BREAKING: ICE Agents ARRESTED for BOMBSHELL ASSAULT ChargesAdded:
Hi everyone, Harry here to talk about the arrest in Texas of an ICE agent facing assault charges under Minnesota state law. They issued an arrest warrant for this guy. No help of course from the feds, but they have finally found him in Texas and executed the arrest warrant on the criminal complaint on four counts of an assault and one of u basically lying about the episode. So now he's on his way back to Minnesota to face charges and we're going to have the most pointedto-date kind of battle between state authorities. This is the Henipin County prosecutor, Mary Morardi, that's out of Minneapolis, and the feds, who who knows what they'll try to say about the man who's been charged, an ICE agent named Castro. Here is what happened, and it's really a um very difficult case for the feds to try to defend. The episode was in January. There were two Venezuelan immigrants and the federal agent Christian Castro, who is uh one of two agents on the scene who races to arrest them. Uh and there's a whole little scrum. All four go in the house.
Castro fires a shot that hits one of the two men in the leg. Uh and then we have the normal ice response. They throw in tear gas. Uh they go into the house.
They take all four of the adults into custody. They don't let them get any medical treatment for over an hour. And they charge them with federal crimes basically of um interfering with law enforcement. And then lo and behold, there is video that emerges and DOJ and ICE are humiliated. They have to DOJ has to drop the charges, has to fess up that Castro was lying about them. Talks a little bit about how they could try to discipline Castro, but really stands to the side and uh Mary Morardi, the Minneapolis DA, steps into the breach and charges uh this guy with assault uh and the falsification. They issue an arrest warrant. Nobody can find him until just this morning he's picked up in Texas with the help, by the way, of Texas Rangers. That's not to say that Texas has like turned a new page and is all anti-Trump immigration. It's just the way it works when a state a sister state issues an arrest warrant. You're supposed to help. I I suppose they could have gotten a counterman from the governor or whatever, but it just went the way it's supposed to. Okay, more about the crime and especially Castro's efforts to uh obstruct it and lie about it. So, he and a partner are chasing these two related Venezuelans down. Uh they pull up to the house as the two of them try to run in the door. There's a brief moment where um the actual victim uh in the case, one of the two immigrants whose name is Sosa Celis, uh is seen holding a um a shovel but doesn't use it. Uh the other man, uh his cousin, uh Alfredo Aljou, uh slips and there's a quick little melee, but they're able to bring him in the house. door closes. At that point, 180 degrees different from what Castro says. Ice goes all out. They um fire tear gas into the house. They come in and pick up four adults. There are also two children there, but the four adults, the two men and their two partners, uh, two women, and they take them out, charge them, and issued the customary press release about how, uh, the ICE agents were in terrible danger, and they fired defensively, and fortunately, uh, they were able to apprehend these terrible criminals and the like. Then the footage uh, captured by a city camera. So, I infer it's kind of one of those things you see in cities about traffic and stuff. It's up on a post um from the intersection near the house and guess what? Um Cast Rose uh lying like a thief. Uh and it turns out that uh so Cecilis briefly holds the shovel. no effort to to try to um assault him with it as they said and he in fact tosses it to the ground, goes back toward the front door. Uh his cousin slips. He is able to bring him in and Ice shoots tear gas uh and does everything to apprehend them while one of the women in there is actually calling 911 talking about what's going on. more evidence uh to contradict what Castro had um said. So, um they ICE takes him into custody and they charge them of course, but then uh the next month DOJ tail between his legs has to uh actually dismiss the charges fess up that the guys were lying. There's nothing else to say.
Here's the footage. And the real question it raises is what about all the other cases in which there is not footage? But anyway, uh they dismiss the charges and um make some talk about uh officers not supposed to give false statements and maybe there's internal discipline and the like, but nothing has happened. And now, um, the district attorney of Minneapolis steps into the breach and charges, um, Castro with four counts of assault, uh, each of the four.
And, uh, and then with a false statement, which is going to come in at trial, uh, if there is a trial, uh, I'll get back to that in a moment, and make it's the kind of evidence that is very powerful and tends to predispose a jury to think ill of the, um, defendant. in this case, the ICE uh agent. So, the the charges should and could be powerful.
Now, we'll see what the feds do because uh they've had to completely disavow this guy, basically throw him under the train. There's no uh nothing uh other to do when you have video showing he's lying. But will they now fight it? and will he fight it and say he this this was official conduct and I have a right to immunity and this will be removed uh and remember how removal works. It's automatic. So they would go to federal court and it would be in federal court that Castro would say I was just doing normal law enforcement here. You can't charge me for that even if uh I fibbed a little bit. uh you know, I don't know what he could possibly say about that charge. Uh that's certainly not part and parcel of his official duties. But anyway, if if that route happens, and I think it probably will, we'll have the whole mini trial in federal court for a federal judge to decide if there's immunity, if there isn't, back to Henipin County for trial. But we can expect all the way through even though they have a very weak hand to play that the Department of Justice will at a minimum not be cooperating trying to circle the wagons and not give any evidence. For instance, uh statements he may have made that they don't already have and uh try to press back. So that that first battle now I think will be joined in this case now that they have him and uh it's going to be really illuminating of what will happen.
There's another assault charge that um Morardi has brought. Remember the sort of cowboy ICE agent who screeches around the non-lane the the shoulder on the right and brandishes a gun. that guy's been charged and we have to think that there are charges in the offing when they can work through the different obstacles that the feds are creating for them for the shooters of uh Alex uh Prey and Renee Good. So, this could be the first of a pretty important test case.
How's this all going to work? uh when ICE agents are charged under state law and jump up and say, "I've got federal immunity." That is um what uh ought to happen next. And at a minimum, the whole uh kind of toddy tale of the um feds apparently not lifting a finger to help even though they know and they've cpped to their guy lying about the whole thing. So, you would think at a minimum they should be behind a prosecution for a false statement. They don't seem to have helped arrest the guy. And I think we can anticipate that they'll be throwing every legal obstacle they can and both on the merits of this case and because it's a test run for the more important cases that I continue to believe will be forthcoming, namely the prosecutions for homicide be it manslaughter or seconddegree murder of the shooters of Prey and Good. uh which will be um that sort of similar battle about immunity and uh removal and and federal uh and and claims of uh necessary law enforcement action and the like uh to be watched by the whole nation. But here we go. They've got him arrested. He'll have to go to Minnesota and appear, enter a plea, etc. And the wheels of justice begin to turn for Christian Castro.
