Here to break down what we know is the Hill's legal affairs reporter Zach Schonfeld. Zach, what can you tell us about this ruling?
>> Hey Judy, this ruling is very temporary, but it does slam the brakes on the Trump administration's plan to dole out this nearly $1.8 billion. This judge is responding to a lawsuit that had been filed by several groups including an abortion group, also a former federal prosecutor who worked on January 6th cases, and a professor out in California. What this judge is doing here is to simply slam the brakes and keep things on hold until she can take a closer look at this lawsuit. As you read through this order, it's about two pages long, it doesn't actually get into the merits of the allegations in this lawsuit, but merely the judge was raising concerns that if she didn't act now, some of this $1.8 billion would go out the door, and that by the time she actually gets around to making her ruling, it would already be too late.
So, in her words, this is just to keep the status quo.
>> How long could this pause last, and what would the next steps be in this case?
>> The judge has now scheduled a hearing for June in order to consider that emergency motion. So, it's about two weeks away from right now. So, it does seem that this new ruling is here to stay at least for several weeks, that is unless the Trump administration tries to appeal it in the meantime, but putting that to the side, it seems that this is going to last at least until that hearing. So, you can expect this block will be a few more weeks, but that's going to be the big hearing where each side actually gets to come into this federal courthouse in Alexandria, Virginia, make their arguments, and then the judge will ultimately rule. I just can't stress enough that as you read through this judge's ruling, it really doesn't get into the merits of this lawsuit at all.
>> Oh, gotcha there. What are some of the key legal issues that we're seeing at the heart of this fund?
>> One thing that you can expect to come up in both this lawsuit, as well as I should note there's actually several other lawsuits challenging the fund as well, and the initial issue that we're seeing is something called standing. In order for someone to sue in federal court, you just can't walk into federal court. You have to show that you're actually somehow injured by something.
So, you have these plaintiffs have to show that this weaponization fund somehow is injuring them and that they have the right to challenge it in court.
And we've already seen a lot of doubts from the Trump administration that these plaintiffs have the right to sue. I've heard some legal experts raising some concerns as well. Not only these plaintiffs, there's another case where you have former Capitol police officers suing who were involved in January 6th.
So, it seems that a lot of the battle still might be about the plaintiffs suing and not necessarily whether this fund is actually legal.
>> What should we be keeping an eye on as this case develops?
>> Yeah, I'd say watch out for two things.
First of all, watch to see if the government appeals this new ruling because it's going to be in place for a few weeks. So, potentially they'll say that that is a stretch too far. They don't want to wait. They want to go ahead and appeal this up the chain immediately. So, we're waiting on that.
And then I'd also wait to see what do these other judges do who are overseeing these other lawsuits today? You know, take a look at this new ruling and decide to take a backseat or will they too go right ahead and issue these immediate rulings? So, this is just the first ruling, but we could still have many to come in the days to come.
