Welcome back to Advocacy Alchemy. Let's watch a video together, guys. This one's from the Tampa International Airport and it's brought to us by Law and Body Cam.
This is a video from just last year.
Don't be this person, okay? This is somebody who's going to dine and dash.
So, just to give you an idea of what we're watching, this is a good one.
I'll call a lawyer. It's not working. I don't know what to do. I mean, I don't know what else to do. It's not working.
That's not working.
>> Welcome back to Advocacy Alchemy with Professor Ross. Today, we have a good one, guys. Let's go back to July 19th, 2025. Let's go to the Tampa International Airport. Now, usually when people think of the airport, they think of delays and overpriced snacks. Now, one traveler, well, he had a $19 restaurant tab that turned into a full-blown nightmare. ass. We're going to look at the intersection of a misunderstanding and criminal fraud.
This video, it gets ridiculous here.
Okay, but this is a good one. Let's watch the video first. We'll talk about the law second. With that, let's jump in.
>> I don't know what to do. I don't have my car in the bar. You call that place. You want me to come with you? I'll go with you. Talk to you somewhere. Private.
>> Okay. Well, you got to pay your >> Can't do it on my >> All right. So, this one starts right off. Uhhuh. The police are are already interacting with him. All right. So, look what time it is, guys. It's 1:20 in the afternoon. This is July 19th of 2025. Okay. So, the police are already with him. There's a person from the restaurant right there. Let's watch what's going to happen.
>> Talking right now.
>> I want to talk to you like here.
>> What do we need to talk about?
>> I don't know. What do you want to talk to me for now? I'll talk to you right here.
>> You owe a bill to >> I don't know.
>> Well, check there and it was in there for a while.
>> I agree with that. I >> You didn't pay.
>> Okay.
>> Cuz we checked >> and he hasn't paid. He left his visa there. He flung his visa.
>> Sorry. Pay on that.
>> And >> I didn't realize it. I I dropped it. I'm sorry.
>> His phone.
Can I go over there?
>> Yeah. So, the big issue nonpayment. You heard that he tried to throw his uh Visa card, his uh credit card at them. And apparently they may still have the card, but obviously the car is no good because they weren't able to charge it and they had to call the police because this guy didn't pay his bill.
>> They don't have don't have a lot of options.
>> Screw me back.
>> They wouldn't pay with it. And I was like, >> "You have the means to pay for the bill?"
>> Absolutely. I tried to pay my cards to take filming behind the bar when I was trying to put my drink there. Pick it up for me. They wouldn't do it.
>> Well, if you pay for So, look, he actually left the restaurant. He was at this PF chains in the airport there. He left the whole restaurant, went over to his gate, and wasn't going to pay.
>> We won't have any issues.
>> I don't even want to talk to you guys, but I will. I can't talk here. Honestly, >> there's nothing to talk about in private. You need to pay for the bill or >> you're going to go to jail. So, >> okay. I'm just saying.
>> All right. What?
>> I got your Visa. You don't have any credit cards on you?
>> Nope. Check my bag.
>> So, how are you? No, >> I got >> So, you're planning on paying with your cable, man. What the hell's going on?
>> Well, you walked out on a $100 tab.
That's what's going on.
>> I got a different $100.
>> I know. I don't want you just sitt >> So what what I don't understand is um how do you up a $100 bill eating lunch right there or something? Uh he must have drank a bunch of drinks or something because that seems kind of high for just one person.
>> We do this 100 times a day. Okay.
Whenever payment comes up, it processes the princess receipt and drops off the register. In the event that it doesn't drop off the register, there's a button that we can push that prompts the payments to come up. Neither of which were done. I have a full receipt here with more on it.
>> If there was payment, there should be a receipt. If he could provide to you, >> I'm going to give you one more option.
Either you pay or you go to jail.
>> Either you pay the bill, >> that is your balance, dude. 109 is your pay.
>> Okay. I don't know what to do now. I don't know what to do about that. You want to go to the hotel where it's at?
You're driving there. It's at Opal something in Clear Water. I paid for it already. You can ask the bartender. He has my card. I left it there.
>> Opal Hotel.
>> You have another way of paying.
>> I do not.
>> Okay.
