In legal disputes, courts evaluate evidence and testimony to determine liability, as demonstrated when a judge awarded $750 to the plaintiff for unpaid loans based on voicemail evidence, while awarding $884 to the defendant for personal property, showing that courts balance competing claims and evidence to reach equitable resolutions.

Restraining Order RevengeAdded:
[music] >> Plaintiff Jerry Rittenhouse says his ex-girlfriend uses sex to get what she [music] wants, which is why she's had over 200 sexual partners. Terry claims he allowed her to move in with him, and [music] she never paid a dime of rent, and in return, she filed a restraining order against him for harassment.
Terry's suing [music] his ex for unpaid loans, rent, and storage fees.
Defendant Anna Ginger says when she first moved in with Terry, he tried to convince her to [music] smoke marijuana and have group sex. Anna claims after Terry kicked her out of his house, he harassed her and even exposed himself to her, so she filed a restraining [music] order against him. Anna's counter-suing for personal property and moving expenses.
Start with him. Okay. [music] Uh me and Anna met in January of 2007.
By March, we were already living together.
And your honor, can you believe she's had sex with over 200 guys in her past?
>> Whatever. Uh this That's not true. This is really That's not >> me, Anna. I'm not paying him.
>> reason I'm bringing this up is she uses sex to get what she wants for money. She did that to me for financial support. Uh she had sex with a professor, she told me at the university.
>> That's not true.
I'm sorry.
>> anybody else that.
That's [laughter] what she told me.
>> anybody else that this woman used sex to get you to do whatever >> your honor, and that's why I'd like to give some This sounds a little Um like I said that Almost ridiculous.
She has a She has a She has a history of doing this, your honor. It was even as late as January 1st of this year, um she had sex with a person >> [laughter] >> that had a crippled girlfriend. Well, anyway, um Ma'am, you want to address these allegations at all? No, I want to crawl under a rock. This is embarrassing and humiliating, and it's not true. It is true.
Go ahead, sir.
>> Okay.
Um she moved in in March and the stipulation on moving in, I asked her for $300 rent and she said she couldn't afford it. She was having financial problems and I said, well, I don't know what will you do? And she goes, well, I'd be more than happy clean, keep your house clean for you and uh also, you know, I'd do some work around the house like painting, you know, spackling, just minor stuff. I don't mean like putting on a new roof or anything like that. But that's what she agreed to do. Sir, I don't want to go back to this because the woman has denied it and I want to allow her to keep her dignity with that nonsense you've said. However, it kind of contradicts what you're saying now.
If, as you say, she uses sex to get what she wants out of men, there's a big difference between having sex to stay in a place for 3 months and painting.
Okay. Well, the reason >> Explain that. Okay. Does she paint in the nude or something?
No, [laughter] she didn't do that.
>> what you've said.
>> Okay. Let me let her speak and then we going to get to the loans and the rent.
Go ahead. Any background you want to give me and anything that he has just said that you want to respond to, feel free to do so.
>> I have a harassment protection order that's currently um been extended for a whole year. He hauled me back into court to fight it and a judge has signed it.
So, I have a copy of that with me.
>> have it, please. And why did you have feel the need to obtain that?
Um Well, let me tell you how it was. Uh first of all, uh when I moved in with Terry, he wanted to have group sex and he wanted to smoke marijuana. All that's not true, yeah.
>> told him no, that's not what I'm about, that's not my lifestyle.
>> uh a statement right here.
>> was absolutely filthy. Uh I got a statement to prove that, your honor.
Saying what? Um I was going for What is this statement referred to? What she's saying?
>> about the house being clean. Cleanly. Uh here's a statement right here as going forward.
>> Fine, sir. Your opinion is that it was clean.
>> is not my opinion, sir.
>> Your witness statement is that it was clean. It's totally irrelevant to the case. It's from an attorney.
When we going for guardianship.
>> Well, you need to fire him.
If that's all he sent as evidence to >> of other things that she said.
>> Here, I'm going to write you something up that says the house was clean. You take that [laughter] in to defend your claim and I guarantee you you'll win.
Protection order. Why did you have to get that?
>> Well, he ended up harassing me so much that I had to get the protection order, which you have a copy of.
Um he came over to my house late at night. He called me constantly. He exposed himself and he said Um He exposed himself to me and he says, "I don't know what you're so upset for.
You've seen it before. I bet you really miss this." What is this now? I have a a CD here that um also talks about the the loan.
>> Your honor, may I say something about the loan?
>> No.
>> [laughter] >> Ma'am, let's get to the rent first.
