Police cannot physically remove a child from a parent during a civil custody dispute, even when a court order is being violated; instead, they should document the violation and provide the involved party with a report number to take to court for legal resolution.

Maryland Lawmaker Argues With Officers During Domestic Dispute Call本站添加:
[music] >> On December 31st, 2025, police responded to a custody dispute that quickly became more complicated once a court order came into question. Hello, how are you doing?
Good, how are you doing? Did you call 911? No. No. No.
What's going on? I do you have any issues with uh baby mama or something like that?
>> Somebody called saying that whoever lives here, they have a baby that a kid in common or maybe they have the wrong address. I think you have the wrong address. We do have an infant baby but it's not ours. We've been married 10 years.
Just on the phone with her dad. Do you know anybody anybody named Shannon?
Shannon is my daughter.
Uh Yeah, she's great and um she does have a son there Landon and her daughter Aurora.
Okay. All right. Thank you. Thank you.
Yep, thank you.
How are you?
Yep, it is.
How are you?
Mhm.
Nope. Uh you can you you can leave them there. Yeah.
Yeah. My name is Officer Lopez, this is Officer Diaz. Everything is being recorded.
All right.
So, essentially my child son my child's son my son's father >> Father.
>> is refusing to return him.
Um we're on a holiday schedule right now. And uh let me ask you this is I guess there is a court order. There's a court Is it shared custody? No, it's primary physical with me and then it's joint legal with me having decision-making like tiebreaker. I know but there is a there is a point where he can where he can have the child that is Does it state it here on the on the order? Yes. What day is? So, it's So, his order today Well, yesterday he got him from 4:30 until 8:15 this morning.
So, I text him and I I "Hey, would you like to hang out later until 9:30?" So then he rebuttals back and says, "I want another overnight." And then he calls and he's just kind of like yelling and screaming and saying, "I'm not going to return him." Mhm. And I said, "We're on holiday schedule. Where Where's his Where's his home? 3127 Chessley Avenue. Chessley? It's about 7 minutes. Yeah, about 7 minutes away.
>> okay. Um so he get He's supposed to get him back tomorrow from 8:00 to 2:00 p.m.
Um he does get a Kwanzaa overnight, but it's He requested it too late.
>> So and and New Year's he's going to have him from Tomorrow he gets 8:00 a.m. to 2:00 p.m.
>> But today he had him? Today he I told him he could keep him until 9:30. And then he said, "Well, I'm not bringing him back because I want to keep him overnight again." So what what would you like us to do in this situation? I mean To bring my child home. So This this is all a civil matters.
We cannot go over there and rip him the child off of him even though you He's violating the order right now. This this is this is civil matter case. Anything that has to do with parenting, it's a civil case. You can actually go to the location, [snorts] bring the paperwork, and have an officer um escort you to the location and maybe have him go talk to him. If he says no, at that point that's it. We We can't do anything else because it's not it's not an abduction. It's not nothing to do with child kidnapping or anything like that. It's a civil matters.
It's a court order. He's violating it.
You can take it back to the court and say, "On this day he actually violated the order by keeping the uh the child on a time that he was not supposed to."
He's violating the order. He can, you know, like you can have that amended.
But when it comes to police, we can actually go over there, like but we have to go, like physically go with the paper.
Can we go together even if he says no, it's documented through you guys that he's violating >> What are you Let me call him.
Okay.
>> And if he says no, he's going to say no over there, too. Even if I bring with the order. You see what I'm saying? If he says no, he's going to say no over the phone and he say he's going to hang up on me and he say that's it. Now we we know that he's not going to bring And then at that point, what I'm going to do is I'm going to I'm going to write a report that he's violating the order. I'm going to give you a report number and with that report number you can go to the court and say that he actually is in violation of this court order. Okay.
>> And then they can make some amendments to the order. Will I get that paperwork today to be able to >> Well, uh we give you the report number.
Okay. And everything is going to be in the report in the next 48 hours. Okay.
>> Okay? Can you give me directions on how to pull the report as well? Oh, yeah, absolutely. So but let me call him first.
Yeah.
But Oh, it is 9:30. You say 9:30, huh? He's He told me he wasn't going to bring him back. No, not yet, sir. Are you bringing Are you going to bring him?
No, no, I'm just asking you. Are you bringing him back?
All right, thank you, sir. 9:30, all right?
Yeah, it's the same attitude that he But he's saying that he's going to bring him. That is not possible that we had.
Yeah. So it it it sounds it's it sounds like he's getting into a car, so it sounds like he I I heard the car. Let's wait until 9:30.
>> Yeah, I can We'll We'll wait out here.