>> I don't I don't know what you're going to do, man. I flew here. I saw someone on a plane. Really?
>> All right. Yes. If you're traveling, always keep just a little bit of extra cash on you. $100, $50, something just in case something like this comes up, you can at least pay the tab and keep going about your business. Now, I don't know what he's talking about. He might be just trying to run a scam. He might have actually lost his wallet or his card or something like that. Uh I don't know what he's trying to pull. Usually, you would try to tell someone this in advance. All right. You don't want to look like you're trying to run a scam.
>> Don't I have money?
>> Prosecute.
>> Yeah, sure. Okay, >> there we go.
>> Well, if you have no way of paying, you're going to go to jail.
>> I want to pay and no one will bail me out. So, what to do? No one would bail me out.
>> Okay. What's wrong with your phone? Why won't >> die? So, I came to charge it and it don't work on this. Can I just pick it up there? Like [ __ ] >> I'm sorry. There's a misunderstanding. I might not speak English sometimes.
>> You don't speak English >> sometimes.
>> It doesn't make me You're speaking perfect English. So, >> okay.
>> So, what's the issue with the payment?
>> You guys aren't understanding. Now he's saying he speaks multiple languages and sometime he doesn't speak English. So I I don't know. He's just being flippant right now. This uh this officer is right there in front of him though. Really isn't having much of any of it. Right.
He's he's like, "All right, I'm just ready to get the word. We're going to arrest this guy."
>> Do you not have the funds to pay for it?
>> Paid.
>> Did not pay >> on my phone.
>> It did not go through.
>> I don't want your phone in the bill.
>> If you're not paying this now, understand you're about to go to jail.
>> All right. Can I try it?
>> This is your last chance. This is your last chance.
>> Okay.
>> You paying this place. Which one? Two of them. Tell me, please. I don't know what I'm doing.
>> Scan this one.
>> Two times.
>> Just scan it. Or you >> stop playing games and scan it.
>> Okay. Do you not have a card with you?
>> I don't have anything. Look at everything. Look through everything.
Please. I can't find my card or I really can't find it. There's nothing illegal.
I just can't find my card. If you can find it, I'll call him or I know his number.
>> Okay. If you knew you didn't have the card, why would you come here and order food?
>> And it don't work.
>> Okay, but wouldn't you verify it with them that it worked? It doesn't work because you don't have a physical card with you. That's why it doesn't work.
>> I called and said I didn't need it cuz I Uber myself. I'll do that. I got Uber right there. I'm not even picking it up.
I already ate it.
>> You knew when you sat down.
>> Yes. I did not have the card. No, I did not have >> Then why would you order food?

>> Never mind. Hold on. Let me do that. I should have done that first place. And that does kind of make sense, right?
Wouldn't you, if you didn't have your physical card on you, wouldn't you ask the restaurant beforehand, hey, do y'all take Tap to Pay or Apple Pay or whatever kind of phone he has there? Maybe that's a a Google Pay or whatever.
>> I thought I probably made a mistake. One second. I'll Uber myself right there, man. I'm not getting >> So, now he's trying to talk about he's going to Uber the food. He's going to Uber eat the food or at least the the cost.
Maybe he has somebody else's phone.
Maybe it's a stolen phone.

>> You said Uber yourself?
>> Yeah. Food to right there because I eat it.
>> No, you're gonna be in the back of a police car going to jail in about 20 seconds.
>> I don't even want to hear. If you can't pay the bills or you going to jail, >> please right now myself right here. One second. Please watch. If I don't, you take me to jail.
>> No, that's not going to happen anyway.
But it's not It's not Let's make a deal.
>> It's not working. I'll call a lawyer.
It's not working. I don't know what to do. I mean, I don't know what else to do. It's not working. That's not working. I'm working. I'm here. Extra shirt that extra in my bag. See it? I'm on a job. I work. Take me to your job. I want to go.
>> Explain to us.
>> I don't live here. I don't live here. I don't understand.
>> I live in Pittsburgh, Pennsylvania.
>> Order a service.
>> No, I flew in business.
>> All right. So, he's down from Pittsburgh, Pennsylvania from uh and he's down in Tampa. He says he's down there for work.
Now, somehow or another, he's lost his credit card or his millions of paying.
