This video analyzes a real-life incident where undercover Gastonia Police officers shot and killed a man who was carrying a fake gun at a gas station in North Carolina. The key legal considerations include: (1) The suspect was verbally threatening and making threats about 'losing your life,' which could be interpreted as a threat to life; (2) The suspect was leaving the scene but still had the fake gun in his hand, creating an ongoing threat; (3) The officers were not charged because the gun was fake, meaning no actual lethal threat existed. This case illustrates the complex legal standards police must follow when using deadly force, including the requirement to assess whether a person poses an imminent threat to life, even when that person is attempting to leave the scene.

Perp w/ FAKE GUN F***S UP BAD | Undercover Gastonia Police UNALIVE Man... SELF DEFENSE or M*RDER?Added:
All right, guys. So, this is a bit of a different video here. This is one of those videos where I genuinely want to get your opinion on it and see what you think. You know what I mean? Uh, no high-speed police chase, no charges, challengers, scat packs, hellcats, none of that in this video. This is one of those kind of police involved encounters that happen in my state. Actually, Gastonia, North Carolina, which is 20 minutes outside of Charlotte, North Carolina, which is where I live, 85 south, like you're going towards Atlanta. So, this hits home. I actually know exactly where this gas station is.
I've been here a couple times, so I this hits home a bit differently. This video has been making its way all over social media, going viral on some of the platforms, and then obviously people in North Carolina are talking about it. So, let's watch it and then we're going to talk about it and I hope to get your uh opinion down in the comments. Let's go.
All right. So, boom. This comes from uh Twitter here. Uh CLT uncensored.
Gastonia police re released surveillance video from a convenience store shooting where two plain closed detectives shot and killed a man earlier this year.
investigators said the gun he was carrying was fake. The officers involved would not be charged. So, I want to get your opinion on this and you tell me uh did the officers do the right thing and did the court system do the right thing for not charging them. Let's get into it.
I just said what's up.
>> I just said I said what's up. That's it.
[ __ ] I was being polite my [ __ ] [ __ ] Straight up. [ __ ] type of time you on [ __ ] Yeah, I'm like that. I'm like that for real.
[ __ ] trying to lose your life tonight.
>> Upper right hand corner red track says three times you trying to lose your life tonight.
>> Pay attention to this guy right here.
>> You better leave me the [ __ ] alone.
>> Straight up, bro. I ain't the [ __ ] one, bro. I promise.
>> There it is. Pulls it from his waistband.
>> I promise you won't be the first time.
Yeah, this will be the last time.
>> I promise you ain't the [ __ ] one. Look at the communication between these two guys.
>> Yep.
>> Get on the ground.
>> Grandma, go outside, bro.
>> You better leave me the [ __ ] [ __ ] with you. Straight up, bro. I ain't the [ __ ] one, bro. I promise you ain't pulls it out the way.
>> I promise you ain't the first time.
>> Yeah, this will be the last time.
>> I promise you I ain't the [ __ ] one, [ __ ] Look at that communication.
>> HEY, WHERE AM I? DOOR DOWN OUTSIDE.
>> ALL RIGHT, so you saw that situation that happened there. Uh, long story short, there were two plane clothes officers under detectives undercover at this particular gas station. The guy with the red uh tracksuit, the red outfit on had a altercation with the brother in the uh the leather jacket.
That altercation spilled from outside to inside. the man in the red jacket decide or the red outfit decides that he's going to up it, you know, from his waistband and that's when one of the plane clothes officers decided to fire.
The question is, you see the man in the red uh tracksuit with the door open. So, he's technically leaving. He's leaving the scene.
A lot of people are saying that because he was leaving the scene, he was fleeing. Therefore, he didn't deserve to be shot. Let's watch it again and we'll talk it out this time. So, you see the altercation outside.
just said what's up.
>> I just said what's up.
>> I said what's up. That's it, [ __ ] >> And obviously this is surveillance camera from outside the gas station.
