The Fourth Amendment protects citizens from unreasonable searches and seizures, requiring police to have reasonable articulable suspicion before detaining or patting down individuals; verbal arguments or emotional conversations do not automatically justify physical force or detention, and citizens retain their constitutional rights to question officers, demand identification, and refuse to provide personal information when no crime has been committed.

Cop Says 4th Amendment Makes No Sense Then Pats Him Down Without Any ReasonAñadido:
Brother, don't roll up on me and talk about >> I I'll roll up wherever I need to, sir.
>> Okay, but you have laws and regulations.
>> Do you have reasonable articulus?
>> We were called here, dude. I told you that >> and I gave you everything you needed to know. My brother just now told you.
>> Cops say the Fourth Amendment doesn't make any sense and pat down the man anyway. These brothers are standing outside near a building talking through personal issues after an emotional argument between them. There's no physical fight happening when the video starts. Then police suddenly arrive on the scene after someone reports a possible fight. And from the moment officers pull up, the younger brother notices how aggressively the officers approach and starts questioning them right away, asking for names and badge numbers while pointing out that they rolled up acting like something serious was happening before even understanding the situation. The officers begin focusing heavily on identification, demanding ID almost immediately, while the younger brother keeps repeating the same point over and over, asking what crime he committed and what reasonable articulable suspicion they actually have to detain him. The man keeps calling this a fourth amendment violation. And the response he gets from the officers along with what happens after raises serious questions about law enforcement and police accountability. Watch the full video and see how this situation unfolds.
>> Were you?
>> No.
>> Is everything good?
>> Everything's great. This is my littleing brother. Don't roll up on me and talk about >> I I'll roll up wherever I need to, sir.
>> Okay. But you have laws and regulations.
>> What's your name and badge number?
>> That's what we're doing.
>> What's your name and badge number now?
>> You can see it. And >> no, I can't. Is that what you tell the judge?
>> You tell the judge you can see it.
>> Tell you anything.
>> What's your name and badge number?
>> No, bro. Name and badge number right now.
>> Run him or do you need an ID? I don't have his ID. I just got up here with >> You're not getting my ID. We ain't committed a crime.
>> You're going to be detained until I can identify you.
>> So, you're going to violate my Fourth Amendment? Nope.
>> It's not Fourth Amendment.
>> For what?
>> Until I can identify you. You're being aggressive.
>> I'm not. Your officer rolled up on me.
>> We were good.
>> We're not going to play. We were good.
There was >> You have an ID in your pocket.
>> There was no >> You're not getting it.
>> You're violating my Fourth Amendment rights. Record it. Record it. You're violating my Fourth Amendment.
Fourth Amendment.
Fourth Amendment.
>> Doesn't even make sense.
>> You have no uh reason to violate my rights like that.
>> I didn't commit a crime. Unless >> you don't have reasonable articulable suspicion.
>> Turn the camera around on me.
>> Quick as I pull it up.
>> Do you have reasonable articulable suspicion?
>> We were called here, dude. I told you that.
>> And I gave you everything you needed to know. My brother just now told you.
>> I'm glad he's all right.
>> Okay. You want that?
>> Do you have reasonable articulable suspicion to reach into my pocket?
>> Yeah. To get your identification.
>> Okay. What reason do you need to uh identify me? What crime did I commit, >> Chad? Point that phone at me. Okay, but that's not a crime.
>> I'm relaxed. I was relaxed until you grabbed me.
>> You're relaxed.
>> I'm relaxed.
>> But you grabbed me up without no provocation.
You violated my fourth amendment right.
>> I did not violate.
>> You are going to be a superstar on YouTube.
>> I didn't commit no crime. So why do we get called here if you guys >> I don't know. We weren't pushing and fighting and arguing. You violated my rights just now. Yes, I'm loud.
>> Is there anything that you could have been doing that could have been misconring just having I mean >> we had a verbal conversation >> arguments.
>> But I mean like is there you guys around or something?
>> I mean I'm going through some in my head and he's just trying to get it out of me and I'm being a >> I'm his big brother.
>> Stop.
>> You violated my rights just now. You snatch me up. I want a I want a sergeant.
>> Okay. I'm a lieutenant. Talk to me for a second.
>> Okay. You're temporarily detained.
Temporary.
>> For what?
>> What reason?
>> Okay. Well, I just got here. I just got here.
>> What's your RA?
>> Just to answer some of those questions.
>> Reasonable.
>> When we get called here, we have to go by what we violate.
>> I don't know if what we're being told is no.
>> But when someone says there's two guys maybe about the fight. We have to come and be prepared because you come if we come here and we find out around it's a big misunderstanding. It's a big misunderstanding to throw me up against wall but I have to at least identify you.
>> He didn't I got it all on me.
