In criminal cases, especially those involving the death penalty, courts must allow testing of all available forensic evidence, including DNA and fingerprints, to ensure due process and prevent wrongful convictions; denying such testing without compelling justification violates fundamental fairness principles.

Tennessee Can't Put Man to Death Without Testing EvidenceAñadido:
In less than 1 month, Tennessee plans to execute Tony Carruthers without testing critical evidence from the crime he's accused of. Tony has maintained his innocence for the entire 30 years he spent on death row. There's no physical evidence placing Tony at the scene of the crime, and his conviction was based on testimony from an informant who was secretly paid by the state. Tennessee has DNA and fingerprint evidence that could prove Tony's innocence, and they refuse to test it. A state court recently denied a request to test that fingerprint evidence, so we're now challenging that decision in federal court. Tennessee must stay the execution and test this evidence before it's too late.
