In domestic battery cases, two independent witnesses corroborating the same alleged acts (such as shoving and headbutting) can establish probable cause for arrest even when the accused denies the allegations, as demonstrated when an intoxicated woman was arrested for domestic battery despite her denials because two witnesses confirmed the assault.

Abusive Girlfriend Denied It — Two Witnesses Said Otherwise | BodycamAdded:
Let me say did you shove his mother? No. Did you headbutt his mother? No. Okay, I have two people saying that. You're under arrest for domestic battery. Turn around. January 1st, 2025.
A domestic disturbance call produces a battery arrest. This footage raises five distinct legal issues worth analyzing carefully.
Okay, what what is going on? Nothing.
Shut up, John. Okay.
>> I did not shut up, John.
Can you can you stay right here for me?
Stay right there for me, okay?
I don't Open the door for my daughter.
Back up.
Back up. Man, man, go this way. Go this way.
Man, man.
Shut up, John.
I have to go. Go this way. Go this way.
Go this way. Go this way.
You didn't come here to help us. You came here to hurt us.
Stop right here. Don't move.
Don't move. I don't know what's going on. I'm trying to figure it out. Got it?
No, I can't give you my Don't touch me. You cannot go over there. I am not telling you to touch my daughter. You cannot go over there right now. Do you understand that? Settle down. You can talk to me about what's going on, okay?
>> [crying] >> You're not moving anywhere.
Can you tell me what's going on?
Nothing. They just got But Take a deep breath. Take a deep breath.
I didn't do anything. I just want >> [crying] >> Take a deep breath, okay?
Everything's going to be okay, okay?
Just take a deep breath. I just want my daughter. I understand that. We're going to get there, okay? But we got to figure out what's going on today.
Okay?
Can you tell me what happened?
They done to me. How did they do that to you? Who who's there?
Who's there? No, I just need my What do you need? Nothing happened. We just came here, my boyfriend and I.
We've been living here for an LA, and his parents are super controlling. And this time we tell them that we're going to do something with my family, his parents can't accept it. And now like listen, I'm not doing anything. Listen, can you please just listen?
>> I can listen yes, there's officers in there right now. I'm not aggressive. I'm not that person.
>> I'm I'm glad you're calming down now, okay? We're okay.
And we're going to get your baby.
And we're going to get her.
Okay.
Can you head inside?
Do you have an idea what you want?
No.
You want to go in the garage? It's a little warmer over here or like in the corner or something?
Just go inside. There's like three inside that are arguing anyway. Okay, so how did you How How did you get >> She like slammed me finger in the door.
In the door?
Close the door in your hand or how did How did you Why did she close the door in your hand? I don't know.
You don't know why? Do you want medical attention for your finger? You want me to call an ambulance?
It's not fair. Yes. You want me to [clears throat] call an ambulance to check out your finger?
Yes?
Or no?
I need a yes or no. They're all inside arguing right now.
Okay, I understand that.
The male officer is here.
No, he like that's it. Don't Don't say that. Why would you say that?
Because you just came out here yelling at us.
Okay? You're not going inside. Can I please get right there for my baby?
What's not fair? Because I didn't do anything wrong.
>> Okay, but did I say you're in trouble?
>> [laughter] >> We're trying to calm down the situation.
Okay. I've been the only one. We moved here from California for help. They have not helped me with my baby. They've babysat her Yeah, his parents they babysat her for one time for two hours and that's it. It's my baby. I want a baby.
I just [laughter] I understand you want your baby. I just want my baby. Like, it's just not fair for me.
Okay.
They told me we're moving here for a month, and then that just didn't happen.
Okay.
Just take some deep breaths again. Just take some more deep breaths.
>> I need my baby.
We're going to get to your baby, okay?
Your baby's fine right now. He's real.
It's not fair.
>> [crying] >> It's not fair.
Can I just Can you just tell him to come here really quick? The The other officers are with him right now.
No. Can you just tell him really quick?