He didn't take any cash with him. And he's in this situation.
You ordered food? Yes.
>> You had no means of paying for it and you knew that.
>> Now I do. Right. You're not waiting.
>> Why would they wait? I have to remember my password. So, give me one second.
Man, you guys are fast here. Wait, I typed the wrong email. One second. New email. My wife stole my phone and Pford.
One second or take me somewhere use my phone while it was locked cuz it's easier to do standing here. Open Uber Eats app.
>> You can't pay them with Uber Eats.
>> No, I can't. They call me unlock. They call me on phone. I know. Wait one second. I have the app actually. Just open that app. Verify that please.
>> No, I'm not verifying anything.
>> Can I have my passport back then before we go to jail? I don't have my ID. I need >> You're not You not positioned to ask for anything? I think so. I need it back.
>> They need their money also.
>> Give him a passport. I give him the passport.
>> It's not Let's make a deal. So, you're going to deal with it. You can't pay.
>> All right. So, it sounds like also that the restaurant is holding on to his passport right now. Maybe they have to verify his age because he bought alcohol. So, he ran up a hundred more than $100 tab there. That's the issue here. He can't pay. And now it looks like he's probably going to be taken to jail behind this.
>> Got the other stuff after that walker.
You want to take outside?
>> I can't hear you.
>> Can you take me outside?
>> As soon as we're finished, you're going.
>> I got to pay for it.
>> Let me Can I go my bag? Sure. Sure.
>> One second.
>> Good to go. All right. Turn around.
>> Hands behind your back.
>> Thanks, guys. I appreciate this.
>> Could have been avoided.
>> It's in bag. Not expert. Please look at my shirt cuz that's what I'm here for.
>> Let's go outside information.
>> Here. I didn't do anything. I'm not a bad guy. I My mom won't tell me your dad's last name. And I Googled it and she's going to me. So talk to me. You got cameras. I'm not doing anything.
I'll pay right now. Try three times. You guys know this. So what's up? Where do we go?
>> You're going to go to the back of the police car and then or in jail. Can I call somebody first? My mom. I'm not jail yet. I want to talk to my lawyer then before I go. You need to arrest me up.
>> Help you out.
>> Yes, sir. Hope you don't mind if I lean on your car for a second.
>> Hey, literally.
>> You got to be staring at me. This >> guy's taking your belt off.
>> Kind of strong, but he doesn't need to be drinking. Um, especially if he's This could happen to anybody, right?
This really can't happen anybody. you can forget your wallet at home or something like that. But usually, you would be able to make good on the bill.
You would tell them, "Hey, look, hold on to my driver's license or let me call someone to get the money up here to me."
Now, he's traveling. He's out of town.
He has no money on him. That's uh I don't know.
Usually, make sure you double check before you leave and go somewhere if you have at least some emergency cash. Once again, >> if I was down, I'll just pay right Apparently 52 days. That's why I'm beard now. There's a shave. They only give me a razor.
>> All right. I'm going to go over here.
>> Okay.
>> Come on, sir. Here's the deal, right?
I'm going to I'm going to pat you down and search you. Okay. You going to be compliant?
>> Absolutely. I'm always you guys. I like you guys. My brother's not even >> turn around. Do it every time. Spread your legs, please.
>> Water.
>> Yep.
>> I don't do that. You can check my arms.
If you take my shirt off, I'll show you my name. So, my arm literally attached it in case when I go to Jamaica, someone cuts my head off.
>> Sorry, guys.
>> Do it again. I'll hold it up. I can I just >> You're too fast. Just put it up and I'll hold it with my legs.
>> Have a seat. Have a seat. Have a seat.
>> I want to go there anyway.
>> All right. Craig goes to law and body cam for this one, guys. Hey, if you're going to be traveling, the biggest tip, always carry some extra money with you.
Okay, just in case if someone steals your wallet, someone uh you you leave a card somewhere else as you're uh traveling, all that, you need to have something extra on you for emergency purposes. He had nothing on him. He had no ability to call anyone uh to get someone on the phone even. Uh uh remember, if you ever get in this kind of situation, you can always call someone also, okay? call uh a family member, let them give their car over the telephone and it could be ran that way also. Okay? So, don't let yourself get arrested when you probably can work this out. He said he had no one who could pay for him. So, really, he put himself in this situation. All right, let's talk about the laws. There's only one law we're going to deal with here, and that's that's obtaining uh food or services through fraud. Okay. All right.
