>> In policing, when we get ready to pull you over, there are several tells that there might be something going on more than just a traffic stop. If when we get behind you, you make a turn on the first street, that's a tell. If you pull over quickly to the right side of the road and the passenger jumps out of the car, that's a tell. And after all those tells, if we figure out what's going on and decide to take you into custody, don't fight because you're going to lose and you're going to go to jail. This is one of those.

>> Another quick turn. If this is radar, there are two types of radar that I'd like you to know about because I believe this was likely radar. So, there's LAR and there's Doppler. LAR goes off laser, Doppler goes off radio waves. That would have been a Doppler radar that he picked this vehicle up on if this was a speed thing, unless he has some other reason.
Couple other quick things. If you get pulled over speed, it's usually radar, estimation, or pacing. Those are the three most common ways.

>> So this is really interesting. So I can tell the officer has some good tactics on the PA. He tells the passenger to get back in the car after you got out of the car and then he calls out the radio stop. I've mentioned this before. It takes some dexterity because it's the same mic. You just have to push different buttons. One to broadcast to the passenger and the other to broadcast to dispatch your location in the vehicle plate. I've seen officers make mistakes and I've made mistakes myself where you accidentally broadcast what you wanted to say off the PA. So, it's good that he has the dexterity to handle that and also the presence of mind to have the passenger get back inside of the vehicle.

But until then, you're detained as well.

>> So, we see it was speed that he pulled them all for. And he mentioned the passenger has to stay throughout the stop. Brenland versus California 2007 US Supreme Court ruling. Not only is a driver seized during a traffic stop, the passengers are considered seized as well during the traffic stop.

I didn't even know he was behind us until I stepped out and looked and I was like, "Oh, shit."
>> Okay. So, this is where I want legal people to chime in here because this is an interesting dynamic and I'm going to explain my understanding of the law here. If the vehicle is stopped, the Brenland case that I mentioned before, US Supreme Court, passengers are seized.
If the passenger jumped out and he's walking off to work, which I don't believe that's what he was really doing, but he's walking off to work. Does he have to provide his information to the officer? Because under normal circumstances, if the passenger was inside the car and had their seatelt on and committed no crime, normally the passenger does not have to provide the information to the officer because they didn't do anything wrong. After the person jumps out, legal minds chime in as to whether you believe that the passenger is required to give the officer his information at this point.
And I'm leaning towards yes, but I'd like to hear your thoughts.

What is his field of view? if this person, the driver or the passenger decide to engage him in some type of violence. I told you and I'll always say the campaign cover is amazing looking as a tactical at this point and position especially when the male says I don't have an ID and we have this suspicious attempting to jump out of the vehicle.
This field of view and field of vision is very very small and it's concerning.
At least one glance back as you're walking back to the vehicle, especially if the person hasn't been identified. Best practice. At least one glance back. Look at the pass the passenger and the driver as you go to your vehicle. We've seen people jump out and attack officers.

>> Just giving him a ride. I've heard that dozens and dozens of times. Just giving him a ride. This is trooper shark. Some things that I'm going to critique about safety. If I watch a video myself, I'll find things about safety as well, but I'm going to mention them. I want officers to go home safe. There's an interesting thing that you may or may not have caught that when he ran her on the computer, something came back that she's on parole. One of the stipulations of parole is that there's free to search her person, likely her vehicle, and maybe even her residence. I've seen it where they have all of those stipulations. Shout out to parole and probation officers, unsung heroes. They do a lot of good, especially when they operate within the confines of the law and follow up on people and make sure that they're doing the right thing cuz some people end up making it right after they get out. And sometimes it's the parole and probation officer that helps them stay in line. and parole officers have a whole lot of leeway that officers on the street don't necessarily have.
The other thing that I want to mention is that I like how he brought her back, got her inside the car out of earshot of the driver and locked her into a story.
Now, she says, "I don't know him. I'm just giving him a ride. It's only been about a week or two now. She's married to that story." As this goes forward, we'll see how that can play out in a very positive way if the troopers continues to work. This is the way that I see him working. Buddy.

