I have looked at a lot of shoplifting cases, but this one out of Hot Springs, Arkansas on August 9th, 2025 hits different. A woman walks into a Walmart for bell peppers and peaches.
She has steaks tucked in her clothes and a trespass order she chose to ignore.

So, you have been trespassed from Walmart before in 23 several other Walmarts apparently. Um you're going to be charged with a felony this time and you're going to go to jail today. You are under arrest. Okay. All right.

That's what happened. Okay, then I need your EBT card with your okay, PIN number wrote down. Okay.
Because I have to have that to go back to her. Okay.
What should have been a misdemeanor citation is about to become a felony arrest. So, how does buying groceries carry the same charge as breaking into a building? Under Arkansas Code Annotated Section 5-39-201 subsection B, commercial burglary requires two elements.
One, entering or remaining unlawfully in a commercial structure.
Two, the purpose of committing any offense punishable by imprisonment.
[music] No broken window needed. No picked lock, just unauthorized entry plus criminal intent. A trespass order covers element one.
Concealed merchandise covers element two.
Both confirmed on this body cam.
But here is where I push back.
This statute was written for people breaking into closed businesses after hours.
Using it on a woman who walked through an open front door during store hours, that is a policy choice worth questioning. The trespass order is doing all the heavy lifting.
Arkansas Code Annotated Section 5 39 203 subsection A says, "A person commits criminal trespass by purposely entering premises owned by another person without authorization."
Ms. Mauer had been trespassed from this Walmart and several others. Her presence became unlawful the moment she crossed the threshold.
But from a defense perspective, the word purposely matters.
If she can argue she was never properly served with written notice or did not understand the order applied to this specific location, element one has a crack in it.
Slim chance given her history, but that is where a defense attorney starts. Now for intent.
Arkansas Code Annotated Section 5 36 116, the shoplifting presumption statute, states that knowingly concealing unpurchased merchandise on your person creates a legal presumption of intent to steal.
That gave loss prevention the authority to detain her and gave the officer probable cause. The concealed steaks lock in the purpose element because theft under Arkansas Code Annotated Section 5 36 103 is punishable by imprisonment.
But presumption is not conviction.
If she argues she had not reached the register yet, that presumption is rebuttable.
Weak argument with steaks in your waistband, but legally it exists. Here is where the case gets heavy.
Theft convictions going back to 2009, 15 years of documented offenses, multiple trespass orders from multiple Walmarts.
Under Arkansas Code Annotated Section 5-4-401, a Class C felony means 3 to 10 years.
Fines up to $10,000 under Section 5-4-201.
But, the real danger is Arkansas Code Annotated Section 5-4-501, the habitual offender enhancement. That could push the ceiling from 10 to 20 years.
A prosecutor looking at 15 years of priors does not need much convincing to file that enhancement.
This is not a shoplifting case anymore.
This is a career criminal file. The officer did something most officers skip. Within 30 seconds of arriving, he asked about trespass history before he even touched the receipt.
That single question changed this from a misdemeanor to a felony.
He confirmed prior orders through dispatch, applied the correct statute, and made the arrest without raising his voice or using force. When Ms. Mauer struggled to stand, he adjusted.
No escalation.
Textbook work.
My one critique, she asked to call her niece waiting in the parking lot.
He said, "No."
He had no legal duty to make that call.
But, a 30-second phone call costs nothing and keeps a family member from sitting in a lot wondering what happened.
The law did not require it. Good judgment would have.

I give her credit for that.
But she walked into a store she was banned from, hid merchandise in her clothes, and carried a record going back more than a decade.
The system gave her chance after chance.
She drove past every off-ramp. Lesson one, a trespass order is not a warning you can ignore.
It is a legal tripwire.
In Arkansas and most states, walking into a property you have been banned from while intending to commit any crime upgrades the charge to burglary.
A felony.
No breaking required.
Step through that door again and you are stepping into a felony.
Lesson two, your record walks into the room before you do.
A first-time offender in this exact situation probably gets a misdemeanor and goes home.
Ms. Mauer got a felony because the system saw 15 years of prior convictions.
If you have a history, the margin for error is gone. Lesson three, cooperation is not weakness.
It is strategy.
You have zero constitutional protections in a parking lot.
You have all of them in a courtroom.
Fight at the scene and you add resisting arrest and whatever injuries come with it.
