[music] >> Luigi Mangione.
He is on film shooting Brian Thompson, the former CEO of United Health in the back.
He was tracked down to Pennsylvania and in a McDonald's, he had a backpack.
He was taken into custody after a tip arrived that the person sitting in the McDonald's was Luigi Mangione and indeed it was.
His backpack, which was not in close proximity, was searched.
The federal courts have ruled that the backpack will be admitted.
Remember, there's two cases going on simultaneous, which my view is it's such a waste of taxpayer money. I understand the New York authorities put a lot of time and effort into this case. And of course the bureau did too. Remember, he traveled across state lines to commit the crime and traveled around along state lines to flee the crime.
Does the bureau always choose to take on a case? Does the US Attorney's office always choose to prosecute? No, but in this case they did.
In fact, the FBI was necessary for this prosecution because of all the jurisdictions that were crossed. This didn't just happen in New York.
Nevertheless, what typically happens, I can tell you in 13 cases that I worked where there was cross jurisdiction and I actually had to go back and count them.
When we, meaning the federal authorities, prosecuted the case, the US Attorney's office took the case and prosecuted, the state authorities dropped their case because it makes no sense to waste millions of dollars of taxpayer monies to prosecute and adjudicate a case in dual jurisdictions.

I I didn't understand it at the time.
New York has even pushed up their uh timeline.
So, they make sure that they try their case before the federal authorities and a state New York judge just tossed out the backpack. So, the federal case the backpack's in in the state case, the backpack's out.
That's the backpack had his uh thumb drive in there. It had his a fully loaded magazine for the gun.
It had his passport. There is important information. Now, thankfully, the gun that was used to kill Brian Thompson, that comes in because that was found as a part of an inventory search.
So, thankfully, that's in along with the uh manifesto, so to speak, which is more like a bunch of scribblings uh about this crime.
>> [music] >> I cannot fathom this New York judge's decision because inevitable discovery doctrine should prevail. In other words, if it wouldn't have been searched, it would have been discovered as a part of the inventory search when they took his belongings after he was arrested.
I think the federal authorities, the federal judge got it right. The case is obviously stronger in the federal court now because the backpack is in and everything in the backpack is in.
So, riddle me this, why can't New York just drop it? This should be a federal case, period, end of story.