Do you make yourself at home? It's cold out there. Do you want water?
>> We'll be in the car. Are you sure?
>> Oh, yeah, just just to be safe, we'll be here.
He'll bring the child back. That'll be the end of it and we'll we'll >> I would if you could So he has a car. He not He brings the child and the car seat. So if you could just >> car seat bring him It's a shared >> him I'll bring him in. I'll bring his stuff.
Don't you think he's Is this the way you have to like It's an expensive car seat.
Well, why is it expensive? Cuz it's just the safety protocol and it's like It is his That'll be just >> want I don't want I don't want to be like rude or anything. When you say the When you say if it's a special car seat for me, I'm thinking that the your son has some physical any like He has a special No, nothing.
Hey. No, I'm just very You're applying for one now.
>> moms who are like very up on like the latest like safety features and for car accidents or like neck injuries.
Oh, like over $300.
Can he get one for your son? It's possible, but I He just kind of do it like this. It's been working. Don't you think you can you go like little crazy over the car seat? Hey, give me my car seat. We The car seat has never been an issue. No, no. That's the That's the easiest part is the car seat. It's sometimes >> had an issue with the car seat. It's more like the exchange of the child.
where he gets and the idea of And he sounds very rude.
Very the way that he was talking to me was like Get off my phone. Get off my phone.
I'll We'll be out here.
>> give you guys some water?
>> No, we're good. We're good. We're good.
Thank you. Okay. We'll be out here.
We're here. We're not leaving you alone, all right? Yeah. Yeah, we'll be out here. When the father arrived, the call turned into a tense disagreement over the court order, making it clear this custody exchange was more complicated than it first appeared. I'm Douglas Young.
Can you talk to him about me? Too many people are here. I'm not I'm a local elected official right now. How you doing today, sir? I was good until this woman tried to call y'all on me just now. She actually She She actually said that you told her that you were you were not bringing the child back, that's why she called.
>> What does that matter?
No, it matters. What does it matter? Is the child here? I know. I know. But, I mean like she said that you said you were not bringing >> whatever she want.
It ain't even 9:30. She didn't give you the clarity that she had I had to >> She did. She did say 9:30.
>> So, she should have called you at 9:30.
Y'all should have reported her then.
>> You're right. You're right. Am I making sense? You're right. I ain't trying to [ __ ] on you when I say that. I don't mean to come with that energy towards you. I apologize if you felt that way.
I'm all right. But, I'm just saying she shouldn't be calling y'all until 9:30 if anything. Yes. You're correct. to after that. You're correct. I know. You need You need to know. I am. That's the more important While we're here, I have the court order prepared. I'm supposed to have an overnight during Kwanzaa.
Kwanzaa starts today.
>> tomorrow in the order say that you coming to get the child like 8:00 I have an overnight.
The The order I'll show it to you. It says >> a new one?
There's only one order. But, the Kwanzaa starts It starts today? At what time?
At what time the Kwanzaa starts today?
Kwanzaa starts every day from the day after Christmas to New Year's Day. I'm entitled The word is entitled in the court order to an overnight during Kwanzaa. So, you got to go and let her know that you wanted to take it or how that works? I've already informed her that I would like my overnight tonight.
Tonight is still Kwanzaa. Kwanzaa goes until the end of New Year's Day.
>> So, the the only issue with that is that it says very clear in the order that you supposed to come here on New Year's Eve to pick up the child at 8:00 a.m.
>> have There is nothing on the order that says anything about New Year's Eve. It does say It does not.
>> You should read it. I already saw it.
You didn't see that. You saw New Year's Day. I'm going to show you right now.
You can't tell me that.
>> I mean New Year's Day, exactly. New Year's Day, not New Year's Eve. New Year's Day, that's tomorrow. I'm very clear. But, New Year's Day is we were irrespective of that.
Tonight is still Kwanzaa. I've asked for my overnight all week. I've yet to receive >> say in the paper I don't see anything that says about Kwanzaa or anything. It is right here, sir. Kwanzaa, father shall be entitled to an overnight during the Kwanzaa period.
This is in addition, father shall have additional holiday time, which means I'm entitled to an additional overnight during the Kwanzaa period. I then additionally get time on New Year's Day.
Which is right here, from 8:00 to 2:00.
So, so irrespective of I'm holding >> What is it What is it that you want to do, sir? Because I'm >> I'd like to have my child tonight. I can't I can't stop you from doing what you want to do, but if she's saying that you're in violation and she go to the court and and she said that you're in violation >> I can deal with the court. I'm an attorney.