>> No, we're separating you guys so we get the story straight.
>> not even that. It's just I just Please.
Please, can you just tell him to come here? It's my baby. I literally just had her.
>> And you'll get your ba You will get your baby.
You don't understand it. And do you have kids? I don't have kids. You don't understand. I literally just had her 4 months ago. And I've been the only person who's taking care of her.
I need her ba I understand. I need at least Can you tell him to come here, please? Please.
Please. Please. I'm going to freak out.
Take a deep breath. No, it's not okay.
This is not okay.
>> right now. You're not speaking straight.
I can smell the alcohol off your breath, okay?
Issue one. Whether probable cause for the arrest was constitutionally established. Beck versus Ohio, 1964, requires a reasonable belief based on articulable facts. Two independent witnesses corroborated the same acts, a shove and a headbutt. That two-witness corroboration satisfies the probable cause standard in virtually every jurisdiction. Chandrig's on-camera denial creates a credibility dispute for a court, not the officer.
Can you tell me at all what happened and how this started?
>> I don't know. We just came in here.
We're in a maker of this house and we came here and and like she gets mad every single time we leave. She has like this control problem where if he leaves the house, she gets upset and I just So you guys were trying to leave and she got upset?
>> No, we already left and we came back and this is like it's always been a problem.
Every time we try to leave, she doesn't understand that her granddaughter has a family.
And like I don't know. I honestly I don't know. And you guys live here?
We just moved in from Cali.
Okay. So how did your finger get injured?
Ask her. What she's going to say?
[laughter] Oh, no, she's great. Wait.
You guys will see right down the street.
You look at the records.
Did you call the police? No. Okay. Why would I do that?
>> wondering. Someone called. I didn't I called the police. Look at my finger.
Like I see I see your finger. She's hurting this one, my baby. And we will get to you later. Baby.
Come over here. Baby. Baby. Come over here.
I don't know, man. This I don't need to >> Cuz it's her.
It's my baby, please.
>> I understand that.
>> It's my daughter, please. I know. It's my daughter, nothing.
I understand. No, it's not me that needs to be separated. It's from his parents.
I promise you everything I'm saying is Well, then why then wait here?
It's not me and him that need to be separated. Okay, I understand that. But you can bring him up, okay? That's why you need to be separated.
Okay.
I don't care about anything that's happening. He just doesn't deserve to be put through this crying. See? I just want my baby.
Yes, we will get to your baby once we figure out what's going on.
I'm not doing anything. I just want my baby. [crying] I understand you want your baby.
[laughter] We're going to get your baby to you okay?
We're going to try for a few more minutes. Breathe a little bit and we'll get you to your baby. It was them.
I don't want these people with my baby.
I didn't I didn't say the people are going to be with the baby. I didn't say that. And you think that they told us we would move here to get help and we didn't get help for them.
They washed our baby for one time for two hours and it was such a big deal.
And then his dad, his mom, I don't know if they closed the finger on my door. I don't know. It wasn't him. It was them and my Do you know what door it was?
Yeah, it was the basement door. The basement [laughter] door coming upstairs? Were you coming up or were you going down?
I was coming up. You were coming up and then your hand was in the door and they closed it on your hand?
I just Okay, who was it? Was it the mom or the dad?
>> the mom. I It was the mom. The mom?
Okay.
>> [laughter] >> And [clears throat] she was going to tell you that I hurt you but I'm not.
I've just been trying to protect my baby. Do you know why she would have done that?
>> [snorts] >> Do you know why she would have done it?
No.
Issue two. The mutual combatant and primary aggressor determination in domestic situations. When both parties allege injury, officers must identify who posed the greater ongoing threat.
The primary aggressor analysis weighs injury severity, context, and any claim of self-defense. Illinois versus Gates 1983 requires a totality of circumstances review of the probable cause determination, intoxication, visible injury, two witnesses, and prior conflict history all informed that totality here. Issue three, alcohol intoxication and its legal relevance in this domestic disturbance response. The officer documented detecting alcohol on Chandrig's breath, a legally significant on-scene observation. Graham versus Connor, 1989, permits intoxication to factor into the officer's threat assessment.
