And from the moment officers pull up, the younger brother notices how aggressively the officers approach and starts questioning them right away, asking for names and badge numbers while pointing out that they rolled up acting like something serious was happening before even understanding the situation. [00:05:15]>> In the end, after all the yelling and arguing, officers finally realize it was a misunderstanding between two brothers and the man was free to leave. Now, this one is serious. Cops demand ID from men standing outside their own home. It starts outside an apartment building at night where a group of men are standing around talking and listening to music and hanging out near the place where they live with people joking around, talking back and forth, and spending time outside like many residents do late at night. Then officers suddenly arrive on the scene after receiving a complaint from someone in the building about noise coming from outside. The officers immediately start questioning people and asking for identification even before clearly explaining what exactly they believe happened. As the officers question the group, one of the men who knows the law and is the one recording the whole interaction pushes back immediately, repeating that he lives there and does not need to provide ID when he has not committed a crime. The officers, however, continue pressing the issue, bringing up possible trespassing and saying they need to verify who belongs there and who does not. And this is where the real clash begins. In the first clip, the biggest issue comes down to the fourth amendment because officers must provide a clear and articulable reason before grabbing someone, patting them down, or detaining them. Arguing with your brother and having an emotional conversation does not automatically justify physical force or detention without solid grounds. The man is frustrated, loud, and emotional. But that does not remove his constitutional rights or mean officers should ignore his questions. Under the First Amendment, he still has the right to question officers, speak out, and demand answers about why he is being detained in the first place. In the second clip, the issue becomes even deeper because it involves people standing outside their own home. A person's home and the area around where they live carry some of the strongest constitutional protections.

[00:13:48]Standing outside your own apartment building, talking with friends, or listening to music does not automatically create probable cause or reasonable, articulable suspicion of a crime. Officers are expected to explain why they are demanding identification, especially when the people involved keep asking what crime they are suspected of committing. At the same time, under the fifth amendment, people also have the right to remain silent and refuse to answer questions that could be used against them. Rights do not disappear simply because police are investigating a complaint. Situations like these show how quickly normal interactions can escalate when constitutional protections are not clearly respected or explained.
