um, just like we saw in the uh Nick Reiner case as well, right? Even though they got money, goes away really fast. You find out who your friends are in situations like this, right? We'll find out uh who eventually uh basically told Mr. Burke that uh hey man, you got something smelly going on in that car.
And he just I don't know what you're talking about. I What are you talking about, man? I don't know what you're talking about. Gross. Gross. Gross.
Gross. Gross. Gross. Anyway, um I just thought that was something that we could talk about here today. Let's take a quick look at the questions, but I wanted to fulfill my because your word matters. Your word matters. And I wanted to basically be able to fulfill my promise that I said I would go live every day this week on top of putting out a video every day this week as well, Monday through Friday.
And we'll have a video on the Sunday, the weekly recap as well.
Uh let's see. I uh you've been I think that's I've been filing complaints with the news stations that still use the term uh child porn. Well, that's really what it is. I mean, you can say child sexual abuse stuff, but let's face it, it's it's child pornography.
Um, that's the new buzzword of the day, but that's really what it is. Um, and Matthew Douglas here says, "Thankful that Athena got justice." Tanner Horn, I can't wait uh for the day that uh uh God freezes your heart and uh penetrate your heart. Yep. Um ugly, ugly case. Ugly case, but at least justice was done there. But, you know, is it really justice? It's not like you're going to bring back Athena in any way, right? I was having this conversation with the district attorney today. I've said it before and we both agreed district like if you want justice, a courthouse is not where you're going to find it. You're never going to get it, right? Your loved one's never going to come back. We were talking about a homicide case.
Never going to get justice. The loved one's not going to come back.
Um, no one's happy, right? the defendant doesn't want to go to prison. The the uh uh family wants justice if that's what what you think you're going to get. But you're not you're never going to get it.
It'll never never make you happy. That's why this is such a tough uh business.
Tough business, ladies and gentlemen. Uh you just never know what you're going to get. And it's cruel. It's cruel. There's never happy people in cases like this.
Um in this particular case, I mean, what what was this B guy thinking for God's sakes?
He knew [snorts] she was 11 and 13 and died what? Right before her 14th birthday or something like that. And you know she wanted more. All we do is sit around and have sex, right? Even at 13, she knew she wanted more, right?
And he put a tattoo on her finger. Then he chopped it off so he can't trace it back to her. Unbelievable. Like no one would ever know. Chopped off her head, put it in the body bag. I didn't even know.
