>> Uh I was at my desk working. I have been recording audio when she's in there talking to me ever since this started because it has been very traumatic. So, uh, I turned it on.
Arkansas is one party consent and it's also my home, but whatever. So, uh, I turned on the recording on the computer.
She yelled at me to stop recording and I said, "I'm recording for my own protection." She then came over and grabbed my face, shook me in the thing.
She ripped the keyboard off of the computer, threw it down, tried to take the mouse, and spun the monitors around.
Uh, then said she was calling the police. I said, "That's fine. I'm going to call the police as well." and then started when I was on the police, she then called her and she's like, "Well, he's hitting me. He's pushing me." And I'm like, "I have been sitting at my desk. You can come to the bedroom and I can show you."

>> Okay. So, I have sat there and then she said, "What are you going to do? Press charge of me. This is my home. I'll stay here." I said, "You can't physically attack me. This is after she said, "I'm going to make your life a living hell and I'm going to interrupt all your work calls since I work remotely." Um, and I said, "You can't physically attack me.
That's not allowed." And she said, "Well, I have journals that prove all the stuff that you've done to me in the past." And I said, "Well, I don't think that's admissible in court. Anybody can write anything, but you can't attack me regardless of what you're" And she's like, "Well, I'm going to sit right here." And so I called the police and she's like, "Well, I'm going to call my dad." And I'm like, "Okay." And so that's when I called you guys and let you know and she kept Oh. Uh, she also tried to grab my phone and stop me from recording her when she was coming after me as well.

Over a different fight where she was screaming at the kids. Uh and she said uh she's just going to leave. And then she said, "No, I'm going to stay. Same thing. I'm going to stay here and make your life a living hell." First she said, "I'm going to sleep in in Lori in my daughter's room and then we just won't talk to each other, be around each other." And I'm like, "Okay." And then she's like, "No, I'm going to make it."
I'm like, "Okay." And then she's like, "I don't know why I'm so over addictive." So, we drove down to Springwood, but they won't admit you unless you're homicidal or or suicidal.
Uh, and so then additional attempts that I have asked for seeking out counseling and stuff, none of them met her desire to do. I can't force anybody to do anything.
>> Okay. Um, so when she put her hands on you, tell me tell me exactly what you did again. Okay. So, I was sitting in my desk chair. She grabbed both hands, grabbed both sides of my cheeks here, grabbed me forward. Um, and then, uh, she started to grab for the stuff. I put my arm up to stop her from grabbing for the stuff, turning off the only thing that's that's >> protecting me.
>> Um, and then she kept trying to do that.
She jumped back at the computer. She grabbed the keyboard, threw it down. I pushed her back away from the computer again because I also have actual work things going. Uh and then she got up.
She spun the like she was trying to rip it down but couldn't. And spun the monitor down that way. Uh and I told her, "You can't touch that.
Can't touch my work equipment. You can't." And uh then she walked back away and I said, "I'm going to call the police."
>> Did it hurt when she did that? Yes, she definitely intended to cause physical violence. I mean physical pain. Sorry, not >> and where did it hurt?

>> Let's break down the legal framework that turned a difficult Arkansas family argument into a domestic battery arrest.
Issue one, the underlying charge under Arkansas Code section 5-26-305, domestic battering in the third degree is a class A misdemeanor. Penalty up to one year in jail and a $2,500 fine. The crime requires purposeful or reckless physical injury to a family or household member. Issue two, what counts as physical injury under Arkansas law? The statute requires substantial pain, bruising, swelling, or a visible mark associated with physical trauma. Red marks on both cheeks from being grabbed and pulled forward in a chair satisfy the visible mark element under Arkansas case law. Issue three, the felony enhancement. The thirdderee charge elevates to a class D felony if the victim is pregnant or with prior domestic battery convictions within 5 years. Without those aggravators, this case stays at the misdemeanor level. The officer mentioned the local jail was overcrowded and may not hold the defendant on this charge alone. Issue four, the Arkansas 1 party consent recording law. Under Arkansas Code section 5-60-120, a participant in a conversation may lawfully record it without the other party's consent. The husband recording his own conversations in his own home was completely legal. The wife's repeated demands to stop recording had no legal force. And I told him stop and he was pushing me and all.

>> Issue five, the predominant aggressor analysis. The lead officer's reasoning shifted in real time. He initially said, "I don't believe she's the aggressor."
After reviewing the audio recording and photographing the marks, he course corrected. Based on the recordings and the marks, she is the aggressor. Issue six. the quote state files charges not the victim doctrine. The officer explained that domestic violence prosecutions belong to the state. In every US jurisdiction, the prosecuting attorney files charges based on evidence, not at the victim's discretion. A spouse who later wants to drop charges typically cannot. Issue seven, the family witness corroboration.
The adult daughter, Lauren, told officers she heard her mother attacking her father. Combined with the audio recording and visible marks, the case became evidence rich enough for an arrest with full prosecutorial confidence. Issue eight, the recording versus threats distinction. The wife threatened to quote, "Make your life miserable and interrupt every work call.
Threats alone are not a basis for arrest in most cases, but threats combined with physical contact form a clear pattern of escalating conduct." Issue nine, the mental health versus criminal liability distinction. The husband mentioned undiagnosed signs of bipolar disorder and a failed Springwood admission attempt.

Daughter Lauren, A cooperated with police, provided witness testimony, demonstrated maturity in a heartbreaking situation. The husband B lawfully recorded, accurately reported events, but should have left the home earlier when threats began. The wife D returned to a contested home, escalated to physical contact, threatened her husband's livelihood and peace. Lesson one for couples. An Arkansas one party consent state allows you to record conversations you are part of.
Documentation is often the strongest defense in a domestic dispute. Lesson two, domestic battery prosecutions belong to the state. Once charges are filed, the victim does not have the power to drop them. This protects victims under coercion. Lesson three, family witnesses are admissible at trial. Okay, answer the phone. Do you want a divorce?" Fine. If you don't answer, I assume your lack of care. Talk to me tonight is the answer. because I was advised to just either say okay or I understand and not engage or get into arguments.

Okay? we're not we're going to be very nice with her cuz cuz I I get the feeling that maybe she there may be some mental health issues going on. Everything is about control for her. The the fight that started yesterday is my adult son, my my 19-year-old son, his girlfriend, who is also an adult, sent him risque pictures on his own phone that he pays for in his name. She took his phone, made uh made him let her read through it. She saw that. She said, "He's despicable.
She's despicable." She said, "You have 30 days to get out of the house. This is your eviction notice." She made him go buy a storage locker to start putting stuff in my work. I'm uh the the lead of of engineers for a large healthcare company. Uh they just went through a mass layoff yesterday. [snorts] So I was busy with I mean it's been a very bad 24 hours. She uh so she did all of this. So when I was finally done by about 5:30, I was able to sit down [snorts] with her.
I sat down in my daughter's room and I said, "I want to understand what's going on." Because she kept trying to talk while it was working. and she said um she basically decided what my opinion already was then got mad at me for it and I said no I said I'm not necessarily saying I disagree with uh everything you're doing but it's the way you're doing it screaming yelling running around the house screaming in their face taking people's you know property etc etc >> what was what was her name again just curious >> my daughter >> Lori >> Lori >> yes >> okay I was just going to tell her because she seemed sad I was just going to talk to We're doing that.
