5.26.26 The Trump Administration is Losing Far More Court Cases Than It Is Winning.

[00:00:00]Hey feds, quick question. The Trump administration has been sued how many times since January of 2025?

[00:00:06]Take a guess.

[00:00:08]So, the New York Times litigation tracker just updated this week, and the answer is more than 750.

[00:00:14]And the result might surprise you, so please stay with me.

[00:00:17]Of those 750 plus lawsuits, the courts have already partially halted the administration's policies in more than 150 cases. Listen to that again. 150 cases where a judge said, "No, Trump administration, you cannot do that." And of the cases where a judge has reached a final decision on the merits, not counting the cases dismissed for procedural reasons, plaintiffs have won 62 times. The administration has won seven. Seven. The narrative that this administration is winning everything in court is wrong. They are losing far more often than usual.

[00:00:52]So, you should not be hopeless. You should be informed. Here are three of the most important lawsuits I think every federal employee should be following, and many do not know about, and we're going to continue following them here. One is Slaughter versus Trump. Currently pending before the Supreme Court, Rebecca Slaughter is the FTC commissioner that Trump tried to fire without cause. The question, can the president fire independent agency officials at will, even when Congress wrote a for cause removal statute? If she wins, every inspector general, every MSPB member, every special counsel would keep their statutory protection. If she loses, many feds in senior independent roles could become effectively at will.

[00:01:29]Two. United States Institute of Peace versus Jackson. The plaintiffs won at the district court. Doeg took over the agency, guided and escorted a leadership out by force.

[00:01:39]The court ordered reinstatement. An appeals court stayed it, and the case is now under review.

[00:01:43]This is the precedent case for what happens when an agency gets dismantled outside regular process. So, if you work in an agency that Doeg is eyeing or has eyed, this will be a case to watch.

[00:01:54]Three. AFGE versus the Federal Mediation Conciliation Service. Filed this month, AFGE is challenging the FMCS for slow-walking union arbitration requests.

[00:02:05]This is the practical pipeline every federal employee grievance flows through. If FMCS gets to delay or block arbitrators forever, your union contract might effectively be unenforceable. So, every union member should be watching this case. Here's the bigger point. The courts are doing their job. I know it's slowly. I know it's imperfectly, but they are doing it. The administration loses more often than it wins on the merits so far.

[00:02:27]The story of the last 17 months is not that the rule of law has collapsed, it's that it's creaking. It's holding, maybe maybe breaking a little bit, but at least it's there. What do you think?