>> I was being polite, my [ __ ] [ __ ] >> So they didn't name the other uh plane closed officer. At first I thought it was this guy and that's why there was so much communication between him and the other officer inside of the uh gas station, but I don't know that for a fact.
>> Straight up some type of town you want, [ __ ] >> So they all they arguing.
>> I'm like that. I'm like that for real, [ __ ] trying to lose your life tonight.
>> So, you see they're in the gas station.
You can uh see the brother here in all red. He's screaming, "Do you want Are you trying to lose your life tonight?"
Says that three times. So, I mean, I guess you could take that as a threat.
You trying to lose your life tonight?
Here is the plane closed officer over here looking suspicious as [ __ ] He's not in line buying anything. He's not looking for anything. He's not playing with the scratchoffs. He's literally just looking like an undercover plane closed detective if you ask me. As soon as I walk into a gas station and I see somebody just standing in the corner observing everything, my antennas would have went up. So, uh, he says, "You're trying to lose your life three times."
>> You better leave me alone.
>> So, you hear what he says? You better leave me alone. And then he turns around and says, "You better leave me the [ __ ] alone." He's walking out. He's on his way out of the grass gas station.
>> [ __ ] me. Straight up, bro. I ain't the [ __ ] one, bro. Boom. Pulls out the hammer. You know what I mean? Pulls it out like that. And now it's a it's a situation.
>> His hand is in his jacket. I don't think he ever removes it.
>> Yeah. This last time.
>> So you see the guy over here, the plane closed officer. He motions to the guy, I guess, to calm down or something like that.
>> And then you see him motion towards that other plane closed officer to calm down or something. And so that's why I thought that this may have been the second plane closed officer that was in on this investigation or plane closed detective because he's motioning towards him, hey, calm down. Almost as if to say, don't do it to him. You know what I mean? Don't do it yet or don't do it period. He's walking out. He's already opening the door, but he's still got the gun in his right hand. You know what I mean? He still poses some sort of threat, but he's leaving.
Literally, as soon as he turns his back, that's when the plane closed officer decides to go off.
But did he really turn his back? Cuz as the plane closed officer is pulling out his firearm, he's still inside of the gas station with his firearm in his hand.
>> Yeah, >> this guy is awfully calm for there to be a shootout right in front of him. That's what leads me to believe that he might have been the second plane's closed officer. Plane closed officer >> outside.
>> So look, here's a better angle.
>> Ain't nobody [ __ ] with you. Straight up, bro. I ain't the [ __ ] one, bro.
>> Pulls it out. Ups it.
>> I promise I disagree last time.
>> Now look at this communication between this plane closed officer and this man right here. I promise you ain't the [ __ ] >> So, this has to be the second detective that's undercover because they're communicating with each other non-verbbally. He's walking out. He's about to open the door.
>> You see, he's still got the gun in his hand. He's opening the door. He's walking. He's leaving. It literally as he's leaving, that's when the officer fires >> and not only fires on him, but literally chases him out the door and continues to fire. Not only does he chase him out, he's literally not only does he follow him out, he's almost chasing him out at this point because at this point he's already turned his back. He's already left the gas station. He's running away for his life. But the officer continues to fire at the man's back. Here it is.
>> He turns around to see WHAT'S GOING ON.
>> WHERE AM I GOING OUTSIDE? AND >> THEN THE OFFICER literally chases him out of the gas station, continues to fire. At no point does the guy fire back at the officer.
So, so technically the officer's life was never in danger at any point. I mean, he never fired at him. Uh, so like I said, here it is. Boom. We can watch it one more time.
>> Then he pulls it out.
>> Three shots.
>> Where my daughter?
>> Where my daughter outside, >> bro? Talking about my daughter outside.
If she outside, GO GET HER.
THE [ __ ] LAW [ __ ] with you straight up, bro. I ain't the [ __ ] one, bro. I promise you I ain't the one.
>> Now, there's a kicker about the gun that he's holding, and we'll talk about that in a minute.
>> I promise you ain't going.
