So, that's not the issue. The issue was the allegations of him waving it.

But the moment we determine that a crime isn't committed, then we can go ahead and okay, it's fine. Take him out of handcuffs and that's that.

>> You're going to get this type of result every single time because we're well educated on the law. We understand what is right, what we can and we can't do.
And in this case here, you're perfectly legal to walk around and carry it. After a long- winded and flawed lecture, police were forced to let the man go because there was zero evidence that he had been waving a gun. Sometimes the very people sworn to enforce the law are the ones who know the least about it.
They prioritize their own sense of safety over your freedom. This officer may have simply lacked knowledge, but the officer in the following incident made a fatal mistake.
On November 28th, 2023, a man cycled past a patrol car and flipped the middle finger, an act constitutionally protected under free speech. Instead of ignoring it, Officer Best decided to pull him over.

>> All right. Well, do me a favor. Give this officer your information. What do you want information?

>> Okay. So, this you don't have an option in. Okay. Cuz if you refuse to give me let me confirm where you live, I can't write you a citation, let alone a written warning. Therefore, I'm going to put you in jail.

>> I have an address.
>> What is your address?
>> I have an address.
>> Last chance. I'm going to put you in jail.
>> You're very smart. I am.
>> So, what's your address?
giving you my name and birth date and date of birth. It's all I'm required.
>> Okay. I need a address for you.
>> You have an address?
>> No, I do not.
>> You have two address listed.
>> Very well. Here's the most ridiculous part. Officer Best practically confesses to his own wrongdoing right on body cam.
He calls in three more officers, inclusioning a sergeant, just to dig for a reason to ticket this man. X-ray.
>> So, normally I just do >> I I really don't care, but I give a written warning for his violations.
>> But since he wants to make job harder, >> then I'm going to get Palm and see if we can print out forms to where >> we can write him city violations.
>> So, it's about $300 about $100 per violation.
You're going to have everything you need.
a ticket where we're waiting for.
>> I'm sorry. We've >> written a ticket where we're ready.
>> I'm waiting for the proper forms I need to use to write an actual ticket for you cuz I was just going to give you a written warning for your violations. But because you're such a joy to deal with, you're going to >> then I'm going I'm going to uh write you tickets. $300 for tickets.
>> All right. So you're going to extend it back.
>> I'm within my legal right to detain you and hold you here.
>> Yeah. So this guy is riding down on the sidewalk and he flips us off and uh so turn around on him and he's being cooperative. There's I'm stopping. He's on the sidewalk. He's not using both his hands. And uh so I get out to see what his problem is and I tell him why I'm stopping him for riding his bicycle on the sidewalk and not using both his hands on the um the uh handlebars and going against traffic and uh so he's uh he's being a tough guy. So regardless, I start to write him a written warning. I was going to give him a warning for it, but then he's just being so uncooperative and like, you know, and then I was getting ready to write him um see ordinances, but then I remember we can't use the 702s anymore, right?
>> Right.
>> Yeah. So, >> so you are we shipping them or you just get them NTA?
>> I was just going to do an NTA.
I just didn't know how much trouble it would be for Palm to probably write it out for you real quick.
>> So, question for you. I just wanted to ask you, you deal with this all the time. City ordinances. We can't use 702s anymore, right?
>> We could.
>> Okay.
>> We could still got this guy for riding his bicycle on the sidewalk. ordinance and for going gauge traffic and not having his hands on the handlebars, both hands on the handlebars. So, the only thing is, and I just got clarification on this like two weeks ago, is that it's only the business district of King Street and couple other areas on that side that they can't ride on the sidewalk. They can ride on the sidewalk here um and basically anywhere else in the city, just not on Beach Street or some of those restrictions.
>> Yeah. But they all still have to have both hands on the uh handlebars.
>> Yeah. Which is traffic statute. So two traffic tickets.
>> Finally, after 45 minutes of wrongful detention, the only thing they could come up with was a $64 ticket for an improper lane change. Officer Best made a fatal career mistake, admitting to retaliation right on camera. He failed to realize that confessing to altering a penalty based on a citizen's attitude is golden evidence for a civil rights lawsuit.

>> You literally write it just like a normal UTC. Um but you just leave the vehicle information blank and then it's violation of bicycle regulations.

>> No, but I'll look it up right now while you're uh doing that. You can just hand me my phone and the visor. So really the ticket's going to end up being then for uh riding the wrong way on the road. The reason why is according to this it's saying that uh it's no longer a Florida requirement to keep hands on the handlebars.
>> So we'll just make it for the You say you drive the wrong way.
>> Yeah. Going this way.
>> Yeah.
God, what a damn.
All right, sir. I'm giving you a citation for riding your bicycle in the opposing lanes of traffic.

One, you can take court to contest it or pay the fine of 6450.
