He [snorts] is arrested for staging that someone was trying to pew pew him and then he actually pew pewed the car but then he survived the pew pewing and then he ran to the house and then they called the cops and then they came and then they took the truck and then the ballistics expert aka Mangena, okay, from Silverton and his team did all the ballistics. I mean funds were dispatched to go through and check what happened only for them to find wait a damn minute. Wait wait a damn minute. I see I always tell you you got to watch the Senzo Meyiwa trial.
That is the prerequisite to any collateral activities. Had he watched the Senzo Meyiwa trial, he would have heard Mangena say what they do once they receive what is it called? Shell casings?
Or the bullet or and then they look at the striations and then they match it to the firearm and then they put it in the IBIS system. Is it IBIS? No, not IBIS.
The system that if they put the shell casings or the bullet in the system, it will alert them if that is from a firearm that is already in the system and voila.
Sadly for Brown Machuzi, the firearm that he used in the commissioning of his staged assassination attempt is the firearm that has been used in two other cases. For an address verification, you don't need 7 days to do that. And the state says, "Well, you know, Mr. Brown always plays stupid games. You get stupid prizes."
We went to his premises. Remember? Do you guys remember when the PKTT actually went all the way to Northwest from KZN to Northwest and they got there and he wasn't there.
So, the the defense is saying, "No, but they've been to the business that is near the address we just gave you this morning." And the state [snorts] is saying, "First of all, you gave us the address this morning. Secondly, yeah, we've been there before. He wasn't there. So, we can't verify with that method. We need to go there again.
And it's cross province. So, it is uh going to take days, which means Brown Mokhotso remains inside Polokwane within. Sadly for him. Sadly for him.

From raising funds for ANC delegations to go from Northwest to the Cape Town to now being inside priority within a holding cell.
Ridiculous, if you ask me.

I just want to advance that the accused person instructed me that can result in the police opening you know, perjury charges against you, defeating the ends of justice as well.
And really such cases delay justice for real victims of crime. It's a waste of resources to investigate a false case.
You will recall that this particular incident happened on the 3rd of November.
Um, just after 11:00 when we were told that Mr. Brown Mokhoana wanted um, his vehicle was shot at multiple times while he was inside. Um, you'll recall that on the 4th of November we were at the Fourways Police Station together with our ballistics experts, our detectives on the ground. Um, and on that particular day you'll recall that he had promised that he would come forward to give a statement, to provide a statement to the police on his version of events. So, it did take us quite a long time to obtain that particular statement. Um, but then on further investigation when we compared um, his version of events and our evidence, we found that they were contradicting each other.
And we then um, well, finalized the investigation and you know, handed over the to the DPP for a decision. And indeed, uh the DPP then agreed with the police that Mr. Brown has a case to answer to.
Um so, the false reporting is what has brought us to court today. He's currently well, facing about five charges. Well, the first one being the defeating of um defeating the ends of justice, as well as perjury on the fact that we feel that um he provided uh false information. Um he He on on that on his particular statement, he indicated that there were people following him, they shot him multiple times, but remember the evidence that we have then contradicts what he is saying. Um we also added then uh further charges, which are possession of an unlicensed firearm as well as ammunition, that because our ballistics report then tell us that the firearm that was used on that particular evening, that shot at the vehicle of Mr. Vusi Mkhize, has been linked to other crimes as well.
2020, um it was linked to a robbery with case uh where it was an armed robbery where a motorist was uh uh robbed of his belongings. A shot uh went off, uh but the motorist was not injured. So, police then opened a case of um armed robbery with aggravating robbery with aggravating circumstances, as well as an attempted murder case. And then in 2021 as well, according to our ballistics report, um there was a shooting in uh Eldorado Park uh where a man in his 30s was killed in that particular shooting at a drinking spot. And in that particular scene as well, there was one other person who who I shot. So, on that scene we had a one murder case as well as an attempted murder charge because we do have a survivor. So, we are here colleagues and as you've heard we'll be back here I think later on in the week. We're going to be verifying the addresses because previously when our teams went to the addresses that Mr. Brown Mkhize had provided, they couldn't find him. Every time they went to his business premises in Sweden in Mahikeng, he was a no show.
And police really went to great lengths to investigate this particular case and even to try and obtain his statement. It took us a lot of resources and and and capacity because he was not cooperating with the police.
So, it is on that note that we warn members of the public really to not open false cases and provide misleading information to the police because that is what has brought us here today where Mr. Brown Mkhize is facing a charge of perjury, defeating the ends of justice, being in possession of an unlicensed firearm as well as ammunition, as well as discharging a firearm in a municipal area. So, here's the court proceedings of what happened in court where you hear his legal representative speak on his behalf and his needs. And by the way, why is Brown Mkhize dressed in the manner that he is? I mean, he was arrested after leaving Magashule's residence, right?
So, therefore, should he not be dressed in his suit jacket?
No? Or he chose no, I want to dress down today, I don't want to be formal, red is not exactly working out for me, it is not my good luck charm, it landed me inside Pollsmoor prison. So, today he is seen spotted in a Adidas jacket, which to me seems like it's not his jacket. It's a That jacket is too small for him.
That jacket is too small for him. If that is what he's going to survive on to keep warm inside Pollsmoor prison, his lawyers need to do better than this. His lawyers need to do better than this. We need to keep this man warm and alive to face all charges. Next week Monday is a good 7 days away, ladies and gentlemen.