Intoxication also justified preventing Chandrig from accessing the 4-month-old infant inside. Being a biological parent does not override child welfare protective authority under applicable state law.
>> Okay.
I want my baby here. I understand that you want him there.
But right now, they're still trying to figure out what's going on.
And she's going to lie and act like we have text messages saying he left on Saturday proof.
Like she's They act like they're so innocent.
They can literally refuse to babysit our baby.
Like What's happening you guys?
Do you have a place to stay tonight?
Yeah, I do. Where did you guys stay outside of here? They we could we could go to my mom's house. Your mom's house?
Where does your mom live? She lives 5 minutes down the street and we could go there, please.
Down the street one. Down the street one?
Please.
We'll go there and they'll take him.
Okay.
>> [snorts] >> We'll just Once we figure out what's going on here, that that's a good idea for you and him going over there, okay?
I want my baby safe. Yeah.
He literally he just Is that your husband or your fiance or Oh. I'm just wondering. Is that your husband, fiance, who who is it to you?
He's so so disrespectful.
He's your boyfriend? [snorts] Okay. And he's in love with her.
Okay.
I'm telling you she is so controlling.
You can literally call my mom right now and anytime we try to leave, she makes it a big deal. And I'm just like, I don't know why you don't understand that.
Her baby's [clears throat and snorts] family has another family and she always makes it a big deal. And then it's just so unfair and it's always been unfair.
And then she's going to say I'm crazy and this and I'm mad. I'm not crazy.
[clears throat] You can take me. You can do whatever you want. You can do it. It's my baby. I just had her 4 months ago.
Yeah, you can bring your baby out here.
She's totally innocent. Is there a jacket or something inside that you can get I can get for you?
Ask her. She won't let me. I'm just asking you so if I can get in there and see if there's a jacket or something. I have a jacket in there. All right, >> [snorts] >> can you stay here while I grab it?
You're not going to move from here?
Okay, what what color is the jacket?
It's a black jacket?
Is it in the laundry room?
On a coat rack?
Oh, this one. What does it say on it?
I see it.
The cheetah one? No, the the long black one. The long black one. Okay, stay stay there, okay? Don't come inside.
Are you okay?
I'm not okay.
And then he told her everything about your past from from you in the relationship and he did that. And he's doing that?
She can tell you all this nothing she want to hear but she literally slammed the door if you are straight with police officer you know about my story I'm trembling now if it's she literally slammed my daughter in the finger and if I got her charges I would like to We're going to we're going to figure out what's going on here okay No because who did this to me Like this is crazy do you see this Because I wanted my baby advice baby that I went through three inductions and they all failed and now she's trying to keep my baby from me Is that how the story goes she didn't want the baby to go with you when you guys were there She's always controlling she's always controlling she controls everything and I don't understand I'm 20 30 in March he's 32 he turned 32 in March anytime he has to leave she makes it a big [ __ ] deal and it's insane I don't understand Like you have a partner they have a family member and that's just what it is I'm just Okay Can I have shoes please Let's see if we can move you over there where They're over there Where is that we'll get them while you're on your own grab them for you okay You can you can stay in the laundry room as far as you're going to go in there I understand that We're almost done here okay okay so take a couple steps back and we're closing the door here okay What kind of shoes are they what kind of shoes are they are they like these boots They're like they're like like half these.
I'm going to close this door behind me.
>> Can you Can you tell my boyfriend to come down? I'm sorry, we can't do that right now. Just tell him to chill out, okay?
Can you get my phone? Okay. We can't be grabbing all this stuff right now, okay?
Can you tell him to come down? At least like that's the bare least he can do.
>> to come down when we're done with this.
We're almost done. Once we're done here, he'll come down and you'll figure it all out, okay?
But right now you can't be walking around because tensions are high between you guys and I don't want you guys to argue right now.
