The administering officer requested standardized field sobriety exercises after the subject admitted to consuming three alcoholic beverages that evening.
Under South Dakota versus Neville, 459 US 553 refusal to perform sobriety exercises is not protected by the Fifth Amendment and may be used as evidence.
The subject consented to participate legally the more defensible choice.
Refusal would have permitted the admission of refusal itself at trial.
Upon disclosure of a bad hip, bad knee, and prescription medication use, the officer eliminated walk and turn and one-leg stand from the battery. This modification is required under NHTSA standardized field sobriety testing guidelines.
Failing to accommodate known physical limitations can void the evidentiary value of the entire test. The officer administered horizontal gaze nystagmus, the most scientifically validated SFSE indicator, along with finger to nose and a complex divided attention coordination exercise. Instead, she extended [music] it into a criminal encounter. Invoking executive authority as a basis for partial payment reflects a fundamental misunderstanding of both contract law and the limits of political statements as legal defenses in real-time encounters.