>> Yeah, this this last time, >> I promise you ain't the [ __ ] one, [ __ ] Facts.
>> Whole lot of communication going on between these two.
>> I promise you.
>> Oh, OUTSIDE, BRO. COME ON, TURN OUTSIDE.
>> All right, so there's the video right there. Gastonia police released uh video, surveillance footage from the convenience store shooting where the two plane closed detectives shot and killed a man earlier this year. So he did not make it. Uh unfortunately, he did not make it. Investigators said the gun he was carrying was fake.
The officers involved will not be charged. The gun he was carrying was fake. It wasn't real. Um, so I mean he may have had an intention of trying to intimidate the guy, but at no point did he actually pro prove any sort of risk of taking a man's life because the gun was apparently fake. The investigators said the gun was fake. Why you would be carrying a fake gun, I don't know. Why you would pull out a fake gun in such a manner as to actually have someone believe that you're about to shoot them and injure them and possibly take their life. I don't know.
But the gun was fake.
He was leaving the gas station and he was shot at at least seven times. I'm not sure how many times he was actually shot, but it looked like the officer fired at least six rounds his way. So, I'm assuming he, you know, he caught more than a few and as a result lost his life. The officers involved won't be charged. Now, we never saw the other officer up his gun or pull out his firearm or whatever the case may be. I do believe it was the uh the man that we, you know, uh pointed at, the black man that was in a leather jacket, um doing a whole lot of non-verbal communication with the other guy, but you know, neither one of the officers will be charged. So, if you look at the comments, uh right off the bat, this guy here, what effing person, I don't want to call him that. I'm not going to refer to him as that. What effing person pulls out a toy gun and threatens people?
That's a good point. What effing person expects the cop the cops to know that the other effing person pulled a toy gun? The only person injured during this event was the effing person. Okay. You should only draw your firearm to neutralize a threat. He is responsible for his own death. Uh whether it's a real gun or not, he could have taken him down physically if it had to come to that. That's a good point as well. You know, if you got a problem with a man, I mean, you could have taken him down physically. You didn't have to, you know, result to pulling out a gun or a fake gun at that. But uh you know the world that we live in in 2026, nobody's nobody's fighting. You know what I mean?
Especially a random happen stance meeting at a gas station in Gastonia, North Carolina. You're not going to fight somebody like that. That's it.
Always comes to this. Um let's see here. Uh is the guy he threatened the other undercover cop or just a random dude? See, that's the question that we have. The black man that he was threatening and had an issue with, is that another undercover cop or just a random dude? I think it's the other undercover. Uh, let's see here.
Messed up. He didn't announce he was a police officer. Plus, the situation was already deescalated with the guy walking out the store. He was walking out the store, but he was still holding the firearm in his right hand. He was walking out holding the firearm in his right hand. So, some could say he was about to deescalate the situation by leaving the scene, but at the same time, he had the gun in his hand. It would have been easy for him to proverbally open the door, turn around, and then fire a couple and then take off running, which we have seen in in situations like this. We've seen people run out the store while firing back, and the officer took it upon himself to uh go ahead and, you know, escalate it to the level that he did. Uh, a fake gun, uh, being antagonistic. Sounds like he was trying to lose his life. Yeah, he did make some threats, too. He made three threats to the man. Are you trying to lose your life tonight? You trying to lose your life? You're trying to lose your life.
So, I mean, you know, uh, the shop owner saying, "Do it outside. Do it outside."
Like a mother telling her kids, "Ruff house in a yard just [ __ ] sends me murder. This is murder, bro." So, some people are saying that, you know, this was murder on behalf of the police, you know. Uh, but neither one of the officers will be charged. How do you feel about this? Where do you stand on this? You know what I mean? I mean, the argument can be made either way. Number one, the gun was fake. Number two, to some degree he was leaving the scene.
So, I guess you could say he was either deescalating the situation or was in the process of deescalating the situation.