He had better leave. I know.
She's your baby.
>> She [crying] She's your baby. That's okay.
We're not taking you and the baby away from her.
You're not doing anything. Your baby sat here one time for 2 hours.
Calm down.
She baby sat here for 2 hours one time.
She doesn't even try to take care of her.
>> [crying] >> She refuses to take Take a deep breath.
There's no need to yell like that. It would have been She refuses to take care of my baby. She's taking her because she's lying. She took care of her my baby for 2 hours one time one [crying and laughter] day. For her to say anything else is false. She refuses to to take care of my baby. Like it's [ __ ] She's lying. She's lying.
She's lying.
And she's so [ __ ] calm. It's crazy.
She's crazy.
I've been We literally moved up here from California to get back on our feet.
What happened? She refuses to take care to take care of my baby for a couple hours. She did it one [ __ ] time. I was here for one week and each time I asked her to take care of my baby it's a huge deal. I but that's just she's lying. She's going to make it seem like it's something that is not and it's not fair and it's Our job our job She literally [ __ ] closed the door on my finger. Can you take a picture? Can you do something? It's like a purse snatch.
I wanted to do it. Like no, it's not fair. No, she's lying. She's acting like she's the best grandma in the world.
She's not. She's not.
>> One second. She's not. She's acting like the best grandma in the world. She's not. She baby sat my daughter for one day. One day only.
Don't act like you're the best grandma in the world. You gave it to her for two hours one [ __ ] time. You love Ruby.
You're not helping the situation. You're not helping the situation, okay? You're making s- You don't understand. She's saying a [ __ ] lie. Hey, it doesn't matter what she's saying right now.
Okay? We have what you said and we have what she said.
>> I'm the mother of the child.
She's my baby. I have came here for help and she refuses to help me.
She baby sat her one time for two hours and that's it. Ma'am, you're talking in circles, okay?
Thank you. Issue four.
Whether the finger injury constitutes a separate battery against Chandrig.
Chandrig alleged the boyfriend's mother deliberately closed a basement door on her hand. Intentional harmful contact with knowledge the hand is present constitutes battery in most states. The officer acknowledged the injury but prioritized the more corroborated assault allegations against Chandrig. A formal cross complaint filed while sober would carry significantly more evidentiary weight. Issue five. The warrantless arrest authority.
When Chandrig was located outside the residence, United States versus Watson, 1976, held warrantless public arrests are valid when probable cause exists. Payton versus New York, 1980, restricts warrantless home entry, but Chandrig was already outside. No Payton issue was triggered because the arrest occurred at the exterior of the residence.
I understand. It's It's tough, but it's I don't know how It's tough to even like I had her. So, why is even a like Why is what?
Why is this a debate? Like I had her.
So, she should be going with me. Like she's my baby. Did they have her under their [ __ ] belly? No, it was me.
It was me. Okay. And it was traumatizing me to even have her. Okay.
All right. Okay. Where does your mom live? She lives right down the street.
Would she be okay with you being over there just for tonight?
>> Yes, that's fine. Are you going to be able to go over there just [snorts] for tonight?
>> I just want my baby.
Which I Okay, but if the baby stays here No. No. No, because it's my baby. I had her. She came out of me. She came out of me.
Right? And can you take care of him? No.
She is going with me. She She came out of me. I understand, but it takes two people to make a baby, right?
>> No. Yes, and I had her. She's going with me. My mom will take care of her. I will take care of her. I had her. I am her mother. You cannot take that away from me. She is my baby.
She This baby.
Okay.
She is my baby.
Okay.
She is my baby.
I hurt her.
Okay.
Do you want to mess mess mess story first so you're good?
She's got an injury on her. Can you show me show me your finger? That happened in the doorway right here, right?
It's my baby. Okay, yeah, no, that's great. Yeah, I'm going to come in here.
It's good. Get tight. Stay in here.
Hold up.
Take a deep breath.
No, [snorts] it's not.
