In legal proceedings, a defendant's lack of knowledge about the illegality of their actions does not automatically justify dismissing charges, especially when regulatory authorities have provided formal notice through cease and desist orders; the Georgia Board of Dentistry had informed Brandon Dillard nearly 8 months before criminal charges were filed that his unlicensed practice of dentistry was illegal, which his attorney argued should have provided sufficient notice of the law's requirements.

‘Atlanta’s top veneer specialist’ says he didn’t know what he was doing was illegalAdded:
Prosecutors say he ran an illegal dental practice without a license or dental degree. Now the man who called himself Atlanta's top veneer specialist is claiming in court that he had no idea what he was doing was illegal. Channel 2 consumer investigator Justin Gray is here now with these new developments in a story that Justin, you first broke back in 2024. Well George, this is the new motion Brandon Dillard's attorney filed in Fulton County Court this week claiming the charges against him should be thrown out because he had no way to know performing these veneer procedures without a dental degree was illegal.
We were there exclusively when investigators raided Brandon Dillard's allegedly illegal dental practice in 2024 and when he first appeared before judge from behind bars. Now Dillard has just filed this motion to dismiss or quash the indictment claiming he lacked notice that his conduct was in violation of the law. I've read the statute and it seems to be pretty clear.
So you do not find it vague? No, it it's the statute's not vague. We showed a former DeKalb County District Attorney Robert James Dillard's motion. Fulton County prosecutors alleged that for years Dillard called himself a veneer specialist making more than $4 million charging thousands not just for veneers but to train others to be veneer specialists or technicians. Something that legally does not exist in Georgia.
Dillard has no dental degree or license but his attorney claims in this legal filing that the defendants at all times believed that their actions and operations were lawful. You're not changing someone's tire, you're not washing their car.
Um it's a medical procedure. The original arrest warrant cited a letter and phone call Dillard received from the Georgia Board of Dentistry informing him they were investigating and telling Dillard to cease and desist his unlicensed practice of dentistry. That was nearly 8 months before the DA ever took any criminal action. If I were a judge, right?
And you're making an argument that, you know, he's he hasn't been put on notice because the statute's unclear.
And then the dental board act they puts him on notice.
Right?
Argument's over at that point. Doesn't really make much sense.
And Dillard is due back in court in June. He's facing a 110 count indictment on charges including theft by deception and practicing dentistry without a license, Linda. Wow, Justin, thank you.
