Police officers must have reasonable suspicion of criminal activity to conduct a lawful traffic stop; merely being present at a crime scene or having a vehicle parked nearby does not constitute illegal behavior, and officers cannot arbitrarily stop individuals without clear legal justification.

Cop Pulls Him Over For Being Parked Next To A Crime SceneAdded:
What's going on? Reason for the stop is we had an active scene up there. So we see the car sitting here not running with people inside watching. Is it illegal to do that?
>> It's not, but I wanted to make contact with you cuz I saw you suspicious at an active crime scene. I was suspicious of a crime? Someone sitting there with a vehicle not running occupied, that's suspicious.
>> What crime did I do to get pulled over?
>> It's not a crime.
>> So why am I getting pulled over?
>> a welfare check at this point.
>> It's not a welfare check, sir. That's what it is.
>> not. It's still an open case. But is it roped off? I didn't say it was. I said it's suspicious. I didn't say anything about it being roped off.
>> Okay, so why Once again, why am I being pulled over?
>> take those tests. You don't? No, I don't. I invoke my fifth amendment right, sir. Put your car in park. I got to go. You're not going. Excuse me, sir.
What the Where are you coming from? I'm driving Lyft. This is not a traffic stop. It is, actually. It's a big traffic stop. Answer this door or we're going to kick the door open.
>> Y'all getting in trouble for kicking my door in. Thanks for paying your taxes.
[music] I need your ID. Is that all right? Do I need to? You can look from the road. Let's un-violate my rights, officer.
What's good, YouTube? It's BB KiKs back again with another video and another reaction. And in today's video it's from the Johnstown Police Department over there in Pennsylvania, where you have this Johnstown police officer pulled this guy over because he was parked next to a crime scene. This guy was parked down the street, there was a stuff going on. So when he saw more officers come, he decided to leave. This officer followed him, he said it was kind of suspicious that you were parked over there. So he pulled him over for suspicion, but in the end this officer wants to say, "Oh, well you know, really it's for a welfare check." Is it a welfare check or you pulling him over for suspicion? Because either way this guy did not break any laws. This just goes to show how officers really be pulling over the wrong people.
Meanwhile, the person that actually committed a crime is parked all the way halfway across town. I'mma watch it get my reaction. Let me know what y'all think about in the comment section and let's get into the video. What's going on? Obviously, reason for the stop is We had an active scene up there. Okay.
>> So we see the car sitting here not running with people inside watching.
Where?
On Park Avenue in the village. Yeah.
That intersection there. Uh-huh. Is it illegal to do that?
>> It's not, but I wanted to make contact with you cuz that's suspicious at an active crime scene.
>> Uh, is suspicious a crime? Huh?
>> Is suspicious a crime? For someone sitting there with a vehicle not running, occupied? That's just That's suspicious. What crime did I do to get pulled over?
>> It's not It's not a crime.
>> am I getting pulled over?
>> a welfare check at this point.
>> It's not a welfare check, sir.
Absolutely, it's a welfare check.
>> no. Can you get your supervisor?
He's up at the crime scene.
>> Oh, where is he? Okay, because this is unlawful. It's an unlawful stop.
Because what crime did I commit? So, if you >> I'm not trying to give you a hard time.
So, if people are sitting there watching the crime scene, okay? Uh-huh. I have a duty to identify those people who may be involved in that crime scene. Well, it was a crime scene from how many days ago?
That doesn't matter. It's still an open case. But is it roped off?
I didn't say it was. I said it's suspicious. I didn't say anything about it being roped off.
Okay, so what Once again, why am I being pulled over?
Because He's pausing so he could get his lie together. Okay, so what Once again, why am I being pulled over?
Because I see you guys sitting there. As soon as I go past, you turn off and come down the alley Mhm. and loop around.
Well, yeah, I came around there, yep.
You right. Yeah. And I was just coming coming down here to come to the bathroom here, yep. Exactly.
>> Yeah, so what But what crime Cuz I wanted to make sure that you had no dealings with that party with address.
>> not at all. Okay. Not at all. Because from the incident that we're investigating, I think you're one of the officers that had asked us if you're recording out there, if you're walking by there. And that's all we're we're doing. We're just journalists. We come out and we record.
I didn't ask if you're recording. I asked if you're standing out there because >> No, you asked if I was sitting in my car. Yes, I was sitting in my car, but yes, I was recording.
>> you're the one that told me they were screaming from the attic.
>> Yes, yes, yes, yes. And that's all I was asking because the victim Okay. Have your name and badge number? who had broken into the house and running out Okay. Okay. Okay. Okay. okay.
No. No.
We have everything on me recording. No.
No. No. No. No. We're We're cordial.
We're good.
No. I'm glad to see you Honestly, I got to open up my man. Just so you know, we're transparent in everything. That's what we're doing out here because the mayor had put, you know, something online stating of, you know, there's going to be more police presence and that's what we would like to see. I mean, they're even afraid to come out in public and that's pretty scary. No, I got you, man. Like I said, I'm not trying to hassle you. But, we have five officers there. We need a scene security.
>> Sure. Sure. So, I'm not trying to give you guys a hard time. I just wanted to make contact with you guys and see what was going on. And like I said, now that I know that obviously you were across the street.
>> Yes.
Right.
As soon as you told me what you were doing, I didn't bother you anymore.
You're not You're not hurting us. No, I don't I I'm not and see that and and see that, not knowing you're the same person, then I got to make contact with you to make sure that, hey, you're not scoping out this house. Watching No.
Watching that stuff. I don't care if we're being filmed or anything. Yeah.
Yeah. That's That's it. I just want to make sure the in that crime. No. No. And I appreciate that. You know, I appreciate what you guys are doing.
Yeah. You're good to go, my man. Okay?
>> [clears throat] >> All right. Meanwhile, the actual person that committed the crime is already halfway across town. You already know they got to have that good cos playing on why he illegally pulled him over. We had an active scene up there. Okay. So, we see the car sitting here, not running with people inside watching.
>> Uh-huh. Is it legal to do that? It's not, but I wanted to make contact with you to suspect an active crime scene. Uh it's suspicious of a crime. Based on more people over suspicion than actual crime. And then he wants to switch up and say, "Oh, yeah, you know, it's a welfare check."
>> How is it that I didn't get pulled over?
It's not It's not a crime.
>> So, why am I getting pulled over? Cuz it's a welfare check at this point.
>> It's not a welfare check, sir.
When an officer calls you his buddy, trust me, you are not his buddy. And after all the cos playing, he still didn't have a good reason why he stopped this guy. Okay. So, what Once again, why am I being pulled over? Because I see you guys sitting there. As soon as I go past, you turn off and loop around. Well, yeah, I came around there, yep. You were right. Yeah.
And I was just coming coming down here to come to the bathroom here.
>> He's over here cosplaying to this guy.
The actual person that committed a crime is already gone. But that's my take on it though. Let me know what y'all think about in the comment section. How do you feel about this Johnstown police officer for pulling this guy over over suspicion? You having this officer do all of his cosplaying wants to say, "Oh, you know, you was in the area." And the vehicle was occupied and it was off. And then he wants to switch it to, "Oh, you know, it's a welfare check." And then he wants to switch it to, "Well, you know, you kind of drove off when we came."
Make up your mind on why you stopped this guy. But even then, he's over here wasting his time with this guy when the actual person that did the crime is like already gone. And this is why a lot of those cases don't get solved because they keep pulling over the wrong people.
But that's my take on it though. Let me know what y'all think about in the comment section. Make sure like and subscribe and y'all have a wonderful day.