I I have my baby. And let me tell you something. I I got induced three times to have her.
No, but she's good though. It's cool.
It's cool. Listen, I'm going to ask you some simple questions.
>> [snorts] >> What happened here tonight?
We came back here. Anytime we try to leave, his mom has this crazy controlling problem where if he says leave as a 32-year-old man, it's a problem.
We went to my grandpa's house for the first time. My grandpa decided at his age 78 We're talking We're talking about tonight. What happened with with the door slamming? How did that happen? You seem intoxicated, okay?
You I I'm trying to give you a chance to give me a coherent statement. But as of right now, you're not helping anything out. Okay, so just give me a quick rundown. You had a verbal altercation.
That's that much is clear, correct? Look at my finger. Did you have a verbal altercation, yes or no?
And it wasn't an argument. You didn't There was no yelling. There was no calling for the baby. There was no following.
It happened.
I mean, I'm he's my >> it happened. Yeah, that that's corroborated by eyewitness testimony.
>> So so like I'm going to go with >> yes, it did. It's corroborated by eyewitness testimony. Okay.
>> We weren't We weren't arguing or anything.
>> did you shove his mother? No. Did you headbutt his mother? No. Okay. I have two people saying that. You're under arrest for domestic battery. Turn around.
You have one clo- one jacket on?
We're going to get shoes on you and we're going to get Where's your ID?
You don't have an ID?
Okay.
All right.
You want to You want to walk there?
Such room one one female in custody.
Happy New Year.
Okay. Listen, you don't have an ID here?
Well, what's happening?
>> have an ID?
What's happening?
>> Nothing. You're going to come with us.
That's all. Do you have an ID? Well, why though? It's for domestic battery. I told you already.
>> What did I do? So, listen. This is your turn.
You Can we search this coat?
Do you have any pockets on your dress? I don't want to Okay. It doesn't look like you have anything in possession.
You don't have an ID or a credit card?
Did you get the credit card from my wallet?
Where did you park at?
So, I'll go with this.
Let's go front door actually. There's cars. It's so tight. Yeah.
We'll explain when we get there.
Okay.
It's real tight in the the garage.
Do you have any shoes here? No, I don't.
Just by the door?
Just the other one by the door?
All right. I got them over I guess we'll try and fit her in between cars. I'm not I hope we're going to have any problems with to get car, some all right.
Okay.
Go on then.
Shift shoes. Shift shoes.
Okay, here's some flip flops. No, I can't get you some other property right now.
Yeah, we're going to get you some shoes.
Let's go.
Why do you need these shoes, man? You get the shoes? Okay, cool. Thank you.
They're not non-lethal. Okay, go out to the car. Let's go out there.
Yeah, in just a minute. I got Well, those are the shoes. Yeah, go out this way. Let's go.
All right.
I don't I don't understand that.
Here, these shoes are yours.
We're going to get you shoes. We're going to have you talk with everybody in a few minutes. The responding officer receives an A- minus. Immediate party separation, structured yes or no questioning, and documented witness corroboration were all sound. The deduction structured questioning should have replaced the circular conversation much earlier.
Chandrig receives a C. She correctly denied the specific allegations when asked the right legal decision. However, she did not invoke the right to silence or formally request legal counsel. 22 minutes of circular intoxicated statements actively undermined her credibility as a witness. The boyfriend's mother receives a B based on witness accounts and officer documentation only. Her account was consistent and corroborated, but the door injury allegation remains unresolved here. Three lessons from this footage. First, a suspect denial does not negate probable cause when two witnesses corroborate the offense. Beck versus Ohio requires only reasonable belief based on articulable facts, not certainty. Second, intoxication eliminates the credibility advantage that would otherwise favor an injured victim. A cross complaint filed while sober, with clear documentation, is far stronger than one made impaired. Third, in mutual combatant situations, the primary aggressor determination is what drives the arrest decision.
Understanding and clearly presenting your position to officers on scene is a practical legal skill.