Had the situation played out for another 3 to 5 seconds or 7 10 seconds, he might have just left the story and went on about his business. Obviously, he would have if the gun was fake, he wouldn't have been able to escalate it any more than that. If the gun was fake, he wouldn't have been able to shoot. What am I thinking here? So, if the gun was fake, there was no way of him escalating the situation any more than it already was. I mean, the words that he had with the man would have been as far as the escalation would have gone cuz it didn't get physical. It wasn't about to get deadly because the gun was fake. So, it wasn't like he was going to shoot anybody. You know what I mean? So, the situation was being deescalated. Is that correct? But, of course, no one knows that. All they know is that there's a I rateate man with something that looks like a gun, sounds like a gun, right? As far as, you know, the way it's moving and all of that stuff. I don't even think he ever cocked it. So, I mean, you know, that would lead to it being fake gun as well. I don't know why he would be walking around with a fake gun, let alone pulling out a fake gun and and, you know, waving it around. I don't think he ever pointed it at the man. I think he just pulled it out and just kind of waved it around the gun just kind of as a sign of intimidation.
Why you would be holding a gun, I a fake gun, I don't know why you would pull out a gun, period, in that situation. Once again, I don't know. But getting back to the point, the gun was fake. He never physically threatened the man. He verbally threatened him, but he never physically threatened the man. The gun was fake. He was leaving the scene. Some would say he was deescalating the scene.
He was deescalating the situation by him leaving and or on his way out the door, having the door open. By him leaving on his way out, he was in the process of deescalating the situation. If the situation played out for another, like I said, three to five to seven seconds, he probably would have went out the door, door would have closed, gone on about his business. Him and his fake gun would have gone on about their business as well. But no one knows that the gun is fake. Everything about the way that he was holding the gun, the way he pulled out the gun, the way he was waving a gun leads you to believe that the gun was real. So, the officer took it upon himself to neutralize the situation or neutralize the, you know, the threat and he took the man down.
Um, he saw an opportunity where it was advantageous for him to just go ahead and pull out his gun and fire. You know, uh, prior to that, I think the suspect was a little too close to him for him to feel comfortable enough to reach for his gun and do it like that. which is why maybe when he was distracted walking out the door and talking to the man, that's when the officer found the opportune time to up it and go to work on him.
Now, with that being said, the suspect is already outside. He's already has his back turned. He's already running away.
And the officer continues to fire. I think the first set of rounds, the officer fired at point blank range. He fired like three rounds, two or three rounds. And then as the man runs out of the store, the officer proceeds to fire another three or four. So, you know, that's where it gets a little dicey.
It's one of those things where he's already left the scene. He's no longer a threat. He's no longer a threat to you or anybody in the store. He's running away for his life. He's got his back turned, but you proceed to continue to fire at the man.
But I'll put it to you like this. As far as the courts are concerned, the officers involved will not be charged.
So, no one's catching a murder case here. You know, this is not a murder case here. This is not a police brutality case here. As far as the courts are concerned uh in Charlotte or in North Carolina, this will probably be tried in Meckllinburgg County because Gastonia is so close. So, as far as the Meckllinburgg County is concerned or Gaston County, however they want to do it, this is not a murder case. This will not be uh the officers will not be charged and uh you know, one man has lost his life. How do you feel about this? Was this murder?
Or was this a simple situation of you should simply not be walking around with the fake firearm? Regardless, as an adult, if you're a child, it's a little more understandable. Although still frowned upon frown frowned upon, but as an adult, you have no reason to be carrying a fake firearm, especially in 2026.
You know what I mean? Other than to do what he planned on doing, which is intimidating people with it. Um, and unfortunately, that did not work at this time. So, was this murder on behalf of the plane closed detectives, police brutality, or was this a situation where the officer didn't know the gun was fake? He neutralized the situation and in the process of him taking out one person, he saved everyone in the gas station as far as he knew before he found out the gun was fake.
How do you feel about this, guys? Talk to me. This happened, like I said, in Gastonia, North Carolina, 20 minutes up the road from Charlotte, which is where I live.
