Kentucky HB 568 restricting public adjusters draws legal challenge ahead of Monday hearing

[00:00:00]Kentucky General Assembly passed House Bill 568 modifying licensing requirements and fees for public adjusters. I spoke with an attorney for a group that says this bill strips policy holder protection. It's tonight's big story at 5:30.

That's what Brian Goodman told me regarding Kentucky House Bill 568, a bill detrimental to Kentucky citizens specifically for two reasons, according to Goodman, general counsel to the National Association of Public Insurance Adjusters. First of all, no new licenses will be issued to public adjusters for 2 years. Second, They also have specifically said that public adjusters can no longer negotiate insurance claims for claimants. This would be the only state in the country that would do anything remotely like this. This is from Kevin Stamper of Thoroughbred Alliance Group who lives in Kentucky. Part of his reaction, quote, "What we're seeing is a coordinated shift changing the rules at the state level to control claim outcomes. After a storm or fire, homeowners don't need fewer options.

[00:01:15]End quote. It raises the question, What would be your response to people who just feel in general public adjusters are being singled out by this bill? This bill is only directed at public adjusters. It's very draconian and we don't think it's legal.

[00:01:28]I reached out seeking comment from sponsors of House Bill 568. A spokesperson for those sponsors said they don't comment on pending litigation. There's a hearing about this bill scheduled for Monday at 2:00 p.m.
