Stefan Borson REVEALS LATEST on Man City's 115 Charges & Chelsea's LEGAL ACTION over Enzo Maresca!Added:
The news coming in is that Chelsea could look to take a legal claim against Manchester City if and when Enzo Moresca is appointed as the replacement for Pep Guardiola. Pep going at the end of the season. Earlier this season, while still Chelsea head coach, it's understood Moresca held a meeting with City via intermediaries about taking over at the ETA. Not long after that, Moresca and Chelsea parted ways in acrimonious circumstances. Simon, you were at Stanford Bridge the other night. Can you give us anything more on that?
>> Well, I mean, it's it's similar but different to the sort of circumstances I had with Steve Bruce when he sought to leave and he had a notice period and couldn't just walk out the door and that's why he got injuncted and that's why David Sullivan had to pay me some money in the end to get him. I would imagine that the consequences and Stephan can add some meat to this in terms of perception is that the real issue is with Moresca and Man City might have to step in and bridge the consequences of Mesa's behavior and obligations that he has as a result of any deal he did on the way out. Because if he's under contract to Chelsea and that contract doesn't provide him with the opportunity just to walk out, then the fact that Chelsea have allowed him to do that probably has a sting in it in terms of some sort of consequence if he rocks up somewhere else. A bit similar like Ian Dowey going to Charlton and being injuncted by me and sued in court for fraud for representing it in the incorrect way and a bit similar to Steve Bruce trying to leave me having a notice period and then get injuncted stopping him going for Birmingham. But that's how I would read the situation. And I think Chelsea feel um or in fact I know Chelsea feel that someone's going to have to pay a rather significant amount of money to resolve this situation. I think there's little doubt in their mind that the deed and the and the seeds were sewn whilst he was Chelsea manager that Manchester City were potentially going to take him or wanted to take him or looking towards taking him.
>> Yeah.
>> And and various discussions went on between themselves and their manager how that looked and what it didn't look like look like. But I would imagine that Mesa's got because first of all, Mesa, from what I understand, resigns and then expects expects some sort of settlement.
I mean, I'm not entirely sure the guy's program for questions. If you resign from something, I'm not entirely sure how you think you're going to get paid up on it.
>> Okay. So, Stephan, should City appoint Mesa, Chelsea, it seems, will seek compensation from them with the added threat of disclosure about the terms of Moresca's departure from Sanford Bridge and what led up to it. It's quite murky, isn't it? Well, I look, they've been briefing that in the way that you've just described that they're going to complain. The first step will be to complain to the Premier League, but if they do that, they're going to lose control of the situation from a legal perspective because it will then end up being the Premier League versus Manchester City.
>> Now, those two parties occasionally have a a tussle. So, that could be another thing that they can have an argument about. I think it's pretty clear that intermediaries spoke to Moresca during the season. I don't think anybody would suggest that that hasn't happened.
>> Uh so we know that that did happen. We know that there was uh they were on behalf of Manchester City. Uh it's quite possible that it it was somebody playing both sides as we know that also happens in football. So City have probably done it uh in terms of the offense of tapping.
>> No, Manchester City always operate properly.
>> Well, of course. Uh but so they've probably done that. Um however, how does that help Chelsea?
Well, it does happen all the time, but I I don't what I don't understand is how that helps Chelsea in in their claim here. I think what's more likely to have occurred is that uh he left ultimately under some kind of settlement agreement legally and within that settlement agreement there was a clause that effectively said should you Enzo Moresca end up managing let's say Manchester City or somebody else within the defined uh agreement um before let's say 30th of June 2026 you will pay X million pounds. And so there is then an obligation on Moresca to Chelsea to make that payment. And clearly in the negotiation that Moresca has with his next club, he will say to them, I'm happy to join, but of course, you'll have to indemnify me for the payment I've got to make to Chelsea. And that's an expensive way of doing it because it's a benefit in kind. There's all sorts of tax consequences on top. But that's probably how the uh work h how the movement of the compensation would go. If that clause isn't there and this is just a bit of a tryon from Chelsea, I'm not totally convinced that they've got any claim at all just purely based on the fact that City had some conversations um in the middle of the season because ultimately that had no effect. It was settled between the parties. He resigned. They accepted his resignation. He left. They appeared quite happy to for him to go and and so you know it's hard to see what their loss is in any event.
>> Sure.
>> You don't miss being back in football?
>> No.
>> No, I don't.
>> I mean, in fairness, these are the sorts of issues that are alive in all sorts of businesses, you know, with senior members of staff, looking for a move, being tapped up by a competitor, being offered more money.
>> It's not just about football.
>> But of course, Manchester City would obviously deny there was any tapping up whatsoever of Enzo Moresca. Stephan, thank you as always. Stephan Boston coming in and we know a lot more uh after Stephan's been in studio than we did before. Um Stephan, before you go and you know what's coming, any news on 115 and City?
>> Well, Lord Panic, who of course is >> at some point is going to have to read, let's say, 5 to 800 pages of a decision about 115. He was busy on Southampton last night. So, he's clearly got a bit of time in his diary and therefore you would think he therefore has not got his draft decision yet from uh the panel and he still awaits that uh before he can start his work reading through that and advising the club on the next steps. So, uh you know, as I say, I think it will come uh as soon as the season finishes.
Um or well, within a reasonable amount of time after the season finishes.
>> Uh yeah. Well, I think into June, early June, I would think. Um, >> really, >> you know, but that's a guess.
>> Bloody no.
>> We might have to hold you.
>> I don't just to be clear, I don't express to know, right? All the best we can do >> near towards the end of the decade.
>> The the best we can do, he is he is almost right. The best we can do is base it on the knowledge that we have from the parties, right?
>> You know, noises.
>> Yes. um try and read between the lines and also look at the maximum it can take for a decision. There's almost no decisions that have taken longer than 18 months in British legal history.