So, all right. We'll let that one law pop up here so we can see.
And it's obtaining food with the intent to defraud. That's what that's what the law is we're going to be dealing with today. Let me get it pulled up here on the side also. And here's the law here.
It's available right now in the in the uh Google Drive.
And we also get it pulled up over here. All right. So, as you see, the law is fairly simple here. It's found that um the Florida statutes well, let's go back.

together. Anyway, >> so as it's trying to get there, anyways, there's only uh a couple of elements here we have to deal with with this one.
All right, now we got to pause there.
All right, once again, so this is obtaining food or lodging with the intent to defraud. All right, any person who obtains food, I have that part highlighted here for us. and it's going to be a misdemeanor of the second degree. Remember, these secondderee misdemeanors carry up to 60 days in jail if a person is convicted here. They're going to have everything lined up for him. Okay? They called the police on on him and they called the airport police.
They're in the they're in the airport.
So, that was an easy easy call. They come over, they have to go find the guy first. Okay. So, he actually did get up and leave. So, that does also play into the intent to actually not pay. All right. he left and he didn't try to stay there and handle the business of making sure these people were going to get paid. So, I think that's a pretty easy charge for them to um to win on. Now, the whole thing here, what's going to happen behind this? He'll probably be able to pay that um that ticket that's involved, the restitution. Um he might be placed on some uh probation or something of that nature.
All right. So, let's um move into our evidentary standards.
They're important every time we're going to be dealing with uh something like this where you might have to have a police interaction. Don't be the person that's trying to dine and dash like uh our person here. We don't have his name, so we can't look up to see what actually happened there in Tampa. He's not even from Tampa, guys. So, he's going to he looks like he's traveling back home to uh Pittsburgh where he says he's from.
So, um look, that's going to be some extra uh time he has to spend in Florida when he probably wants to get home.
All right.
Okay. So, our standards, we talk about these daily. Uh let's move through them from our lowest to our highest. So the first one we always deal with is mere suspicion. Now what that is is simply when someone's going to contact the police and tell them, "Hey, look, we need you to come out to handle whatever issue." The thing is when the police uh when they arrive on the scene, they're just going to be at the level of mere suspicion and just have a hunch that something's wrong. All they have is the hearsay. They just have the information they got from the phone call. They haven't been there yet to actually ask the person and basically have them under oath that they're telling the truth about whatever incident they're talking about. Now, once the police arrive, all right, they're going to be on high alert looking for any and every violation. All right. Now, they don't have any real proof just yet, but they're going to be looking for it as soon as they arrive here. That's when the restaurant PF Chain calls the airport police and says, "Hey, look, we have a patron who just left and they did not pay. They arrive and they go find them." Once they find them, they're going to be at this level of uh our next one here, reasonable suspicion.
So, at the level of reasonable suspicion, that's when the police actually have articulable facts they can point to to suggest that there's some criminal activity that's happening. Now, what's our criminal activity today?
That's a person here that obtained some food or services by some means of defrauding them. Okay.
So, through some scheme, he defrauded them out of food. He basically came in acting like he was going to pay. He ate uh to his field and he could not pay.
All right? So, that's an issue. That's going to be an issue everywhere you go.
Okay? Don't be a person that dine and dash. Now, this is funny because it's this is a simple this is something petty.
No one's going to be hitting the head forever over this little simple D and Dash $100 bill. Now, he's going to get some u he's going to get a penalty behind this, more than $100. He's going to probably get maybe some probation, couple months of probation behind this and um it's going to affect his life a little bit, but it's not like uh anything serious. I don't expect any jail time to come behind something this simple. All right. Now, at the level of reasonable suspicion, the police can detain you and they can go into an investigation to see if there's actually a crime that's happening. Now, that detention cannot last forever. Now, during that detention, sometime the police will place a person in handcuffs.
They may even store them away in the back of a police car while they're investigating a scene. That does not mean the person is actually arrested yet. But what it does mean is the person is not free to leave. All right. So during reasonable suspicion, the suspect is not free to leave.
