A 68-year-old man named Tatay Irineo was sitting along the sidewalks of Cebu City playing his harmonica. Not holding a knife, not selling drugs, not robbing anyone. Just performing old music hoping that kind strangers passing by would give him a few coins as tips. But instead of help, he was accosted by the Cebu City's anti-mendicancy task force, brought to the Carbon Police Station, placed inside a detention cell, and allegedly [music] threatened with cases that may even expose him to jail time. And when interviewed, Tatay Irineo simply said, "Wala koy panginabuhi para ipakaon sa akong walo anios nga apo." And somehow that sentence [music] hurt more than the handcuffs.
Now, legally speaking, let us discuss the law. Presidential Decree No. 1563 or the anti-mendicancy law of 1978 defines mendicancy as begging for alms as a means of livelihood for going around publicly asking for money, food, or help. But here now lies the legal gray area. [music] Is busking the same as begging? Because busking by international and even common social understanding [music] is a form of street performance. A musician performs music in public places while passersby voluntarily give him tips or donations [music] out of appreciation, not because they were compelled, harassed, intimidated, or directly solicited. And that distinction matters because under our Constitution, freedom of expression is protected.
Music is expression. Performance is expression. Art is expression. Now, of course, local governments are [music] empowered under the Local Government Code to regulate streets, sidewalks, and public order through ordinances and police power. But, police power must always pass the test of reasonableness and proportionality. Ideally, Mom could wear that every poor person in public automatically becomes a criminal. The task force says several times now you want me to ask the city mayor. The highly the Google others even alleged a drug user now. But, let me ask this very directly. The law should distinguish between a person aggressively [music] begging and harassing pedestrians for money versus an elderly man quietly playing a harmonica while strangers voluntarily leave coins beside him.
There are far bigger threats to peace and order in our cities than an old man playing old songs on a sidewalk.
The role of government is to reduce the conditions that create poverty in the first place.
And that should disturb all of us.
