The High Court today dismissed the prosecution's application for a prohibition order preventing former Finance Minister Daim Zainuddin's widow, Naimah Khalid, and eight others from accessing approximately 544 million ringgit held in Singapore.
Justice Arif Emran Ariffin made the ruling after finding that the prosecution failed to meet the requirements under Section 53 of the Anti-Money Laundering and the Terrorism Financing and Proceeds of Unlawful Activities Act 2001.
The judge said that the test under Section 53 of the Act has not been satisfied, and therefore, the application is dismissed.
On June 19, 2025, MACC filed an ex parte application seeking to restrain Naimah, her son Amir Zainuddin, two individuals, five companies, and related parties from managing overseas assets.
MACC alleged that the assets comprised investment funds totaling 21 million pounds and 99 million US dollars held in several bank accounts in Singapore. The application was filed under Section 53 of the AMLA Act 2001 following investigations under Section 113 of the Income Tax Act and Section 4 subsection 1 of the AMLA Act 2001.