I can't exactly hear what he's saying, but when she called out buddy like that, he didn't respond. and she says buddy again. It almost feels like she's trying to tell him that that's what I told him your name is. And I don't know that that's the case, but my police minded that's how I think through these kinds of things. And you could be wrong, but it's always good to think about half what you see, none of what you hear.

>> Let's look at his shirt. All the way down. Pants are baggy enough to easily conceal a firearm. We don't want him to be able to walk all that way before we tell him to go back. The control needs to happen way back there or have him patted down if he's going to be out of the vehicle.

>> So, one of the things that I notic and I always pay attention to is the fact that if a person starts smoking like that, I always feel like they may be thinking I'm about to go to jail and I want to get this cigarette in. >> This configuration is incredibly challenging, especially when it's just one trooper. In these rural areas, a lot of times they do this stuff by themselves, and I get it. However, I'm going to share what I believe is best practices. don't have the person who's the driver of the vehicle looking at when you're searching inside. They're going to know when you find whatever you find. And it appears that he found some contraband inside of a cup inside of the car. Now they know and they can formulate a plan. And being sandwiched in the people is an incredible challenge.

I mean, it just doesn't really make sense. It's just really strange that she knows that, but obviously she's emotionally involved in this, too. These things are all going to play out as you see this going.
People tell you whatever they want to tell you. Hey, >> you need to calm down. And when I tell you to come back here with me, don't pull away from me.

>> Did you see that? It looked like when the officer is searching the male around his pants. The female reaches down into her waistband. It looks like she's shoving something down into the crevice between both of her cheeks. She could be scratching or adjusting her undergarment. I don't know. And I'm not trying to be funny. If we watch that again, there was definitely something going on with what she was doing back there. It's interesting that it was as the officer is searching the mail, maybe in that area or keying off what the trooper is saying to the mail. That was peculiar.
>> I don't have nothing right now. I don't have nothing, man. Did you not smash on me right there?
>> Well, until I figure out if you have any weapons on you.
>> I don't, man.
>> Why are you trying to pull away from me?
>> I don't have any weapons. I don't have any drugs.

If a person is detained and not under arrest, we know that we can pat them down, but we cannot do a search.

>> Okay. So, when we see the trooper retrieving these items and tossing them to the side, I can't see where he's retrieving them from. But again, we just have to be careful. Are we now inside of pockets where it would be deemed a search? Now, he could have made the decision in between when he said you're detained that you're under arrest cuz I saw an arrestable offense myself. He could have made that that distinction.
It's just that we should be cautious when we say you're detained. Switching over and not necessarily saying, "Well, you're under arrest." We have to be really, really careful in these spaces because we want to make sure we operate within the confines of the law.

Oh, >> so I'm going to need some assistance from someone who has a radio ear that can assist me cuz I couldn't piece together exactly when he broadcast that he was in a struggle with this guy. I will tell you this that I do know is that there are several ways that an officer can know that they need to roll code to your situation. That means with lights and sirens. Sometimes you can just be in a struggle with someone. Key the mic, they'll hear and then there's no response. When dispatch does like a roll call to say, "Who was that? Is everyone code for? Is everyone okay?"
And then they'll figure out if you don't respond, everyone's going to roll to your location. There's a button on most hacks where you could push a button.
They'll go to your location GPS. There's a whole bunch of ways that officers will end up rolling code. Even if you don't call it, he may have called and said that this guy's resisting. I just did not hear it. So, just know that even if you just garble something that the dispatch is going to be on it and then units are going to start rolling to your location. If you're the one person that doesn't respond on a roll call, meaning they call every unit and then figure out that it's you and if they know where everyone else is.

>> I figure you do.
>> Yeah, it's all for some and I didn't do it.

There are some things that I think that the trooper definitely could have done to be safer, but I know that they do work alone a lot. I want to make sure that they go home safe at the end of the night. And then some legal things that you could bounce back and forth, especially in your briefings and debriefings or just amongst friends if you're not into law enforcement, cuz these are interesting things. Everyone should know the basis of what laws work and don't work. Arkansas, another super sharp trooper. It appears that they found a hypodermic needle, from what I read in the report, inside of a cup inside the center console. And that would likely be a violation of the driver's probation or parole, which the trooper said that she was on.
