In criminal trials, when a court clerk makes inappropriate comments to the jury, courts can presume prejudice without requiring a detailed review of the entire trial transcript, as demonstrated by the South Carolina Supreme Court's decision to overturn Alex Murdaugh's murder convictions based solely on the clerk's inappropriate remarks.

Prosecutors to retry Alex Murdaugh after murder convictions overturnedAdded:
The justices today overturned Alex Murdaugh's murder conviction and life sentences for the 2021 killings of his wife and his young younger son.
I'm innocent.
I would never hurt my wife Maggie.
And I would never hurt my son Paul Paul.
Makes sense to me because this is not a ruling where you had to look over the entire transcript of the trial and look over the evidence in a fine-tooth comb.
This ruling was in a very narrow issue which was a clerk of court who made inappropriate comments to the jury. And as the state Supreme Court noted, we can presume prejudice from that. And that's exactly what they did. I don't think this was a decision that required months or years of agonizing over all the fine details.
There was a clear legal standard here to apply.
Alex Murdaugh has claimed ever since the killings that he did not kill his wife and son. He's adamantly denied it all the way to this all the way to today.
His lawyers say that the Supreme Court's decision overturning his convictions validates that. But he said he was very glad with the Supreme Court's decision and he looks forward to fighting for it to clear his name, at least as far as the murders go, at a retrial.
Prosecutors say that retrial is coming.
They're going to seek it very aggressively, but there's no timetable on when this case might be tried again.
It's a very complicated case. It took 6 weeks to try before. No idea how long it might take to try it again.