>> Then it's going to be on you, and it's going to be between you and the and the judge.
>> What's going to happen is she's going to be in violation when she doesn't give me my overnight. Let's make Let's make sure that we have the right proper context. I am I'm not saying I'm not Let me tell you why I'm skeptical. Mhm. The last time I had to deal with Baltimore police with her, Mhm. we were at her mother's house.
>> Mhm. She violated my rights.
>> Okay. She assaulted me. Okay. And then an officer charged me with assault Mhm. from the Northeast District. Okay. So, he keeps talking and he keeps saying about Kwanzaa.
So, he's keep bringing it back again bringing it out. So, I I just going to stand by and see what he's going to do.
Okay, he's coming.
All right. I do not appreciate you calling law enforcement here. You well know that I'm a local elected official.
You well know that this is a problem.
This is the second time that you called law enforcement on me. The last time you called me, you had me charged with assault.
And when you had me charged with assault, I beat the charge using your doorbell camera.
Because you assaulted me, and that's what judge said.
So, once again, so once again, I'm going to ask you to not do this. So, sir, sir, we're not arguing about that right now.
We're talking about the the child.
>> to you, sir. I'm not talking to >> Ma'am, do you want to talk to him? I would like my child. That's all she's I would like you if you're going to give me till 9:30, do not call the police until 9:30.
I've never violated I've never violated the time.
>> Your child is in the car, sir? He's fine and he's safe. And the car is on. The engine is on. You cannot walk away from a car when the engine is on.
>> now? Go ahead and do what you need to do, sir. Do me a favor and you let Major Brown know All right, miss sir. I don't have no issues with that. Nobody knows about you.
Okay. All right. Would you like a copy of the court order as well?
No, not because I mean like I said, anything that is happening here it's a civil matter. Okay. Yeah, so um I'm just going to write in the report whatever you just said, whatever he says and that should be the end of it. Okay.
Yeah, it's not this is not um a big deal of a report.
>> Right.
Yeah, but it's just for to keep it in record that you call in reference to your child custody. That's that's all it is. Trying to Mom trying to buy another house? Yeah, 22. Do you have all of two?
X2 yes for custody, child custody.
Two? One, two?
X2 no child custody.
X2 yes. The father pushed back over the early police call as old tensions between the parents resurfaced.
Officers documented both sides and treated it as a civil dispute. I received a phone call from your office at 9:15. Mhm.
>> [snorts] >> So, I'm trying to figure out first of all what's why I'm even here.
Why I'm dealing with y'all.
Secondly, so what I want you to understand is this is not the first time that she's leveraged the police to try to The reason I mentioned that I'm a delegate is because she does this. I've previously had to deal with an assault charge that she previously created that one of your officers put in because she lied to them.
Mhm. She so she told me that I had till 9:30 >> Mhm. and then I get here at 9:15, 9:20.
I got a 9:15 you got a call, 9:20 I pulled up. He asked me to tell you. Mhm.
And I'm trying to figure out why I'm even dealing >> So, so what's your main concern?
>> My concern also is Lopez. I think his attitude is poor. Okay.
Frankly, I haven't violated anything, but I'm the one that's having to deal with his attitude. I don't understand why. So, so let me get this straight. You have a joint custody agreement or is it just a mutual verbal support order?
>> Okay. through the proper procedures.
Um but other than that, from what I understand it was just a dispute. Um and he just got copy of the text? Yes.
Okay. It just It's just saying I don't know if if Lopez looked at these, but Now, here again, she's called y'all. She clearly gave me till 9:30. She clearly called y'all before 9:30 and she's alleging that I said I wasn't going to bring the child. I brought him early.
Mhm.
>> I've never missed a drop-off time. So, then that's what the report's going to say, right? I'm just making sure you understand before you walk away.
>> Yeah, I'm saying that. As long as you understand that. Let me finish, if you don't mind.
>> Yeah, go ahead. At a certain point it becomes an abuse and it becomes a perjury.
At a certain point she's got to You all have to understand [snorts] the pattern and practice that she's going through and that we've got to then have to address the fact that she's making these things up and doing these things. She cannot be weaponizing you all as a resource in that regard.
That's a That's inappropriate.
>> so let let me make this very abundantly clear. Every time that we get called out to a scene or a situation or an incident, it is handled independently.
>> Which one of you called me?
That's the That's the first thing he He was on his mind when he pulled off.
Uh okay. Who called me?
I think it was Lopez. He said they started you know going back and forth. I got you. All right. Well, let me call Lopez back, make sure he's good. But, that guy calmed down. He said he wanted to apologize to Lopez. So, All right.
Thank you.