>> I have to put my police reported. I talked to you. I talked to you. It was a big mistake. Blah blah blah.
>> So let me talk to him so I can get some answers to you. Okay.
>> You're violating my fourth amendment. He threw me up against the wall and put me in handcuffs.
>> Bull. I got it on video. You >> So do we.
>> Yeah.
>> And I'm telling you, stop yelling.
>> You're violating my fourth amendment.
>> Is chill out.
>> You came up here with no reasonable articulation. We were called here.
>> Okay. 911. You called for an investigation. Do you have physical proof of anything?
>> Dude, will you chill the [ __ ] out?
>> No. Violating my fourth amendment.
>> You're about to go to jail. So >> Chad, right?
>> Yes, sir.
>> What's your name?
>> In the end, after all the yelling and arguing, officers finally realize it was a misunderstanding between two brothers and the man was free to leave. Now, this one is serious. Cops demand ID from men standing outside their own home. It starts outside an apartment building at night where a group of men are standing around talking and listening to music and hanging out near the place where they live with people joking around, talking back and forth, and spending time outside like many residents do late at night. Then officers suddenly arrive on the scene after receiving a complaint from someone in the building about noise coming from outside. The officers immediately start questioning people and asking for identification even before clearly explaining what exactly they believe happened. As the officers question the group, one of the men who knows the law and is the one recording the whole interaction pushes back immediately, repeating that he lives there and does not need to provide ID when he has not committed a crime. The officers, however, continue pressing the issue, bringing up possible trespassing and saying they need to verify who belongs there and who does not. And this is where the real clash begins. Watch the full video and see how this escalates because this leaves a very powerful message by the end of it. You >> have your ID.
>> You don't have to You don't have to You don't have to tell your ID if you live here.
>> Not if you live here. Not if you live here.
>> You need to prove that you live here.
>> I don't have to prove nothing if I live here. No, I don't. I don't have to prove nothing if I live here.
>> I don't have to prove nothing, bro. I don't have to prove nothing. I live here. We not expected of a crime.
Nothing. Yo, you're not expected of doing a crime or nothing. So, you don't have to get him no ID. No, nothing. Yo, you ain't had to You ain't did no crime.
>> You ain't did no crime, son.
>> No, you don't. No, you don't. Yo, he don't have to prove. No, he does not. He does not. Officer. Officer, can I have your badge? And Yo, can I have your badge?
>> You have your name and badge? Have your name and badge, bro?
>> Can I have your name and badge?
>> I don't care. Stop putting your hands in your pocket.
>> No name in bad.
>> I'll talk to you in a second. All right.
>> All right, cool. But no name and badge.
But we live here. We live here.
>> Just show me your ID and then >> I don't have to show you ID. I live here. What? I haven't been >> suspected of a crime or criminal offense. Nothing. Why? Why y'all out here asking for ID? I live here.
>> Criminal trespass is a crime. Okay.
>> I'm not criminal trespassing. No, I I live here and I'm telling you that.
>> But that's not you. Your word doesn't mean anything to me.
>> Yes, it does. Yes, it does. I don't have to give you ID, bro. You know, I don't have to. No, I don't. No, I don't. Well, then we'll just go through the process.
>> What process is that?
>> I don't whatever process you want.
>> The simplest way >> if you want to try to try to take me down. So, >> the simplest way to end out here.
>> All right. I'll let you talk and then you let me know.
>> I'm just I'm out here doing my civil right now >> chilling like I'm just outside chilling just like anybody else. You out here messing with us for no reason. For no reason. >> You do. My name is right here.
>> No, I don't. I didn't I asked you that.

>> If you are still here, we thank you for watching till now. These encounters are not something to ignore. In the first clip, the biggest issue comes down to the fourth amendment because officers must provide a clear and articulable reason before grabbing someone, patting them down, or detaining them. Arguing with your brother and having an emotional conversation does not automatically justify physical force or detention without solid grounds. The man is frustrated, loud, and emotional. But that does not remove his constitutional rights or mean officers should ignore his questions. Under the First Amendment, he still has the right to question officers, speak out, and demand answers about why he is being detained in the first place. In the second clip, the issue becomes even deeper because it involves people standing outside their own home. A person's home and the area around where they live carry some of the strongest constitutional protections.
Standing outside your own apartment building, talking with friends, or listening to music does not automatically create probable cause or reasonable, articulable suspicion of a crime. Officers are expected to explain why they are demanding identification, especially when the people involved keep asking what crime they are suspected of committing. At the same time, under the fifth amendment, people also have the right to remain silent and refuse to answer questions that could be used against them. Rights do not disappear simply because police are investigating a complaint. Situations like these show how quickly normal interactions can escalate when constitutional protections are not clearly respected or explained.