All right. Next we have probable cause.
Now once the police can reach this level of probable cause, that's where someone's going to be arrested. Now, this level means that the police have gathered enough evidence that it would lead a reasonable officer in their same shoes to say, "Yes, we have enough evidence to make an arrest." Here, they have a witness statement that he did not pay. They have the receipts showing uh um that it was never cleared in their system. They have an explanation from another worker there of how that system works. And then they have him back here trying to explain about why he didn't get paid. So I think they've met all the elements here of showing that he did actually have some sort of scheme to defraud them of their payment.
All right. At the level probable cause, remember someone's going to be arrested.
That's the big key point there. Also, when the police reach probable cause, they'll have enough evidence gathered where they can go back and request a judge sign a arrest warrant or that they give them a search warrant to go back and search for certain property.
All right, our next one is going to be uh preponderance of the evidence. Now, at this level, we're going to be actually in civil court. Now, remember, civil court is where people are going to settle their issues and disputes, and the final result is someone's going to be asking for money. Okay. So, at the level of preponderance of the evidence, what's going to be required is that you have at least 51% of the evidence in your favor. That means that the claim you brought is more than likely true.
So, if you can make the balance tilt in your favor, then you can win. Now, if the other side comes and they have a good defense and they tilt the balance in their favor, they'll win. All right?
So this would be uh if the restaurant P of chain tried to sue this man, this is what they would be bringing and this is the level they would have to achieve.
They need 51% of the evidence to win. I believe they'll be able to get that very easily here in this case. Okay? Now understand that a civil case is actually different than a criminal case. Okay?
Civil cases require less evidence than a criminal case. We'll talk about the criminal standard at the very end here.
So next you have clear and convincing evidence. Now this is a level that's in between the usual civil standard of 51% and the criminal standard that's about 95%. Okay, clear and convincing evidence is going to be the standard whenever you're going to be required to have more evidence to prove your point. This level means that it's highly probable that the claim you're bringing is true. To win your point, you're going to need somewhere about 75% of the evidence in your favor. All right? So, that's much higher than just having 51%. All right?
Now, to lose, you lose by not getting to that level of 75%. You see this standard used when you're talking about um uh certain government agencies that are bringing you to court. Uh so, IRS, DMV, uh housing authority, all those different agencies are out there. when you have those different commissions you go in front of, it's clear and convincing evidence you're talking about. Now, you'll also see this used sometime in in the criminal circumstances when you're talking about bond situations. If a person is determined to not be given a bond or or or a no bond situation, then that means that there was clear and convincing evidence that was put on that there will be a danger to the public or that they will uh um jump bail or not return to court.
All right. Finally, let's move up to our highest level, which is going to be beyond a reasonable doubt. Now, this level, beyond a reasonable doubt, is reserved for every uh criminal case that's brought in America.
We'll let these two finish trying to convince that judge there.
All right. So beyond a reasonable doubt, this level means that there is no other reasonable uh or no other logical conclusion that a person could come to besides the defendant being guilty of the charges brought against them. All right, this is uh once again used for every criminal case that's brought here.
In this situation, the government's going to need to prove uh uh this point by having somewhere between 90 and 95% of the evidence in their favor. Now, from what we heard from this man, he really didn't put on very much evidence of all or at all that he was going to be able to pay. He had no card. All right.
What we do have is information that he threw a card at them that was not working. He had no cash on him. He had no one he could call to make a payment for him. So right now it's really looking like he would be probably found guilty of this charge of trying to defraud this um restaurant in order to get food without paying.
So that's just how it sort of tumbles for him here. Not saying he's a bad person or not, but he definitely didn't have money to pay in this situation. You have to be prepared when you're going in and especially if you've already consumed the goods.
So, you all tell me what you think about this one.
Okay. So in the end, the suspect's choice to prioritize some kind of creative narrative over the simple transaction, that's what ultimately sealed his fate here. Now, in the eyes of the law, once that meal was consumed and the ability to pay was absent, the misunderstanding transformed into a criminal act. Remember, especially in Florida, the law isn't that you need to announce that you're going to steal.
It's your behavior, the excuses, the failed suggestions, and the inability to produce a working card. All that's going to serve as evidence of intent.
