When a traffic accident results in fatalities, the legal charge can be reclassified from a traffic violation (such as Section 41 of the Road Transport Act 1987) to a murder charge (Section 302 of the Penal Code), as demonstrated in this case where a 24-year-old driver suspected of driving under the influence of alcohol caused a fatal crash that killed a husband and wife, leading to the case being referred to the Kuala Lumpur Deputy Public Prosecutor's office for further instructions.

Remand of driver in fatal Jalan Ampang crash extendedAdded:
Investigation papers into a fatal crash involving a 24-year-old driver suspected of driving under the influence of alcohol have been submitted to the Kuala Lumpur Deputy Public Prosecutor's office for further instructions.
Kuala Lumpur Traffic Investigation and Enforcement Department Chief Assistant Commissioner Muhammad Zamzuri Mohamed Esa said the papers were submitted at 3:00 p.m. on Monday.
He added that the suspect's remand has been extended from Monday until Friday under Section 302 of the Penal Code for murder.
In the incident, a husband and wife were killed after their motorcycle was struck by a car near Menara Great Eastern along Jalan Ampang on May 2nd.
Police are still awaiting toxicology results to determine whether the driver was under the influence of alcohol or drugs at the time of the incident.
The case initially classified under Section 41 subsection 1 of the Road Transport Act 1987 has since been reclassified under Section 302 of the Penal Code for murder.
The family of the victims has called for swift justice after learning that the case is being investigated under the murder provision.
The deceased have been identified as A.
Menaga and her husband A. Doraisingam.
They died at the scene from severe head injuries leaving behind three children aged between 19 and 26.
Preliminary investigations found that the driver is believed to have lost control of the vehicle before crashing into the rear of the couple's motorcycle at about 5:34 a.m.
The 24-year-old driver and two male passengers aged 23 and 24 were traveling towards Kuala Lumpur city center at the time.
The driver and front passenger sustained head injuries and were sent to Kuala Lumpur Hospital for treatment while the rear passenger suffered minor facial bruises and received outpatient care.
Police arrested the driver after he went to the Jalan Tun H.S. Lee traffic police station to have his statement recorded on Monday night following his discharge from the hospital.
