How Much Compensation Could Just Eat Driver's Get?

[00:00:00]So, following my video about the just lead day legal claim, I've had quite a lot of questions. And it's fair to say that most of them fall into two categories. First one being is, is this actually legit or is it a scam? Well, first thing I can answer is yes, it is definitely legit. If you look it up online, you'll find loads of articles about it. It's going through the court as we speak. The second one is if drivers were to win, how much compensation are we likely to get? Now, this one's a bit more of a nuanced answer. So, just for a bit of fun, this is obviously not actual advice. Uh, I popped it into chat GPT to see what chat GPT would come out with. Um, so we're going to go through the answers because there's five different answers, five different scenarios that this came out with. Just for anybody that missed out on the first video, the court case is basically to decide whether justice is classified as workers in this right way.

[00:00:58]So at the moment we are classed as self-employed contractors, but the argument is is that the uh have a lot of control over our work. So we should be classified as limb workers. And if we win the court case, we could be entitled to thousands in compensation for things like backdated holiday pay, national wage shortfalls, and the fact that we did not have a proper worker protection contract in place. As well as this, Justine might be forced to completely restructure the way that they work their app. Scenario one covers the casual side hustle driver that's only driving maybe 8 to 10 hours a week, and they've been doing it for less than a year. These people are definitely not buying a brand new Lamborghini, but they might be looking at something like 500 to,400 before legal fees. And after deductions, that might be 350 to,000.

[00:01:49]Scenario two, the regular part-time driver. If you work consistently for about one to two years and you've maybe done 15 to 20 hours per week, you could possibly be looking at £2,5,000 uh before the fees and maybe £1,300 to £3,500 after the fees. Scenario three is the full-time grinder. Now, you know who you are, and I probably fall into this category a little bit as well. Uh the drivers are doing 30 to 40, sometimes ridiculous hours every week. the ones who know every McDonald's delay pattern.

[00:02:32]If you did two to year 3 years or even more potentially you get 6,000 15,000 before fees probably £4,000 to 10,000 plus after deductions are made.

[00:02:46]Now that is serious money. Now, I think I got it wrong at the beginning of the video because I said five cases, five different scenarios, but actually four.

[00:02:53]So, scenario four is the absolute top end cases. This could be drivers with years of full-time work, strong evidence, and detailed expense records.

[00:03:06]Um, and I could go back. I've got screenshots of every week that I've worked. Um, so it could be me. I don't know. Um, these cases could potentially go for higher. I think 15,000 to 30,000 plus the four fees. But let's be real, these would be exceptions, not the average payout. No, that is Yeah, probably not going to be me. Um, but this all does lead me into the same sort of thinking. There's a few people out there that are saying to me, I'm not going to bother with this claim uh because I'm just going to go on my own.

[00:03:48]Now, there are fees. Uh lead days 25% plus fat. Um but from my point of view, this is money that I wasn't expecting to get and I think it would be very difficult to try and do this on your own. Now, you wouldn't necessarily have to pay for a solicitor or a lawyer, but I think it would be much easier. And I think you'd probably have to go and ask for all your data from Just Eat and then find a way of analyzing that data to get yourself uh an idea of what your compensation would be. Um, within this claim, I'm guessing that Lee Day is going to deal with all of it for you and just tell you what your payout is. For me, that's just much simpler. And also the fact that is no win, no fee. You don't have to take all the time to gather all your evidence or pay somebody to analyze the evidence. It's all just done for you.