>> [clears throat] >> The oral agreement was make some light repairs and clean the house.
>> Correct. That's not true.
>> And how long did you all live together?
Almost 3 months. And at the end of that time, when did he first ask you for cash?
Um the day be- the day that I said that I wanted to to be roommates and be in the second bedroom because I could I had to move into the other room because the snoring was so loud I couldn't sleep.
The very next morning, he uh kicked me out. That's not true. He didn't kick you out.
>> about June, 3 months after you >> June uh June 21st that he told me what >> of him kicking you out. This is important.
>> came into my into the little bedroom um in the morning at 7:00 in the morning, flipped on the light and said, "I can't stand the sight of your face. I want you out of here in 48 hours, or I'm going to call the sheriff." Now, did she >> [clears throat] >> make any repairs or give you any money?
No. All right. And so, did you ever ask her to move because of non-payment?
>> No. Uh did she move? Why did she move?
>> Okay. She said it was too far for her to drive in the Lincoln.
>> I gave him a check for $200.
>> true. She did give me a check for $200, and I do have a copy of that.
>> Sir. Yeah.
Do you remember just telling me she never gave you a dime and never made any repairs? Well, the last day she lived there And you told me no. Go ahead.
Okay. Well, this is it. We had an argument, and she said, "Well, this is irreconcilable differences. I'm moving out." I go, "What?" I said, "Why don't we just talk about this and come to an agreement?"
>> No, that's not true at all. That's true.
He gave me 48 hours and I left. No.
No. And she says, "I want to move out."
And I said, >> Did she move that day?
She moved that day. Okay.
>> 20th of June. All right. 20th of June.
She told you >> No. Please be quiet.
>> What things did she have at your home?
Okay.
She took uh six car loads of stuff in her car.
The only items she left in the storage shed was uh there was a box of files.
Did she ever come and get them? No, because she filed a restraining order protection order on me. Let's get to the loans you also suing her for, sir. Okay.
Um she borrowed it. It was up to $1,050.
She worked for me at flea market, and I knocked off $100 of it and made it $950.
>> true. I have it on the CD. Hold on. How much? Go ahead.
Okay.
And um then she gave me 200, which knocked it down to 750. And what she's going to bring up on the CD is I was trying to negotiate with her on the loan just to settle out so we wouldn't have to go to court. And I said, "You know, if you want to settle right now," I said, "I'll do it for 500."
>> did you ever borrow money from him? Yes, I did.
How much? I think it was around $500.
>> No. Well, I think if you listen to the recording, it will become clear.
>> you want me to know. Hey Anna, I'm just willing to be friends and I'll knock everything down to 500 bucks for you.
>> I said Okay.
Saved messages, Monday 10:28.
Yeah, Anna, I'm going to tack on $300 a month for rent for 3 months. I'll make it 1650 since you want to try and make a big deal about the friends, which isn't true. All right. Couple of things are clear in that.
And that is, ma'am, that he believes that you owe him $750 and he even offered to negotiate the money down to $500.
So, I believe it.
You failed to accept his offer of $500 instead of 750. And you then uh ignored him. And so, he said, "I'm going to tack on 3 months' rent." And by the way, that tacking on, sir, means that you had not originally made that agreement. That's something I'm going to come up with now.
So, let me get to your counter claim, ma'am. Personal property and moving expenses. How does he owe you?
Well, the reason that he owes me for the moving expenses is because I had no notice. He gave me Well, actually that's He gave me 48 hours' notice.
>> property? I said you could leave your stuff as long as you wanted to.
>> Quiet.
You have to prove to me that he evicted you illegally.
You have any way or means of doing so?
>> Um I can show you that the movers actually came He He told me to move out on the 20th.
>> he says he didn't. He says you voluntarily left. Do you have any way of proving that you didn't, that he put you out? Um Well, I have that that I hired movers when I didn't have any money. I had to I had >> get to the personal property. How does he owe you for personal property? The personal property that's still in the storage shed that he said he was holding in lieu of paying the loan. He he wouldn't >> you tell her that?
Yeah. All right. So, I am going to grant her judgment for $884.
Uh for the personal property, you're withholding it illegally, and I am going to grant you, however, $750 for the unpaid loans. I believe she owes you that based on the nature of this voicemail that you left. I'm not going to grant you any of the rent. I believe you came up that with that at the last minute uh because she wouldn't respond to you in a positive way. 750 for the plaintiff, 884, the exact amount you're asking for, leaving you, ma'am, with $134.
Have a good day.
