A lucid breakdown of the precarious balance between self-defense rights and the crushing weight of cumulative sentencing guidelines. It serves as a sobering reminder of how legal technicalities can transform a single confrontation into a lifetime behind bars.

Chud the Builder's Full Court Hearing — 4 Felony Counts, 27 to 96 Years PossibleAdded:
We've been talking about this guy, Chud the Builder.
He's this big racist sack of [ __ ] that walks around uh Memphis uh calling black people the N-word, trying to provoke them into an altercation, and he live streams all of this.
And well, he apparently based on the reporting uh attacked a black man in front of a courthouse and ended up shooting him and got arrested.
Uh I I showed you a video of the judge setting the bond at 1.25 million.
And Chud going basically like, "Fuck, I'm not getting out of here."
I want to show you the whole hearing.
It's about 5 minutes long. I want you to watch it because it breaks down how many years this guy is looking at for all the various charges as a result of this uh this altercation, and why some of these charges have been enhanced.
Watch this.
If anybody causes any kind of disturbance at all, it's subject to being in direct contempt and serving 10 days in jail and a $50 fine or both.
Just want you to know that. We're not going to put up with any uh outburst or any static in today.
Okay? He's led into the court by a black man, which is awesome.
Okay.
Uh what do we got?
State versus Dalton Etherly.
That's his name. Dalton Etherly.
Just stick with this. It's it's going to be very informative. Like I said, I love the fact that he's being led into the court by a black man. Then watch the other black man in uniform standing there basically looking at him. And I you just got to know that one of them has to be like, "Say it now, motherfucker." You're here this morning in case number 26 CR5295.
Uh you're charged in count one of criminal homicide 3913201. That's a D felony. It's punishable by 15 to 60 years in state penitentiary.
>> That's one.
>> Count two is employment of firearm during a dangerous felony 39171324.
That's a D felony. Normally, that range of punishment would be two to four years in state penitentiary. However, uh by statute, this case is uh this uh a charge is enhanced, and if you don't have any prior convictions, it's a mandatory 6-year sentence at 100%. Count three is aggravated assault with serious bodily harm 3913102. It's a C felony. It carries a range of punishment 3 to 15 years in state penitentiary. Count four is reckless endangerment with a deadly weapon. It's also a C felony.
3 to 15 years in state penitentiary. Um Do you Have you hired an attorney, sir?
Yes, sir. You have? Well, I have Jake Finley. Okay. Mr. Finley is here. You've been hired yet, Mr. Finley?
I know you have a prior uh relationship with him in other cases.
No money has changed hands.
>> All right. So, uh So, I'm going to appoint Mr. Finley right now to uh represent you should you make your bond, and you want to hire Mr. If you make bond, you're going to need to pay hire Mr. Finley.
Uh I'm going to set this for a preliminary hearing on the 26th of May. All right? That'll be inside 14 days, Mr. Finley. May 26th.
Does that work for your calendar? I can double-check, Judge. Yes. Uh is the bail set? Not yet. I'm about to do that. I want to make sure he's got an attorney and all that stuff first. Yes, sir. May 26th.
>> Okay.
All right. Bond. Bond's not been set yet. General, do you have a position on bond today?
Yeah. Mr. Eatherton is on the bond on two cases, one from here, one from Davidson County.
Pending a hearing where the court can be informed and make an informed decision based on the factors, I respectfully request respectfully request to be held without bond until a day we can have a hearing.
So the court can make an informed decision. Right now it would just be arbitrary to set a number.
All right.
Thank you, General.
Um if the court sets bond, if we have bond, when do we have a bond hearing or consider statute TCA 40-11-118?
The overriding intent of that statute now is to protect the public interest, public safety.
Mr. Easley is on bond apparently on several other matters when this matter was um allegedly committed. I'm looking at an A really a super D to see really three C's and an A really for tracking kind of park assistance pretty serious. Your honor mentioned criminal homicide. I thought that was attempted.
I said Did I say homicide? I meant to say attempted criminal homicide if I didn't.
Okay, understood. Thought I did, but that's still an A felony. Yes, sir.
Okay. Um So bail's been approved. We're going to have a bail hearing.
>> I'm going to set I'm going to set a just a bond right now till we have our bail hearing then I'll let you make all the arguments so we can go through all the factors in the statute and see if that incident is up or down, okay? Yes, sir.
>> I'm going to set initial bond at 1.25 million.
Based upon the fact of having people in the courtyard or here at the courthouse.
Okay.
So, based on what I heard in that hearing, he is looking at four counts. Count one 15 to 60 years. Count two is an enhanced charge, which if convicted carries a minimum of 6 years with 100%. He's got to do all of it, he can't get out early.
And counts three and four are each three to 15 years. So, unless my math is off, he's looking at 27 to 96 years in this case. And my question is, is this going to finally be the thing that puts this [ __ ] menace to society behind bars?
And I ask that question not because I don't think he's going to get convicted.
I do think he's going to get convicted.
But my wife, Renee, is not so sure because Tennessee is a Tennessee and B, it's a stand your ground state.
And he can claim that he felt threatened.
So, um I'm going to tag some lawyers here.
I'm going to tag Barrester and Legal Dad and Hawk and I'm going to ask them, "What's the likelihood that this guy walks because of a stand your ground uh uh uh because it's in a stand your ground state? And what's the likelihood that he gets convicted at any of these charges, if not all of these charges, and does serious time?"
