In legal disputes, determining whether money was given as a gift or a loan depends on the nature of the relationship and the intent of the parties at the time of transfer; courts examine factors such as the relationship history, communication patterns, and circumstances to establish whether the transfer was voluntary (gift) or expected to be repaid (loan).

Man Denies Being "Sugar Daddy" and Wants Money Back | Part 1Added:
Mr. Croft, Ms. Ozdemir, you two have very different takes on what happened in this case, and on the history of your relationship.
Mr. Croft, you are suing Ms. Ozdemir for $4,950 for unpaid personal loans.
Correct.
You claim that Ms. Ozdemir was a friend, who you sometimes helped out with little gifts.
But when you found out that she was in need of a car, this was a bigger ask.
And so you agreed to loan her the money to get a car.
$3,000 to buy it.
Once she got it, you said that she didn't have the funds for insurance, so you covered the cost of the insurance policy, at least for a while, for another $1,500.
But when it came time to pay back the money, she wasn't willing to do it.
So you would like your $4,950, which includes a car, insurance, and a little bit of money for car repairs that she incurred after purchasing the car.
Ms. Ozdemir, you have told us that this was a sugar daddy-sugar baby relationship, and part of the deal was that he bought you stuff, and that you thought that this was a gift.
And you claim that what happened here was that you told him eventually that you were in another relationship that was going to have to force a stop to the sugar daddy-sugar baby situation.
And that he got mad and then said, now it was a loan, not a gift, and I want my money back.
So you claim that he was giving you money of his own volition as a gift, and you do not owe him anything.
All right.
So, Mr. Croft, let's start out with this.
How did you meet Ms. Ozdemir?
RICHARD: I met her where she works at a club.
OK.
Accurate? - Yes.
You're a dancer at a club?
CHELSEA: Mm-hmm.
JUDGE JUAREZ: How did you see her again after you met her?
We formed a relationship.
I went to her house.
We went-- I'd hang out with her.
Maybe we would go to lunch or dinner.
All right, what was the nature of the relationship?
And let me preface this by saying, the nature of the relationship is important factual information for us to discern exactly what happened.
Were you dating?
Was this a romantic-- you were just strictly friends?
No, romance, no intimacy.
JUDGE JUAREZ: No romance, no intimacy.
Do you agree with that? - Yes.
JUDGE JUAREZ: OK.
So you told us that you had helped her out in the past by paying for things.
And you said, like, for groceries.
But then you said, "And by paying her rent here and there."
That's when it starts to seem a little different.
RICHARD: So she was in a relationship with someone who was paying half the rent and he moved out.
So all of a sudden, she didn't have funds one month.
And so I helped her out.
I gave her money.
JUDGE JUAREZ: OK.
So this was, like, covering a specific situation.
Yeah.
JUDGE JUAREZ: Not like, oh, hey, let me pay your rent this month.
No.
All right, Ms. Ozdemir, is that accurate?
CHELSEA: Yeah, he would help me with things.
I never asked.
I never even asked for this car.
I never once begged or complained.
It just I think he wanted to see me just have something to have on my own.
JUDGE JUAREZ: But you didn't come to him and say, oh my God, I'm $20 short for my bills this month.
If I can't make this utility payment, I'm going to be in the dark.
OK.
Di you milk this?
No, actually.
So that breakup that he's talking about, he told me that I should finally give him some of his time, since I'm not in a relationship anymore.
So I said OK.
So it started off with going to lunches and then a night in Atlantic City, which was the in-person conversation regarding him considering that he had a lot of thought for my driving situation and said that he would gift me this car.
Why did he have a lot of fault for your driving situation?
CHELSEA: Because he would pretty much be the one I was seeing all the time.
He'd take me to the store, take me to the bank.
He was driving you places.
So it was really a benefit to himself to not have to drive you if he got you a car?
That's what I'm assuming.
He never said that.
I mean, we've heard this one before.
OK.
So, Mr. Croft, is this accurate?
No.
If I didn't want to take her somewhere, I would just-- JUDGE JUAREZ: Not take her. - Not take her.
I mean, she works at Wawa, which is maybe, like, five or six blocks.
So she'd have to walk 5:00 or 5:30 in the morning to go there.
And then she always had problems getting to the club to make money.
But I had no regular driving routine to pick her up and deliver her someplace.
OK.
Did you often give her rides places?
RICHARD: I may have taken her to the club once or twice if she was in a jam time-wise.
JUDGE JUAREZ: OK.
One thing in the evidence package.
JUDGE JUAREZ: Yeah.
Page six.
It says, "Hi, Rich, I'm sorry to ask, but is there any way I can borrow $100 from you?
If you can maybe send it, I want to grab some dinner and make sure my bank account doesn't go into negatives because I paid my electric and Wi-Fi."
It also says, "I'm working this weekend, so I know I owe you the car, and I owe the breeder the last $300."
What is "So I know I owe you the car" mean?
She owes me the money for the car.
JUDGE JUAREZ: OK, so this was after the money for the car?
RICHARD: Yeah.
JUDGE JUAREZ: Do you have relationships like this with other friends?
RICHARD: I have a lot of friends.
A lot of friends. Are they all-- Male and female.