Your worship, the instruction that I hold on behalf of the accused is that a a 7-day period for address verification it's a very long period for this particular address.
And we request a postponement to Thursday for address verification.
Your worship, the state has not indicated its attitude in relation to bail.
And to postpone for 7 days merely for address verification only for that particular date uh that the state request another further postponement for bail application, it would be unreasonable.
Your worship, perhaps it will also be uh proper to place uh place it on record that uh it is the accused person's first appearance on uh before this honorable court and he has a duty to disclose any previous uh opening cases against him.
Your worship, the accused person uh discloses the following previous convictions.
And the possibility that he might do the trial is make sure I don't think that he will do will disclose it as a bail court.
Court pleases, your worship. Your worship, uh in that instance, your worship, uh we will not uh make any further disclosures in relation to it.

Your worship, uh it must be remembered that uh the address that this is supposed to be verified is not within the the province. It's outside the province.
And for the police officers to move from one province to another province, there are certain conditions.
Um therefore I have also consulted with the investigating officer uh about today's >> [clears throat] >> Um if this address was given earlier we should have I do not think that there was going to be anything.
Uh your worship regarding the issue of bail, it is unfortunate that the state is not in a position to uh uh tell the uh inform the honorable court about the status of the bail. The reason being that uh it will depend on the address. If the address is very far, there's no problem with the transfer of the address. Then the state uh needs investigation. Uh Your worship, it it must also be noted that this is a uh schedule schedule offense.
And uh the state will not be able to but it is for the court to uh decide the issue.
Your worship with regards to the the the uh the um case that it is not a demand of the case.
I I submit that it is not [clears throat] a sufficient time for the for the police to to do the verification.
I am I would submit further that uh the uh appropriate time period should be 7 days.

Now, I do concede, your worship, that an address was not uh fully furnished. Uh however, your worship, to further postpone him to a date which is in 7 days, uh it is quite a long period considering that he has already been in custody throughout this previous weekend. And uh I do understand that the address is outside the province. However, uh it should have been anticipated, your worship, by the state that uh proper authority or rather those particular logistics should be prepared way in advance so that they can actually allow the investigating officer to go and verify the address. Hence our stance your worship is that the matter be postponed to Thursday for that purpose your worship. It's got to be the same. I have no other submissions. Your worship, perhaps before the state responds, I just want to advance that the accused person instructs me that there was a previous occasion in March wherein the investigating investigating officer came to the business premises of the accused person which is not far from where the accused person resides. That is what he wanted and me to advance in relation to the address your worship. Mr. Prosecutor.
Your worship, I do confirm the fact that the investigating officer visited his address of the business address.
Your worship, the problem with the address is that the investigating officer was present in his address. He could have verified the address over the weekend.
And the investigating officer was not in the address.
So the logistics, they expired on Sunday because he could have done that over the weekend.
That was my understanding.
In fact, the address was given this morning.
So it is not the fault of the state that the state did not go out there and did not I've considered the request by the state as well as the submission by the the defense.
All After considering these arguments I'm of the opinion that the state is entitled to a postponement.
I'm verifying the accused address.
And furthermore, I'm going to make an order that this matter be adjourned until next week Monday for his proper bail application.
Monday.
That will be next week Monday.
I think 30 days would have been completed by then.
So, I'm going to adjourn the matter then for formal bail application court number 13 next week Monday. Next week Monday that will be >> [clears throat] >> The 25th. 25th.
