The idea was simple. If someone left a company, they couldn't immediately take confidential information to a direct competitor. But over time, non-competes spread far beyond corporate boardrooms.
Sandwich shop workers, dog groomers, warehouse employees, security guards, hourly workers with little or no access to proprietary information. Some agreements restricted workers from taking similar jobs nearby for months or even years after leaving.
Critics argued the contracts trapped workers in low-paying jobs by limiting their ability to switch employers freely.
Supporters said non-competes protected business investments and customer relationships.
The Federal Trade Commission later estimated that roughly 30 million American workers were covered by some form of non-compete agreement. In 2024, the FTC voted to ban most non-competes nationwide.
But a federal judge blocked the rule before it could take effect. The legal fight is still ongoing.
Meanwhile, many workers remain bound by agreements they may not have fully understood when they signed them. And for a lot of Americans, the bigger realization was strange.
